Oh I can definitely agree with the point that if someone doesn't have the necessary means to become a citizen that it's very understandable. Completely a personal opinion of course and it's not like I completely disagree with those who choose not to, it's their choice. It's just how I feel and my wife and I have already began putting money towards that specific process when we are able to go for it. Whereas I think the previous post was correct, definitely check with an immigration lawyer first. There may be a chance that you somehow fall under an admissable section that would allow you to go for the waiver. I definitely hope you have some luck, and please keep us updated. Hello to Everyone:

I am new to this so please bear with me. Over 5 years ago I had been banned from the US on the grounds that I misrepresented myself as a US Citizen while trying to cross the border at the Detroit crossing. That is a long story and if you need to know how that came about I don't mind you asking. My concern is that the ban was for five years which is up. My now husband of almost five years has filed the I-30 and the I-29F and we are waiting for processing. Being the ban has expired on my overstay and mis representation, will I still need to file something for them to consider our application?


You should definitely check with a lawyer on this, as from what I've read, some forms of misrepresentation can't be waved and are pretty much a lifetime ban. The ban on the overstay can obviously be waived usually with the I-212, but definitely check for the misrep. Good luck!

Hi, once I-130 is approved and sent to NVC, we pay the fee and send Affidavit of Support form to NVC. Does this mean that they make the judgement about whether information on the form is acceptable or not (and they'll reject/ask questions/more info if the info on there is not OK) at NVC before our package is forwarded to the embassy/consulate? -- and it means that once we get to the interview we don't have to worry about being rejected on the grounds of the info on the Affidavit of Support?


Unfortunately not. As the other person said, they just check to make sure that it's filled out correctly. There is absolutely nothing that can't be reviewed or denied when you're at the interview, which I learned from experience on. Good luck!

IR-1 / CR-1 Spouse Visa Process & ProceduresCR 1 spouse immigrant visa

My wife is now in the USA on her CR1 Immigrant Visa. What is the next step we must take? We have already applied for her social security card. I believe now she must file for permission to work. Is form I-765 the proper form? The instructions on the form are vague at best. There is no where in the instructions that even mention immigrant. It only mentions nonimmigrant spouse. Also, to file this form, I must supply form I-94, passport, and K visa. The I-94 was taken at the border entry, and she does not have a K visa. As I said, the instructions are vague at best. Is this information going to be sent to me from NCIS? Also the I-551, will the green card be sent automatically?
Any help would be appreciated. Thanks in advance.


My wife came over on a CR-1 visa back in June, and by getting that visa type, she was already allowed to work once it was stamped at the POE. We just got her Social Security card, her driver's license, and that was it. Good luck!

It is definitely very hard for some people to understand, but after my wife's family's case that spanned over 15 years here in the United States, I can definitely believe that several departments of the government abuse their power, most notably Homeland Security. While not all of these injustices can be corrected, you can definitely fight tooth and nail if you believe there was some abuse in your case.

When my wife and I went to her interview in Montreal back in April, the Consul told us we'd need to file a 601 waiver, and although we disputed what she told us over and over again, even with documentation, we left Montreal with no visa and instructions to file the waiver. Luckily we had hired a lawyer here in Michigan for the entire process, and within two weeks of my wife's denial we had a packet of information sent back to the Consulate as well as numerous requests to speak with the Consulate from my state senator. It took another two months, but my wife did come to the States on June 5 of this year. My main point is that even though we came across a Consul that had absolutely no idea what she was doing and seemed to enjoy telling us she wouldn't argue with us and that she was completely right, we fought hard and got her decision over-turned.

Your best bet is to hire an immigration attorney and have him inquire about what exactly is on your record. Make sure that he knows absolutely everything about your case and you should get a correct answer. I hope this all works out for you and I wish you nothing but the best.

-is the K1 visa as straightforward as it seems? We were going to get a lawyer to file the form but then we thought maybe we should do it ourselves. Is it really just a matter of us sending in a copy of our passports, birth certs and pics intially? It seems to 'easy' and we just really want to get this filed and not be held up going back and forth. Anybody have any advice?

Also on the application there is the question, Has your fiancé(e) met and seen you within the two-year period immediately receding the filing of this petition?

What does that mean? Does it mean that we have seen each other in 2 years?

While the process should be straight forward as long as you don't have any complexities to the case (denial in entering the USA, misrepresentation as USA citizen, etc.). My wife and I did the CR-1 route and hit a few snags, but most have it go pretty much straight through.

As the other person said, you just had to be physically with your significant other within the last 2 years.

We also hired a lawyer just to make sure if there were any snags that we'd be covered, and overall whenever something bad happened, our lawyer got us through it, so I'd highly recommend getting one, even for the simple fact that they can double check all the information you fill out and turn in. -their relationship to me
-that they give their consent for me to marry
-and that they intend to follow through on whatever legal requirements there are in our jurisdiction.

I would also have it notarized to show that it was my parents signing the permission form, not me.

Once you're here, you'll have to do whatever the county you marry in requires you to do if she's still underage.

One thing to keep in mind -- if she's not yet 18, she can't serve as a sponsor for you, so you will need to have a co-sponsor (like her parents) lined up.

A letter of consent for your fiancee's parents, is her parents' responsibility. I take it she is the petitioner. If she and her family can't figure out how to write such a letter on their own, I would have serious doubts about the validity of your case. The letter is a simple statement that could be as short as a single sentence, plus a date and signature.

I have checked. We require a letter of consent from a parent. As there are example forms on the site of how to write a cover letter and fiance intent letter, i just figured there might be a certain way this letter needed to be worded.

If you are worried at all about what the letter should say, you should consult with an immigration attorney. The price wouldn't be too much for one to aid in the drafting of a letter, and that way you'd know it was spot on. I used an immigration attorney throughout our entire immigration process and I found him to be most helpful and kept me from getting any RFEs. Good luck!

Unfortunately, you're making your relationship sound like you're arranging for a wife. The process is intended to be one where the USC petitioner makes arrangements for their fiance(e) to apply for a K1 visa, so they can marry in the US. As such, she and her parents take the lead. Your need to draft a letter of consent for a 17 year old's parents furthers this impression. The letter should be in their words, giving their permission for their daughter to marry you. It's pretty darn simple. The local requirements aren't part of the petition process. Her parents can deal with that if she still needs it by the time you arrive and are ready for a wedding.


I didn't get that impression at all either. This entire website is to help people with the little parts of the process that could end up hindering a speedy resolution to their case. I was the USC petitioner in my wife's case and she spent many nights online researching different avenues of action, and we even had a lawyer for the entire process. I see nothing wrong in trying to make sure all their ducks are in a row, and if you don't feel like giving them a just response without harsh comments, perhaps you don't need to post?

If you are looking for being able to work right away, another possibility is to go with the CR-1 visa. My wife and I went for that visa, it took a year and a few months, but right when it's activated at the POE the visa holder is allowed to work. If you have any questions on the visa process, this is a great site, but if you have any questions that you can't find here, definitely get an immigration attorney. My wife and I also used one as our case was not as easy as most and had many complexities, but it kept us from getting any RFEs. Good luck!

Okay so I eat VERY regimented, only certain foods, certain ratios of protein/carbs/fat, and only at specified times. Well today is not only a baby shower type thing for one of my co-workers, we have a huge cafeteria downstairs yet everyone keeps bringing their food back to their desks so they can surf the net while at lunch.

I have like the least amount of patience for people who call the office lost and who use a GPS.

I wouldn't mind giving directions if people would just shut up about their GPS. Listen, I don't care what your GPS says, I'm letting you know that you've gone the wrong way! Oh but your GPS says what? Well I am telling you to shut the hell up and listen to me.

It's like they call.. tell me their GPS has led them to the wrong place, I'll tell them where to go, and they'll say: "Oh well my GPS says go here.." Fine go there, what do I know? I just live here!

Got a new phone this weekend. Between all the overage and international calls, we were getting hit for about $150 per month on our cell phone bill each month, and that was just for basic phones with basic service. We never went over our minute alotment or texts each month, just got reamed by calls to Canada, and nickel and dimed to death with minute service fees. So we started looking elsewhere and found out we could get top of the line phones and service for about what we were already paying. First thing, i now understand completely why they call them 'crackberry's' :lol: The sad thing though is that I still don't get any service in my office. It's like the black hole of mobile service here. I can go 2 or 3 levels underground, in the basement and get a great signal, but not in my office. To make things even better, they have shut off the wi-fi here at work. So i managed to get myself addicted to my blackberry and now facebook, and I can't even check them now. You gotta love poetic justice.

Lol My old room at my parents' house became known as The Vault because for some reason I couldn't get phone service in there, no idea what that was all about.

Also after getting my new phone I made sure not to get the Internet option in my plan just because I knew I'd get addicted to it and probably would stop doing anything but playing on it all day Lol

The media here in the States is actually ripping on the Women's team from yesterday for celebrating with beer and cigars on the ice. I always wanted the hockey coverage in the States to increase but these Olympics are showing me I'm glad it's a niche sport here, this is unbelieveable lol. You've got football players killing people while driving under the influence, funding dog fighting rings, and basketball players cheating on their wives and brining guns into the lockerroom for Jeebus Sake lol.

My sister-in-law, who has since married and moved, used to spend upwards of $400/wk of her mom's money on groceries for dinner.

In an effort to ease my mother-in-law's stress over that financial burden, and to offset the fact that hubby and I only pay a piddly amount for rent, I took over all of the cooking for the family. A much, much more involved task than what I believed upon agreeing.

Lol You seriously must be a saint, my family isn't even that picky and they're incredibly horrible to try to cook for. Sounds like the family needs to start learning to love some good ol' fashioned microwaved hot dogs haha :)

From my old Canadian company - I have requested it 3 or 4 times - nada.

From Allstate in the U.S., I am on hold with them right now, this is my 3rd request. :huh:

I remember calling around for homeowners insurance when that time came and thank God I already have a pretty good company that returns my calls quickly. I left messages or spoke with reps with at least 15 companies and had MAYBE 2 return with numbers in an entire month. I was happy to scratch them off the list of people I have to give money to Lol.

So far NBC has done a horrible job covering the Olympics. I've seen the same replays of figure skating showing at all times of the day as well as ski-jumping. No coverage or previews of other events or even quality stories about the athletes. It's really rough right now, blowing such a great chance of showing the Olympics during the most watched hours of the day while the Olympics are so close, big bummer.

One just called from ADT security asked for my husband, I said he wasn't here. They asked if there was another decision maker in the house, and I asked what it was about. They said ADT security, I said I wasn't interested, thanked them and hung up. Then she calls back.

She asks for my husband again. I said: "He wasn't here 5 seconds ago and he still isn't here, we're not interested" and she says: "I don't want to speak to you, I want to speak to Mike."

So I said: "B1tch I don't want to speak to you either, I want to talk to your supervisor"

She hung up.
