You both would have to get marry, then apply for Adj of Status and include the form that is called Advance Parole, it takes around 3-6 months to receive it back, then she would be able to travel without not problem.

You are correct. Age difference is NOT a valid reason and they will never use that. They CAN use "not clearly eligible". Try to appeal that one.

Again, I have not heard it is a problem in the Latin American/Carribean cultures. Make your your evidence is solid. The problem lies in that YOU must clearly prove the relationship is legitimate and not for immigration benefits. The burden is on YOU, not them. But if you have good evidence, you should be OK. I would also suggest strongly you attend the interview. (I do that anyway for anyone)

Trust me this is a total wrong notion. We live in India in much more safer and free and non fear way. No job loss no tension of how to pay the bills. So dnt think all these. My wife USC is 56 and I am 32. So what ?? that man must have demonstrated deeper sense of maturity and spiritual evolvement. Thats why she choose her. If he is using her for GC thats a different case though. But thats not is expressed here. In consulate stage interviews age difference can create a bit problem but rajojo321 i will give you certain things they looks as good proofs and you can use to circumvate these flags, if at all it arises which at all i doubt.
i) at least 15-20 pics together with the application
ii) A statement written by the USC where she states why she married,how did you two meet, add humour and make it believable. Trust me they read that. Though our marriage was from b1/b2 visa and didnt involve consulates but then they read it . Thats what our IO said us during interview.
iii) I dnt know about Dominican but many consulates do allow USC s to join

iv) last but not the least, write a letter from his perents and relatives about you two................ do the same from your end... means ur relatives write something about him and it matters. Our IO was very very impressed by the way her relatives wrote about me.
I dnt think there can be any problem in such little age difference so long he can convince the consulate officer. No one has ever been denied for age difference but they look at how much deep you are into each other. Thats what they want to see...... nothing else. They may ask you about plans to have babies together. Get a good reply ready.
Hope this helps............. be confident and tell him to gather all these & look into the eyes of the officer during interview and smile. They take stuffs as , looking down or looking away or to left, as signs of telling lies of hiding facts. So tell him to avoid these. Thanks .. Tell him to go to get a record police at Fiscalia RD330.00 to check if he is totally clean in the police records, which is computarized now. It is not like in the past that is done manually.

When you get approved and you filled out the forms, do not lie about this because it is going to be worst for your both.

Write NOW to the Embassy and ask for some explanation and some kind of prove that he has been banned. Go to the webpage and you will find an email there where you can ask for info.

A "passport style" photo refers to a photo taken to US passport specifications:

She'll need to get a photo taken that conforms to the requirements described on that page, and give it to you to submit with the petition. She'll need more of those photos to submit at the interview, and may also need to submit photos when she gets her medical. The photos are usually supposed to be taken within the previous 30 days at the time they are submitted.

Your fiancee WILL need a passport by the time she goes to the interview. She should go ahead and get started on that.

I even added a catpion on each photo. Then I printed the pages on 8 1/2 x 11 pages so it fit nicely in the folder.

As an added note, I didn't like dealing with punching holes in everything or the look of the binders that held the punched papers, so I found at Staples a punchless binder. It had a clear cover and when the packet was complete, it looked quite neat, orderly, and slick!

We are hopefully going to file for CR-1 next week.
But there are so many small questions that are hard to find answers for. Most I already found myself but there is one that I couldn't find.

It is also NOT described in the guides for how to fill out forms. I really looked everywhere I could.

I'm in the USA right now with a J1 Internship Work Visa but am going home in 2 Weeks.
I've been here for a total of about 7 Months.
Now do I need to list my address here in the USA where I lived during this time in the address box?

According to my Visa Status I am a "non-resident alien", so it sounds like I don't have to list my USA address in the "residency " address box, but I of course don't want to knowingly withold information or risk having my application returned because of this.

I hope somebody can help me.

Good afternoon,

We have a concern in regards to filling out the form DS-230, my wife is from Peru and for some reason when a woman gets married in Peru she does not take the husband's last name. When she went to change her status in her DNI, DNI is the Peruvian identification, they only added my last name to her full name. So now her name is like: Angela Teresa Smith Johnson James.

Now we are aware that when she gets her Peruvian Passport for the first time they are going to put the name that appears on her DNI. We are also informed that when she is issued her CR1 Visa, US Embassy is going to issue the Green Card with the name that appears on her Peruvian Passport. Our concern is how do we correct this, we do not want her Green Card with three last names, I mean it sounds ridiculous, I don't know if there is any other country that does this nonsense. Does she have a choice of correcting her name or will she be asked how she wants her name to appear on her Green Card. If someone can give us any advice on how to solve this issue, do we fill out maybe the DS-230 form with my last name as her Family Name, but then when we send her Peruvian Passport copy it will show up differently. Please help

Hi,

my wife is a US LPR and will hopefully be naturalized later next year. I will be leaving the US to fulfill whatever is left on my 2 year home residency requirement (J-1). Fingers crossed, I will have fulfilled the requirement by the time she becomes US citizen.

My wife was advised by an attorney to submit an I130 while she is a LPR. We know that the case will be given priority and the petition will no longer be subject to numerical limit when she becomes a citizen. Granted, she does petition now, does she have to submit additional papers and/or call once she becomes naturalized? Will this shift cause a delay?

Lastly, what is your take on petitioning while a LPR who will become a citizen before a visa number becomes available?

Hi , I was in the same situation...My husband was a LPR when he applied on September 1st....the same day He applied for his citizen..his process was done by November 16th and on the 18th he calls to USCIS to upgraded my petition and they send him an email asking for a fax with his copy of the naturalization certificate..he also mailed it just to be sure a letter requesting this with a copy of my NOA1 and his Naturalization certificate,...and on the 20th my petition was upgraded to immediate relative..and on January 27th I receive my NOA2 of approval...so as you see everything was really fast... ..

As I have noticed I guess there's no such word tied (simple) in with this process.

(I realize this may have been asked many times on here and some may feel like a broken record. Please feel free to direct me to any other thread that has been started that could give me the answers I am looking for. I tried to search a bit (not hard I'll admit) with no luck.)

I am looking for advice from start to finish without having to spend oddles of money on a lawyer. I have bought the book: Fiance and Marriage Visa: A couples Guide to U.S. Immigration. I'll admit I was and am very, very intimidated/overwhelmed.

I'll explain what it is I understand at this point.

My husband and I married in Canada April 18th 2009. We were in Canada till September 18th Due to the wonderful economy my husband lost his job which meant he lost his temp work visa in Canada. So onward and upward as we made the decision to reside back in the USA. Since then I've been racking my head around which way to go with this process. In short I'm not dumb but at the same time it's hard to get specific answers from a book.

I understand we have 2 options the K-3 (designed to be faster than any other way of filing which is now not the case now a days) I am also hearing the K-3 is a bit more expensive then another option the CR-1. We need to ensure we have all proper documentation together (marriage license, a Canadian Birth certificate. (that's all I know))
I also have all of my current identification matched up with my new last name and with my current Canadian address to ensure all addresses match up etc.

But before we can even begin on those steps I'm stuck at the opening gate. The I-130 form (I am choosing to file while in Canada), I am confused as to what I need to submit and I understand what I need to submit depends on which process we choose to go with (I think please clarify if that's not the case). With the I-130 form I am confused if all these other forms need to accompany it as well such as the (affidavit of support, geographical information) those are the only two I can think of right now.

What I'm looking for is an angel right now to help me get past my confusion. What I'm looking for is a simplified step 1 ,2 , 3 and perhaps even inbetweens.

Please help me:


Step one


1. File for I-130 petition (what forms will accompany this?)

Step 2
1. K-3 or CR-1 visa (which one would be best advised to go with and a possible explanation of why)
2. Filing fees associated with either process. (I know it's $335 for the I-130)
3. Does anyone know of any good checklists to get online to ensure we have all the proper forms filled out etc.

I guess right now I don't want to get too a head of ourselves and would probably be better if I just dealt with these answers first. Then proceeded to ask further questions.

Misc Questions:


When they say 'copies' do they accept actual 'photo' copies of paper work/identification? Or will I have to apply for secondary documents to send with everything. (by this I mean an actual Marriage certificate, an actual Birth certificate.

with this petition :

1. Payment as required by USCIS. Use a personal check if allowed by the Service Center (as of 4/2005 they do allow this). If not, use a money order so you can track the payment.
2. Cover Letter. Should include a description of what your are petitioning for (I-130), a table of contents (list everything in the packet). If you need additional room to explain your case, attach a separate sheet (list the attachment on the cover sheet). Make sure to sign and date the cover sheet.
3. Form I-130: Petition for Alien Relative
4. Copy of the full Birth certificate (front and back) for the US Citizen or a copy of ALL pages of the US Citizen's passport. This is used to establish citizenship.
5. A copy of petitioner's proof of naturalization. (If applicable)
6. A copy of petitioner's proof of permanent residency. (If applicable)
7. A copy of your marriage certificate (If not inEnglish then again get a translation)
8. If either you or your spouse were previously married, submit copies of documents showing that all prior marriages were legally terminated (court certified copies of the petitioner's and/or intending immigrant's divorce documents).

12. G-325A filled out by the non-US Citzen spouse signed and dated.

Beneficiary: Get NVC# + receive DS3032 + send DS3032+ DS3032 accepted + IV fee bill available to be paid + pay and wait to show paid + print IV cover sheet + mail DS230 package with all original/certified documents

= wait for case complete + wait for interview to be scheduled.

Do you mean filling the DS 230 IN THE COMPUTER OR BY HAND?? you can do both but DS230 FORM CANNOT BE SAVED in the computer..so as soon you fill this form you printed check to see if everything is correct before you closed the file because you cannot save it

Hi everyone,
I have a quick question. I'm currently in the NVC process for a CR-1 for my wife and daughter. I'm here in Peru and I've been here for awhile (12/09). My job allows me to work remotely and because of that I've been lucky enough to spend allot of time with my girls, especially since I have a 2yr old. I really want to stay and finished the visa process so I can come home with my girls. The problem is that I'm only able to stay here until the end of March before I have to go home. Has anyone gone through the CR-1 process in Lima recently? If so can you let me know what type of timeline should I expect?

Just this past Monday we sent back the DS-3022 and my I-864. When can I roughly expect the whole thing to finish? If I have a date I can ask my boss for an extension, but I need a rough date.

Also, do we have to send all of her paperwork on NVC or do we do it all here in Lima?

if it is for the application anybody can do it..at least a 3rd person...not a certified translator

if it is for the NVC form you dont need to translated if your spouse is in the country where the interview will be in your case Colombia..

Perhaps they do check the IP address but I kind of find that hard to believe. I actually filled out the email (ds-3032) myself on my husband's email address and sent it out to him AND CC it to myself so that way they would have both address attached to the email. I did it here in Florida while he was in Egypt.
We didn't have any problem with that. They accepted it just fine.


PERHAPS IT WAS A GOOD IDEA TO CC YOU SO THEY SEE BOTH EMAILS ADDRESS WERE TOGETHER..AND I DONT FIND HARD TO BELIEVE THAT THEY TRACK THE IP ADDRESS IS REALLY EASY

another question on DS230 checklist
* Original/Certified Passport Office Police Certificate for Beneficiary and a copy

aren't these 2 the same thing asking for police certificate?? how r they diff. from each other.
how old does the police certificate have to be? like if he makes one right now and by the time we're ready to send the DS230 package, it'll be outdated? i heard 6 months old will do it.is it true

They will accept the DS 3032 (signed or not) from the beneficiary's email address, even a new one created for them five minutes before, no matter the IP address. Trust me on this. Who physically complete's which tasks in the process is a personal choice for couples to make.


I am not talking about new or old address I am talking about the geographic location of a computer. I am pretty sure tha Nvc must do some checks to make sure that the person sending a choice of agent is the one that was request to do this is not like they will trust every email that they received. I am not an expert of this area but it's difficult for me understand why a person cannot send a simple email... The OP of this post can do whatever they want is not my case I just say hey ask your spouse to send it from his home

Sachi..I have read that the thing with email from a computer in another country and the thing about the ip address thing whatever..is not a good idea to do that..because they can see that the email is not sent by the legitimate country... is the beneficiary without fingers that cannot send an email?? come on you and I are beneficiaries and we have done our homework
