CanadaMontreal Consulate Packet 3/K1

Hi everyone,

This is my first time posting on this site so let me know if there is a better forum for this!

I (USC) filed for my Canadian fiancee's K1 visa back in February and so far everything has gone as expected.  I got the notice from NVC on 8/20 saying she would get a packet from Montreal soon on how to apply for the visa.  The status checker has said since 8/26 that Montreal is ready to schedule her interview, however she still has not gotten anything from them.  I assume they mailed out "packet 3" when the status checker was updated so I'm getting kind of worried that something is wrong, (lost in the mail, etc.)  She lives in PEI but I can't imagine it would take that long for mail to arrive from Montreal.  Has anyone else experienced this?

I submitted a question through MTL's public inquiry form but it looks like it will be at least a week or so before I get a response.  Can I call NVC or at this point is everything handled through the consulate?  With all the stories I hear about how long it can take to schedule an interview at Montreal we are starting to get nervous since we are planning on getting married in March 2014.

Thanks for any info anyone can give me!

Hi! We are April filers for I-130. We got an NOA1 on April 17, 2013. Then we got an intimation on November 14, 2013 that our case is transferred to Nebraska Service Center for further processing. We havent heard from USCIS after that. Its been 216 days since NOA1. Please let us know if anyone has an idea  about when should we expect NOA2.  Thanks for the help!

US Embassy and Consulate Discussionwhat shows on the police certificate
WELL it seems no one has the answer for this, but thanks to my Sherlockian tenacity i have unearthed the mystery of exactly what is on the uk police certificate. if you have a category c caution, that did not result in a conviction and have a clear record the record is stepped down from your record after 5 years and is only available for the police to view.

if you have a category b or a, the time it takes to step down is dependent on the severity of the crime, and the time starts at 10 years to 30 years, or never. to get a more comprehensive list of the rules of whats on a police certificate please look here, its comprehensive and will put your mind at rest if like me you had a little blip many a eon ago.

hello again,

yup yuup they are busy busy busy, nvc got our approved stuff this week sent it on the friday, eg 12th september so its moving faaaaaaast. now my question is about the police certificate:what exactly is on it? ???? tongue_ss.gif

obviously i know criminal records etc, but would it include cautions that were given way back in 1998/1999????? helpsmilie.gif

i had one. the last time i had a crb enhanced disclosure it didnt come up, and i remember that the police said after five years it would be taken off. I also know that they say in the UK that this stuff never comes off your record, because it s a caution it cant be spent, therefore not removed, and also that police records are different from the ones police get here.

The I-134 will need a good explanation why a return was not filed for 2007.

MORE: http://www.usembassy...faffidavit.html

You can use a co-sponsor, but the petitioner still needs to provide an I-134.

Thanks for your reply,

Yes he will type up a letter with regards to that.

do i need to bring his birth certificate??

we also have a co sponsor just incase, but all in all can this pass muster you think?
also i read on 'ere that I dont need the love of my life's birth certificate in the interview?? true/not true

The rule in London is if your NOA2 is more than 4 months old at the time of the interview, you must provide a notarized statement of intent to marry. Nothing to worry about. Around here you can get things notarized at small banks.

oooooooooooh thats why. we have our interview at the london embassy on the 27th of April. or should i say , i have the interview. i was wondering why they asked for the letter of intent, thanks for clearing that up.

aoifee,

It looks like London is not very consistent with the income requirements. Jon just had his interview on Monday and we were approved using only my income. I make well above the poverty level, but I've only been in this job since October 08 and before was traveling and/or in university. My 2008 tax return was for 14 grand and they didn't even ask me for an employee letter/pay stubs. I was present for the interview. Also, I have a professional job with the state government so maybe the job itself affects their decision making.

My advice is to make sure you have a backup co sponsor.

Best of luck!

ok well here's the thing hope and pray that you dont get this blonde woman , apparently she has reddish blonde hair, whatever she has she is a stickler where others arent. there was absolutely no need to pass me on to get a co sponsor, his employer letter states that he earns over the amount, anyway its over with. got the first part of the co sponsors papers today, just waiting now on his birth cert. It should be ok to use a copy of it right???

Hi Prima and Jay
I am panicked that we will be asked for a co-sponsor at the interview too. Can I ask why specifically the CO turned you down?

From what I have read if this happens the delay will be 2 weeks from the day the consulate courier collects signed forms from co-sponsor...am i right?

Sorry things weren't smooth sailing for you.

Aoife.

his gross on the tax return was just below poverty level, recently changed jobs. she didn t accept employer letter all they are conerned about is the tax return

Sorry to hear it didn't go as smoothly, but know that you're not turned down! If getting the requirements for a co sponsor is all you need, then that's good. I hope there is someone available. Did he not have any assets to claim?

No he didnt have any assets as yet. we have the co sponsor now, i'm getting his papers tomorrow, it seems however we have to get a birth cert for him to prove citizenship. he doesnt have one so we are goin to try to rush him through it in one day. fingers crossed, if not i will tell the courier to come get the papers the following week. we have waited this long so a few more days ( will drive me nuts)wont kill, harm or fatten, i'll survive

The blue slip tells you what the CO wants to see. You are assembling the info and when you submit, the process will continue. For my wife the CO examined the docs when she returned them to the consulate and approved the petition right then.

oh i know that, was asking for people to share their story. seems like people dont wanna, so 'll leave it.

hello ,

had interview on 24th april, got told had to provide co sponsor even though employer letter said was over p. line. so now in the process of getting all that stuff together. i was given back my passport however. i have read that some people have their passports taken and have to pay the courier fee there and then. when i rang DOS they said i'm in AP but thats not what I was told at the embassy, your application gets suspended until you return the documents, not administrative processing.

I'm in a tizzy....can anyone here tell me about thier experiences.... would like to know so i could compare.

US Embassy and Consulate DiscussionMarriage, Divorce Records and Name Change

Some of the instructrions are generic. IF the person applying for the visa has a name different than the birth certificate, then you must show the legal "lineage" of that name. Ie. Woman born Mary Smith, married John Doe, changed her name to "Doe", got divorced and married Jim Brown and now changed her name to "Brown" If the name was never changed, no other names were ever used and the person applying for the visa has the same name as the person on the birth certificate (as was the case for Alla) there is no issue to be determined by documents.

Ukrainian marriage and divorce certificates note which name the person chooses after marriage or divorce. So these documents show name changes. They are also required for the I-129f to prove name changes and that each person is "free to marry" Ukrainian law requires that marriage certificates be surrendered upon a divorce and be replaced with a "name change" certificate. In practice this is rarely done.

American marriage and divorce certificates are public record and it is very easy to get "originals" for a small fee. Ukrainian ones can usually be obtained for a small bribe. Your fiancee may find the lawyer that handled a divorce has her originals.

In my experience in Kiev...

I had marriage and divorce certificates for BOTH of us. I had submitted copies of the marriage and divorce certificates for BOTH of us with the I-129f petition. Everything you send in the I-129f goes to Kiev for the interview. In Kiev, we were not asked for them. This may be bacuase they already had them or it may be because Alla never changed her name and no "other names used" were listed in any of the applications or data forms.

I do not suggest you or your fiancee go to the interview without them. Translations are no longer required in Kiev IF the document is in Russian, Ukrainian or English.

Bring the original, and a copy.

Thanks Gary and Alla and everyone else who chimed-in. Your help and experience is invaluable!

My thoughts as well. As the petitioner, I will order my previous marriage (official with stamp) records if required. We have time since we are December filers. My fiance had also been married before. Would this apply to her as well? Will she need to obtain her previous marriage records as well? Just want to get things right. Thanks experienced K-1ers.

I've read and re-read the list of documents required at the Embassy K-1 Interview. Could you verify that both, divorce and marriage (original) records must be presented? It is my understanding that name changes must be proven as well? It would be great to hear input and advice from couples who have been approved at the embassy interview stage. Thanks.

Well, the bubble burst today. Lena managed through the medical exam after a long car ride last night. After the chest x-ray, which had to be repeated for an additional 20 USD, the doctor told her that she had to return next Monday, Tuesday and Wednesday morning for daily sputum tests at 50 USD per test. Sheesh! It looks like the most appropriate hotel for her stay is the Rus (about 85 USD). Any thoughts?
