IR-1 / CR-1 Spouse Visa Process & ProceduresIve tried this post b4 but people just cut me down and were unhelpful:(

DFA has recently added the CFO seminar certificate as one of the requirements for those married to foreigners in applying for passport.

Interesting...only if you are already married do you need the CFO seminar for a passport.

I think the reason you had some mixed reactions to your post was because, like Darnell said, a great deal of your questions can be answered by reading just on this site.

As far as the child goes, IF the baby was conceived between January and March and IF you are approved, the baby would be born stateside IF you immediately brought your wife over after approval...there are a lot of IF'S....but the main thing is to get approval quickly....your almost there....do your homework.... keep asking questions if you can't find the answer....

I'm no authority, but I'll here's my 2 cents....

1. Always be honest, if not it will be a for sure way to get denied or worse.
2 & 18 I never heard of any seminar for a phils passport...and YES if you want her to give birth in the US you should get it asap
3. Yes, it may only take one day probably two and if you could do the CFO and medical in 3 days...it would be a miracle.
4. The exam is a flat rate...idk about vaccinations but I would guess they are above and beyond the exam.
5-15 I don't believe you can have a co-sponsor in the phils.
16. The NVC is in the US, so yes, it goes from NVC to Manila.
17. Read up in guides
19. No problem
20. You COULD always be denied for any or no reason.
21. Manila
22-26 I would really focus on the approval and not the unborn child.
27. You do not, but it would be a help I'm sure.

I'm sure you'll be getting other good input, lots of reading and you'll get it figured out.... from a fellow Michigander.... Good Luck, hope I was some help.

IR-1 / CR-1 Spouse Visa Process & ProceduresSponsorship!!!!!!!!!!!!!!!!!!!!

Companies can't sponsor, only individuals.

If you can't find another person willing to sponsor, the best solution may be for you to take a year off of school and get a job that would give you the needed income.

She can apply for Citizenship after being a green card holder for 3 years. There is nothing automatic.

IR-1 / CR-1 Spouse Visa Process & ProceduresInterview email arrived today, a question

The NVC received our final paperwork on July 2, our case was closed on July 9 and today, July 12 we received the email on my wife and step son's Embassy interview for Moldova on August 17.

As my stepson is going into 4th grade, I was hoping for an interview sooner. WE would like him to have a few weeks to adjust to the USA before starting school. I have emailed the Embassy, asking for a quicker date.

What are the odds of getting the date moved up ?

Thanks

Hi

Just wondering if the five months processing time by USCIS is written in stone of could it be less

Assuming all the papers are in order is it possible that they will be forwarded to NVC in less time

I read somewhere that 5 months is a maximum.

Thanks much
W

5 months is the goal....

It could be less, more than likely it is that or more.

Good Luck!

That's no problem at all, or should I say, it should not be a problem....
abner137MalePhilippines2012-08-05 09:37:00
IR-1 / CR-1 Spouse Visa Process & ProceduresAbout the petition
A person can enter the Philippines with just a passport for 21 days. If your planning on staying longer than that you must go to the Bureau of Immigration and apply for an extension of your stay. Once you've completed your 21 days of entering the Philippines with your passport. You can apply for an extension of another 38 days. This first extension will cost you 3,030 pesos or $62.00. So with your 21 day entry and your 38 day extension that is a total of 59 days. When your 59 days are up you are now able to apply for 2 month extensions from here on up to 16 months.

Other travel doesn't matter.

Have a good time!

K-1 Fiance(e) Visa Process & Proceduresbig age difference
Age gap of 20 years is not a big deal..especially in the Philippines.....just make sure all your evidence is strong, letters from family (besides the parent(s)), is also a strong point that I actually do not see posted on here, ever. We front loaded with letters from Giselle's mother and four of her nine siblings, as well one from her and I and my daughter. Family pics and monetary support would be the other biggest things IMHO.
Were 18 years apart BTW, and she's 24....

Be thorough and you'll need patience.....and most likely......LOTS of it.

Good Luck!

K-1 Fiance(e) Visa Process & ProceduresStill waiting for my NOA2 are they usually 5 months to the date?

Been checking my mailbox lately so far nothing from USCIS. :(

Are the NOA2 or RFE usually 5 months to the date of NOA1?

unfortunately that seems to be the fast side....good luck!
abner137MalePhilippines2012-06-09 08:09:00
K-1 Fiance(e) Visa Process & ProceduresWhat to do now :(?

As frustrating as it will be, I would say no. The USCIS considers normal processing time to be six months. (The normal is 5 months but because that's an average they don't do anything until 30 days after)

I would suggest waiting. Calling at this stage could potentially slow you down according to some other information

I would call after 6 months myself, I can't believe it would slow it down no matter when you call....

K-1 Fiance(e) Visa Process & Proceduresis this 5 months wasted?????

Two senario I am guessing,

One your fiance didn't send the correct amount and the package was returned and lost. So you would have to resend all the information and the correct amount back as if you are starting over again.
Two your fiance did send the correct amount and they lost your packet, which they will want you to send proof of the original payment along with the new package. However if they lost your original packet you can request it to be expedited due to their administrative error.

Not much can be done until your fiance can confirm how much she paid for the intial process. But Good Luck to the both you and hope all ends well!

Three...not saying its true, but it sounds possible.....Nothing was sent at all.................hope not....good luck!

K-1 Fiance(e) Visa Process & ProceduresI-134 insufficient Income

I don't have to "fangle" my assets. LOL

I have roughly 20k in the bank, and I own a house in Kansas worth 40k that is paid off.

As far as the new $2500 a month with no IRS backup, I am researching her giving me a 1099 at the end of the year.

As far as the tax liability, that is not a problem to me, I just want to get my Fiance here. I took my current tax statement on Turbo Tax and added another 15k of 1099 income to see how it would look. I went from receiving $2700 from the IRS to paying a little over $1000. That is fine with me.

I just need to know if my mother has to set up a business first to 1099 me or can she do it as an individual?

Thanks

But you are..lol...(fanagling) but I misspoke if I said assets, I meant income and you are speaking of using assets to supplement your income (as far as the government is concerned)....because you obviously don't show your true income....I didn't mean it in a derogatory way....we all just need to tell them what they want to hear....believe me, I applaud you if you can live in Cali and only show 11k income.

I believe you need an EIN# to create a 1099, but that's a question that could be easily answered with a call to any CPA.

K-1 Fiance(e) Visa Process & ProceduresI-134 insufficient Income

Hi all,

I am looking to start my K1 Visa to bring my Fiance over from the Philippines. My problem is that my 1099 income from my job is only around 11k a year as stated on IRS forms. My mother owns a lot of property in the Los Angeles area and she provides me with a free house that's rental value is over $2k a month in exchange for taking care of maintenance and such on her other properties. What should I be thinking about providing or doing to make sure that I don't have any issues on the I-134?

Thank You

Steve M

11k dollars a year on a 1099 is just a bad idea, I would get married there and start showing my legitimate income at least until she was approved and stateside....I highly doubt you would be approved without a co-sponsor even if you fanagled your assets or suddenly had a new $2500 a month with no IRS backup.

Good luck either way.!!!

K-1 Fiance(e) Visa Process & Proceduresa few questions before i send out the I-129..some specific to the Philippines

1. I don't know.

2. $223.35 St. Lukes Medical Extension Clinic medical exam fee - paid to St. Lukes on the day of the medical in Philippine pesos at the prevailing exchange rate.
$240.00 K-1 visa application fee - paid in Philippine pesos at the prevailing exchange rate at BPI before you schedule the interview.
Php650 CFO seminar.
Travel expense to and from Manila.
Hotel expense in Manila.
Food and taxi expenses in Manila.
Plane flight expense from Bacolod to the U.S.

3. Never ever send your documents via the U.S. Postal Service/Philippines Postal Service. You will be sorry if you do. Instead, send them via FedEx or DHL. They will find her. Does she have someone's address in her village she can use? Does she have any relatives in Bacolod? Hopefully, you will need to send her only one packet of your documents, and it will be close in time to her interview. Other than that, she will be able to pick up her passport/visa/visa packet at the 2GO office of her choice. She probably should designate the Bacolod 2GO office as her choice.

Good luck. :star: See you here on VJ.

As well as her passport, passport pictures, NSO documents and travel....there are a lot of smaller expenses that add up....

They will understand he was a student and only started working last Sept. If he was self-employed it would be different as they only base the income off the most recent tax return. However, for someone that is a regular employee, the current income is the biggest factor. The letter from his employer and his most recent pay stubs will prove his current annual income.
