Received our NVC packet today with the AOS Invoice and Choice of Agent Form DS-3032. Paid the fee and will have the form back to the NVC tomorrow. What's next? What should we be doing now and what does the timeline look like for us going forward. Thanks for your help!

In my case we paid the AOS the 14th and sent the DS-3032 the 16th so we received the IV bill on 24th..

you should call to the NVC in about week!

That's the thing though Kailey, it is not entirely legal, and you leave yourself open to possible denial of adjustment of status and deportation with no avenue of appeal, and then bannishment.

Yes it happens every day that people come to the US and lie to officials about their reason for being here. Then they apply to adjust status, their lie is found out, then they're sent packing.

Your choice if you want that possible outcome to your marriage, of if you'd rather do it the entirely legal way and wait it out in your home country.

Your B1/B2 is cancelled at the interview level, before printing the K1 in your visa, you can't continue using it for traveling back and forth but you have to show strong ties at the POE. Good luck but I wouldn't recommend this to you. I had B1/B2 visa and we filed for a K1. wacko.gif

Yes, the consulate in the Dominican Republic can be difficult, but you have to understand why they are being difficult. Fraud is extremely high in this country for numerous reasons. No, the consulate cannot just decide on whatever they want. That's against the law. If that were the case, I'm pretty sure no one would get approved. It's up to us to be prepared properly. If we know that we're going to be tested and tried going into the fire then we need have ALL (and I mean ALL) documentation prepared. Sometimes you have to fight fire with fire. If you go in to the consulate with a gaping hole in proving your relationship is valid....guess what? They are going to hone in and move in for the kill. No doubt about it.


I said the same thing your saying. But look what happened to me. When i was there i think only 4 couples got their visas, once they tell you to go to room 11, its over.


The consulate it is not difficult, we are the difficult. Maybe your partner was messing around with other girls and you didn't know about it. They do field investigations and nobody knows they are doing that. They go undercover. No logos in the clothes, not ID, not vehicles. They just go like a simple person but they are employees, they have been trained in investigation techniques.

You figure out what you both did to have the denial on your petition. I am almost sure there is something wrong here.

If your fiance receives a K3, she can immediately file for work permission on entry to the USA. It usually takes 2-3 months to receive and then she can apply for a SSN, which takes a few weeks to receive. In my recent personal experience, my husband had all he needed to work legally in about 2.5 months.

She can apply for an SSN approximately 2 weeks after entering the country. This is the time it takes to get her entry record updated on the database they search. Make sure that your cosponsor is aware of his/her 40 quarter obligation, as the Officer may make a call to this person to verify that he/she truly understands what they are signing up for as a cosponsor. After all, it is a ten-year obligation!

The 40 quarter obligation can be shared, can't it? Namely, if the beneficiary begins work in the second quarter after arriving and remains continuously employed, then the obligation period is reduced to 5 years and 1 quarter (where they would actually have 41 documented quarters as a couple). I'm not sure about this, so will need to research but interested in anyone else's input!



Just a word of caution: While you may be allowed to apply for a SSN on entry with a K3 visa, that does not mean it will granted. Many K3 holders are turned down because the SSA does not feel that they require and/or are eligible for one. Once a spouse obtains work authorization, it is very unlikely that a SSN would not be issued, since there is a clear reason why one is needed.

Also, thanks PB for the clarification on the IR1/CR1. I knew the eligibilty requirements, just not which one was which. My husband and I are waiting until our two year anniversary to adjust status so that he will get the 10 year GC.


An application for SSN will not be accepted from a K3 visa holder until they have either EAD or a green card.


Sorry, I mixed up the terms, yes she should be entitled to a CR-1. Go for it don't think twice. good.gif

-Should I file now, or tax season?

Read the guides, at the National visa Center try to change for a IR1 visa, this way you don't have to pay for adj (US1,100)of status once she gets there, and she would get permission for work in 1 month.

it's actually 120 Days...worldwide...so 4 months


Once the visa is issued the fiance has 6 months to enter, the kid of the fiance (if any) 1 year for entering to US.

120 days is the validity of the NOA2 from the moment of the approval to the interview, the CO has the right the provide more time for this since some embassies are busier than other, and everything depends of the interview schedule.

CARNET style means ID pictures, same pictures 2 x 2 used for attaching to the G325 or for other type of personal document where a picture is needed.

Maybe yours is for Nov too,there are only 3 days of difference between both applications. Nobody knows. I am going to request to reeschedule the appointment for next year. this way I can wait until my son ends the school. So I can take advantage of the 6 months range once they stamp the visa in my passport.. smile.gif

Your SO has to receive the packet and return the forms to the consulate, then your SO will receive the information for the appointment. Please read the guides, they are very useful.

Actually ADHD kids are WAY better off in the USA since their treatment and school system is MUCH better for kids like that in the States.
Just a little example from my son,
he is almost 8 years old ,his "school" (regular elementary) kicked him out and wanted to force me to put him into a Psychiatric Childrens Hospital.luckily the Doctor there is a very smart man who told me that if possible I should move to the US asap because in Germany my son does not have a future.
Luckily my Fiance has had a severe case of ADHD himself when he was a child and therefor understands the difficulties my son has and so does his family.
So all in all,do not worry about the medical and be glad that you are moving to the US with your child.

I have not, but I wouldn't think that being diagnosed (when you say detected, I assumed you meant diagnosed?? unsure.gif ) with ADD would be a problem unless it caused him to be aggressive. Have the doctor who detected/diagnosed his ADD write a statement on his practice stationary explaining the circumstances of the diagnosis (level of aggressiveness, etc.) and take the original to the medical and the interview when it comes around.

If the doctor at the medical asks, I wouldn't try hiding it...Hiding facts like that may cause problems later on down the road. Take a letter from the doctor who gave the diagnosis to help clarify your son's situation smile.gif

**ADD dianosis tends to be overdiagnosed and misunderstood. When I was taking my special education courses in school, that very fact of overdiagnosis of ADD and ADHD came up quite a bit!! It seems that boys between the ages of 7 and 13 are statistically found to be overdiagnosed because of their high energy level wacko.gif Go figure...boys with energy who can't help falling asleep when the teacher is BOOOORING... whistling.gif Anyway, my point is that if you haven't thought about it, you may want to consider getting a second opinion from a different doctor as well just to be sure smile.gif If the second doctor says he doesn't see it, then that's one less thing to worry about at the medical smile.gif**


Yes i wanted to say diagnosed, sorry it is a translation problem from Spanish to English. He is not aggresive, just he doesn´t pay attention in school and can´t be quiet. Yes, I took him to 3 doctors to get opinions from them.

I got that writen diagnosis yesterday but I didn´t think about the interwiew, I got this for the school thanks for the recommendation I am going to send a photocopy to the school and to keep the original for the interview.

I-864 is for K3 and CR-1 visas, for K1 the one needed is I-134. They changed the form and now doesn't have to be notarized.

I came across a new version of the I-134 (2008) at the USCIS webpage. In this current version there is no need to notarize the signature of the sponsor, whereas older versions require that.
As I'm ready to send the docs to file for my son's K-2 in Rio, Brazil, I wonder if someone has had the same experience and if wether the new version was accepted. They tend to be a little confusing and I don't want to mess this up.
Any thoughts, suggestions will be greatly appreciated. Thanks!


Yes, the new version of the form, doesn't need to be be notarized.

I have my interview next month, I have the form ready I hope do not have any problem.

I will be waiting for inputs here.

Don't send anything, all what you are going to send thru Internet is the form 156 that has to be filled out, send and printed out by the applicant and take it to the interview.

Take all the docs to the interview, the CO has the right to ask for them.

I called them and requested to have a later interview in order to make time that allows me that my son finish the schools since he is moving with me. The person i talked to, said not problem and changed it. My interview was supposed to be on Nov-2008, I requested to have it on March and I got the new appointment later with the new date for March 2009.

It is up to you to change it or not but you can make it work. Good luck good.gif

He has to ask for at the oficial (gov office) for a Acta de Nacimiento Inextensa RD$200.00 this is the one for consular matters. Then to have it notarized for RD$200.00, for a total of RD$400.00.

Invitation letter

Original/certified Birth Certificate for him and his daughter who WAS BORN IN Monterrey Mexico ( not Immigrating her)
Proof of relationship ( lots of proof)
My income info and my parents ( i was laid off work Dec 4th, not working right now)
CDJ-402- INTENT TO MARRY FORMS
Police letter from Mexico- no priors

Now my immigration conslate said that I did not need to fill out I-134, but have been told by many others that I did need to fill out this forms..

to make the story short: the consular didnt even bother to look at most of the items.. oh by the way this was already after they took his finger prints, he said Consular was in a horrible mood..He got to consulate at 8am and didnt leave until 4:30pm

He was told he needed: acta de nacimiento "actual" ??? Which means what ? the one he gave them was dated for June 2007

Next item: Police report from Dominican Republic

- Seach Registro civil where his daughter was born, search 5 years before her birth and 5 years after to verify that he was never married in Mexico

- and last they want the old book of his FM3, which is his visa to be in mexico.. My fiance said that when he renewed his visa Mexican Immigration kept the old booklet and gave him new book, so i guess he have to search and investigate with Mexican Immigration.

Have any of you ever heard this before.. why would they ask for a new birth Certificate when the one he had was ceritifed copy from 2007-- DO YOU guys suggest I have his search the Registar in Dominican Republic to get letter he wasnt married there too??

The Consular didnt mention to him that he had open appt, Do we have to call to make another appt? they kept that letter along with other tiems..

How long are the Medical Exam good for??

Do we have to pay another Banamex Fee?

Sorry lots of questions..but I want to make sure next visit to Juarez is the last!!

Birth certicates here in DR are only good for 90 days for Consulate matters, if he has one of 2007, he needs a new one.

we are both bringing our "binders" and she is also bringing her medical exam results and recent police record. in addition to the binder, is there someting else i should bring?

any advice would be appreciated!!



Binders, it would be easier to put everything in folders with labels identifying each document. This is what I did last month for my interview.

The space in the windows where the interview takes place is really small and the binder will take a lot of space. Just my comment.

Not too long after that, my fiancee got notification from the consulate in Ho Chi Minh city and setup a date for an interview. When she went to the interview, in her words, they were very abrasive in the questioning, and in the end they denied the petition. Upon hearing news of this I flew back to Vietnam 4 days later in an effort to get an audience with the visa chief and try to change his mind. When I got there I stayed in Ho Chi Minh visiting the consulate for 3 days straight trying to get an appointment(I could get inside but they were utterly unhelpful) and just got run in circles until finally on the third day I managed to talk to an American woman (all the people I talked to up till then were Vietnamese working in the consulate and they were very strict in following their jobs, which is admirable but not helpful for me) who was apparently an interviewer and she passed my phone number and request along to the visa chief. In less than two hours after I left I got a call from the chief's secretary to come in the next day to see him. I came back and stated my case and disputed the reasons they had used to deny the case, but to no avail, he said the decision remained the same and that he was sending the petition back to the US for review. So me and my fiancee felt utterly hopeless and wondering what else we could do. I stayed for 2 weeks total before I had to return to the US. We have been keeping regular contact and I've consulted several attorneys to see what we can do. Just a week ago I received two letters in the mail from the Vermont service center saying they had "re-affirmed our previous decision" on the case that the consulate had returned with a recommendation for denial. It said some more but wasn't clear about what happens next. So I called my attorney and he told me that it was pretty rare for them to confirm a previous approval after a consular denial that they usually stick together in the decision making. He said that the consulate returns 99% of all fiancee cases and that the USCIS is getting tired of it, that they are overstepping their responsibilities in the process by trying to re-adjudicate the cases. I asked him what would happen at this point and he said that either they will just issue my fiancee the visa and cut their losses or try to send it back again. Hopefully it's the first of the two events.

I got a number for an American lawyer living in Vietnam and he referred me to a place that studies cases and coaches you for the interview in the consulate. We're currently waiting on word from the consulate before we go ahead with that.

Any advice on what we can do now to increase our chances of passing? Comments appreciated, too.
