No, you can´t. She has to be in her country for you to place a petition for her

She's a virtual prisoner in her country. What would happen if she just got on a plane, passport in hand, and flew to the US?

She won´t be able to take the plane, inmigration officer won´t let her to put her body inside of the plane, it is the same way for all poor country. She can fly to US if she she has a US valid visa. Period.

I guess I didn't realize that getting one visa automatically canceled all previous visas. If true, I guess it makes sense, as there's probably not too many reasons to have more than one kind. The only exception I can think of is a frequent business traveler having a business visa as well as a tourist visa.


There is not exception it is a visa clasification that is different, each visa has a letter and number assigned for this case, for frequent business traveler having a business visa as well as a tourist visa
they assign a combination of B1/B2 visa. B1 is for business and B2 is for pleasure.

I have it stamped in my passport that is way I handle this information. Each visa type has a purpose whistling.gif

Also while she is waiting for the approval they can deny the enter to US. All the information is going to be in the computer systems and red flags can come up.

She intends to apply for citizenship as soon as she can next year.

She and I are very happy, she's going to school to become a nurse and we have a great marriage. It is not that there are never problems, but there are in any marriage. You just get through them and work together.

So....for whatever it is worth, things can and will work out, at least for many people.

Just wanted to give all of you encouragement since it is a lot of effort - but worth it!

He did say one good thing and that they are easy to get overturned and they then send them back again to the consular with the recomendation to issue the visa but she still has to go threw another interview.

My girlfriend and lawyer want me to go over there and marry her and file for the K3 visa but here is the problem my job will not give me the time off from work for the 45 days I would have to spend over there to get married. So I would have to quit my job. Is it possible to file a new K1 visa and get it approved? My gf is fluent in cantonise and her english and vietnamise is not that strong so they didn't understand some of the awnser. I found out you could get a cantonise translator she was also very nervouse at the interview. I also plan on traveling out to see her one more time and if she gets that second interview I will travel out for that as well for a total of 3 times I think that will help us since they listed on the denial that I only came out there 1 time. I would also be brining a recomendation letter from my case workers that work for the senators.

The appeal could take 2 years and we want to try and have a child while she still can can. I have read several of the messages on this board and would like some helpfull advice. I spent 3K on the lawyer but he does not return my phone calls anymore to give advice he wants some more money. I don't have much more money left and I would rather spend what little money I have on lawyer that has decent advise. I am going to be working 2 jobs to pay for a new lawyer but I don't have a big lump sum of money I can give them now.

The other option is to move to HCMC and find a job I would live poor but at least we would have each other. I would have to sell my house and give up a decent job.

Yes, it is worth, if you want to do everything in order. But if i would have the chance i would go for a CR-1, but it was too late when I read it about it here in JV.

Yes, you can marry in your home country and apply for a CR-1, In my opinion it is the best option. Read the guides and you will see the differences.

Your fiance can apply now as LPR and once he becomes citizen, he can upgrade the petition calling to USCIS and sending a copy of the naturalization docs.

You can take advantage of the time this way, I am going thru K1 myself even when I have a B1/B2 visa since a long time ago. I went yesterday to Clinica Abreu for the medical test. My interview is on March.

Or better you both can get marry and apply for a CR-1 this way you get the green card when you enter to US, in 2 or 3 weeks and you don't have to wait for the adjustment of status.

I didn't know about it, that's way we I didn't do it this way.

Now the next question is I am a Farmer, I do not make alot of money that shows on my tax forms cause of the way I work and my investment back into the farm. Do they go by gross or the end line on how what you make and will I run into problems. if it is not much?

I make enough to support myself and her with out problem I have my own home only thing would be insurance, but I am hoping that when she comes here she will be able to get a job that will get insurance for both of us.

I am paying her way through to take her test to get her license now also. to show support for her.

It is considered visa fraud, at the moment of the adjustment status interview, your SO can be asked and questioned about marriage under a visitor visa. It is up to the examiner to grant the visa or not. If I were you I wouldn't risk into that. File for the K1 and wait your turn.

The easier part is most definitely the part where the petitioner gathers everything together, writes the check [$455.00] and mails it off. Unfortunately, the system isn't the greatest, so you're going to have to hope that luck is on your side.

They wont let you in to the interview in Thailand. Best you can do is give her your passport to show them you are in country. If you have to gather more evidence, you have wasted a plane ticket.

This is kinda your call. I wasn't there for my wife's interview, but that had nothing to do with them telling her to come back with more info. She had to go back twice to submit more evidence. I was there when she went back, and was allowed inside, although I didn't talk to anyone, I made sure they knew I was there. You can see my review here:

I would recommand you to check with your work to see if you can keep your security clearance and you Job after she comes here, then I would worry about how long it would take, trust me is a long time, longer that you think. - in some cases you might have to apply for security clearance .

One of the forms that you has to fill out ask your for your phone number, if she highlights your number on her phone bill it is a prove, two persons can´t have the same phone number.

I've seen a lot of examples on this site of people successfully entering the US on tourist visas while their K1 visas are pending approval. however, i understand that entry is in the hands of the border patrol agent.

my question is, what happens if entry is denied by the border patrol agent? if a person is sent back, is it at the expense of the individual? more importantly, can a denial adversely affect the K1 visa process?

i don't mean to focus on the negative, but i just want to know both sides of the story.

i would love for my fiancee to visit me during this process, but we don't want to do anything that will jeopardize our future together.

My recommendation put your brain to work and try to remember that information for putting it there, if you don't put anything the CO would think that you want to hide something and it can be a denial for you.

Do you have a new passport now? If yes, go to check the passport and you will find the info printed on the visa.

If you booked online, then would have an email from the airline or travel agency. It's the same for this purpose.

I didn't include messenger conversations, I had phone bills copies too in case the CO asked for it.

There may be more paperwork with the K3 than the K1. According to the California Service Center both takes 5 months now. I met someone in the Philippines and I am going with the K1. Everyone tells me it is less hastle than the K3. I thought that a Mexican can visit the USA without a visa and vise versa. If this is true you can still visit while you wait.

If you are into a real relationship i don´t see the problems, just keep all the prove that you both can save and you will be done. Start reading the guides here and you can do the whole by yourself. You don´t need a lawyer for this.

I have a K1 approved, we going to blowing it up and getting marry here in my homeland in order to apply for a CR-1. I am talking to you for my own experience.
