I had no idea that your prints could be rejected. I have never heard of this before.

I have still not received my Interview letter. I did the fingerprints on May 15, four days after Raleighn400. He got his letter on May 22. I hope there is no problem.

Got my BIO appointment today. It went very well, no surprises and no wait. The staff was also very cordial.

Ok I guess it will take two weeks before I get my Interview letter.

J&D : Don't be disappointed. I don't consider your appointment to be so far away. We're talking about two weeks.
I rather wait than spend several hours waiting for an improbable appointment. On the grand scheme of things, unless you would like to apply for a government job, two weeks are not such a big deal.

Maybe I am just unrealistic, I just had to wait almost a year for my removal of condition on my permanent residence, so this N-400 application seems to be going pretty fast.

Good luck with your walk-in.

Walk-ins don't change priority dates, so application processing time isn't affected what it affects though is that it gives a head-start to the fbi name-check



Exactly. There's been a lot of cases lately where the interviews are scheduled while the name-check is pending resulting in 3 scenarios : re-schedule to a later date, interview without final approval, and the worse is the applicant shows up but the IO refused to interview her/him.

I figured I cannot go wrong with a few days head start.


Good idea, but I had heard that the FBI backlog had been resolved? Are there still some delays?

Funny story. Got my BIO letter today. The appointment is for the day after tomorrow.
That's fast!!! The letter got mailed on the 7th, talk about snailmail.

Anyway I am happy to have gotten the appointment.

It seems to me that this would work.
the only question you might get is at the airline counter on the way out of Brazil, they will ask for proper documentation for entry into the US (you show them your US passport ) but you show the German one at the Brazilian police control.

My son is a dual national and he leaves and enters the US with its US passport and enter and leaves France with its French one. We never had any problem.

Well one thing very well could be that you are living outside the US so they might require a N-470 to preserve your residency. Not sure how the whole missionary thing works, but to maintain residency you either must be living and residing in the US or having (I believe the N-470 intact before going overseas).

So that's one thing to look at. You must also be residing in your current district (Illinois) for I think 3-6 months before the N-400. They are most likely seeing you are not living there and are automatically rejected.

You might want to just hold off until you get back to the US, maintain the ties and go from there. This is what I'm seeing could be the major cause...


I agree, the easiest might be for you to wait until your mission is completed and apply once you are back in the US.
Also, I am not sure you can apply since you are living outside the US. Are you on an official US gvt. assigment? If not, I would certainly consult with a lawyer to make sure that you are eligible.
This should not cost you too much money.

Do you have all your paperwork in order regarding the residency requirements? Are you 100% positive about this?

I agree the forms are easy to fill out if you are a standard case but it can get tricky if you are outside the norm.

If you believe that you should not have been rejected you could also contact a lawyer and file a complaint in Federal court and ask the judge to overturn the decision.

I guess I'll just have to live with this now. I had a picture taken at a pharmacy and it was very grainy. So I decided OK I'll go to the Post Office and they'll take a new one.

But I guess that the employee did not go to photography school happy.gif

The pen was totally my fault though. So nobody to blame for this one.

I really like the new passport, the pictures are awesome.

HORRIBLE PASSPORT PICTURE though. I was kind of disappointed about it. And to make things worse, my pen ran out of ink in the middle of the signature so Bottom line I have an ugly looking passport.

If it was not so expensive I would get a new one. Anyway my immigration journey is really over now.

I don't have the green card anymore so that's why I need the stamp.
I talked to the person at the 1800 number and this is what she told me to do: bring my passport, the NOA and two pictures and I should be good to go.
I finally got an appointment (Next Monday) by logging in at 6:00am this morning on the website.

Hi,

My stolen expired green card has been stolen and I only have left my passport and the NOA.

My case is pending at the VTC but I will soon need to take a trip outside the USA.

I thought about applying for a replacement card but It seems strange to apply for a replacement of an expired card.

I am thinking going to my nearest field office but I don't know if they will be able to help me?

What do you think?

CanadaQuestions regarding Medical Exam and Interview in Montreal

Is the Montreal interview only for the foreign/Canadian spouse or are both the American & foreign spouse required to attend? I'm a dual American-Canadian who just started the process for my husband (Canadian). We live near Toronto and are planning a move to the US this summer. Oh how I wish I had started this process sooner! I had no idea how complicated this process would be.

 

By the time my husband gets an interview, we will likely be living in the US - if he is allowed to stay with me and our dual-citizen kids as a temporary visitor. He would be going to Toronto for the medical exam, and likely driving from Toronto to Montreal for the interview.

I'm just wondering for planning purposes, if both of us are expected at the Montreal interview. I would like to be there with him, but not sure how things will work if I'm in the US with our kids and working down there.

Could anyone out there please give me a time estimate for the remainder of our visa process, and what steps we will still need to take? My husband's immigration application for IR-1 visa (filed in May 2013) was transferred to the NVC in March 2014. We submitted what we thought were all of the necessary documents, including sponsorship forms from my parents, in May 2014. The NVC finally responded on July 8, 2014. They said we were still missing a sponsorship document and supporting tax records, so I emailed those things to the NVC on July 15, 2014. On August 5, 2014, we got a notice that our documents were received on July 15, 2014, but that processing would likely be at least 60 days (due to high volumes of applications in the system). We asked our local congressman's office for help, and the inquiry made on July 24, 2014 simply indicated that our application was in process (that the NVC had received documents in mid-July and would eventually review them). As far as I can tell, this inquiry did nothing.

 

I'm feeling really stuck right now. I had thought that the direct consular method for obtaining a spousal visa would be the quickest way to apply, but it does not seem to be the case. It looks like this process will be taking at least several more months. Can anyone tell me about Packets 3 and 4? I've seen these listed on other people's timelines, as something to be done before the consular interview in Montreal. I am now living in the US with our two young kids, and it looks like this will continue for many more months. If anyone has any advice on when we might expect to get the consular interview appointment and what's required in these packets, please let me know. Thanks!

IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsNVC- 60 Day Letter

We are in the same position as you, waiting on NVC to finish processing and schedule the consular interview. Our final documents were emailed to the NVC on July 15th and July 17th, and we got the letter about the 60 day processing time in early August. My background is that I'm a US-Canadian citizen with a Canadian spouse and 2 dual-citizen US-Canadian children. I grew up in the U.S. and moved to Canada to live with my husband in 2002, and later got my Canadian citizenship. We moved from Canada to the US in late 2013, after starting the I-130 process in May 2013. I naively assumed that our 10 year marriage would count for something and that this process would be over in just a few months based on I-130 processing times in previous years.

 

It's very frustrating to be stuck like this. At least my husband has been able to visit us for part of this year. But he is now back in Canada waiting, as we weren't successful in getting an extension of stay on his visitor status. USCIS decided he didn't qualify as a visitor, because we have an ongoing immigration visa application, and they said if they gave him lawful visitor status to stay longer, then he might use that time to file an I-485 and become a permanent resident that way. It feels like USCIS is punishing us for something we haven't done and had no intention of doing. At least in Canada, I was allowed to stay with my husband as a visitor while filing for permanent residence.

 

Besides the long wait, my other source of frustration is that many of our American friends and family believe that there is an easy remedy to this problem, like hiring a lawyer or seeking help from a Congressman or U.S. Senator. They cannot fathom these bureaucratic delays, and they try to come up with solutions that are unfortunately not going to work. I am really tired of being told that I just need to hire a lawyer! We don't have the money to do that, and I seriously doubt a lawyer can do anything to move the process along at this point.  I've tried asking both the local congressman and our U.S. Senator for help. Our congressman's office made an inquiry with the congressional liason in late July who said that our documents should be reviewed within 30 days. But then we received the 60 day letter a few days later. Our US Senator's office also "expressed their interest" in our case last week and they were told that it would likely be reviewed around mid-September (60 day mark). There seems to be nothing further they can do to help right now beyond making these inquiries.

 

Thanks for giving me a chance to vent a little! I'm sure we will all get through this soon... we're trying to stay positive and focus on being very close to the end of a long process. :)

I would also recommend that once he has received his new passport and if he is still waiting for the new card, to go to the ACS to get his passport stamped.
In the meantime, I would avoid any international travel has his entry into the US might be delayed at the port of entry.

Well, you can't apply for a naturalization without a valid green card so the first step is to get one.
So, he should first apply to get a new and valid card.
He might have to pay a fine for letting the old card expire and not renewing it, i am not sure as I am not a lawyer. Legally, you are under the obligation to always carry with you a valid card. If they refuse renewing the card I would consult with a lawyer ASAP, because at this stage I am not sure your brother should even be in the US.
Also he should get a valid passport from his country of origin.

Second, I would file a new N400 with all the documentation and one of the questions is : have you ever applied for citizenship? he should answer yes and provide an explanation with what exactly happened. Then he waits for the USCIS answer. He has a problem he should consult with a lawyer. In any case he should never lie to an immigration inspector.
