Nope, don't attach any photos. You take them, with nothing written on them at all, to the interview with you.

Send DS-230 back with the packet three stuff. Unsigned. It must be at the consulate FOR your interview. They check it is okay before your interview. Then, once there, you sign it in front of the consular officer.

Depending where you file there may be 2 parts to this form. Part 1 the Biographic Data pages you can sign, Part 2 The Sworn Statement requires you to take it to the interview sign in front of the Visa Officer at the Visa interview. So don't sign part 2 the Sworn Statement if you have to use part 2.

It's fair not to assume anything unitl you have your passport/visa in your hand.

I went to my intervew 3 weeks ago thinking that everything would be ok and we just needed to be finally approved. I was advised at that point that FBI Name check needed to be completed. I was also advised that this process would take one week. Now 3 weeks later I wait............


You poor thing. oh no now I am even more worried!
Good luck! Hope you get it very soon. Was there any reason to expect you may have needed an FBI check? Aything like many visits to the US? did they give a reason at all?

The police check you submitted with your K1 visa application is only relevant to anything (offences) that occured ( or not ) in the UK. The FBI check which is run when you apply for AOS, is relevant to anything that has occured here and probably due to the terrorist threat anywhere else.

I was wondering if my family history or the fact I used to live in the states will hold up my case?

My dad used to work for AMEX and so we all moved out as a family when I was 15. We lived there (i was a dependant on my dads visa) for 2 years aprox. I even have a USA social security no.

My brother ended up staying and meeting his wife, he applied for a Fiance Visa but as his wife was pregnant , so he got married and then pleaded his case, they decided he was ok to stay. My Brother now lives in CA with his wife and 6 (yes 6!) children He has lived there for 16 years and is now a us citizen.

Now, to complicat matters, my Mum and Dad also live in CA. They both stayed there illegally, and sought legal perminent recedency through a lawyer, they are now fully legal and have been living in CA for about 3 years.

Now, will this effect my case or is it viewed on a personal basis and I wont be held responsible for my naughty family? Or will they be suspect?

I have been in and out of the US 5 or 6 times, twice with my Fiance and always legal. And I will actually be living in Dublin OH so a 6 hour flight away from my family, so not the reason for me going out there. Its pure coincidence.

Opinions or advice please!

Cannot believe it, me and Amie are so happy right now!

What happens next, I haven't a clue! Do I just wait for a pack to arrive to me in England?

Jeez I feel like the kill joy, but again, caution, caution, caution. Please bear that 'legal' title in mind when you are traveling as a 'fiancee'.
While unusual, there was a recent example of a fiance being refused entry for referring to his partner as his wife (because of their 'unofficial' ceremony).

You would travel on an Advance Parole doc. You cant apply for one until you submit the AOS I-485 package. Included in that package is a certified copy of your marriage certificate from the County Recorders office. If you do not have a certified copy, you will receive an RFE, etc.

I think the OP is planning a wedding ceremony that she won't have the visa in time for, and the idea is that the fiancé will come here for the ceremony (since the party is already planned), then return and enter later on the K-1 when they'll have a legal ceremony.

Or, she's planning a wedding ceremony in the UK that won't count as a legal marriage, and then they'll get legally married in the U.S. once he enters on the K-1. I'm a little confused because I'm not sure quite what the OP's plan is w/r/t the wedding party.

Just to clarify again. The wedding is planned for the US. My Fiance is there, I am in the Uk. We started planning the wedding when we were both living in the uk before my Fiance was transfered back to the US. So, my back up plan is go to the US. Have a church wedding, not do the legal part which my Preist has checked is ok. In the eyes of the church, my family and friends we would be married. In the eyes of the law we wont. I come back to uk for Embassu interview, travel back to US on K! and get the legal part done. As far as I am concerend the 1st wedding willbe the day we are married! OR we can do what the queen does with her birthdays and have 2 anniversarys!

Its not ideal, but then none of this is! I wouldnt have done it this way in hind site, but I dont have any choice now.

Be careful with this one. Getting into the US while a petition is pending is hard enough, but if Immigration knows you are coming for some kind of ceremony, and you are carrying a wedding dress, etc., you could be easily denied entry.

Yeah i know, i am very worried. To my benifit I have been to the US once already in the arly stahes of my K! process, and I will fedex the dress! I will take a letter from my employer and landlord too. Anything I can think of, I have been in and out of the us loads of times before, so am praying its not a problem!

Also, does calling and hassling people the USCIS help or hinder? Any evidence?

Claire, I have read most of the replies and I think you have a good understanding that expedite needs a good reason and can be done. If I understand your timeline from this post, you are still inside the 60 days published by the USCIS. As we have seen in this site, if the USCIS has not responded or acted on RFEs and petitions within the published 60 days, you can subit an expedite request. Do a search for expedite and there is a thread with and example letter, that just got his expedite approved because USCIS had busted their 60 day response timeline. Good luck, Payato

They are granted for the right reasons. If you have to search for a reason, you probably don't have one that will qualify.


i would never dream of making up a reason! Ever! And I never EVER park in a handicapped parking spot! LOL.

It was just a question, if you if dont aks you dont get right? i dont know all the rules and reulations. If this process was really fair then we wouldnt be having people having aprovals from August and September with people still waiting form April! Not that I am not pleased for them, I really am, but why dont they just do it in order, then us who applied before the mess up would know exaclty when we were next, intead of it feeling like a lotter!

The waiting time for an interview in London is 4-12 weeks, 8 is average, but that is just an average!
There are people on here who have had the interview in a week!

We do have a backup plan, we have the "church wedding" but not a legal wedding, our priest has already looked into that. I just need to get in the county! Then come back to uk and have the lega wedding once I have the Visa.

Its a long story about why we planned the wedding in advance, which I have already posted, I know the rules " dont plan ANYTHING till you have the visa etc etc" but we didnt need a Visa when we stated the planning. So no need for a telling off from anyone! (again!)



Late last summer, we were 3 months from NOA2 to interview date. I don't think things are much improved now.


Wow 3 months! Eeek1 Oh well, it will be what it will be, I guess I make sure I take proof I will be returning to the UK! When they scan your passport can they see you have a fiance Visa?

Sorry. All I was thinking is that if you have deposits or airline tickets purchased for the wedding, you have a better chance of not losing money if you delay the ceremony now rather than later.

yup, had already done that prior to the advice!

Our response was not that helpfull, it was something like, you should get aproval before the 15th October, but its not guaranteed and it could be sooner or later! Not exactly a concrete answer!

Last winter there was a poster here who had a VERY unrealistic travel date/wedding date listed on her Packet 3 checklist.

Damned if London didn't cough up the dates she needed.

Hmmm. Interesting. It will be tight for sure. As far as booking a flight a few days after interveiws & all.

I'm not trying to be rude, but I've seen you post several frantic posts that could easily be answered by research on your own. The timeline search in an easy one & would have answered several of your posts.

We're all in a hurry here but patience is needed in this process!

PS: You WILL need a copy of your NOA2 for AOS if not at the interview. A replacement costs $200!!!

Trouble is I actually dont kow when I had my NOA2 as we never received, all the embassy said was they sent packet 3 on the 27th September. I am trying to be realistinc, but actually an convinced it will happen in time, things allways seemt o work out in the end, and I am keeping that in mind! Staying possitive works for me, My fiance does the negativity and pessemistic part.

Well, I am ready to go, any time they like!!!!!

Wow, the Saga goes on!

My Fiance has now received a letter, which he is yet to send me a copy of.

It is addressed to me! And says something about leting the embassy know of my correct address!

We had called the USCIS about my change of address, and sent a letter recorded delivery! We even have a notice frome the USCIS saying thankyou for your informations blah blah blah...

I can not believe how ineficiant this is!

Oh well, I still thankful we are further along than I thought. I would urge people going through CA USCIS to double check their files if they have moved address!

clairerubunda.....having processed through London and having seen their paperwork...this would be my suggestion to you....

Firstly, unfortunately it won't do you much good to call London. As Yodrak said, your case has probably already left the NVC. Once the case does reach London, it will PROBABLY take 2-3 weeks for them to get it logged into their system (some of this time MAY have passed already). So, if you ring them, they literally won't be able to find it. Also when you call their number for UK citizens, you are actually contacting Glasgow. All those folks know is what they see on a screen - and they can't see your case until someone in the mailroom in London puts it in the system.

You can email them - this is the method of communication they prefer. They absolutely can't answer your questions until you have your case number. Your NEW case number will be on the NVC letter your fiance gets.

Here's the good news - once you get Packet Three - there is a place on the 'checklist' form for you to indicate a travel date and a wedding date! FILL THESE IN! DO NOT LEAVE IT BLANK...London does try to accomodate these dates if it all possible.

Whilst you are awaiting Packet 3, you can be preparing the forms and have them ready to go. The forms are available here on VJ. That way you can fire them back off the same day you receive them. WHEN YOU RETURN PACKET THREE SEND IT BY REGISTERED MAIL or an Express carrier.

This is the best advice I can give you from my experience with London. We processed last year but the system hasn't changed.

I am actually a step ahead than I thought, without any NOA2" at all we are on our way to the embassy!
I had my fiance's parents scan the letter so I could read it;

The letter is from the NVC saying they forwarded the visa on to the embassy on the 21st September.

Lets hope packet 3 gfoes tothe right address fast! Will be checking with them tommorow.

I just called the NVC. They asked me to type in my receipt number, i did and they had no record of me so I could not continue the call.
Does that mean it has left there and gone to the Embassy already? How long would it normally take from approval to the Embassy receiing? Its 14 days tomorrow.


Don't use the automated system! Make sure you speak to an live operator. I think you press #1 for English and then #2, and you should be put in line to speak to someone. They take calls until 12 or 12:30am Eastern. The automated system is not for K1 visas. You asked me how long it takes for the package to reach the consulate, and I think it varies. They told me to wait a week before calling the consulate to see if it arrived, but it got there in 2 days. Yours has to go overseas though, so it'll probably take a little longer. My recommendation is the consular section - they're the ones who need to know, who will be sending out the visa application package.

The case has probably left the NVC already.

Are you referencing your foreign address? You can contact the NVC or wait until your package arrives at the applicable Embassy/Consulate and change it there.


I just called the NVC. They asked me to type in my receipt number, i did and they had no record of me so I could not continue the call.
Does that mean it has left there and gone to the Embassy already? How long would it normally take from approval to the Embassy receiing? Its 14 days tomorrow.

Make sure you contact both the NVC and your consulate to follow up. I changed my address at the NVC, but they did not forward the new address to the consulate, who had already sent packet 3 to my old address. It wasn't a huge deal though, they just changed my address and sent a new package out, but it did probably lose me about a week as it took them a few days to send out the new package. So start calling the NVC now, and after they transfer your case to the consulate, start calling them as well.



How long does it take to get from the NVC to the Embassy?

Have your USCIS case number ready.

Failing that, contact the Embassy/Consulate handling your case, after NVC forwards it to them.

We set up a forward to His parents in the US. The approval went from the us, to the UK and back to the us. So 2 weeks have gone by. Trouble is they may have my old address to for packet 3?

What address are you referencing? If you already have the approval NOA-2 (I-797), it seems they have the correct address.
Can you clarify?

So, I have contacted the Embassy and they have sent my Package 3 to my old address.
They have wrong addresses listed for both my Fiance and I. Even thought we notified them recorded delivery in writing and by letter.

I have emailed them again with my new address, and I am going to go to my old house and see if I can track the letter down! I hope they kept it???

i don't think you need it for the interview, but you do when you AOS. you use the I-824 to get a duplicate approval notice.

They told us wait for 60 days before u contact us regarding the case and now 60 days passed still no decision and waiting for approval. Moreover i see that many people who file their case of I-129-F after me got approved but i m still waiting so will u help me on what ground those are getting approved after me and when i see the processing date of CALIFORNIA SERVICE CENTER on 19 Sep 2006 they are doing case on 20 MARCH 2006.

When i make contact with the USCIS they say u had to wait more for 30 days how long we had to wait more when i see people are getting approved after me



I have the same message but dated August 10th. Its so frustrating isnt it. there are many cases aproved before mine. I am at CA office.
