Hi, it's been a while since I visited here, but I wanted to come back and share my experiences to date and maybe get some advice, too. Here's my situation:

In November of 2007 I submitted my k1 petition for my fiancee in Vietnam. I got the approval from the service center in Vermont back in February 2008. Not too long after that, my fiancee got notification from the consulate in Ho Chi Minh city and setup a date for an interview. When she went to the interview, in her words, they were very abrasive in the questioning, and in the end they denied the petition. Upon hearing news of this I flew back to Vietnam 4 days later in an effort to get an audience with the visa chief and try to change his mind. When I got there I stayed in Ho Chi Minh visiting the consulate for 3 days straight trying to get an appointment(I could get inside but they were utterly unhelpful) and just got run in circles until finally on the third day I managed to talk to an American woman (all the people I talked to up till then were Vietnamese working in the consulate and they were very strict in following their jobs, which is admirable but not helpful for me) who was apparently an interviewer and she passed my phone number and request along to the visa chief. In less than two hours after I left I got a call from the chief's secretary to come in the next day to see him. I came back and stated my case and disputed the reasons they had used to deny the case, but to no avail, he said the decision remained the same and that he was sending the petition back to the US for review. So me and my fiancee felt utterly hopeless and wondering what else we could do. I stayed for 2 weeks total before I had to return to the US. We have been keeping regular contact and I've consulted several attorneys to see what we can do. Just a week ago I received two letters in the mail from the Vermont service center saying they had "re-affirmed our previous decision" on the case that the consulate had returned with a recommendation for denial. It said some more but wasn't clear about what happens next. So I called my attorney and he told me that it was pretty rare for them to confirm a previous approval after a consular denial that they usually stick together in the decision making. He said that the consulate returns 99% of all fiancee cases and that the USCIS is getting tired of it, that they are overstepping their responsibilities in the process by trying to re-adjudicate the cases. I asked him what would happen at this point and he said that either they will just issue my fiancee the visa and cut their losses or try to send it back again. Hopefully it's the first of the two events.

I got a number for an American lawyer living in Vietnam and he referred me to a place that studies cases and coaches you for the interview in the consulate. We're currently waiting on word from the consulate before we go ahead with that.

Any advice on what we can do now to increase our chances of passing? Comments appreciated, too.

Yes, you better double check because I asked here in Dominican Republic and they told me. It is not allowed. Write down the name of the person you talk to over the phone.

Not it is not possible, all what you can do is to enter with her to US, to get marry, apply for AOS and you go back to Korea and she stay in US, because she can't go back with you.

Visa has to be used before the expiration date. Use or loose it.

To the OP -- my now husband and I went through the DR on a K-1. It is a tough consulate.

If you are ready to get married, I suggest you plan a trip and get married. If you prefer to marry in the US (I did for my family) or if don't have time for a trip soon, I'd file another K-1. Make sure you explain in your cover letter that you are refiling.

Before the interview, make sure you practice your answers to questions. Start on the phone and again the day before the interview. Bring all the possible ones you can get your hands on. Do not be embarrassed about questions about your sex life. We were interviewed separately by two different men and answered all but one question right. It is an important part of them determining the validity of your relationship.


I expect you know about dominicanstotheusa dot com - started by Tim and full of info. They may not be supportive of your denial, but they have question examples.

Our relationship was real and sincere. Well we disagreed on some questions, which was more because we were so nervous. Anyway so visa was denied, it was devasting. We have continued our relationship and now it has been almost 2 years since interview. we really want to be together but we are unsure as to what step to take next in our case.

A second denial will be unbearable. What can we do?

I would recommend you to get marry and to apply for a CR-1 visa and document better your relatioship. Maybe you failed for the question they did to both of you, but the Consulate goes thru interviews when they are not sure about the documentation.

Sorry if I'm misunderstanding, but how did you both have an interview? My understanding is that in the K1, only the beneficiary interviews, in his/her home country.

When she Picked-up her Passport Today with the VISA she brought the ORIGINAL NAO2 with her for the Embassy to re-validate stamp and she was told (by a local not an American Consul) " that she is a trouble maker " and that " the re-validated NAO2 was in the "Do Not Open Document PACKET " " Anya tried showing the " assistant " the Origian NAO2 and the e-mail from the Embassy saying they would re-validate it at this time but again this " assistan " told her " she has made her own problems and that the this Assistance and Consul told ME and Her the re-validated NAO2 would be in the PACKET and that she could thro away the ORIGINAL NAO2 "

this is not what we were told.... !!!!

Can anyone shed some light on this Issue... I am concerned because I think we need this for the AOS filing to come ...

Do we need to have the Local Embassy RE-Validate the NAO2 for the AOS and other filing later on ?

The CO has the power the revalidate the NO2 for 4 additional months, but don't worry about that if she has the visa printed in the passport. NO2 is a paper, that she doesn't need for travelling. What is really important is the visa printed in the passport and the I-94 she is going to receive when she travels to your country. good.gif

Well, I just got back from my oath ceremony this afternoon in Atlanta and I am officially a US citizen.

We were told to arrive at 1 pm and when we got there at 12:45, the line was already down the sidewalk and around the corner! My husband who was with me wasn't allowed into that waiting room and he along with all family members of other applicants were directed to a waiting room on the 3rd floor. We were 'assigned' the next seat available in the rows and as the rows filled up, USCIS Immigration Officers started going down each row asking for the oath letters, reviewing all of the questions on the back one by one, verifying names and addresses, then checking them off. For those who had travelled since their interview, they made notations of the dates out of the country on the forms. Just down from me was a little girl about 3 years old with her mother. The IO knelt down in front of her and smiled at her and said 'do you want to answer my questions too?'. The little girl nodded her head up and down vigorously, smiling really wide. So the IO asked, 'so, did you get married since you were last here?' and the little girl nodded her head up and down again. everyone laughed and the IO smiled and said "So, you are married now?' and the little girl smiled back and nodded. Anyway, it was really cute.

We waited for quite some time as the room filled to capacity. At about 2 oclock they started moving people into the ceremony room one row at a time. When it was our turn I found out they were having every individual check over their citizenship certificate for accuracy and then turning in their green cards. We each received a number and if we needed to leave the room (ie go to the restroom, etc. ) the number let us back in. Finally, the room was full so they then let all of the family members who had been waiting upstairs into the room. There were almost no seats left so everyone stood around the outside of the room. It was packed. On each seat was a package that contained a small flag, the oath, information about what to do next (re passport, SSN, etc.), a small booklet containing the Declaration of Independence and the Constitution and a really nice book containing excerpts of famous American speeches, documents and information about American symbols.

The Head of the Atlanta USCIS office then welcomed us, said a few words about the importance of immigration. She said that there were 190 people from 70 countries receiving their citizenship today, then alphabetically called out each country and asked its citizens to stand. There were 2 other Canadians along with me. While standing we then recited the oath and pledged allegiance to the flag. After the Oath we then watched a video on the Faces of America, a welcome video from President Obama, and a video entitled "Proud to be an American'.

Family members were then asked to leave again, and the rest of us filed out row by row, receiving our citizenship certificates as we left. We were advised that if they needed any corrections try to do those today but that our files would remain at the Atlanta office for 30 days so corrections could still be made then. The Director also said to make a good copy of the certificate even though it says on it not to copy it - she said we were authorized to make a copy to keep safe so we would be able to send off the original for the passport and such.

She also gave information about children under 18 who would receive derivative citizenship through their parents - and I found this information very useful and wanted to share it here. For such children, the parents need to file an N600 form with the necessary documents and fee. For children 13 years and under, their certificates would be mailed to them. For children 14 to 17, they would need to appear in person at the USCIS office to actually take the oath.

So that was it. They said to allow 3 hours and that was about right what with all of the waiting and such.

So, tomorrow I'm off to SSA and the Post Office to apply for my passport - after I make a copy of my certificate. Now we're going to go out to dinner and celebrate!

Trail-Usually I would do it like that, which is the appropriate way. But a month ago, before I knew I had to take a day off for NEXUS, my boss had already requested tomorrow off. There was NO way the vice president was letting me take the day off just because I needed it. He would have asked me to wait. I was desperate!!!


Rule here is first come, first served. We use a calendar vacation where you have to write the days that you would like off in advance, except for emergencies like family sickness (fever, flu) stuffs that you can't handle.

The agent interviewing has the right to ask for the originals of the documents that you submitted in your packet. Sometimes they keep it, sometimes not. Good Luck good.gif

Embassies generally close for both major local holidays and American holidays.



US gov office are close here in Dominica Republic, employees takes off American and Local holidays, and today it is a Local holiday.

Why not gather the info yourself and post what you have done here (making sure to look at the completed forms for examples if you have never filled out your forms before) and then depending on the feedback you get ... then make your decision. All that being said... be prepared for a year's wait or more ESPECIALLY if you are filing through VSC. Your wife will stress that entire time. Will the $2K prevent her from giving herself ulcers worrying about it?

Thanks Guys.... You guys gave me some great advise. I am not giving the lawyer even a penny now. I have to slog my butt off to make that money and he will make it in 15 mins by preying on our uncertainties.


I printed the guides and the examples forms. I feel comfortable reading in the paper rather than in the computer and filled out my application and helped my SO to do it. I am going to continue doing all the process by myself. No way to pay all that money to a lawyer for a work that I can do by myself.

Just read everything and you will be fine. Encourage to your wife to read the docs too. good.gif

We are under the understanding that once the I-751 conditions are removed then she will be able to divorce him and not have to worry about him removing her sponsorship and her possibly being deported.

She did marry him with the intention of making things work, but this guy wants a slave...not a wife. He is not physically abusive, but he is mentally abusive and this is something I cannot prove.

This is the current situation that I am aware of.

In January she filed her I-751
In February she received and went on her Biometrics appointment.

Now the waiting game begins. I am not sure what kind of timeline we are waiting on, but what are the recommendations out there. I fully understand that waiting for the 10 year green card is the best thing, but this is so very hard and I am wondering if there is anything that can be done without worry about her getting deported. As soon as she does divorce this guy she and I will be married....that is our eventual goal....but for now, we have to keep things quiet. By the way, I am an american citizen and if I could make this happen, I would do it, but not quite sure what can be done.

A lawyer won't be able to do anything for you, except for helping her with the removal of condition in her own, for doing this she needs to prove it.

While you both were dating, didn't you emailed each other? Don't you have pictures together with the familiess? Don't you have holiday cards addressed to both? Don't you have the house lease in the name of both? Phone bills? If not, then you are going to have a hard time with the inmigration people. What about the first package that you both assembled for preparing the K1?

Yes, you have to attach 2 passport pictures or you both will get a RFE as happened to us.

You can write your name in the back of the picture with black ink.

You have to prepare 2 letters, one for you to sign and one for your SO

REMMEMBER THAT THE COUPLE HAVE TO STUDY AND ANALIZE EVERYTHING WHAT THEY ARE GOING TO SHOW TO THE OFFICER IN THE IMMIGRATION OFFICE, OR ELSE, YOU ARE GOING TO BE IN A BIG PROBLEM. THERE IS A POPULAR SAYING : "YOU CANNOT GIVE AWAY TO YOUR ENEMY THE KNIFE THAT THEY ARE GOING TO USE TO KILL YOU". Therefore, the message is clear, it is fine to give some good convincing probes, but DO NOT GIVE TOO MUCH PROBES NEITHER TOO MUCH PHOTOS. The immigration officer can take out or pull out any any of the information that is on the phtos; from the failure to try to reject your case as soon as possible. ANOTHER IMPORTANT THING, DO NOT SPEAK MUCH MORE THAN THE NORMAL QUESTION ASKED. WHAT IS EXACTLY THIS IDEA? Yes, I agree on this, just be concise and clear, do not give more what they need for when answering. In reference to proofs is better to give as much as you can.

BESIDES THAT IDEA NOBODY IS FORCED TO OPEN THE DOOR TO AN IMMIGRATION OFFICER, BECAUSE YOUR ARE THE TENANT, OCCUPANTS OR OWNER OF THE HOUSE; GUYS, YOU DO NOT OPEN THE DOOR TO NOBODY THAT YOU DO NOT WANT, AND THAT'S IT. YOU ARE NOT FORCED TO OPEN THE DOOR TO NOBODY THAT YOU DON'T WANT. THE LEVEL OF INOCENCY OR NAIVENESS OF THE PERSON MAY CAN HARM OR HINDER YOUR CASE OF IMMIGRATION, SO IT IS BETTER ALWAYS TO GET THIS WARNINGS AND DETAILS. They never show up in the house alone, there is always a team that go for visits in case they need back up the information they saw and yes they have the right to do that.

This is the explanation of this WARNING, there are couple who sometimes leave any person or child in the house; this scenario has happenned before and what is really is that meanwhile you are interviewing guys, another officer of immigration performs a little or much better A BIG WORK OF SPIONAGE and it is going to call to your place exactly the same time that you are in the immigration office with your questioner officer. Therefore, the other officer can make up and he can state that he or she is an agent of insurance or any kind of promotions, and it is when the people may screw up everything; from this information, USCIS through the other immigration officer can figure out and exact know that maybe if you are or you are not living right now with your husband, if you are actually really married with the person; any person or child who is in the house at that exact time where the couple is in the dreadful immigration interview might commit any mistake and give out information to immigration that you may not that they want and your case is going to be DENIED. HENCE, THE CONVINIENCE OF KEEPING ONLY JUST A NUMBER, THE CELL PHONE NUMBER OF THE BENEFICIARY OR THE CELL PHONE NUMBER OF THE PETITIONER, ANY KIND OF LEAKING OUT OF THE INFORMATION OR MAYBE A MISTAKE OR MISUNDERSTANDING, IT MIGHT BE USED AGAINST YOU AND UNFORTUNATELY, YOU ARE WELCOME BACK TO YOUR COUNTRY OF ORIGIN BECAUSE YOU ARE GOING TO GET A DEPORTATION. They do that too, I went for my K-1 interview, 2 days later the CO called by herself to my office to confirm that I worked where I said and inquiried to my supervisor if he knew about my SO and me moving and so on. He knew about my moving but didn't met in person my SO, so he told her what he knew at that moment.

Home phones and cel are in the forms, they can contact you the way they prefer. wacko.gif

They have to provide a lot of documentations and proves that they are coming back and are not going to stay with your fiance there in US. A good way for them to prove they are coming back is showing the following at the interview.

Bank letter with the a good amount of money in it. Better if it is an old account, not a new one because they are going to know it was open with the purpose of going to the Consulate.

Land or house titles if they have some property in their country

Car titles if they have

Employment Letter

Birth Certificate showing that they are the parents of her

Her documents that you mentioned.

The fact that she is going to get married doesn´t mean an approval for getting a visa.
