She should be able to prove she has a new surname somehow. Why isn't it on the marriage certificate? And in many governments (like in Germany) there's a second "change of name" certificate that accompanies the marriage certificate. She wouldn't be able to change the name on her passport/license until she has a document to show a name change in the first place.



The marragige certificates in Michigan do not state the new name on them.

I appreciate im probably not the first person to ask this but I have been reading several differant things as I have been looking into this issue.

My wife is confused about which name to use on the i-130 and G-325 form I know that she has to state her maiden name on the I-130 but not on the G-325. On our marraige cert it does not state her new name but she did sign it with her new surname. She had not yet changed her passport drivers licence and so on with the state. So which name should we use her maiden name or my name any advice would be appreciated

$19662 is the right number for a family of 2 (125% of HHS Poverty Guidelines). So your income is plenty good. You need to send her the 2013 Tax Transcript (or 2013 Tax Return +W2), new form I-864 (with the 2013 income info). This is a must. At the consulate they will ask for it for sure.

The employment letter would be great. Since you are going to mail her this package anyway why not include the letter also. It must be on a company letter head with signature in ink by someone like a supervisor or someone in Payroll/HR/Accounting etc.

Use DHL to mail the package to India. They are super fast.

Financial support documents are submitted during NVC processing. Are they again required to be shown at the interview at the Consulate?

Ms. Kaur: My wife's interview was yesterday (6/4). The CEAC website said "Administrative Processing" until yesterday morning (6/4). Then at 1 pm California time (PST), the website said "Issued".  

So I have not doubt your visa status will change to Issued sometime today.

Hi,

 

I had my CR1 interview. The CO told me that it is approved. I checked the status of my visa on the Ceac site and it says "Administrative Processing". The content written in it is "Your visa case is currently undergoing necessary administrative processing. This processing can take several weeks. Please follow any instructions provided by the Consular Officer at the time of your interview. If further information is needed, you will be contacted. If your visa application is approved, it will be processed and mailed/available within two business days. Under the U.S. Immigration and Nationality Act, Immigrant Visas for "Diversity Visas" cannot be issued after September 30th of the year in which you were selected to apply for a Diversity Visa. For example, entrants into the Diversity Visa Program in Fall of 2011 were selected for Diversity Visa 2012 Program, and selectees MUST apply and receive their visa prior to September 30, 2012 otherwise they lose eligibility to receive a Diversity Immigrant Visa, regardless of additional administrative processing. In addition, please note that some immigrant visas may not be able to be issued if the annual numerical limit for that category has been reached."

 

Can someone please help me and tell me whether this is the standard text or something to be worry about?

So he went to his appointment today at the scheduled time.  He saw the same woman who interviewed him and she told him everything is looks good and took his passport and said that the visa would be issued in 2 - 3 days!  So, hopefully 2 - 3 days doesn't mean 2 - 3 weeks in Embassy time!  LOL  Just relieved and happy to hear that we are almost at the end of dealing with this process!

Congrats Nefeure, I have a question , did they give him a small paper that says comback on ( certain date) for visa pick up or the consular just said that his visa will be issued in two or three days

Hi 3ammer,

I'm hoping it will inshallah, but idk maybe sleepless_36 is right maybe they scheduled her visa pickup on Nov 25th, about 2 months after her interview, for administrative processing. I'm guessing its like that for most people that try to get visas in Yemen, because it said "Necessary Administrative Processing" so maybe everyone from Yemen gets AP nowadays.


*I am telling you this based on experience, my wife had her visa interview back on May 2013, they put her on AP, then they called her on September to bring in all documents and gave her a pick up visa on November, it's about 6 weeks long between the drop off of the documents and visa pick up day. When I checked the DOS website it was shown that the case still under AP but the date of last update was changed to the same date she was in the embassy, it stayed couple days then it changed to 'issued' . But I just want to let everyone knows that I know one person(guy) that the embassy gave him a pick up visa appointment and when he went to the embassy to pick up his visa they told him we will call u again even though the DOS website shows that his visa was issued . Bottom line don't make any plans unless u have the visa on ur hands

I was surprised too.  That gives me hope. 

 

One question though.... she said she asked for an expedite but does not think that was the reason for the approval... I was wondering if they might be hoarding the files that requested expedites at the NBC and just adjudicating them there instead of transferring them???  Does that make sense??  Even though they aren't technically expedited.

 

I get what you mean, but I doubt it was because of my expedite request... I mean, I had the infopass a week prior to sending in the expedite and was informed my case had been already assigned to someone since Oct 17...

 

Btw the senator rep glared and made it seem that my husband wouldn't even be approved an expedite (because his life wasn't threatened or at risk) made it seem she wouldn't even submit my form

 

I would think if they saw my expedite request they would at least update my G1145 form.... hmm...blink.png

Oh my goodness!! 

JUST GOT APPROVED!! 

 

I've been reading this forum since it only had 10 pages and have been checking this forum out constantly, but have never posted anything till now!!! 

 

I had a PD date April 11, 2013 and got approved today November 22, 2013!! I literally had to leave work from the excitement I got from receiving a notification for my approval via the USCIS Case Status App for android.

 

The case was adjudicated from NBC (never transferred nor RFE nor applied for K3).

 

Had an infopass approximately 3 weeks ago and was told that my case has been assigned to someone on October 17, 2013.

I did attempt to expedite (due to the political situation of the country) 2 weeks ago via a very rude senator rep, I doubt this was the reason I received the approval because I also sent along with the expedite another G1145 to be notified by my new phone number and never received the notification. 

 

I just want to let you guys know to hang in there. I totally understand how difficult it is to be separated from your loved one for so long, but I promise the wait is well worth it! Just have patience! The greater the struggle, the greater the happiness!!

when i got here i complained about everything, part of it is just adjusting to life in USA, for some it takes longer than others to get used to the difference especially if there is a language barrier. perhaps a need to be understanding is also in order, most ppl come here and do not experience anything bad in the USA, some of us had had a horrible time of it, unemployment, recession, but eventually we acclimated to the new culture and territory. hope you will be able to see that their fears are just as valid as your outlook. have a blessed new year.

I have been checking on this forum for at least 3 months but I have not had a chance to register until today. Well, It was a few days ago when I read these comments from two new green card holder of America where they were planning their way back to the countries because it is SAFER for them and their families.

I believe this forum is intended for people that are going through a legal process where they left their native homeland because they are working towards achieving the American dream. America is a free country so whoever is not happy can leave and look for a better life elsewhere.

I have a question for these complaining people that feel SAFER in their countries as they stated on the forum. They just feel the need to complain and complain and try to rain on our parade.

What are you doing here and why are you wasting homeland security time and tax payer money trying to be a citizen? Did you just realize that the USA was not Candy land? Don't you research before you completely move your life?
I just going to forget about these comments and enter to the forum. Maybe, BenAna or anyone in the forum can answer my question.

BenAna and forum, my application was received by USCIS on 05/16, biometrics was done on 06/27 and I have not heard from them as of now. Maybe people like new complaining US green card holder are causing delays for us! My last touch was on 09/28 and I am anxious to get my approval

I will go to my country for Christmas and I am would like to know the experience of you guys coming back to the US on expired green card and extended letter. I have not been out the country since I submitted my I751 back on May 2012.

I understand how u feel... I don't wanna apply for American citizenship either because I don't wanna lose my home country's citizenship. And think about tragic, hurricane, disaster, killing happened too much in AMERICA!!! My parents want me to have American citizenship because my country is a poor country in Asia. If I were European like urself, I would not lose it.

went to case status today on the off chance and saw thisOn December 10, 2012, we ordered production of your new card. Please allow 30 days for your card to be mailed to you. If we need something from you we will contact you. If you move before you receive the card, call customer service at 1-800-375-5283.
i think i'm one of the first may 29 filers for CSC that have been approved, i have recieved no approval letter just this saying that my card will be produced. pretty cool. doing the happy dance. would edit this list but until i get the letter i wont know when i was approved but will hold off on that for now. yippee, no more uscis at least until citizenship time. yesss

I botched my money order put USCIS on it instead of the US depatment wotsit... all cause the grumpy woman at theP.O. was rushing me. still after having checked on here my mind is at rest, it seems money is money to uscis and they will cash it. so please could someone add me to the list. my GC expires 06/15/2012. Lena's conditional GC expires in April, 2014. While on the USCIS site, I found that the I-751 can be completed online with step-by-step instructions. If we go the online route, when completed, will I be able to print the completed form to add associated documentation and proof of our continued relationship, cohabitation, health insurance, lease, etc.? I have read that with an explanation it should be ok. And I do have a good explanation. Anyway that should not be a prove of my love for him and as some people say...USCIS does not care about last names. Will call them to confirm though


Changing back to your maiden name would look suspicious when you remove conditions. It would make it look like your marriage has already failed, and that you remain legally married just for immigration. You would then have to supply evidence to prove otherwise.

Now this is interesting, I ran on reading more information after posting the above. I found this "6.Police certificates from your country of residence for the past 6 months and from other countries in which you have lived for more than 12 months after age 16." on the Document Checklist for Immigrant & K Visa Applicants on the Hong Kong Consulate General of United States. Yet, it's stated on the website of the US department of State that "•Police certificates from your present country of residence and all countries where you have lived for 6 months or more since age 16"

This is very confusing :unsure: Does my fiance require a police certificate from Canada if she only lived there for 9 months after she turned 16? :bonk:

I filed for K1 mid March and it happens that my Fiance would need a canada police certificate. She now resides in Hong Kong and I know it could takes months for her to get her certificate doing it online and getting her fingerprints...etc. However, I read through information on the VJ Canada wiki page and learned that it's possible for her to get a Certificate of no conviction with the Canada-wide name check during her visit in May. I live very close to the Canada border so I am thinking to take the opportunity to drive her over to Canada and get her Certificate of no conviction instead of getting the Certified Criminal Record Check outside Canada.

So my questions are
1) Is the Certificate of no conviction good enough after we get the NOA2?
2) How much is this certificate?
3) Is this service only available to Canadian PR or citizen or just anyone that needs it?
4) Is it true that she can get her certificate at any police station within Canada?
5) If the process took longer than 2 weeks, the max it stated, will they post it to me or to her in Hong Kong?
6) Is it true that it valids for 6 months?
7) Is showing the NOA1 enough to get the agent to help us with the certificate?

Any advice is appreciated! Thanks in advance!

Is this just for August filers or September filers too? I also filed 2 weeks ago to the Chicago Lockbox which was routed to the Vermont Service Center and now they sent the NOA1 saying they've transferred it to NBC...is this something I need to be worried about? My brain feels fried from the stress.



Don't worry about the transfers. Everyone is getting transferred all over the place. I called and spoke with a tier 2 rep and was told that this is happening to alleviate the workload of the other service centers who usually adjudicate I-130s. I know VSC is really behind and that's where my case was originally sent to, I'm hoping it is better that our cases have been transferred.

We filed I-130 for my mother-in-law with NOA1 date of August 28, 2012. On Sept 4, the case was transferred to National Benefits Center in Lee's Summit, Missouri.

On September 13, 2012, we transferred this case I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN to another office for processing and sent you a notice explaining this action. Please follow any instructions provided on the notice. We will notify you by mail when a decision is made. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283.

I got an email (NOA1) that says my file is being sent to Vermont also. Aren't some people getting through in less than three months? I'd love to see my husband here by the end of the year! :D

From my knowledge, the only people getting through in three months are ones that were routed to the CSC. Also, that is only the first stage which usually takes the longest. Then you have to go through the NVC. The whole process approximately takes 8 - 10 months if everything goes smooth. Unfortunately for us, we will not have our spouse's with us before the end of the year. Unless we get expedited for some miraculous reason, but even then the process will need longer than 3 months. You should also fix your timeline. Patience is our friend.
