They will understand he was a student and only started working last Sept. If he was self-employed it would be different as they only base the income off the most recent tax return. However, for someone that is a regular employee, the current income is the biggest factor. The letter from his employer and his most recent pay stubs will prove his current annual income.

Hello...Diane and I just received our NOA2 yesterday and we are both ecstatic! We filed on March 8th and received our NOA2 in just 120 days. Shortly after our filing we realized that we had made a number of mistakes on our Petition. Our mistakes were pretty significant:: I failed to answer I-129F part C Question 2 which asks if you have ever been convicted; We failed to include letters of intent to marry within 90 days; I failed to provide certified copies of my divorce, and, I failed to include a copy of my US Passport identification page.
Of course we knew that we were destined to receive an RFE. I posted a number of questions here on VJ and everyone advised me that we certainly would receive an RFE and that there was nothing we could do besides wait for the RFE and then submit the corrections.
Out of curiosity, I called the USCIS National Service Center and inquired if there was a process to submit corrections to an accepted petition. My call took a while but eventually the CSR found a protocol in his database that provided for a process to submit corrections. The process was fairly simple: The CSR told me to gather the corrections and omissions and write a cover letter that included the following: The title was "I-129-F Correction to Accepted Petition"; next was the receipt number WAC1290XXXXXX; next was the I-797C Notice of Action date of March 13, 2012; next the name of the Petitioner; next the date of birth of the Petitioner, and , last the Alien Fiancee name.
The CSR told me to address the letter to the California Service Center and include an opening paragraph stating that I was submitting corrections to my original submission I-129F, Petition for K-1 Fiancee Visa, for Diane (my Fiancee) and to write that I was directed by the CSR at the USCIS National Customer Service Center to file my correction in this manner. I then listed the five corrected items that were included with my letter (corrected I-129F Part C Question 2; two letters of intent to marry, one from each of us; Certified copy of my divorce decree, Copy of my US Passport ID page.)
I sent all of the above to the CSC on June 8th. I never received and text or email update that my file had been touched. What we did receive was an approved I-129F Petition for Fiancee on July 11th.
It is our hope that this information will be of some help to all other Petitioners who have filed the I-129F and realized that some mistakes were made.

Ah yes, you are right...but only if there are criminal convictions. If you answer no to question C part 2, then you do not need to include it. Some consulates require a police report for the interview, but you only need to include the reports in the petition if you have any convictions.

For the petition, proof of relationship is NOT required--however it is helpful to include it. You only need to prove you have met within the last 2 years.

For the I-129F petition, you don't need proof of a relationship--only that you have met in person within the last 2 years. Also any police records are not required for the petition at USCIS. Those would be required later at the embassy for the visa interview. Proof of relationship will also be needed for the interview and I think you can use a wedding invitation as proof, but you may need other forms of evidence as well.

To help you in the right direction, you should start reading the K-1 guide. Hopefully this will help you and if any more questions or doubts just ask!!


You absolutely DO need police records and court documents for ANY and ALL of the petitioners crimes listed on page 3 of the I-129F....as well as proof of a relationship...a wedding invitation would seem useless as you don't know when you will be able to marry.

I highly recommend you seek a reputable LOCAL immigration attorney if you have any amount of criminal convictions.

You must be prepared to prove to the consular officer that you have a genuine relationship with your petitioner and a clear intention to marry within 90 days of admission into the U.S. In the past, successful applicants have submitted photographs, letters, e-mails, phone records, bank records, and remittance records as evidence supporting their relationships and intent to marry.

The more evidence the better, no matter how small or seemingly insignificant.

Ok I will try to answer your questions.

1: The address to use for your letters, like the cover letter and letters of intent, will be the Dallas Lockbox address. Using this address will be just fine.

2: The forms you need are the I-129f and the G-325A for both petitioner and beneficiary. Make sure you fill out both forms completely and especially answer the question about meeting within the last 2 years. Some people just write a little in the box on the form, others like myself write a litte more detailed and attach it as a supplement to the question. With the G-325A forms, you need to include a passport style photo of each the petitioner and beneficiary behind the corresponding forms. You also need to include proof of your US citizenship, proof of being legally free to marry (in case you were married before and are now divorced--may not even apply to your case), two letters of intent to marry, and finally PROOF of having met within the last 2 years. As far as making copies of your I-129f packet, it is advised to make an exact copy of everything you send to USCIS.

3: The interview will ALWAYS take place at the embassy near where the beneficiary lives. There may be a rare case where that doesn't happen, but I'm sure that 99% of the time it is the case.

4: You shouldn't need to translate any records for the interview, however for other processes you may need to have an English translation made. I know in Colombia it is not required to have documents translated to English for the interview. Other consulates may vary with their requirements.

The best advice to give you would be to read the K1 guide, and I think that it may help you a lot. Good luck in your journey!

Depends on how close his income is to the poverty level. If his income is pretty good then the tax transcripts, the letter from his employer and his last few pay stubs should be fine.

It has now been exactly 5 month since we filed for our k-1 fiancé visa. Every day it says it's in the initial stages on the web site, and when I call it says the same thing. I guess there are just some days when I get so irritated that it takes so much time to do this, not irritated at my fiancé or our relationship, just at the process.

I was told by our lawyer that this process would take about 9 months total, but at this rate I don't see it happening anytime soon. I real don't want to be a pessimist, because that not how I am at all, but there are some days when I just want to cry! I just want wait to be his wife and for us to start our life together.

Does anyone else feel like there life is kind of on hold right now? Like you are waiting for it to start kind of?


99.9% of the people on here feels that way I'm sure.......

If you do not get married within those 90 days, you will not be able to stay in the US and get the Green Card. So make very sure that there are no problems. Waiting until the last day is risky.

When you do get your NOA1 (and this could take a 1-4 weeks from the date you filed), you will have a receipt number that begins with either EAC(Vermont Service Center) or WAC(California Service Center). Once you have created your account with this receipt number from the link abner137 has provided, you will see the status of your case. You can toggle the settings in your account and request email and text notifications for anything further. More than likely, this means you won't receive any notification for roughly 5-7 months. You have a long journey ahead so better strap yourself in and take this wonderful lesson in patience. :lol: NOA2 is just the beginning. :o Good luck! :yes:

No you don't need to make another trip. I applied after one trip and I just got my NOA2 a few days ago. As long as your relationship is valid and you have proof of your visit you should be fine. I applied within one week after I visited.

Three and even much more can be approved, they are very particular that all the documents are there, or the certified letter from whoever can't provide them stating whatever documents are unavailable.

Yes, without knowing what the RFE says its hard to help you.

As far as "all the paperwork" ..... It must include certified copy from relevant courts showing the charges and disposition for the convictions along with complete incident reports form the relevant law enforcement agency including blood breath and urine, the order of conviction and sentence, the petition and order for discharge or case history showing the judgement has been satisfied. If documents are non-existent then you must have a certified letter from that agency stating so.

In short, if you had 3 dui's you should have had about 30-40 pages of ORIGINAL court and police documents as well as spelling out the charges in your cover letter.

I'd like to hear what the RFE says to help more if we can.
