Dear all,

USCIS don't care about pictures. They said the pics are secondary evidence and they have to be film dated not HAND dated. They also said in the RFE that emails, chats, phone bills, bills...are irrelevant and unacceptable. They also said Flight itineraries and undated boarding passes are not acceptable. Finally, they said please submit copies of passport pages showing name and stamped entries to the beneficiary's country. I suppose dated boarding passes are acceptable. This is extremely important as I didn't know this stuff when I first submitted and got a RFE. I don't think anybody should get RFE for something like this. So guys, listen, I told you this exactly from my RFE paper. Hope my RFE becomes NOA2 now.

They are asking for (highlighted above) bcoz they are trying to find the proof that you have met within 2 years. About pictures, they dont really focus their attention to that bcoz in modern ways now you can make a picture of you together without seeing each other in reality. I am leaving for Morocco tomorrow to bring my fiance back to the U.S. on Nov. 30th. Today, he was visiting a friend that works at the Embassy, his friend told him that he may not be able to leave Morocco on a booked/paid for by me a "ONE WAY" ticket. He said that they do not consider a K1 a permanent visa and he would have to have bought a round trip ticket. I find this to be just impossible as there many do not book round trip tickets as they would lose that money and it's not cheap.

Is there any truth to this????? Do I need to re-purchase another ticket tonight for him to return to Morocco? OMG the night before I leave and I get this bit of information.

Thanks in advance for any advice.

Ok, I`d like to present my case and tell me if you think the Embassy in Manila consulate will grant my Fiance a K-1 Visa

Let`s just assume that the proof of meeting/relationship has been proved via boarding passes, pictures, Yahoo messenger and Skype records, other documentation,ect

I`m 46 Fiance is 30

I`m on Social security disability (SSDI). My minor child lives with me. I`m about $2500 a year short of the 125% needed for 3 people. My minor daughter, based on my disability also receives financial support via SSDI. It is approximately one half of what I receive. For example if I received $1800 per month she would receive $900 per month. Her SSDI is paid to me but in her name. For example the social security administration addresses letters/payments as followed "John Smith for Sally Smith" I`m assuming I can`t use my daughters income on the I-134. This is where I have a concern. If I list my household on the I-134 as 3 people (myself,fiance,my daughter) Do I only list my SSDI income ? She is getting that monthly payment as support for her. Therefore I have to spend very little of my monthly income on her. Based on just my income I would be above the 125% level for my Fiance and I but I`m $2500 short if I list household as 3 people. I hope I explained that clearly enough. I dont have much debt other then the typical monthly utilities and a small credit card bill.

I have about $6000 in savings. My fiance has about $1200

My condo, where I live is paid in full. When it was originally built in about 1970 the condos were all actually apartments. Many years later they were sold separately as individual units or condos. Mine was about $50,000 when I bought it but now is just valued at $41,000. My vehicle is also paid in full
My Fiance owns her own home in the Philippines. It is in her name. The house was built about 3 years ago. She received a loan via the gov`t. It was a 30 year mortgage so she has 27 more years to pay on it.

Fiance is a working and licensed Physical Therapist(PT) in the Philippines. Her degree has been certified in the USA. Meaning it is recognized by the PT licensing board in the USA. She still has to pass the state boards here to work in the USA as a licensed PT. However she would be qualified to work in the USA as a PT aide. She plans on taking that PT licensing exam in 2011

Fiance was granted a USA tourist visa 2 years ago in order to take the USA PT state boards. The exam was in the USA territory of Guam. The Visa specifically said "Guam Only" She abided by all regulations of the visa. Failed the exam :( Returned to the Philippines. Also I`m not marrying her to be a caregiver to me. Based on my disability there isn`t anything that can be done for me by a PT.

Fiance also worked for 2 years in UAE as a secretary. No problems in that area.

So based on the above info do you think the Visa would be approved ? Yes, I realize each interviewer is different but in general do you think we have a good chance despite the affidavit of support issue ?? Maybe I left out some key info? If I did please let me know. Many of you have very good knowledge of how this process works. I`m interested to hear what your opinion is. Thanks so much !!


If I am the the consul yes I will approve the visa. :) My fiance is almost the same situation as you. He is on SSDI as well since 2009 and his 16 year old daughter is partially dependent to him and also receiving some money based on his SSDI. He owned a franchise of Dairy Queen for 10 years but gave it up bcoz of his health. Currently he is still working as part time whenever he is needed and well enough to work from his families businesses. I can say that your daughters money can be added to the income you receive in SSDI. You need to write a letter stating that you are exempted to file a tax and you should include the award statement and bank statement that shows the money you received from social security. And also the the supporting documents that you own your condo and you can use it as an asset based on what I've learned here in visajourney. She has the possibility to be able to work and sounds great that she's going to take the licensing exam. I was offered some jobs from his family right away when I get there and ofcourse I will need a temporary working permit to be able to work. I have a friend here in visajourney on the same boat as well. She is on SSDI and her child is dependent to her and receiving some money as well and she combined together as her income. It was accepted and her visa was approved. I understand that SSDI is a stable income. Currently, Im waiting for my interview date. About your age difference, it doesnt matter at all. In proof of meeting the main proof that you can use is the copies of all pages of your passport. It shows everything the stamps and other infos that you've been in Philippines. it doesnt make you look anything,half the time all they do is manually check your case status.sometimes they dont even do that.
OP emailing USCIS worked for me.my fiance called them five times,they didnt even bother to check our case status manually.after i emailed them i found out we have been approved for about one month now.so try doing that

The income for 2010 was OK but the CO asked only for a co-sponsor based on 2009. SInce her fiance is self employed, his income is not steady.

His family offered me 4 jobs which are full time & part time. They have letters stating that they are offering me a job as soon as i arrive in the US but ofcourse if I will be issued a temporary work permit as i enter US otherwise i'll wait for my authorization to be able to work.



Just want to add something. Though he is on SSDI, it is a steady income and accepted for I-134. He was a self employed for 10 years and stopped last 2009 because of his health. We have Form 1040 for 2007 and 2008, notice of award for SSDI, pay stubs & letters from his part time jobs, SS benefit statement for 2009 and bank statements. Im telling all this so others can give their opinions.

You are right...but the thing is the USCIS personnel are loaded with works. I have read somewhere that someone got an RFE for filling out an abbreviation.

If cannot fit, Write * Pls. see attachment. Then, provide a piece of paper and write * Attachment (name of form then Q. 2 for example). Do not abbreviate anything on the form. Other people might not understand. Goodluck! :thumbs:

In my case, I overdone this. I made double to triple copies of any documents and I end up bringing 10 inches of documents during my interview! :lol: And guess what? Only half inch of documents were taken from me. Well, its better to safe than sorry/RFE. I've been in 4 countries but they only asked for NBI from Philippines. I think it really depends on embassy you are dealing with. Just prepare original documents along with photocopies during your interview. All the best! :thumbs:

Common sense is that you don't grant someone a k1 visa when they are on their second different petitioner within one year. I think that was the concern. Also wouldn't homeland security red flag the whole thing when they see someone getting petitioned by two different people? How did the second petition get to interview so quick? If the first petition was from six months earlier and made it to nvc then it sounds like the second petition was filed at close to the same time right? Why was an interview appointment even made for the second petition or were they using the appointment from the first petitioner? omg!

I recently withdrew my first petition because I found out that I qualified to file direct through the embassy. After emailing and calling the USCIS several times, I determined that the only way to make sure that it would get cancelled was to send in a request in writing. I even questioned what address to send it to and was told over the phone to use the address on the acceptance form. Hopefully the USCIS won't drag their feet too long or we might have the same problem when we go for the interview. If anyone knows more info on this help us out.



If you filed a petition to the same person and withdrew it, I think it wont be a problem. As long as you are saying the TRUTH during interview, you'll never go wrong. Goodluck! :thumbs:

Yes it's true that no matter how bad is your past, we should be open enough to our significant other. ..especially those things that matters in a relationship and the future. Past is past and we cant do anything about it but Learn. Some people deserve a second chance but others don't.

I hope as a petitioner, you'll find out the whole truth and move on with your life. The sun will always shine after the rain! (F) If this is just a great trial in your relationship, I'm sure everything will work out for you both. Try to talk to her and contact the previous petitioner and ask to withdraw the petition. Another problem here is if she lied during the interview, she is subject to permanently/temporarily be barred to enter the U.S. Interview is a sworn statement...to tell nothing but the TRUTH. If you decide to reopen your case, you may need an immigrant lawyer. All the best!

our interview was yesterday and I was in attendance. we had all the standard proof of a relationship e.g. chat logs phone records text logs letters from family and friends. He was interviewed by a woman in english and then given the same questions by a man in arabic. he answered consistently and truthfully for over an hour. I was then interviewed by the same man for about an hour. We were given no specific reasons for denial just the usual "appears to be for immigration purposes" statement. i'm fairly sure that they did not like the fact that I had met him in may 2009 and went to see him in december 2009. the man said " that was quick!!" they also did no tlike our 15 year age difference. that's all i can think that it would be since we co,pared our answers to their questions afterwards and we gave the same;

so, i have tried contacting my senator, no response yet; what about getting in touch aith an attorney, and how do I find a good one?

This is out of respect to the many Filipinas like myself who are in genuine relationships and only wish to be with their loved ones, like most people on this site.

It is a 90 day buffer zone, where the foreign bride begins her adaptation period to the USA and her new man. There are TOO MANY cases seen on this board, where the relationship implodes prior to the 90 day marriage deadline period. Sorry you don't see it that way, but if you were a man whose Filipina flipped out on him, stole money, went out with other guys, by day 55, and then you could send her back home by day 60, then maybe you would have a different perspective. Oh, and to quote a guy who did CR1 Visa, and had the latter happen to him, "Gee, I wish I had a 90 day K1 Trial Period. "

WAHOO!!! NOA2 email yesterday, 12/7!!!!!!!!!!!!! Exactly one week from the receipt of my RFE materials. They asked for proof of citizenship, proof that we've met in the last two years, and intent to marry. (I included all those things the first time, but WHATEVER.) So I mailed back copies of both my and my fiance's passports, letters from friends, coworkers and my pastor, emails/contracts for wedding related stuff, screen shots of photos w/digital dates from media card, and a pleading letter! Hahaha...Either way, WE GOT APPROVED! And now it's on to the next round!

Some friend from work surprised us with plane tickets for my fiance to come for Christmas/New Year's/our birthdays (mine's the 23rd and his is the 25th of Dec)!!!!!!!!! They knew we couldn't afford a trip and got together and bought it themselves!!!!!! So my BABY IS GOING TO BE HERE IN TWO WEEKS, arriving ON my birthday!!!!!!!! What an AMAZING December this is shaping up to be!! GOD IS GOOD!

What I did with my wife in China is set up Schwab brokerage and checking accounts and then sent her the atm debit card. I can transfer money to these from my bank account at no cost and she can withdraw money at any ATM in the world. There are no fees from Schwab for this and they advertise that they will reimburse any other banks atm fees to you. So far we haven't seen any transaction or currency exchange fees on the account and we have been doing it this way since August. Beats the heck of of the fees for WU, moneygram or bank wire.

Since I met my Fiance online, we never missed a day without chatting, calling or sending emails everyday and I am 9 hours ahead. My day is not complete without talking to him. All of us are busy and get tired of working but hearing something from your special someone can make you feel great except ofcourse in times that you have misunderstandings (it's normal). :lol:

In your case, maybe your husband is busy working but it's not an excuse. He should find time for YOU. Send him an email telling exactly how you feel or call him. I know the feeling. :luv:

I really hope they will accept the SSDI. My fiancee is on SSDI too. I have read in many posts that SSDI is acceptable income for I-134. Goodluck on your journey! I still have to ask the USE here in Dubai if they will consider it.

Fire your attorney! :lol: Don't be disappointed with your attorney. He didnt know that USE Philippines doesn't accept a co-sponsor in most cases. The acceptance of co-sponsor really depends on the situation and USE regulations. Just let your mom write a sworn statement that she will be your co-sponsor in i-864 when you adjust your status after your marriage and let your attorney be the witness. Anyway, your fiancee will bring all these documents for interview in Philippines.

hello!, im new to this site and i think it can help me on my k1 visa issue, if somebody can help me to give some advices for my k1 visa it would be much appreciated! so here is my situation, i am a 20y.o filipino american citizen just came here in C.A last may after my graduation as a nurse and now currently reviewing for NCLEX. i decided to get a k1 visa for my finance(4yrs relationship) who is also a nurse graduate and recently passed the board exams, because it doesn't make sense if she would still stay there now that i am here and we can't stand to be separated for a longtime. :( as i browsed the internet i knew that PHILIPPINE IMMIGRATION doesn't accept a CO-SPONSOR, it really concerns me because my MOM who is also a nurse is the one who will provide the affidavit of support we even used an attorney to help us and prevent any mistakes so the process could run smoothly, im really disappointed that the atty. didn't bring this scenario to us, i live with my brother and stepfather they are both CNA's and im only the one who is not yet employed, im really concerned that our application will get denied after spending much on attorney's fee and k1 application. i would give my advance gratitude for those who will take time to read and reply to my concerns! thanks. :no:


I think it's acceptable in some cases like yours. Your mom is your co-sponsor and that sounds Ok plus, both of you has a possibility to land a job in the near future if not sooner. Goodluck and God bless in your journey! :thumbs:

My fiancé is going to have his interview in few weeks, in USA Embassy at Abu Dhabi he was asked to provide evidence of finical support, currently am not working and my income is SSI, can I use my sister as co-sponsor because she met the requirement for income? Do I have to fill out i-134 application to?



Yes, you have to fill out I-134 and your Co-sponsor need to fill out the I-134 as well along with the evidences like pay stabs, letter from employer, bank statements, W2 and Tax transcript. Goodluck!! :thumbs: You can do it!

No need. The second part of my I-134 (that shows the petitioner's signature) is not original actually bcoz the actual form that I got was expired and I just asked my fiance to scan and send me.

I contacted the US Embassy in Manila and they just referred me to the reciprocity table. I then spoke to Ms Geraldyn Chen, Second Secretary (Consular) Embassy of the Republic of Singapore in Washington DC and she said that we could try several things since the Singapore government will not issue any official letter that says they no longer are issuing the CNCC to foreigners.

1. Print out the notice on the Singapore Police website and bring that to the interview. It indicates that they no longer offer police certificates for non-Singapore citizens.

2. Get a Statutory Declaration from a Commissioner of Oaths in Singapore and take that to the interview. The Singapore Police website states that a nominal fee may be charged (approximately S$20) for this by the Commissioner of Oaths.

3. Go to the Singapore Embassy in Manila and request a Statutory Declaration there. They may also charge a fee for this document.


Well, I have a copy of the notice from the Singapore website ready. I contacted a Commissioner of Oaths in Singapore and requested what they would charge for the Statutory Declaration. They told me US$400 and I would have to go to the Singapore Embassy in Manila and get it certified. What a bunch of BS.

I am going to have my fiancée go to the Singapore Embassy when she goes to Manila for her medical and see what they want for the Statuary Declaration. If the fee is of an appropriate amount, I will tell her to get one. Otherwise I am prepared to have her present all of the correspondence that I have had with the US Embassy in Manila, the Embassy of the Republic of Singapore in Washington DC, the Commissioner of Oaths in Singapore and the notice from the Singapore Police website and hope that this will be enough for the CO at the interview. I am not sure what else we can do.

Thanks for reply John. Thats really crazy $400? I am in UAE. I actually emailed the CID Singapore and they replied me. I will use this and i will inquire as well for statutory Declaration.

I will definitely print it out and send to my fiancée with all the other docs that are required for the interview. I just wonder if that will be enough for the CO as to why she doesn't have the information that they require, i.e.: police cert from places lived over 6 months after age 16.

I guess we will just have to wait and see.

Hello John! I just want to update about the instructions given by the US embassy for unobtainable police clearance in any countries.

POLICE RECORDS: Each applicant aged 16 years or over is required to submit a certificate from the appropriate judicial or police authorities from the country of the applicant's nationality or current residence where the applicant has resided for at least six months since attaining the age of sixteen, as well as from all other countries where the applicant resided for at least one year since attaining the age of sixteen. For countries maintaining national police records, a certificate from the national police or judicial authorities must be submitted. For countries not maintaining national police records, a certificate must be obtained from each locality. A police certificate must also be obtained from the police authorities of any place where the applicant has been arrested for any areas.

On my own understanding, if we cant obtain a police clearance certificate, we must obtain a Statutory Declaration through the Commissioner of Oath or qualified legal practitioner or lawyer. Im quite confuse now. :whistle:

Well, after calling and/or going to all the major banks where I live, I have concluded that there is no way that I will be able to get the CNCC from Singapore. Only 2 banks would issue a foreign draft but neither would do it on the spot. Both required you to order it and then they mail it to you with delivery in 5 business days. Since today is October 13th in Singapore, 5 days would put me at October 18th when I received the draft and Singapore will no longer issue a CNCC to non-citizens from that date forward. I just can't get the application to them in time. I will just have to write them and request a letter stating that the CNCC is no longer issued to non-citizens and hope that will be enough for the interviewing CO.

I know that this will affect others as will as me and my fiancée so the best of luck to all of us. I am very frustrated by Singapore's change in policy.
