Hi ALSA,
I got an email (NOA1) that says my file is being sent to Vermont also. Aren't some people getting through in less than three months? I'd love to see my husband here by the end of the year! :D

From my knowledge, the only people getting through in three months are ones that were routed to the CSC. Also, that is only the first stage which usually takes the longest. Then you have to go through the NVC. The whole process approximately takes 8 - 10 months if everything goes smooth. Unfortunately for us, we will not have our spouse's with us before the end of the year. Unless we get expedited for some miraculous reason, but even then the process will need longer than 3 months. You should also fix your timeline. Patience is our friend.

Hopefully all of the August 2012 filers can use this thread to keep each other updated on the status of our cases. It is nice to know how others with similar filing dates are doing. My I-130 was sent to VSC and from all the reading I've been doing, they seem to be very backed up. I hope they can pick up the slack. I am really not wanting to wait more than 5 months. I hope we're all in for a smooth ride.

Oh the overall numbers have changed, but the randomness of the process has not. There are transfers approaching the sixty-day mark, while others are on their way to the NVC in just a couple of weeks!

 

I get the same impression too. But it is really hard for March and April filers to see May, June, and July ... and even November get approved!!

I do not know who edits the sample forms on this site, but this sample form for the I-864 has incorrect information: http://www.visajourn...-Form-I-864.pdf.

 

For question 2.a through 2.h, it states the address of the sponsor instead of the principal immigrant (all other information I have found says that it is the address of the principal immigrant).

 

In question 5, it also leave the impression that the principal immigrant already has an A-number (that may be the case only very occasionally).

As another member said, yes, it'll have wording like that. But, as they also said, there's a preparer question. NVC understands that not all beneficiaries can fill the online forms out for themselves (either due to a language barrier or due to low/no internet connection [or even both!]), so like I said, it's fine to fill it out on their behalf.

I know that Saylin says that the U.S. citizen can fill DS-261 and and DS-260 in the States. But .... I am nervous about one issue: I looked at the old DS-3032 and DS 230 and I see that there are places where the Applicant (the beneficiary) has to sign. If I fill this these forms online in the U.S. for my wife (who is in Pakistan), will I get to a point that says something like: "By submitting this form you are attaching an electronic signature" (or some similar wording).

 

Does anyone know if I actually get to a point like this in the online versions of the form? If this is the case, would I not be forging my wife's signature electronically if I fill out DS 261 and DS-260?

 

Maybe I am being too nervous about this, but I would appreciate knowing how you all dealt with this issue.

I see lots of variation in the time, but the cases I have seen are mostly for men. I thought that they were only putting males through AP. Sorry, I do not have a better answer.

Oh goodness. I went through the same thing. I was terrified I would forget something, or somehow miss an important document. But... it really is a piece of cake once you're there. I know that doesn't mean much when you're on the other side waiting and nervous, but once you get into that little interview room, it's really all quite easy and pleasant.

Okay, so... the actual interview letter asked for passport, two pics, the $131 and then "originals and one copy of all documents". So, I took that to mean... the original and copy of pretty much everything you submitted last: birth certificate, I-134, evidence of relationship, police record, the official forms (DS, etc). So, I made sure to have one stack with the originals all neat and tidy, and then in the same order I had a stack of the copies of those. That's what I took to the interview.

When you get to the consulate and make it to the 19th floor, you first go to a window to get a number. Then they hand you a page that lists what they want to see in what order: passport, passport pics, evidence.

Then, in the first window where you are processed, the woman we had was very nice and easy to chat with. She asked for the passport, the pics, the renewed letter from my fiance saying he was still legally able and wanting to marry me, the original police certificate, and then she took the fee and my fingerprints.

She did not ask for the DS-160, and I didn't offer it, but I did have it ready for her. The only thing she asked for that I did not have was a photocopy of my passport. She then photocopied it herself. Otherwise, from my stack of papers, she did not ask for anything. But I was glad to be prepared!

Then, we sat down and waited for our name to be called to the interview room. Once inside, we raised our hands in oath/affirmation, answered questions (how did you meet, where was this picture taken, when is the wedding), and I signed the oath form. The officer made small talk while looking at the medical, checking off boxes, and verifying I had not been denied entry, had problems at the border previously, or been in trouble with the police. Once he signed off on a form or two, he said the visa would be processed and be in the mail. Then he wished us luck.

So, to summarize... take the original of your official documents, and one copy. Take an updated letter from your fiance that says he/she is legally able to marry you. Take a photocopy of the inside of your passport. Remember the police certificate. Carry additional evidence in case it is requested. And most importantly, relax. They were really nice people, easy to talk to, and we felt entirely at ease the whole time. It was five minutes with each person and it went by so quick, it really was painless.

Hey everyone, Chris and I are back from the Montreal interview. kicking.gif

Our appointment was on Tuesday, and after spending a few days in Montreal to enjoy the food (and brave the cold) it all went well and we made it home in one piece.

The interview was super easy and basic. We arrived at the consulate around 8am, got in from the cold right away, went through security, up the elevator and waited for our number to be called. When it was, we handed over originals and copies of requested documents, paid the fee, and then sat down for about half an hour before we were called to window 8 for our interview.

We had a really pleasant officer ask us questions, check our documents, verify this and that, and it was really so super fast and easy, there was nothing tricky about it. I think we were in there for oh.. maybe five minutes. Then he explained the visa would be processed that day, sent off in the Xpresspost, and sure enough.... my visa arrived today! Yup. Interview Tuesday, Visa by Thursday. Not bad. I am truly impressed.

All in all, we were there for about two hours or so, and it was the most pleasant and painless process to date. The Montreal folks were a pleasure to deal with and it was a good overall experience.

Our hotel was perfect (Travelodge on Rene Levesque) and within three walking blocks. We couldn't have had a better overall experience. Plus, the food was great as per usual. star_smile.gif

So, now, with Visa in hand... I'll be packing it in and crossing the border in a few weeks. Not bad. Phew. It's nice to have this part of the process over. On to the next stages of the game!

Best of luck to all waiting and gearing up for interviews, etc. And relax. Once you get to that point, it's a breeze!

With so many Montreal interviews in the next week or so, I wanted to send out some good vibes to all the interviewees. Here's hoping we all have some smooth stories to share in the aftermath.

So, next week, there are a number of us on the 12th, 13th, and 15th? Oh heck, let's just think happy thoughts all week to cover it all. Ha.

Chris and I are scheduled on the 13th, but we're actually headed to Montreal in the morning (Sat) to make the best of a weekend getaway, and also chill out and eat well prior to the Big Day. Plus, with this weather blast lately, better safe than sorry. On that note, happy and safe travels to all no matter how you're getting there. Methinks it's best to bundle up!

Anyways, fingers crossed for all. We'll be thinking happy thoughts for the others, and hopefully we make it back in one piece to share the experience. wacko.gif

Hi Amy,

You can call the DOS again just to verify the date is in fact Feb 25th. When I called yesterday and got our date, the first thing I did when I hung up was call back to verify with another operator. I just wanted to be sure.

Looking at our timelines, we're quite close in similarities. The Consulate received our last package exactly one week after you guys mailed yours. The only thing I notice different is that my medical was done a couple weeks before we sent in our package, and yours was done after you sent your package. I don't know if that makes any difference or why it might, but that's the only thing I can tell that's different between our timelines.

Chris said he guesses it's not necessarily about the order of the pile, but the order an assigned officer picks up off the pile. As in, if all cases are in one stack, and an officer picks up a dozen cases, and another picks up a dozen cases, one may work through dates faster than the other, and thereby have different dates for cases that came in around the same time. That's a possibility.

But, I'd say, if you call the DOS again and know 100% that your interview date is set, then it's set. I would not guess it has anything to do with anything you guys control or submit (as in, don't worry something is wrong!), but is just luck of the draw.

We have a date!!!!!!

I called the DOS, as per my weekly ritual, and today - they actually had great news! We have a date. My K-1 visa interview is on Jan 13th. Phew. We're so excited. We figured it was going to be a long, long wait still as time kept dragging on with nothing happening. But we have a date!

So, that's... three months ago now that we submitted our Packet 3, the interview date means four months since then, so not bad. We started in March 2008, so not quite a full year. Yippppeeeee. We finally have a date!

I called the DOS yesterday to check on our status and still no appointment set. In another week, it will be three months since they have received our Packet 3; we're about 11 weeks in. At this point we're assuming Feb/March/April, but who knows. I'll keep calling once or twice a week to see if there's anything happening.

Removing Conditions on Residency General DiscussionRelocation
Ljrascoe, you'll definitely need to consider the move very carefully. My fiance and I (I'm Canadian and he's American) have talked about this, as we do plan on coming to Canada someday. From what we have learned, if you do not yet have your US citizenship you will lose permanent residency status if you move out of the country. Meaning... if you move out of the US, to anywhere, but then someday want to go back to the US you will have to start all over for the visa process.

For this reason, my soon-to-be-hubby and I have decided we will not move outside the US until I have my citizenship several years from now. To lose all that money, to have to go through the paperwork again... oh boy. But, depending on your situation and if the move seems like it will be really, really permanent, that will be something you'll want to consider. Sometimes you just have to do what you have to do.

Just keep in mind that a move to Canada means you lose your US residency, if you do not have citizenship. So, try to think about the future as much as you can, and see what works for you guys.

1. For the US taxes, what do I put when they ask this:

"2008 Foreign Earned Income Excluded Less Related Deductions"
"Total Foreign Earned Income Less Related Deductions"

What deductions are they referring to?


2. How do I exclude the income she earned before she got her green card?

3. Do I just put enter her income from line 14 on her T4 (in USD)? Is that the only entry under the W2 section?

US

1) Yes.
2) No.. She can only exclude the income that was earned before she got her green card. Everything after her green card requires using the foreign tax credit
3) As normal wage income.
4) You have to do multiple scenarios and see which one works best.

Canada.

1) She was a Canadian resident up to the day she got her Green Card. She's a non-resident after that.
2) Canada was her tax home up to the day she got her green card. The US was her tax home after that. Did she notify her employer so they take non-resident tax out?
3) A leaving Canada return is a T1 with the date she left Canada put in the first page. It's filed to the international tax services office, so she cannot e-file. Just to let you know, QuickTax does not support what we need to do.

1. I'm finished inputting into QuickTax and they want to know what my net income is as her husband. Since I didn't work in Canada and didn't live in Canada, do I just put Zero?
2. Plus, it wants to know what "Amounts included on your spouse's tax return". Once again, what do I put?
3. Also, I know now that I can't e-file, but can I still use QuickTax and then just mail it in?

Just got approved I'm PD nov 15 got approved May 27 from NSC. I'm in Australia with my hubby and I'm USC!

Guys, when I called tier 1 to make sure approval wasn't my imagination they said NVC is back logged and it might take up to 90 days to even receive my case. PLEASE tell me this is a tier 1 just talking #######???

Any ideas/similar experiences??

Sol88, we are in the same boat as you albeit for a little less time. Our tracking shows they have had our packet 3 since October 1st. I called Dos today and got someone who was actually much more helpful than others who told me that based on how long it's been there, they probably have already seen it, but just have not updated their databases yet. He made it sound like they update only every so often, and said I should call back by the end of next week if we haven't heard/received anything by that point. So it sounds like its possible that packet 4 can be sent before they actually update. I don't know if that helps you much but I thought I would share what I found out.

If you have already gotten packet 4/when you get it can you post to let us know how long it took them to send it out? We are hoping for a March wedding and are hoping the ball gets rolling soon for us. Good luck!

I will give them a call.  Also, it looks like some of you used xpresspost rather than the free loomis services.  My fiancee is in PEI, 2-3 hours from nearest loomis location so I think we are going to just send it xpresspost as well.  Did you guys just send it  US Consulate General Attn IV Unit to the "place d'youville" address?

I still have not heard back from the email I sent through the online form but it does not sound like I will be hearing back anytime soon.  

 

I think we are going to take the advice and just send out the packet 3 found on the website with the courier services.  The only question I have is that I am not 100% sure they actually sent packet 3/are expecting it.  All the CEAC tracker says is that Montreal is ready to schedule the interview.  Can I take that to mean they think they have already sent out packet 3/are expecting to receive it back?  I noticed that some of you knew the exact date Montreal "logged" receipt of the completed packet 3.  Does CEAC update to show that or is there somewhere else you guys are checking on that?  I tried calling NVC to get information but all they would tell me is that Montreal had probably received the approved I-129f.

Unfortunately she has not yet received packet 3 so we haven't been able to respond to it yet.  Just curious Jsillat, did you have to wait long after getting the initial notice from NVC before you received packet 3?  I saw some posts where applicants had never received packet 3 and just went ahead without it and sent all the documents listed on the Montreal website.  I'm considering doing that but I don't want to cause any confusion and delay things further.

Hi everyone,

 

This is my first time posting on this site so let me know if there is a better forum for this!

 

I (USC) filed for my Canadian fiancee's K1 visa back in February and so far everything has gone as expected.  I got the notice from NVC on 8/20 saying she would get a packet from Montreal soon on how to apply for the visa.  The status checker has said since 8/26 that Montreal is ready to schedule her interview, however she still has not gotten anything from them.  I assume they mailed out "packet 3" when the status checker was updated so I'm getting kind of worried that something is wrong, (lost in the mail, etc.)  She lives in PEI but I can't imagine it would take that long for mail to arrive from Montreal.  Has anyone else experienced this?

 

I submitted a question through MTL's public inquiry form but it looks like it will be at least a week or so before I get a response.  Can I call NVC or at this point is everything handled through the consulate?  With all the stories I hear about how long it can take to schedule an interview at Montreal we are starting to get nervous since we are planning on getting married in March 2014.
