Hi guys. I have an issue and I need an advice. 

 

I was engaged with someone 2 years ago , we filed a K1 visa and got our NOA2 last August 2011. But  we broke up last  2012. Our relationship did not work because he cheated. So , I ended it. I didn't proceed since I got our NOA2 last 2011. I didn't undergo my medical and interview appointment. We just left our application and ignored it. so we thought, it was automatically cancelled. I am now engaged with the most loving and wonderful person and we filed our K1 visa last February , 2013. and still waiting for our NOA2. I read a topic here that one of K1 applicants was denied for "multiple petitioner".. I don't want it to happen on me. I contacted my ex but he didn't reply. I need your help here guys. How can I cancel my old K1 application? Who do I need to contact to? My interview might be soon and I don't want to be denied. I love my fiance so much and I want to be with him soon.

we almost have same problm  teh only difference is my petitioner is my parents...but still "multiple petitioner"...bcoz we r so worried that time my f called USCIS and asked about  if do we need to cancel my previous petition or what we should do?...they said i have nothing to worry....i dotn know if dis will also applicable to ur situation but atleast u will ahve idea..the best thing u can do is tell ur f to call USCIS about this matter(for u to have peace of mind)...ur a feb filer ?wow ur almost der goodluck to all of us...

same situation. my fiance was jobless when he petitioned me last nov 2012, so he get a co sponsor which is his mom. application got approved, now he is working since january.. my interview date is on july 30 2013 which is nextweek monday.. oh and we have a baby btw..

Hi I hope someone can help me with my question.

So if someone admitted that they had USED drugs before to the physician during the medical? Is it automatic that they will disclose the information to the embassy right away or it will depend upon the result of the psych eval?

What are the consequences of disclosing drug use? I know that the life time ban has been lifted already, so what can possibly be the result of such? 1 year ban? 3 year ban? Or just merely visa denied? What are the factors that will affect the CO's decision? Does it matter whether the person had recently USED drugs, let's say 6 months before medical, or 5 or more years before medical? How can someone reapply or be given a chance to apply for another visa after being denied for admiiting previous drug use?

I've too many questions. I'm sorry. Any input would be very much appreciated. Thank you in advance.

He divorced at Harris County District Clerk Houston, TX.

must be gotten from her hukuo city.

USUALLY if it's a small city or farming community,
then
She can go to the larger city in that district, handle that there,
but still must to get the white books that Guangzhou IV will need.

If she can't travel because of work commitments , then anyone else listed in her hukuo book can get these things on her behalf, showing THEIR hukuo book.


Single status? Is there no end to what we need? And what is a pcc? Is that the police certs? I am guessing just the one from her hu kou town is enough?

And, you are the first person to mention this 'white book' and I read more through the GZ embassy sites that were given to me above and they talk about them even more. I have no idea what these are, and I don't even know where to begin to look for them.

The US consulate in Guangzhou does all of the K-1 visas in China. It is my impression that they are in the middle of changing their processes, you likely should contact the GUZ IV unit for specifics:

I can never get a grasp of what is needed bc sites and people all say different things. This is for those who have filed a K-1 visa for a beneficiary who is from China...a question about the police reports that is needed for the visa interview.

As all who live, have lived, or have been to China may know, getting proper documents from your local government or police stations is almost an impossible feat (unless you have connections and/or money of course). Since my fiancee has neither of those, we are worried about getting these police reports from the police stations. My question is, what reports are these? Is there something that USCIS supplies for us that is good in all countries? Or do we have to just get a basic form signed and stamped by the police station?

What information does the report need to have on there that is acceptable for the interview?

Also, my fiancee lives in the city, but her Hu Kou is from her small hometown and she has no residence in the city. Would I need to get a police report from from the area where she lives in the city too, even though they have no evidence of her living there? I only ask this because I put on the initial K-1 visa application form that her address is in this city.

PLEASE HELP!! WE DON'T KNOW WHAT TO DO!!

Yes, now you have to wait again.  Luckily, you didn't receive your NOA2 just before Christmas, New Years, and Chunjie (Spring Festival) as did I.  Our US Consulate took off all the USA holidays, then they took off all the China holidays (intake staff are PRC), so it took a long time.  Besides the holidays, the Guangzhou staff is very busy.  And, official documents may be held up by PRC longer than regular mail.  Give it 3 or 4 weeks.  If you don't hear anything in 3 or 4 weeks, then use the email contact on the US Consulate Guangzhou Immigrant Visa Unit website to inquire.  The good news is that the wait (until interview) will be shorter than what you endured on the USA side of the house.  However, if you don't complete all the documents correctly, and even if you do - sometimes additional information is requested - and RFE's take a long time on both sides of the water.  Be happy!  You are half-way home!

I received my NOA2 in the mail on April 27th (approved on the 23rd). 

Now...my question is do we just still need to wait?  Do I just have to wait for my application to be sent to NVC and then the NVC sends it to the Guangzhou embassy in China?  Then the embassy will send my fiancee something in the mail notifying her??  Then after that we can set up the interview date?  So is all this just still a few more weeks of just waiting around?????? (i mean, of course preaparing all of our documents in the meantime)  I just feel that there should be something I need to do.

The VJ timeline seems to just say that we can only wait until the embassy/consulate contacts us.

 

Also, what is this whole Priority date and Qualifying date on the NVC website talking about?  I am a little lost on that.

 

One more thing, the NOA2 form does NOT say which embassy it will send to.  Earlier I said Guangzhou bc that is the only embassy in China which deals with K1 visa interviews.  BUT, the NOA2 clearly states "The above petition has been approved, and forwarded to the listed consulate."  However, I checked my NOA2 a hundred times, and nowhere on there does it "list" any consulate/embassy.  A little confused by this.

 

I appreciate any help I can get.  Thanks in advance!!  (and sorry to those who have answered these questions a million times)

The only consulate I am aware of that does not require an I-134 from the petitioner/sponsor is London. Even if you have no income, you need to fill out your own.

 

You can bring both parents information, but they really only need to see the father's proof of income, tax return and W-2 since he is filling out the I-134 as the co-sponsor. He needs to earn enough on his own for his own household size plus the beneficiary.

 

But with no income, is that going to hurt the process?  Should I just put the yearly salary I make in China, and just have my school write a letter stating my annual income?  Its ok even with no tax returns from America?

But, I guess like you said, my father will be what they are looking at.

He will be the co-sponsor. Be sure to fill out your own I-134 as the petitioner/primary sponsor. You can only have one co-sponsor with the I-134. Have whichever parent earns the most individually fill it out. They should list their own individual income and proof of current income amount. If you use a tax transcript from the IRS, be sure they still include their W-2 to show what their own separate income was.

 

I have been working in China for the past 4 years so I don't have any tax return information nor any proof of income.  Do I really need to fill one out?  I was told for one applicant only needed one i-134/ one sponsor.

 

Ok, thanks.  That was helpful, I will let them know.  So my fiancee should bring each of my parents employment, and tax return information to the interview?  But just one of them fills out the form.

This isn't really part of your original question, but I have a question about the i-134 form.

My dad will be sponsoring my fiancee to the states.  However, his tax returns are filed jointly with my mom.  So on the form itself, do they put both names or just one name?  Would they put down their total income for annual income on the form, or just one person's annual income?

I really don't know what to do in this situation...and no one has an answer!!!

It is N/A because it does not apply for those seeking a K-1. The I-134 form was not created specifically for those applying for a K-1. It is used by those seeking other non-immigrant visa types. The K-1 is technically a non-immigrant visa, but the purpose is for the K-1 entrant is to actually stay and adjust status after marrying, so they are not a temporary visitor in need of temporary support. If you feel uncomfortable about it, then just check 'intend' and still put 'K-1 visa process for permanent residence' on the line, minus the N/A in front of it.

 

Well, which one should you do? 

Can I not check either, and then write "N/A, K-1 fiancee visa" ?

Yes... oh goodness, I thought it was me. I have tried to save and/or download a few forms (G-325A, I-864, I-485, I-765, I-131) in prep for our next stage. But.. I keep getting an error message saying the file is corrupted or something to that effect, and the PDFs won't open for me.

I have tried both Explorer and Firefox to no avail. I finally had my fiance do it on his computer and that worked fine.

What I wonder, is perhaps USCIS has used a more updated version of Adobe than I can handle. My computer is Windows 2000 (yikes) and so I can no longer upgrade my Acrobat since the website only has XP, Vista, etc now.

Try another computer and hopefully that works for you. My fiance was successful getting the documents, so it's not the actual PDFs that are a problem.

We're US and Canada, so our border is fairly friendly as it is - but my US fiance visits about three weekends a month without any problem, and he's always been honest about who he's visiting and the process we're in.
