Hi All,
I have a quick question. I was out of the country for sometime (visiting my fiancee) and missed the Approval notice that was supposed to be sent, I was wondering what is in the second package also if its a package that needs to be signed for. I'm a student so it was sent to my school and I figured that I would not need anybody to pick it up for me since the school would probably keep letter. However, I believe it must have been a letter that needs to be signed for and as a result my school sent it back to USCIS. So now I called USCIS to resend it but its been since November . I am so worried right now because I don't know how far it will push the process back. I was also wondering if I should expect my fiancee to receive his letter from the embassy ( I am the US Citizen) or if his letter will not be sent until I recieve the iapproval letter from USCIS. you will need a co sponsor if you do not make the required amount of money, keep your hope alive and look for one. Also like you have been told gater evidence of you having met and read this site, you will get a wealth of information that will be very helpful. Best of luck and travel well.

Or I have to wait til Sept 2009 to file because that was when we met online Sept of 07?

My understanding of that rule is that within the last two years, the ywo of you must have met in person. Thats all that is required. It doesnt matter where you met but you must have proof of meeting in person like passport page with visas of either you visiting s/he, s/he visiting you or the two of you meeting in a third country. Also include photos and plane tickets. Throughout the visits keep your evidence of meeting in person.
I think you fulfil the requirement even now if you wanted to. Others can help out.

We paid $1,800.00 in lawyers fees not including filing fees about $500.00 ???? but honestly it was a rip off!!! They didnt even call before or after the interview. They didnt even give us details we needed to know before the interview like what to present as proof of relationship, I got it all on VJ..... However, we had peace of mind knowing that everything was well taken care of before the interview.

If you read posts from here very well, I think you can file without an attorney and do it successfully. Also you can consider a cheaper attorney..... think about it.

The problem with doing nothing and later giving contradicting information later is that it shows some level of not being truthful. However if you correct the information now then its on record that you tried to correct it before the interview. As long as it doesnt hurt to send a correction, why not do it? Also just make sure you have a record of the correction and an acknowledgement from USCIS. To Some interviewing officers any inconsistency will justify a denial.

Hey, there's a reason for the minimums. And there's a reason they're baaed on POVERY guidelines. POVERTY, right? Do you really want to live that close to the edge, and bring someone else to share in that status?
Moreover, if you (not a specific 'you', just those defending living on the minimums) wish to do so, that's your business ... until it affects taxpayers.
The purpose for the support affidavit is to ensure that this new immigrant to the US will not immediately be accepting welfare, Medicaid or other public assistance. There are millions of Americans unfortunately needing these underfunded programs already.

US Immigration law recognizes the right of US Citizens to be reunited with their loved ones. But only insofar as they can support them without public assistance. Why should I as a taxpayer have to subsidize your lifestyle and your choices? If you really can't afford, quite literally, to marry and be with your loved one, well - you wouldn't be the first. In times gone by people would WAIT to marry and start families when they could afford to.

If you can meet the thresholds on your own or find a co-sponsor to shoulder the responsibility jointly, fine. Welcome to America. But if you can't, why should you expect the taxpayer to effectively be your co-sponsor?

We've got enough corporate welfare cases on Wall Street these days. Who needs more?

Please avoid mocking them. Tax payers do not co sponsor anyone! The government effectively recovers any money spent from the co sponsor. Am sorry about your relationships if all they are about is money, things property and who bought what in the house??? Fiance`s / fiancees from abroad also have a life and professions while in their countries. Try to be respectful there are many of them who are very learned and not beggers using this post/ board.

I believe you because something similar happened to me. The individual wrote a nasty email to the embassy with bad allegations, but I had all my documents in order. After the first interview, I left thinking I was approved and when I returned to pick up the visa the following day, I was questioned again and this time approved. Live your life and trust God. As long as your relationship is genuine no one can destroy you. Also, with official 'stuff' no one can simply blackmail you and get away with it... your records are confidential and the gov't or agency does not give people's info anyhow. Have all your documents in order for the interview. I understand your fear but you will be fine. Good luck!

Just one more data point for your research:

Our overall situation is a little different from yours but similar in that my husband and I decided we wanted to get married while he was here, about 3 months before his visa expired. We could have rushed and tried to make a wedding happen (AND file AOS, yeesh - that alone took us 2 months) before he fell out of status, but we had personal/family reasons for feeling it was not appropriate to be having a wedding at that time, and as you've observed, it can be difficult to plan a wedding (even a pretty humble one like ours) in 3 months. So we ran to the courthouse and got married on my lunch hour, keeping everything very utilitarian for paranoia that if we celebrated too much, we wouldn't see the point in spending time/money to have a wedding down the road. We took those months instead to join our lives - bank accounts, etc, and file AOS. We were approved without any trouble, at which point we breathed a huge sigh of relief and started talking about how we wanted to celebrate our marriage on our own timeline.

Two years later, we are one month (to the day!) from our wedding, and everything is exactly how we wanted it to be -- E has his green card and we've had a chance to make several trips to visit his family in Honduras, and my family knows him well and loves him for the wonderful man and husband he is. Everyone is going to be able to celebrate with each other without hushed speculation about E's motives in marrying me or what would happen if his green card petition isn't successful. In our case, it was absolutely the right decision, one that is letting our families be more involved in our lives and share in our joy rather than rush to cross the country/globe in order to support us in a union they know little about. And although I thought the idea that somehow our wedding isn't as legitimate because we're already married was going to be a bit of a buzzkill, it has actually (weirdly) made things better, I think, for lots of reasons. We've been living as a married couple for two years, after all, and we haven't had any real problems yet -- so if nothing else, at least people know that we aren't going to freak out about combining finances and everything is going to fall apart before the catering bill is even paid. I like to joke that our marriage is like a pregnancy -- you don't let yourself get too excited about it until your second trimester, ha ha.

Anyhow, the point is -- what we did isn't for everyone, but it can be done and we have no regrets. It's a little awkward to be married and be planning a wedding, I won't lie about that, but lots of people on these forums have done it. Some even say that they only celebrate the anniversary of their wedding because that's what feels most "real" to them. That has not been the case for us (although ask me again after the wedding), but I have no problem celebrating two anniversaries for the rest of our lives, ha ha. It's ok to distinguish between making a civil commitment (being financially responsible for each other, paying taxes together, functioning as a household/family in the eyes of the law) and making a commitment to each other, your families, and your God to love each other. They're both big life changes, and I think it's totally ok to honor those commitments on separate days if that's what you decide is best for you.

When I applied for the CIA several years ago, having a wife that was a non-US citizen was a deal-breaker. I had the background - Military Service, Speak 4 Languages fluently, & International MBA from Duke. They were ecstatic about my application until the moment they found out about my wife. They dropped me like a penny off the Empire State Building.

I don't know for which agency you are working. However, my guess is that once they find out about it, you are likely to run into a truckload of bureaucratic chicken S*%& on this one.

It is pretty likely - The last I heard, JFK is still pretty routinely stamping K1 entrant's passports with the Temporary EAD. It is of course temporary (valid until the I-94 expires) so its not terribly useful though. good.gif


So essentially it is only helpful for 3months then after that if you haven't gotten it renewed you can't work right? Also, is there a fee when they stamp it?

The reason it is supported by people that have not been through the process is because they are ignorant of the process. I could print a "vow renewal invitation" on my computer in the next three minutes. I will email them to you. Proves nothing.

If you have legitimate evidence of your legitimate marriage, you do not need this. You are married, you received the conditional green card on that basis. You do not need to get "married again". There is nothing wrong with what you plan but it has no bearing on the RoC.

FWIW I did not include ANY photos, affidavits from friends, cards or letters mailed to us or ANY utility bills. We were approved without interview.



Thanks for your feedback. I would definitely agree that things like cards and utility bills (or beneficiaries for life insurance, which i could change online just long enough to print it) don't prove anything, the same way that a wedding invitation wouldn't. But people on these forums do include those things and encourage each other to, which is why I asked about the invitation since it's a similar kind of thing. I definitely think that the state should only concern itself with the civil aspects of your marriage (your tax status, whether you co-mingle finances/assets, etc) rather than whether you have vacation photos together or if your families know about each other, but we've all seen on these boards where I/Os did delve into the more personal/sentimental details of a relationship, as they did in our interview, which is the only reason I figured this might go in the "can't hurt, might help" category. Unless it does hurt, ha ha.

I appreciate hearing about your experience -- definitely makes me more inclined to leave it out. We have lots of other evidence (since AOS we've bought a house and a car and still have all the same accounts from AOS), so I'm thinking that should be enough. It's just so easy to obsess about the packet when an immigration misstep can make life so complicated.

HI VJ-ers! I would love your opinion on our RoC evidence.

So my husband and I are preparing our packet to remove conditions on his green card, and our background should be summarized pretty concisely in my signature, but basically we married while he was here on a B-2 tourist visa and adjusted status from there. Naturally, we had to show in our AOS interview that my husband absolutely intended to return to his country after this trip -- we just realized somewhere along the way that we didn't want to spend another day apart if we didn't have to.

We're now about 2 weeks away from being able to file RoC, and about 5 weeks out from a vow renewal that we've been planning for quite some time. I don't think it's probably worth waiting until after the vow renewal to have more photos to send (although I'd love to hear if you think we should), but I could certainly send a copy of our invitations as part of the packet. The invitations call the event "a celebration of [our] marriage", which is admittedly not as clear as, "as they renew their marriage vows" or something like that.

Anyhow. I know that many couples do what we're doing and there's nothing wrong with it, but I'm divided as to whether including the invitation is more likely to help or hurt our application. I mean, there's a gigantic difference between "we couldn't afford a wedding when we decided to get married, but we're having one now!" and "I'm getting married! It's so weird because we actually got 'married' two years ago, but that was just so this cute guy i met on spring break coud score a green card. Who woudl've thought we'd fall in love and get married for real?". Obviously, our situation is the former, but since my husband forgot our camera on the day of our legal marriage, all we have is a grainy cell phone picture, and I can see how that might make it look like we were rather flippant about the legal part, and I woud hate to promote suspicion because the invitation itself does not clearly indicate that this is a renewal of vows for a marriage that our families know about and have known about for two years now. On the other hand, friends and relatives who have not been through this process keep bringing up the point that a vow renewal invitation is a great piece of evidence of a legitimate marriage, because who the heck throws a giant party to celebrate a sham marriage? I'm afraid that the whole immigration process has made me paranoid and unable to make decisions, ha ha.

Am I overthinking this? What would you do? Thanks in advance for your help!

GC received yesterday January 25th.

I am still amazed that an organization like the USCIS is sending Green Cards in a regular envelope, with no signature required, with the origin (Laguna Niguel), clearly stated on the outside of the envelope. Oh well...


We got ours yesterday too! I had the same thought -- it really speaks to the honesty of U.S. postal workers that they haven't been forced to change this yet. I'm sure green cards must have a higher street value than your average piece of mail...

Oh, my! January 19th was indeed a good day... We have 100% approval for the CSC!
Tricia599 was approved at the interview and I got an email from USCIS saying Angela was approved too... Go Brazil!
And Mary and Enrique whom I have kept contact with since the early days were approved too at VSC. Congrats to all of you!


Aww, I'm so happy for everybody who's finally been approved and staying subscribed to this topic in solidarity with the people still pending. Paul, it is fun how many people here went through AOS at the same time, and I hope to be going through the citizenship process at the same time as you all as well. I am just so thankful for this community of people who can relate to each other and look out for each other as well. You are all the best!

Happy New Year to all!

Congrats to all those approved! Just an update since everyone from CSC is almost done - we had an RFE in October. As we were closing on our house and had other assorted stress, I didn't send in our response until 12/17. In a letter dated 12/22, we got a letter stating that we were being referred for an interview. The letter actually arrived on New Year's Eve. Yeah, that sucked.

So after having a few days to kick it around, I am still pretty worried, but we'll get through it. We got our RFE for proof of communal residence, which is hard, since when we lived in Brazil, we lived in his houe (I couldn't own anything since my residency was still pending when we left), and when we moved here, we lived with my parents until last October when we bought the house. I sent what I had with the RFE - new house docs, explanation of our residence history, a few letters mailed to both of us, and 5 affidavits with pics and such from family and friends. I'm at a loss for what else to give, because I am pretty tapped out for evidence. If the interview is like the one we had in Rio de Janeiro, where we had a binder (that I am sorry to say I cannot find after the move) of stuff that no one even asked to look at, that would be great. But I don't know. My husband's english is still not fantastic - he can get by, but there is still a lot he doesn't understand. That is my main worry.

So if anyone has any advice, please feel free to pass it along! It would be appreciated!


oh Tricia599, I am so sorry to hear that. What a pain!

Regarding your husband's English, I would highly recommend finding an interpreter to bring to your interview. That is what we did for AOS even though it seemed a little like overkill, but we wanted to take every possible precaution (we were one of those tourist visa marriages, so we were automatically in that position of having to go above and beyond to prove that we hadn't committed any sort of fraud) and the VJ community advised us that I would not be permitted to interpret the questions for Enrique if he didn't understand them. Professionals can be expensive, so we found a bilingual grad student with an interest in latino issues who I think would have done it for free just for the curiosity aspect of seeing one of these fabled immigration interviews. We were able to score the piece of mind of having him for the cost of taking him out to dinner and giving him a card afterward that we'd slipped $50 into.

As it turns out, the interpeter was dismissed to wait in the hallway almost immediately, but I would bring him again in a heartbeat because I really feel that having a clean-cut, professional looking representative at our side showed an attention to detail that the immigration officer appreciated. He asked us why we opted for one, and I said that we wanted to take every possible measure to ensure that he could get the answers to the questions he needed without us answering for each other or any miscommunications. He seemed satisfied with that.

Anyhow, I hope that helps -- I'd avoid bringing a friend or relative to interpret, but hopefully you can find someone in your community who can make the communication factor one less thing you have to worry about. Please keep us posted and best of luck with your interview!

Christmas came early to our house this morning in the form of THE letter from Vermont.
Permanent residence status approved . conditions removed and green card on the way.
Remarkable as we had very little evidence or relationship as we don't do banks , credit cards etc.
Outstanding behavior Vermont, our adopted home state.

I have a friend who applied a month AFTER I did, with a divorce waiver, while pregnant with the child of someone other than the initial petitioner..and she was approved back in September. Not much logic behind that, other than the fact that maybe she actually got an officer that does some work.


Was she carrying the USCIS officer's baby perhaps? hahaha....

For what it's worth, I applied February 4th to Vermont and I am still waiting. Don't mean to drag anyone down however, since it seems there is no logic when it comes to the order in which cases are processed (there are already some April filers approved at Vermont). It seems some filing periods are just "lost in time" (end up in a bad batch with a lazy/sick officer?) while others both before and after are approved - seems early February is one of them. It's pretty ridiculous but I guess all we can do is wait.


I just wanted to say that your username made me laugh out loud, so thank you for that. Posted Image It's frustrating, to be sure, but I like to think that they're prioritizing cases for couples trapped in different countries. It's annoying that they're falling so short of the expectations set for VSC, but at least we get to spend the meantime together as couples, rather than wondering when we'll get to see each other again...

(of course, i have no way of knowing that that's true at all, it just helps me stay sane...)

traveling with the extension letter is LEGAL. traveling with the extension letter AND supporting documentation is even better. i dont think anyone should be intimidated in to NOT traveling because of fears of being hassled at the border. we are (or our spouses are) legal permanent residents and we have paid our dues.

(i know that in theory this sounds great and that in practice it might not feel so great, but it is our right to travel to and from the states. the same way that the gov't has the right to scrutinize our comings and goings. but as VJers we are fairly well-educated and have the advantage!)


I'm aware that it's legal -- we wouldn't have dared leave the country if we weren't quite sure that we had every right to! I only mention our issues because we were overly paranoid and brought totally unnecessary documentation for worst-case-scenario situations, and we turned out to need every piece of it to convince an official (who flatly told us there was no way we were getting on a plane that day and that we needed to leave) to let us move on with our trip. My intention was definitely not to scare people, but like you said, providing supporting documentation is a good idea, even if you shouldn't have to. I think most of us develop a little healthy paranoia in this process (send the extra docs to the USCIS, make 3 copies of your petition, etc) and this is another case where it doesn't hurt to over-prepare.


Again, I hope I didn't give the impression that I don't think people should exercise their legal rights if they choose to; I only meant that we try to plan our more flexible international travel for when there's as little potential for misunderstanding as possible. As it is, we are consistently detained 6-8 hours at US customs every time we come home (thanks to E's super common name, his identity has to be checked against thousands of criminals) and we understand the need for that, but if we can avoid traveling internationally while our documentation is anything less than typical, we'll do it. Looks like we won't have the GC in time for our December trip, but that's ok -- it'll be fine, just wasn't quite what we were hoping for.

We are going to Nicaragua in April. The NOA1 says that we have a one year extension...if I remember correctly. I hope things are moving by then or that traveling with the NOA1 will be enough.


I think we'll probably be ok since in both our situations, getting back into the US will be the tricky part and at least the paperwork is legit and US officials can verify that. When we traveled to Canada a few months ago though, the airline officials refused to issue Enrique's boarding pass until I showed them some paperwork I printed up about his eligibility since their computer was telling them he didn't have the right documents. It's annoying that sometimes it doesn't seem to matter that you have the paperwork all in order, if that paperwork isn't what they're used to seeing. Anyhow, hopefully we'll all be set well before April so you guys won't have to worry...crossing fingers for everyone!

So this month is our "6 month" mark... since USCIS have changed the timeframe on their website from 6 months to 24th Feb 2011... can we still call them at the 6 month date and put in a service request?? (Though i wonder if a service request would even help!!)....


Can't hurt to try! So frustrating though, as we booked flights to visit Honduras next month, thinking all this would be straightened out by then. It's always hard enough to get back into the states without an expired green card/extension letter, so I'm expecting even more fun this time...

I know! It sure would be nice to have a valid green card (not just the expired card + extension document) to take with us when we leave the country at the end of the week. But it's ok, I'm sure the June filers cases are much more urgent, ha ha.

Hi Edina, no they didnt tell me that...but the lady who took my fingerprints told me that I will be back again to take another photo for my GC so dont worry about how I look in the photo she took!! i was like "what!? are you sure?!", she said yes, but I believe she is totally wrong! no such thing as taking a photo now and then having to come back for another freakin' photo later. :bonk:


E just had his biometrics at the Durham office and they didn't tell him he was going to have to come back, just for what that's worth. That is really weird to take a photo and then insist you'll have to come back for another. Keep us posted on how they follow up!

Did you try calling the NCSC? Deidre and I got our appointments pretty much exactly two days after we both called, even though we filed at different times.

Out of curiosity, when I entered my case number provided by the biometric appointment letter on the USCIS My Case Status, it shows ----

"On June 1, 2011, we received this CRI89 PETITION TO REMOVE CONDITIONS OF PERMANENT RESIDENT STATUS RECEIVED, and mailed you a notice describing how we will process your case. Please follow any instructions on this notice. You will be notified by mail when a decision is made, or if the office needs something from you. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or contact our customer service center at 1-800-375-5283..."

I clearly remember that I used form I-751. ICRI89, is it another term they use for PETITION TO REMOVE CONDITIONS OF PERMANENT RESIDENT STATUS?

Please advise. Thanks!


A little googling makes it look like they are the same form -- I don't have our paperwork handy (at work) but this thread makes it seem like it's expected/normal. Hope that helps!

Well when we did AOS, i remember you were a week or so ahead of me putting in the paperwork, and this meant i was also then a week behind you with the bio appt, but i did an early walk in too for AOS (either the same day as you or a day later). Because of this, we ended up having our interviews the same day!! And E got his GC only one day before i did.
So as for AOS, the early walk in by a week did catch me up to you.

Lets see how ROC goes! Currently if E keeps the same appt time, I'll be approx 3 weeks "ahead".... :wacko:


well...one week could be lots of things...I wonder if sometimes they work on applications in batches so they aren't constantly switching context between forms. But with a three week biometrics head start on us (after filing 5 days later) we will probably have much better proof that it helps :)

Just got back from my early walk in bio in the Raleigh-Durham NC office! In and out in less than 10 minutes. :thumbs:
The 1st security guard checks asks "you have an appointment today?" .. i replied "yes", she checks my Bio Letter against my ID to make sure name is correct (did not look at the date). The 2nd security guard asks "what time is your appointment"... I replied "2pm" .. he looks at the letter and then points me to the reception area. Who knows if he looked at the date or just didnt care about the fact I was a month early for my appointment? lol But the office was empty! More security personnel and USCIS Staff then us "immigrants" :bonk:




You are gutsy, Deidre! Since we got our notices/appointments within days of each other and are going to the same USCIS office, it will be interesting to see if your application pulls ahead of ours for having gone weeks before your appointment since E is not planning to go early. I'm curious!
