Here is my issue: My husband went in for his first interview in sanaa yemen on march 2013 and they said come back in a week to pick up visa... Went back and they said go home we will call you . currently its may 2013 and we have not heard anything! Through email they tell me they do not have a time slot for him to come and pick up his visa!!! They said once they have an appointment for him they will call him, so that is why I am curious of how so many are saying they have appointments for an interview. And they put our case under "ready for interview" like he will have to go through another interview. I am so frustrated and I have a son who is sick/disabled so I really can't go back to visit!!! I really dont understand any of these. At first they said printing problems then they say until they find an appointment time and date for him... Really it sounds all bs ... Right....???...!!!!! Anyone have any thoughts or has heard of such a thing!!???!! Comments are really appreciated thanks!!!

The USCIS website lists two different addresses for the Chicago lockbox. Depending on the state, you must send your documents to one of the two addresses. Michigan is listed under both addresses so I don't know which one to use.

Since I never sent in the I129, I'm technically not on the K3 track. It's just that I mentioned on the Cover Letter in the Subject Heading...

At the time I sent in my I130, I thought I wanted to go the K3 route. But, after more reading and research, I think I want to just go with the CR1.
My question is this...
When I prepared my I130 package, I indicated on the Cover Letter that I was petitioning for a K3 visa. Will they now hold on to the I130 and wait for my I129? Or, will it automatically get processed as a CR1 if I don't send in the I129?

Hello all,
I'm not sure what to do now after I paid the IV and AOS.
Can someone explain the next steps? I saw the guide created by Lotofpatience, but it's still not clear.
I know I need to complete the DS230, but do I need to wait for them to send it to me or do I just print it out and send it in with the barcode sheet? Are there any other documents to complete at this time? I've heard the documents needed to be sent in with the package might be country-specific.
Let me know what else I need to do.

After my wife went ahead and purchased the Short Form, we noticed on the required documents that her parent's names need to be on the certificate.
Do you think it's ok to go ahead and send the Short Form in with the DS-230 or should we order the long form and wait a few more weeks?
Has anyone else sent in the Short form only and not received an RFE for additional information?

Hello all,
I hope someone can help me with my question.
For all of 2009, my wife was a resisident alien and lived in the states.
She continued to work across the border in Windsor last year and was on maternity leave for half the year (received CRA Employment Insurance).
I'm using TurboTax online and I know I need to fill out the 1116 to take the Foreigh Tax Credit, but where do I input her income? Does that go under "Other Income"?
Any assistance would be appreciated.

Yep I saw that a bit earlier actually!

I feel dumb asking and it's prob on here somewhere else but: if i129f and i130 are processed together... That means at exact same time... So at the i130 pace?

Did you see that response letter from USCIS about October filers to expect May approval or something?

Also you seem to know a lot around here.. What about USC filing from abroad? I heard it can be faster but is that only in UK?

Oh sorry- I mean in regards to the i129f and i130 being processed together and all that. Is it really true- then why do an i129f? Is there actually any benefit? And since mine is in nebraska where they don't list that they even do i129fs... What's that about etc.

I guess we'll have to wait and see, and hopefully what they say is true I guess. If i-130s take 11 months and I-129fs take 5 I'll be happy to pay the money. I wish I could rely on those times but I guess it's calling the tier 2 people and trusting them until I have a reason not to (like when 5 months go by and nothing happens..). I'm with my spouse in Australia but I REALLY want to go back home but with him. My visa here runs out in July. So I don't know what to do.

Oh and just FYI for those going for k3, I sent mine to Texas and it ended up in nebraska where the 130 is. The ARN changed on the 130 a bit later and I was told by uscis that it's prob for the 129..ie now both petitions have the same ARN on it, so it can be linked to the same people. Case numbers are different, this is the alien reg number I'm talking about.

Where does it say they are processing them together? If they do that means 129 pushes the 130 to go faster then.. Because all the stories I read about 129s and 130s being put thru together were both processed at the same time - 6 months. In that case... That's fine! I'm going to call them again on Monday to ask for sure If they do process them together, and if they do... Why they say 129 is faster... Should be interesting. He swore to me today 129s go thru in 5 months -- about half the time as 130s. What we need is the actual number of 129s from 2013 applied for and number which actually got approved. I'll keep updating every time I call so we all know.

NLR - there's only .33% of the time k-3s cuz there's barely any that are submitted! The IO told me "honestly we hardly see any anymore but they're being processed and they are still at half the time as 130s"

If my k-3 doesn't work cuz my 130 goes at the same time... Great! But it won't unless they picked up process times of 130s from 11 months to 5...

I talked to an officer again this morning (they prob know me by name now). He said the reason there's barely any k-3s is because people are scared that it will mess with the process times of the 130. He assured me they are being processed and that they just don't get many. He reaffirmed that they take half the time as 130s. I'm taking my chances. No matter what it's FREE to apply and it CANT hurt. If there's 1000$ AOS later... I will pay it I just want us to go to US. The few people who actually did a k-3 had success. When an IO tells me straight up that no one files for them and he hardly sees them and it's because of what everyone is saying here- they're scared... I'm going to take his advise than from people from online that haven't done one or done the calling and research. I'll keep you all posted. I guess the only way we'll know is when it happens or doesn't. I'll be the guinea pig. :)

Darcy- I have NO IDEA why everyone is saying k-3 / i29f isn't worth it. Our i130 noa1 is nov 2013, and i129f noa1 dec 2013. I did the k-3 path because I had a long and cry filled discussion WITH AN IMMIGRATION OFFICER. He told me that the 130 will take up to 11 months. He TOLD ME to apply for the k-3 path... Since it only takes 5 months. If the CR is going faster now- great! Then it'll be around the same time and k-3 will drop. However if it's not, the k-3 will be worth it. It's ALL theories and misinformation about pulling out of queues and all that. Believe me I've called uscis MULTIPLE times to confirm all this - I mean like 2 hour waits to talk to an officer. I went for it. You should too! There's NO harm.

Also is there any harm in even applying for the K-3 as there is no filing fee for Form I-129F? If they both get processed at the same time then the K-3 get's dropped and automatically turns into the CR-1 Visa. 
 
Is it therefore not worth the chance in case the I-130 really does take a long time? (8+ months)

I'm not sure of the circumstances, But I many have some relevant information. I think there is a hard line minimum income around $22,000 per year that must be met in order to sponsor someone with an I-134. The requirement is 125%(?) of the poverty level or something very similar to that. I don't know if public assistance can be counted towards that goal, but I doubt it. I think the purpose of the I-134 is to ensure that the immigrant fiance will not become a public charge.

But then, that's just my understanding and I am NOT a lawyer. I have heard about people meeting the I-134 requirement by showing savings and other asset information too, so that may be possible.

I hope this helps in some way.
