I am asking for your hlp once again...
we just receive our NOA2 in the mai yesterday and it has an expiration date of July21st,2011...just want to make sure that this date is the validity for the petition's approval?
Also, what are the different form my fiance and I need to gather so he can take them with him when called at the embassy? I know DS 156, DS 156K (but I look for this form online, it is exactly the same as DS150), DS230, I134, along with copy of I 129 package,letter of intent, copy of NOA 2..what else?
All the help and advice I receive will be highly appreciated!
ps: one more question...do we need to contact anyone after receiving NOA2..cuz on the form it says beneficiary to contact consulate?

Yes, it is very long. But it is possible to go through it, I promess. CR1 and K1 currently take about the same time.

If you are worried you won't be able to enter the US on the CR1 visa, I think you can, you just have to be able to show strong ties to India (but this question is probably answered on the CR1 forums, and much more reliable than my opinion). If you can't enter the US, or you think it will be risky and you don't want to risk to travel all the way there and be denied entry, you can always take a vacation together elsewere, meet in the middle :)

Yes we can plan to do that :). I am also employed with a IT firm so showing a return tkt nd a letter from employer that i will resume work will be strong enough. Thanks for feeding me with all the pros and cons of K1 visa. Now we just need to prepare ourselves enough to wait for the right time to aplly for CR1 visa.

Hello Asgo.

3 things:

  • You are planning to get married in India? If so, and if you decide to go with the CR1, I would make sure there are not any specific additional requirement with the CR1 process. Most people on VJ always talk about getting married in the US then go back in their home country, so it might be just a little different (not sure at all, but possible) I think if you go through the CR1 guide, you'll find this info
  • You keep talking about a ceremony you had in india. If you choose to go through the K1 road, make sure it cannot be mistaken with a wedding ceremony. The main requirement for a K1 is that you are both able to marry. They will not grant you the visa if they think you are already married (a little silly but it seems to be the way it works). You'll find so many threads about this on VJ.
  • If you go through the K1 route, don't plan a wedding in July. It won't work. We sent the petition on June 1st, I am still stuck in france, I don't have an interview date... July won't work. And everybody here will tell you if you go for K1, don't make wedding plans before having the visa in hand. You can't apply for the visa and marry in India anyway in July even if you don't have it. With K1, you must be able to marry (ie not married) to get it and still be able to marry when you enter the US on your K1, then enter the US and marry your fiancé. So I think with K1 you can't get married in India...(please correct me if I am wrong)

Thanks for pointing that out.. I didnt knw.. that while K1 will be in process I will not be able to go ahead with our wedding plans in July. But since evethg is finalised for July wedding I guess we will go ahead with CR1 visa. I read a lot of threads and guide about CR1 visa, but my biggest threat is this only that it takes a lot of time to process and not sure if I can travel during that time period and spend some time with my would husband after July on visitors visa. The timeline shown by most of the applicants here is scary.. as it takes almost 8-10 mnths :(

^ :yes: This. I suggest you get married in India and get apply for a spouse visa, especially if you really want to get married in July. But as LorieandPhil said you still need to provide evidence of your bonafide marriage. Co-mingle your assets, collect a lot of evidence. Yes you may have a tourist visa to the US but if you are coming on a tourist visa with the intent to get married they will very likely turn you back around at POE. And you can't lie to CBP and say you don't have that intent or you'll risk a lifetime ban.



If I apply for a spouse visa after I get married.. then my biggest fear is that, will I be allowed to travel to US on tourist while My CR1 application will be in process. Will US embassy surrender my passport? If I can provide the proof with the photos of the ceremony, am I eligible to apply for K1 visa.

Have you met in person within the last two years? can you provide proof of an ongoing relationship? If the answers are no, then you can't get a K-1 visa.
If you get married then apply for CR1 visa you will still need to provide proof of a bona fide relationship. the US citizen will also have to earn above the US poverty levels so as to show you will not be a burden on the state.
Whatever route you go, there is no chance that you will get a visa by July. Read the guides on this site, then decide between you the best route for you both. Good luck in the future, hope it works out for you.



Yes we did meet in person in December'12 and have photos of the ceremony we did in Dec with our family members in it. We used to chat 3 yrs back and then lost touch.. but I guess we cannot show those chats or emails as proofs as there was a break of 3 yrs in btw.

If We go for CR1 visa, We can provide a marriage certificate which we will getting immediately after the wedding in India. I am aware of the salary and Thankfully he is well off :)

I am residing in Bangalore India and getting married to a US citizen who lives in Detroit, in coming July 2013. I had few questions and need your assistance : -
1) Which visa should we apply for ( K1 / K3 / CR1) to enter in USA and how much time it will take for me to obtain that .
2) How soon should we start the process
3) During the process of getting that visa will I be allowed to stay with my spouse in US or I will be staying in my native country until the stamping is done.

Currently I hold a tourist visa (B2) to US valid until 2017.

Note : Ours is an arranged marriage ( arranged by our parents ) and we did a small ceremony of exchanging gifts which was like a verbal commitment.
I am not sure If we can apply for a Fiance visa as they ask for proof like emails, love letters, travel tkts etc... but I want to accompany my fiance immediately after the wedding in July.

Please help us as we both don't know from where to start and which visa will be best for us.

After a long plane trip with a very active 2 year old, we are finally home :) Since the three of us had tickets at the end of plane we got to the border patrol/immigration line almost last...Things moved rather quickly though; after about 20 min or so we were presenting our passports to the immigration officer, he asked me for my packet from the Consulate and asked us to follow him to the office. While my hubby was getting our luggage, I waited in the room. It took 20-25 minutes or so. Very nice immigration officer came out of the room, asked me to sign some forms, took my finger prints, and welcomed me to America. Very easy and stress free :)

You only need one from the HK police if you have only lived in the states and hk. However, you would also need police clearance from any other countries you lived for more than 12 months after age 16, if any that is. B-)

The NVC will not ask for a police clearance. Once your case passed through NVC it will be forwarded to the US Embassy in HK, when your husband gets the packet 3 from the Embassy he will be asked to go to Wan Chai to get the No Conviction Certificate from the HK Police. Hope this helps!

they want the marriage contract in arabic from the issuing court and certified english translation. My husband arrived from Jordan a month ago, and I attended the interview in Amman with him. I was the one who did all of the papers. And just so you know Amman is a 100% electronic consulate, from here on all correspondence with the nvc will be electronically. I mean EVERYTHING. All papers, and documents will be scanned and sent to the NVC, including the i 864 and AOS and the ds-260 All originals of the papers and documents must be brought with the beneficiary and handed to the CO the day of the interview. Do not send any paper to the NVC at all. They will only be rejected and sent back to you delaying your case.The marriage certificate is obtained at the civil status department, you do not need to be there to get it and the NVC doesn;t need it, only the day of the interview. Your spouse will also need a certificate of personal record from the civil status department as well. You need to go the the Amman consulate site and read their embassy specific requirements. Good luck


One last thing I forgot to ask. Do I scan and email the ds3032 or do they have something else for Amman electronic filing?

I have read the requirements on the Amman consulate site and this was the only stump I came across. Do you know how long it takes to get a marriage certificate? Also, where to get it from? I am looking for the names of the place and marriage certificate in Arabic since my Spouse doe not know English. I am still waiting on a reply from another member about the name of the certificate of personal record in Arabic so I can let my spouse know to pick that up along with a passport and police clearance. I also heard there was a beneficiary ID number for electronic filing, would you happen to know how to obtain that? I will be calling NVC on Monday for Case number and IIN, should I ask for anything else? From what I have read, the first thing to do after receiving the case number and IIN is to fill out the DS-261, then fee for I-864 and when confirmed send I-864 documents. Then IV fee and when confirmed send IV documents which is what I need to work on now. Thanks for everything.

My I-130 has just been approved a few days ago and now I have begun the NVC process. I am just waiting for my case number and IIN number. I was reading the Amman embassy website and it states that for the day of the interview to bring:

Original or certified copy of your marriage certificate issued by Jordanian civil status Department plus a photocopy and English translation.

Original or certified copy of your marriage contract (katb al-kitaab) plus a photocopy and English translation. Contracts that list divorced spouses as “single” will not be accepted and must be corrected by the Sharia Court.

I just got married in Amman this past summer and I only got a marriage contract from the Sharia court. My question is do I need to send both contract and certificate to the NVC and bring them along to the interview? If so, where do I get a marriage certificate from. I am not Jordanian but my wife is. Do I have to be there with her to obtain this document? Inshaa'Allaah someone can shed some light on this matter. Thanks!

[yes, this sentence should be put in each letter that you obtain. for USCIS it is not like: how they all knew what to write -- it is you that notarize the letter and ask them to put that sentence - it is important for USCIS OP to have that information in the letter so he can that notarized letter put in your chart as additional evidence.

I have my oath ceremony for my US citizenship this upcoming Thursday and had a couple questions in regards to it. I plan on mailing my I-130 on the Friday after, once I photocopy my certificate of naturalization so I can mail them a copy. I am a Canadian citizen and I flew to Jordan to get married using my Canadian passport. My question is how should I send a copy of my Canadian passport as proof that I traveled to Jordan to get married. Should I also photocopy every page of the Canadian passport or just the biographic page and pages of the visas. Should I write a letter explaining why I am sending a copy of my Canadian passport? I am still confused. It would be nice to get some simple answers. The example I-130 has the petitioners name listed in #17. dwheels76 is stating I should put the name of the beneficiary in that box. My wife and I Have never lived together so question# 21 has been solved, thanks to all. But for question #22, do I put just N/A or the Amman Jordan embassy under "If your relative is not eligible for adjustment of status, he or she will apply for a visa abroad at the American consular post in:". Hello everyone, I'm filling out an I-130 to bring my Wife to the US. I have seen the example I-130 and read several posts on this question but I am still confused as to who to list on #17. Do I list Myself, the petitioner as in the example form, or my Wife, the beneficiary? Or both of us as some people have stated?

Also, for question# 21 is it fine to write "We just got married, we have never lived together"?

For question# 22, do i just put N/A since my wife is not in the US?

I just called USCIS again and spoke with tier 2, they told me that my case will be processed at the National Benefits Center. They said it was to alleviate the stress off of other USCIS centers. Hopefully this is good news.

I just received an update on my case saying,

The I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN was transferred and is now being processed at a USCIS office. You will be notified by mail when a decision is made, or if the office needs something from you. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283.

I called them wanting to speak to an ISO, but they were still closed, apparently the automated message I got was to wait 180 days from the day the case was transferred. It looks like I lost almost a month since I applied on the 20th of August. So I take it your I-130 is put at the end of the list after it was transferred, that's horrible.

I am receiving money from my Aunt to pay for my school. It is $9000 coming from Saudi Arabia using moneygram. I just petitioned for my wife to come to the USA from Jordan. I remember reading somewhere that USCIS or someone else up there look for large transactions that the petitioner receives in case of a fraud marriage. Can this affect bringing my wife to the US?

That's what I said, yes. The I-864a is used when combining income. If your brother qualifies on his own, I-864, not I-864a. Believe it.

Based on what you wrote, if your brother is willing, he is the better choice for a joint sponsor, if you don't qualify on your own. Provide an I-864 from you and one from your brother. Don't use an I-864a. That's for combining income with a household member. Your brother doesn't need to combine income.


I just started a part time job last week, it doesn't qualify me, but I just wanted to make sure that my Brother and I both fill out the i864? So he doesn't have to fill out the i864a?

My I-130 was approved for my spouse today. I want to use my Father as a sponsor. I live with Him and my Mother and 4 other siblings, we are all over 18 except for one of us. My Father makes $80 000/year. He has bad credit. My Brother who lives with us makes $60 000/year and is single. Am I able to use my Father as a sponsor? How about my Brother. He makes $60 000/ year but only for the last 2 years, but he has good credit. Do I have to get a letter of employment and tax transcripts from my sponsor? Is that enough or do they require more? Please advise me.
