Since I am sending out the I-129F from aboard to the Vermont Service location, which mail carrier should I use? Many of you send it US postal service with return reciept? Can someone explain what that means and why you do that please? Should I use DHL since the NVC uses them anyway to send the packets to the embassies?

Thanks for your advice... I am getting ready to send it out hopefully this week

it says on the I-129F instruction form that, "Translations, any document containing foreign language submitted to the service shall be accompanied by a full english translation... blah blah blah"

does that statement mean we can have someone translate our documents who isnt a professional translator. Can someone who is fluent in English and the document's language do the translation and certify that it is complete and that he is competent to translate it. Thanks for your help

I joined visajourney thinking I would use it as a supplement to my own research and in conjuction with the use of a lawyer. Here I am now about to submit adn I totally learned everything worth knowing about the process from this site and everyones help here. Oh and no lawyer either!

Some things I should mention before the advice comes in. I saw a post just yesterday that some people may have had issues with RFE about fiances birth-certificate if she is applying from a third country not where she was born... I was like "bingo" thats my situation so I am now including a copy of her birth-cert. Thanks for that one.

I am not worried about evidence.. we met in one country.. with evidence.. and we have been in her country and the U.S. all with passport stamps, tickets and pictures.

My biggest concern is that I am sending the petition from Israel and when everything starts to happen in 5-6 months (hopefully), I will be back in the U.S. I put my addresss as if I was in the U.S now though so that the NOA1 will be sent there. That cool?

Now I am seeing just how big this packet gets too... 50 pages! and I have to make 2 more duplicates wow. Great thing that I am in a country that charges 25cents a copy.

At this stage the only thing that needs to be translated is her birth-cert and I just want to be clear that she can translate it herself right? Just add the letter that says she is fluent in both languages and that it is an accurate translation.

So Any last minute advice I would appreciate

Sending out my pettion tommorrow and if she arrives in the US in 7months which seems to be a fair length then we will have been apart (POTENTIALLY)for 7 months out of 19 months since we started dating.

Side note....

I calculated that I spend 82 dollars just to complete the I-129F petition... not including the filing fee or the postage to send it.. I mean for developing pictures, passport photos, buying ink cartriges and paper for the friend who's printer and copier we were using and for travel to pick up important documents, and supplies like paperclips

Probably doesnt help that i am in Israel where it is super expensive for office related things

Also like to add that I am going over to Federal Express tommorrow where I assume to get a 2-3 day priority mailing to the U.S. is gonna cost me $50+

Lets face it it is harder for the non USC in this situation.. they have to deal with a complete un-known beauracracy, language issues, the wait the confusion the fear of medicals and interviews... All this while most of us are in the country we grew up in with support structures in place. I'll add that I am living with my fiance outside the U.S. but in April I have to return and the seperation begins. Also, she is technically in a third country ( not the country she grew up in or the U.S.

I dont think my situation is unique... I think that a lot of us meet someone and decide to get married and then run into this road block cause most of us when falling in love dont just decide to stumble across this or USCIS.org and know whats going on. We decide we wnat to marry and then check out the info and then we realize we have to wait.

Did anyone here actually send out a I-129F prior to asking or getting asked by thier significant other to marry them. That seems strange and even stranger when you think that two people have to have that conversation... "well if you ask me one day to marry or if I ask you lets fill out this paperwork so things will be quicker" who does that?

I sent my I-129F in last week and it was received by VSC on Friday.

I really want to check in on everything but I filed from abroad and the address the NOA1 is being sent to in the U.S., the person is away for 3 weeks. Without being able to see if the check was cashed, whether a NOA1 came, or knowing any file numbers what can I do to verify that I am in the system?

If I call the suport number will they be able to give me info without a number? Should I just wait the few weeks till the person checks the mail?

I just want some peaece of mind...

I filed from Israel. I had my mother send me check from her account to me filled out properly. The check is in her name but that doesnt matter. That is the only fee you will have to pay until the fiance begins the interview stages with the packets and medical. Those can usually be paid in local currency or if not, the fiance is there and can exchange funds in person and figure it out.

If there are no friends or family who can help you ... try an international bank like citibank. They can usually write you a bank check but it will cost you more. I would try the embassy again though to be sure

It is slightly more stressful filing from abroad... I watched my UPS tracking every other hour for 2 days until it arrived in Vermont.

I know that there are many people here that got married almost immediately upon the spouses entry. Does the clerk's office really take a month to give you a license? What is the story here. We have decided to get a civil ceremony immediately to file AOS and plan a real wedding later.

With this in mind we dont want to wait a month for the license to come through. Does it really take a month and is there a way around this month waiting if I present the K-1 visa information to the county clerk?

Also if it does take that long which states around NY have different marriage laws to expedite this?

Any NY marriages out there... please help me

The NOA2 is valid for I think 4 months. Interviews are happening like 1.5 months from approval depending on the NVC and embassy processing. Check out the India embassy page for information on timelines. You could definately delay the interview until you get back but I would want to get this journey over with as soon as possible. Don't know about the packets. Does anyone know when they are sent do you have to sign for them or are they just left like regular mail? Cause if it is like regular mail you could have them then mailed to you in Canada and send them back no prob.

Depends on how she is likely to react to things. If she has good English and isn't afraid to travel there is no point spending the money unless you are going to have a long vacation there with her and go to the interview with her.

As far as helping her at the POE... She will have everything and the immigration officials will take care of everything. There isn't much you will be able to do to facilitate that process.

It would be nice to have international travel with your fiance and be with her every step of the way of course.

There have been many thoeries as to why Vermont is faster... my theory is two-fold:

1 is that CSC gets more applications from Mexico and Asia... these are applications which require more time because of waivers and higher fraud rates. Thus adjuncators are spending more time per application than in Vermont

2 is actual location of service centers. CSC is outside of LA... more diversity, worse commutes, urban setting. VSC is in the boonnies... tighter-nit group, better commute. Sense of community...

That my take... by the way I am a VSC filier...

Does CSC handle more K-1, K-3 from beneficiaries of Mexico and Asia where fraud rates and waiver delays are more prevelant....?

Just a thought... I agree with an earlier poster that if everyone is paying the same fee for a government service, there should be a similar timeframe.

Another thought is the actual location and thus type of persons working in the service center... CSC is right outside LA and the working situation will be urban, commutes, diverse group of people. VSC is in bumblef*k Vermont. I would think a better commute... happier people

You have to go to a town or city clerk in the place you want to marry... in fact if you get a marriage liscense from one place and get married somewhere else all that means is your marriage certificate and record will be from whereever you were married...

you can get a marriage certificate in Polk county Texas and get married in Lee county Florida and it will legitamte and valid.... But I don't know why anyone would want to do that since most marriage certificates are issued the same day and can be used the after 24 hours...

Remember that both parties have to be present to sign the certificate

the adobe reader allows you to fill in the sections by typing... Myself and most people will type unless the information requested requires more space than is alloted. You can then sign by hand which is required and very important. You can copy the birth certificate front and back on one piece of paper which means that the copy will be a copy of the birth certificicate with the front being the front and the back being the back.

I think you're exactly right. The percentage of VJ'ers who end up with RFE's MUST be substantially lower than those who haven't found VJ. I wonder how much time that shaves off for all of us, on average.

As long as on the I-129F you stated the beneficiaries address and overseas consulate/e,bassy as Kiev then you are fine... the packet is probably on its way or even already at the NVC as the NOA2 by mail arrives later

Or are there precedents where this scenario was seriously frowned upon?


I'd also really, really welcome advice on how best to deal with our specific situation. In particular, Erin (citizen) will be a student for the next few years, and as such, she has negative assets and income (aka student loans). She uses her Mom's address in NH for now, but we would probably ask her Dad or sister to be co-sponsor, and will move to OR right away for her to go to university there. (I plan on finding a job as soon as I can - have Ph.D. in physics, hope someone will be interested in that). I myself of course don't have a job now (am travelling), have lived in the U.S. on a student F-1 visa from July 2005 until Aug 2007 without incidents, have enough $$ to pay all the fees and survive for about a year but not enough to matter for purposes of public charge etc.
Has anyone else pulled it off with the US partner being a student? Any special catches?

I live with my fiance abroad in Israel and we filed from here. The issue is that your fiance needs to have an address in the US where someone can look at her mail. While you are traveling you will wnat to know you got the NOA1 reciept and be able to check its status online. Also, if you are approved while traveling, you will need someone to forward the NOA2 or possible RFE notices to you to take care of and continue the steps.

I used my mother's address in NY for this and she lets me know when something comes up. It seems that the service centers are speeding up and if you filed even in April, the completion of the process could very well fall within your timeframe at September. But remeber your fiance may reecieve your NOA2 but all the paperwork and packets will be sent to your address in Belgium. So if you are not there you are delaying your visa. The NOA2 is valid for months so even if you are accepted quickly you will have time to come back to Belgium and fill out the paperwork and begin the Embassy side of the process.

The process does seem daunting... but a few minutes a day on this site will really get you up to speed in a hurry. Check the guides and flowchart. The co-sponsor part doesn't need to be figured out until the I-129F is completed and accepted which is the longest process. Seems you will be filing at VSC which is the quicker of the two centers.

1) no problem although she may need to go back to S.K. for police certificates depending on policies. (My fiance is filing from a country other than her country of birth as well)

2) I believe the visa needs to be used to enter the U.S. within 6 months of the visa being stamped in her passport

3) You cannot have a legal wedding in Australia and still recieve a K-1 visa

You can certainly apply for the visa and have a non-legal wedding in Australia.
