IR-1 / CR-1 Spouse Visa Process & ProceduresG-325a Help

Hello VJ

we are slightly confused by the g-325a form for a couple reasons.

in the applicants last address outside the us of more than 1 year.

there Is a from and to however, if you have lived at the same address for longer above it has present time. so what month should go in the to. the current month or should I write present time again?

last occupation abroad if not shown above (include all information requested above. now above it asked for name and address of employer but doesn't ask for occupation. should we leave this blank as above we have listed my employed which is outside the US.

thank you for any replys

Hello,

We have noticed while putting our petition together that the g-1145 expires today. Do you think this will be an issue when we file? Or will they edit the date and repost the new form tomorrow?

Thank you

K-1 Fiance(e) Visa Process & ProceduresHooray for English!
Hello! I've searched around and run some forum searches for this topic and I can't find it anywhere. I'd like to ask something if you don't mind. happy.gif

How well does your Fiance speak English? I have a little worry about it, not because of my fiance, but because of me. You see, my fiance is from Asia, and I work for an Asian company. I work with a lot of people from Asia and I know how to speak English in a way that is easy for people from Asia to understand. Additionally, she worked in Japan for many years, and she can speak Japanese. I can also speak Japanese. She is fluent, and I am... well... conversant, but certainly not fluent. I would have to say that her English is better than my Japanese, though. Therefore, I am worried that, when someone from the Embassy speaks to her, they will find that her English is insufficient.

My fiance was an English interpreter at her previous job. Her language level is good, but it's certainly not native. I don't have any idea what kind of English level meets the requirement for a K1 interview, but I have been given to understand that a good English level is a little critical. If he/she doesn't speak well enough, the interviewing officer may believe that the relationship is a fake due to the inability to communicate. I can certainly see the logic in this. I just wonder where the bar is.

May I ask, what is your fiance's level of English? Where do you think the stumbling block is? To be honest, I am sure my fiance's English is more than sufficient, but I am by nature a worrier and would like to know more.

Please let me know about your experience and opinions. Thank you!

Hello all!

I've searched for this topic and in the Embassy info section, but I can't find anything.

Has anyone been to Guangzhou for an interview recently? Can you suggest a good hotel close to the interview annex? My sweetie lives on basically the other side of China and she has no idea.

Where did you stay? What was it like? Would you go again?

Thanks! happy.gif

I wouldn't waste the money. I also had this situation with my fiancee. We didn't want her to immigrate at that time. We honestly just wanted to spend a little more time together. But the consulate people are just doing their job.

Don't worry about your K1 interview. I have spoken to two lawyers about it and both agree that it will have no bearing on the K1.

Good luck!

IR-1 / CR-1 Spouse Visa Process & ProceduresWife and I are separating during my IR-1 VISA application
Thanks for all of the replies. My wife and I have been talking a lot about our current situation with our landlord selling the house and is being forced to leave. And we have a solution. I think we will get a place in the us before my visa interview. Bit only she will be relocating while I stay back until my visa is approved at the consulate. Then I will move in with her after my visa is approved and in hand. That's really our only legitimate option at this moment.

Your wife can move to the USA at anytime as she is a USC.  You have 6 months from the medical date, if your visa is approved, in which to move to the USA.   Most of us do not complete this process together.  My husband lived in the USA the entire process and I was in Canada.  We were able to visit but there are some who don't even have that.

Excellent. Thank you! :)

ok, i can't find this in official sources, about the validity of an IR-1 from date of issuing. I know for a K-1 validity is up to 6 months which means the holder can enter the US within 6 months from it being issued. Somehow i was under the impression this is the same for IR-1/CR-1 but now i'm having some doubts about it. Maybe some more experienced member could comment on that.

I would think they would have similar lengths? Not good to assume during an immigration process though. By the way, this forum is incredibly insightful. It definitely makes the process easier.

No, you have six months from the time you are granted the visa at the consulate to immigrate to the US, it has nothing to do with when your wife arrived in the US.

Gotchya. So what about the procedures at the POE with CBP? Should she come with me, and should I have proof of domicile?

You have 6 months to enter the US, will this not be enough?

So you are saying that she can move to the US, and I can move in with her at a later date, as long as 6 months have not passed?

IR-1 / CR-1 Spouse Visa Process & ProceduresWife and I are separating during my IR-1 VISA application

I just want to give an update to my OP. My wife and I are going though some issues with life, and our current situation with things other than our relationship are stressful. Earlier we were contemplating living separately because of our situation. We still love each other and want to be together. She really wants to move back to the US, and I do to. But my OP was simply a question to see what kind of responses I get in a worst case scenario like a separation, but still married.

Thank you for your responses, but separation is probably not a legitimate option.

IR-1 / CR-1 Spouse Visa Process & ProceduresWife and I are separating during my IR-1 VISA application

In my current situation, our landlord has sold the house and we have 60 days to vacate the property. It forces my wife an I into a difficult situation as we are near the end of our NVC process, we have paid all the fees, and filed all the necessary paperwork and supporting docs. But we have yet to hear back from NVC, and the clock is ticking. As the days pass I'm to assume that my interview at the Consulate in Montreal will be after the date we have to vacate. If that is the case, can my wife (American) get us a place in the US, and I can follow at a later date? Is that a problem with my POE procedure? Would I have to be on the lease as well?

Any help or pointers would be very helpful.

Thank you :)

IR-1 / CR-1 Spouse Visa Process & ProceduresWife and I are separating during my IR-1 VISA application

Hello Visa Journey,

I am in the final processing of my Visa application with the NVC, and soon I should have my consulate appointment letter and medical.

To keep the story short, my wife and I have been married for over 3 years, and are separating. She plans on moving back to the US come January. I was looking forward to moving to the US, and still want to move to the US, but financially and logistically I won't be able to move there for at least 2-3 years from now.

I have heard of a re-entry permit, but I'm not sure if that would be valid in my case. What would be the most ideal way to move to the US in the next few years if I get approved for a temporary visa at the consulate. Should I go through wit the rest of my process, or should I stop and cancel my Visa application.

Can anyone give me any insight on this?

Thank you

I would bring it up at POE and hand over what they gave you. Not sure why they did that, but I don't think they should have. POE officers should take it and put it back in the envelope with the other forms.

I will show the form at the POE and see what they say. Thanks a lot for the help! :)

I am done with my interview. At the interview they have the AOS docs back. We submitted the AOS docs again after a checklist came. Is it the extra copy?

No. The only things they return after an approved interview is the original/certified copy of the submitted birth and marriage certificate (and divorce and military certificates, if applicable). They keep everything else.

They gave it back to me. What do I do now?

QUOTE (Gemmie @ May 3 2009, 12:53 PM) <{POST_SNAPBACK}>
I understand exactly how you feel, Sherri.

We decided to start this process 3 years ago but I had just started university. We were naive to the immigration process and thought it would only take a few weeks (!) so I would be able to move over and get married in the summer, and then come back and finish my studies. Of course it's nothing like that, so we waited 2 years..,

We finally got to the point where we could file, but my fiance's boss went through some financial problems and couldn't pay him for about 6 months. This meant we didn't have the money to apply, even though it was only $455... everything he had went on loan repayments and bills. We applied last August (another few months after we intended) because family loaned us the money.

It was a very long and difficult process. It took almost 5 months to be approved, and then because of other circumstances, we couldn't get a medical booked for a while; we did the medical, but THEN my fiance's boss went through "personal problems" and never filed his tax returns until after the tax return date, which means we couldn't be ready for interview.

More waiting... we got the taxes filed, sent off for interview and then waited a month for London to give us an interview.

2 years of waiting to apply.. 8.5 months for the process.. it's been hard. I thought that when I got here, I would be escatic, but truth is, I feel exhausted. My fiance has agreed to get the ball rolling on the AOS process because I was the one to do all of the research and paperwork for the K1. I feel I need a break from USCIS for a while, and never want to look at forms again, but it's what we have to do. All of us... luckily, when one of us falls, the other can carry the immigration process for a while.

As well as the process, you have people constantly asking you when you'll be able to get married, why you have to apply for a visa when "you're not foreign, you're British..." (yes, people are that ignorant), why it's taking so long, and yes even making comments about how the relationship isn't going to work out after the long wait.

Your time will come very soon.

i read this with so much sympathy, empathy..... i know what it is like to feel like you are a deadwoman walking, permanently on pause, in a freakish limbo. I have been in class teaching and all of a sudden I get a flashback....lol some repressed memory... of a place i have been to with him, a smell, a shopping mall. Its not easy missing someone ALL THE Time... but you will get through it. In this you will find strength You didnt know you have .

only yesterday i finally booked my ticket to detroit, for the second week of july, we get married the day after. I finally could send a text to all my friends and family letting them know that i will be leaving england for good and we will be getting hitched in October( two weddings.....aint that something) straight after i did that i got phonecalls some congratulating me. and some asking silly things like why do you need a visa, your'e not criminal or from one of "those" countries, your british. I dont know if i would call it ignorance, just that people dont know the rigmarole you have to go through when immigrating.

Also you have to put some of how you feel down to leaving your home and going to another country. I find that hard for me, as much as the visa process, particularly as i'm a college lecturer here but i know that my subject isnt taught there and i will have to pretty much start all over again. I find it hard but not impossible, I love this man with my whole heart and it counts for a lot that he would go through this with me, so i believe that two is better than one, tough it out..... and find some way to relax that doesnt involve you going over every detail, all the time.

i wish you all the best.....
