Listen. All these well-meaning VJers will baffle you with the BS. High falutent clearances. Turn around and walk the other way towards the trucking industry. It sounds as if you are desperate my man. Desperate people do desperate things. It is forth and goal and your running back just went down with a badly sprained ankle. Are you going to worry yourself to death or get on with it. You decide!!! You have exhausted your co-sponsor opportunities and USEM Manila will not accept them anyways. You have only one option; get a real good paying job as quickly as you can. You look young and daring. I dare you to go to that website I suggested and just talk to a recruiter. Beggars can't be too choosy nowadays.

No job, no co sponsor. Ouch!! I recommend getting out of that mess; at least temporarily by joining the trucking industry. Might not be what you really want to do for the rest of your life, but it is the most stable industry known to man. You can be working within 2 weeks and making $35-$45,000 your first year. Your pay continues to go up each year and the other benefits cannot be matched by most other companies. Why humiliate yourself by begging others for their charity? I really need your help. My I- I 29F petiton got denied due to lack of evidence. I got an email from USCIS
saying"our Case Status:

Decision On May 17, 2011, we mailed you a denial decision notice for this case I129F PETITION FOR FIANCE(E). The notice explains why the denial decision was made and the options that may be available to you. If you have not received this notice within 15 days of May 17, 2011, please call customer service at 1-800-375-5283 for further assistance. During this step the formal decision (approved/denied) is written and the decision notice is mailed and/or emailed to the applicant/petitioner. You can use our current processing time to gauge when you can expect to receive a final decision."

We got the letter and the reason why it got declined was due to lack of information, it's frustrating because I called them before submitting my petition and I was told to submit just the I- I 29F form ( that's it, I asked them 3 times) Anyway, on the denial letter, it say's we have an option to appeal and to submit additional information like (proof we met, forms etc)and to $600 fee. Should I refile again instead of submitting an appeal? I heard filing an appeal would take longer. If it's possible to refile, what do I need to do with the initial petition? Do i need to cancel it and send a I- I 29F petiton form? Please advise. Would appreciate your feedback

I feel for you man. I think you are stuck between a least costly cancellation of the current I-129F and a refile or the more costly and more time consuming appeal. Please, please, please thoroughly study this website for a minimum of one week before proceeding with the new K1 petition. I went solo just like you and I thought I would get denied, but at least I had the basic documents which saved my rear. There is a wealth of knowledge here and you would be foolish to ignore it again. Take my advice; start over. At least this time, you will have peace of mind, knowing that you have crossed all your Ts and dotted all of your Is. But, you can appeal, and it will most likely take you just as much time as a refile and cost you plenty.

My fiancée has three children, who are not going to come to the US at this time. No k-2 petition is being filed for them. Do we still need to meet the 125% poverty guideline for all of them or is it just for her and I.

Only the two of you for now. Only if you included them on your I-134 would they be counted whether they are to accompany your fiance or to follow later. You can file the I-130 for them as the step parent after you marry your fiance.

Recently, I got the REF mail as following:
"REQUIREMENT THAT PETITIONER AND BENEFICIARY HAVE MET IN PERSON: It mus be established that the petitioner and beneficiary have met in person and/ or have been in each other's physical presence at any time during the two years immediately preceding the filing of this petition.
Last Personal Meeting-Submit evidence of meeting the beneficiary in person within the two-year period preceding the filing of the petition (3/32/2009 TO 3/23/2011). Primary evidence may include airline ticket stubs and receipts (that indicate month, day, and year), copies of passport pages that show the identification page and admission stamps, military order(s), letter from Commanding Officer, or any evidence that will help the USCIS to determine that the petitioner has met the beneficiary with the two years. Secondary evidence may include film-dated photographs of the petitioner and beneficiary together. The following DOES NOT constitute evidence of meeting: disc, videos, emails, letters, phone bills, and greeting cards. "

I have several questions:
1. I did submit the copies of passport pages which show the identification page and admission stamps. However, I got my citizenship on February 2011 and I used my Chinese passport for traveling. Do I need to do notary for it?
2. I did not keep the airline tickets stubs and all my tickets were booked by travel agents. They sent me the receipts and e-tickets via emails. Can those receipts and e-tickets be counted as evidence?
3. My fiancée and I did not take many photos together. In some of the pictures(took when we visited SHANGHAI EXPO last year), she was wearing sunglasses. Can those photos be counted as evidence?
4. Last question... During the time I visited my fiancée, She and I had a 3-day trip in China. I saved the hotel and the airline ticket receipts. I did not do translation for those receipts and I am going to do word-for-word English translations. Do I need to do notary for the translations?

I am kind of nervous and I keep calling uscis but do know which option shall I choose...

First establish that you were there; airline tickets, boarding pass, copy of your bank statement showing purchases made with your credit card. Next establish that you were their with her; hotel receipt showing both of your names and photos (if you had taken any). Good luck!!!

The 156 and 157 forms are the forms that you will submit on the day of the interview. Ignore the DS-160. The state department website tells us the exceptions to using the DS-160 and K-1 is one of those exceptions.

Hey everyone! My man just had his K1 visa interview today and everything went well :) I was just wanting to make sure I knew of everything he is going to need at his port of entry (detroit) I know he obviously will need the visa and sealed medical envelope and he'll be bringing his huge binder of 'our relationship/all forms from the past'. What else will he need?

ps. do you guys think it will be easy enough to do the AOS without a lawyer? My lawyer just tagged on an additional $700 bogus fee that came out of no where. I've already spent well over $3000 and its getting/has already gotten ridiculous.

Just wanted to find out if people think when dealing with the Manila Embassy. Is there an advantage going with a K-1 visa service, if so which ones are the best or should you jsut file it yourself? I have noticed from others time lines that many get approved in 4 or 5 months while average is 8 months or longer.

Just looking for any advice on best way to file for it to run smooter and to be approved as quick as possible.

Whether you do it or have a visa service complete it, the timeline will not change. Word of advice; study the K1 visa guide for about two weeks. Think of any potential hangups you would have in obtaining any and all of the supporting evidence required. You will be paying good money to somebody for only arranging the documents that you will send them. Get familiar with the process. Study the guidelines for K1 until you can visualize the process in your mind without reading further. If you have already visited her, then you will need to gather all the required documents, even if you use the visa service. The only task remaining is to arrange the documents according to the K1 guidelines. I have confidence in you. Save your hard-earned money and do it yourself. You can ask questions to all those VJ members who have been through most of the K1 visa process.

I asked them about the DS-156 form if it is still accepted since it's expired already on May 31,2011 and they replied that the DS-156 form unfortunately is no longer accepted, just filling out the new DS-160 form and save each page regularly on your hard drive for reference.

Sorry, but you are 100% wrong. The K-1 is an exception to that rule. Search DS-160 and it will bring up the US State Department website. It will explain that the DS-160 is used for temporary travel to the US. The K-1 is not used for temporary travel although it is a non-immigrant type visa. Other visa types are under that same exception. Again, I am sorry, but the State Dept makes the rules and the rules you are citing are not correct.

Hi all, just looking to see if the is some info out there with regards to the scheduling of Fiance medical, such as when can it be scheduled. I understand that immunizations are a big part of it, wondering what else. Also with regards to shots what if any shots that might have been given are counted, and what kind of documentation does she need to provide with regards to any she might have already had? One of her local Docs told her she can get a Hepa screening, i am wondering why when that shot is one of the onces given at the medical. If she is afraid of being stuck like a pin cushion then seek proof of vaccination. It won't (hurt just to make sure of proper vaccination). It is included in the cost of the medical, so why not just get it done?

You will not receive anything concerning a preparation packet. You must download the state department website forms 156, 156K and 157. Complete them and print them on your computer. Those are the forms you must complete for the interview as the beneficiary. You will receive nothing except maybe the acceptance letter.

There has been a lot of issues when it came to paying someone else to do their I-129F packet. When I called to see how much mine packet was going to cost. They told me 1,100 US dollars. I decided to do my own packet. Did anyone else do their own or went through a lawyer?

Do you really think an attorney actually cares about your needs? I have an attorney for other issues and he continually wants to provide more and more services. If I knew how to file court motions, I would never seek legal counsel. Do it yourself!! Study up using this website. Knowledge is power and power makes you free. Once that attorney knows that you are totally relying on them, they will rob you blind. Open your eyes and think for yourself. You will have the satisfaction of knowing that you are the only one who can take real control of your life. Think of it as an adventure. Many others before you have been through it to the end. I am at the AOS stage. It has been a while since my last Visa process, but it is time do get down with this AOS. An attorney is the farthest thing from my mind right now. I am the happiest man in the world knowing that my new family is here to support me and I in return will bestow all the unconditional love and respect upon them. So I finally heard back from USCIS and we got an RFE. I have no idea what it could be. Hopefully I will receive the letter in the mail tomorrow with the details. Does anyone want to share some of their own RFEs? Also, was the RFE letter very detailed?

I was doing a K-1. I went it alone before I found this website. I soon discovered that I could expect an RFE and low and behold, I did. My application (129F) was lacking many documents, but the RFE wanted only a few items which I was already prepared to send. I sent the reply and within 5 days I had my approval. Think of anything you might have missed (may be so obvious it would hurt you). Read the RFE carefully and respond expeditiously. You will have your approval soon and on to the interview process. I would follow the guides section. Specifically the K1 flow-chart. Study all the guides that pertain to the K1 process. If you plan on doing everything yourself without the aid of an attorney or other assistance group, you must become familiar with the K1 process. It will take you about 2-3 weeks to become familiar enough to begin, Putting the I-129F together will be the biggest challenge and then the I-134 during the interview process. Ask many questions of the senior members who have been there before you. Study-up and good luck!

We were married three weeks ago. We went to the social security office today to find out the status of the ss card application made prior to the marriage. They told us we were going to get the card in 10 days. We then asked them if we could then show the marriage certificate as evidence of name change. The ss office stated that changing the last name must occur at immigration. We are so confused. This website states that as soon as the marriage certificate is in hand that we could bring it to the SS office to apply for a new card with the new last name. Can someone with experience with this help us?

Went to apply for new card using married name. Seems as though some of our faithful public servants are sometimes just as confused as we are. We gave the application to a young guy. He did not question the application and just processed it it without difficulty. Today we received the new card with my loves new name. The moral of this story is "Never give up!!!!" One person almost made us stop, but we just said to ourselves, "why not?" If you run into a road block, try to find a way around it!!!

suspension???????????????????????????????????????? What is that? You are being tested like a wing on a plane seeing how far you will go to be with your loved one. I have never heard of a suspension and I am sure nobody else here has either. Get more documents and make another appointment. If they get nasty with you give them the same. Stand your ground. They want to know how serious you are. Don't threaten them, but return the favor when they get in your face. When they see you will not back down then the tide will turn in your favor. We had three kids 10, 13 and 17 y/o. They were asked their names, DOB and ages. The officer also asked them if the petitioner was nice. Don't worry!

Just wondering if any USC here has ever been married to a Filipina before and married her in the Philippines, brought her here on Family Based Immediate Relative VISA (what they used to call it when I did it) and has since divorced here in the US and has since successfully petitions for Filipina Fiancee K-1 VISA? I'm asking because I did this and based on some recent posts I just got a little unnerved and worried about my previous marriage on record in the Philippines and any possible problems that may cause my Fiancee at her CFO semimar or VISA interview or getting VISA issued or even for AOS later. I have a certified copy of my divorce decree ready for her for the interview. I know I am free to marry here in the US.

Here is my situation exactly:

- Years ago married a Filipina in the Philippines (Traditional Church wedding and also filed with Civil Registrar) Remember jumping through many hoops just to get license and then more hoops to get married there!)

- She filed for divorce many years later here in the US. Divorced finalized and I have certified copies of decree.

- I petitioned for current Filipina Fiancee on K-1 and I-129f approved and we are waiting medical exam and interview and CFO seminar, etc.

Just want to know first if any USC petitioners here have ever married a filipina before in the Phils and then divorced here in the US and petitioned for Filipina Fiancee on K-1 and been successful getting the K-1 VISA for her? How did the USEM and CFO view your previous marriage to first wife in the Philippines? Did they even know? Did you have to annull the marriage in the Philippines? Did you have to do anything? Was it non-issue? Should I be concerned?

I've searched previous posts and can't seem t find any others. Not saying there aren't any, just not that I've been able to find.

I think once you are divorced in a US Court from anybody, that divorce must be recognized by any US Government agency to include immigration.

Legal capacity to marry? how can the USC get it if they are not here? They do ave website and they should be particular on what they ask before making people go there whewww....but anyways, isn't the divorce decree with court seal enough for them? CENOMAR for USC???? doesn't make sense unless they may had seen in divorce paper that the USC had previous marriage in the Philippines...IMHO :D

You would need the legal cap to get married only if you have made the decision to marry in the Philippines. As the USC, you do not need to furnish any more documents than you already have.

For K1 VISA -- My fiance and I retained an Attorney (in USA). Yes, he has done a wonderful job with making sure we submit all the proper paperwork and our proofs (photos, airlines, passports photos, phone records, etc.) But now we have not heard from him. Is there anything more he can do for us? Would he be able to prepare us for our Interview? What do we need him for now that we are filed?

I have been dealing with an excellent immigration attorney for years. He is from the Detroit area. I would trust him if I absolutely needed a top notch lawyer. But in cases that are simple and straight forward, their is no need for any attorney. Of course, we all have the right to waste our money. This attorney went from a small three room office to where he has 7 partners working on an entire floor of a large office building in Farmington Hills, Michigan. George Mann ESQ. Greetings!

We're gearing up for the interview and I've scoured this website, the government sites and Google for specifics on the K2 and have yet to find anything. I feel like I'm going into that part of it blind and thus, unprepared.

The consulate in Manila sent us a happy-joy letter with just my fiance's case number (not any for the children), although both of their names were mentioned on the I-129.

My questions:

1. Are there no case numbers for the children?
2. At what point specifically does the K2 happen?

The way I'm seeing it now, my fiance will simply pay 3 VISA fees ($350 each). She will get the medicals done for herself and her two children. Using HER single case number, the doctors and such at St. Luke's Medical Center will fax a form with her case number to the appropriate folks who will have that for the interview. Honestly at that point, I'd schedule the interview (looks like it's up to 6 business days out? http://travel.state....anila&x=65&y=11). Are we to just assume they'll pull out K2s at the interview and fill them out there.. ?

She will have all of the forms prepared at the time she walks into the embassy on interview day. Our kids were their ages 11, 13 and 17. The CO asked them if I was nice. The interview will concentrate on the K-1; not the kids.

Hey guys! I have a friend who just got engaged in the Dominican Republic with his fiancee. He has consulted with 3 different lawyers but they all gave him 3 different answers which has confused him even more. The situation is that his fiancee has a 6 month old baby girl. The baby doesn`t belong to my friend but to his fiancee`s ex boyfriend who resides in New York. The ex claims that the baby is not his and that he already took the DNA test and the results came out negative but that he refuses to give her a copy of the test. The baby has not been registered nor does she have a birth certificate. What are the steps on bringing a fiancee with a baby whom is not blood related with the petitioner to the U.S? I will play devils advocate. Lets say that the baby does belong to your friends fiance. In that case the baby is automatically entitled to US Citizenship. Lets also say that the fiances ex boyfriend has some criminal past. He knows that he cannot perform a petition due to his criminal past. The fiance might be playing games with the petitioner. After the fiance arrives and gets her removal of conditions she is free to divorce and seek out her babies father. This is one scenario that could play out here. This is a very bad scenario but very possible. If this is not the truth then tell your friend to file the birth certificate with the baby as illegitimate. This will eliminate many headaches with USCIS and the State Department.

I have to say that this application was kinda to put together, because I did not know we had so much memories, including our first Starbucks together. Anyway, We have been together for almost four years since June 2008. I am planning to mail the application by Thursday. My fiancee is from the Philippines which is a high fraud country. My main question is front-loading and the amount of evidence required. Within the past two years, I visited her twice (11/2010 and 4/2012). I had a lot of receipts and boarding pass during the 11/2010 trip. We were basically traveling together. However, I have scarce evidence during my latest trip since my parents paid for most if not all of our travels. So far, my application is 81 pages and approximately 60 pictures (both trips). I also have pictures from the first time I met her in 2009, but the pictures are outdated and exceeded the two year limit. Should I include them? For now, I did not include them. Also, the application did not say anything about proof of ongoing relationship yet. Someone said in the forum, that's for the interview. I have thousands of pages of chat logs, and phone calls, etc. Should I front load those information in the initial application? I am thinking that's an overkill. I guess that I am just nervous because this is for our relationship and the next chapter of my fiancee and I's lives. I am sure you guys know how I feel. thank you for any input.

Follow the guides and you can't go wrong. I followed them after trying to go it alone the first time I mailed the 129 and got an RFE. Don't make my mistakes!!! Read these guides carefully!!!

I was wondering, mostly because we will use a co sponser for the k1 visa and I know that the embassy in manila is really tough on that... so i was wondering can i join my fiance during his interview? so I can prove my point that he would not become a public charge? My fiance isn't really strong in speaking english...

Sorry for getting off subject a little. You stated that you are studying nursing in the Philippines. That means you will be there for a minimum of 4 years. What is the hurry to do a K-1 now? You are together for at least 4 years while studying. Your income will be way over the minimum guidelines upon graduation. I would just wait until graduation to do the K-1 or just get married there before graduation. Just giving you alternative ideas. Good luck in your journey!!!

If it is not too late in the process, you can change to a Cr1. It is cheaper, probably easier than my K1 process and the family can all see the wedding in person without any Visa hassles. Only an idea though.

If you are doing this on your own, take my advice and everybody else on this website; do your homework!!!!! Read the K-1 visa guide over and over again in detail. Study it and know what each procedure entails. The first stage; the 129F, initial petition for a K-1. If you have already met, get all the proof of that meeting. Each of you make letters of intent. He will go to his employer and get proof of employment. Read, read and read again the K-1 guides. Many people have made mistakes and we do not want you to make those same mistakes. Once you are absolutely sure you have followed the guide instructions without error, then you are ready and not until then. Do not RUSH this. Do it right the first time. If you have questions after you have vigorously studied the process as detailed in the study guides, ask, ask, ask ask and ask again the people on this website. good Luck in your studies and your journey!!!!!!!!!!!

If you get the letter from them, and you are indeed denied, your best option is to refile, following the guides and enclosing all the bits and pieces necessary to support your petition. Read the guide, you will find it is a valuable tool.

GUys I need help, My fiance asked me:

1. What kind of Letter of Employment will he needs to ask from his company? Is it Certificate of Employment when he started up to present? Does his position in his company needs to address on that letter? Can you give me an example please?

2. When he filed ITR he used turbo tax that can be bought in Costco Store. He filled it out and emailed it. My question is, He will just print them (last 3yrs itr, 2010,2011,2012) then send to me for my interview in USEM.

Not everyone is cut out for that job... Making such a specific sugestion towards a career choice especially one that requires the kind of sacrifice that a truck driver has to make simply isn't appropriate for an immigration venue.. Truck Drivers work countless hours and 60-70K sounds good to many, but when you consider the sacrifice you make and hours you must work to make 60-70K, it's peanuts.. Being a truck drive is like being a musician, it's something you have to love to do...

That suggestion doesn't get the OP where he needs to be if its something he's gonna hate and eventually give up... It's not a thoughtful suggestion... Like any other career choice, its something you have to want to do..

I simply want ot encourage you.. You've come a long way to get to this point, so dont give up now.. Be creative.. If you need, take on a second job.. You need to show you're earning above the minimum requirement.. You can do that with a current employment as well as your tax returns.. Just think creatively, or as extremerecluse said; "outside the tiny box"..

Think of the alternative in the OPs case. No co sponsor. No valid I-134. No significant other coming to the US. No happiness. Absolute Despair. Loneliness. I like the other alternative. This can be a temporary fix. Again, we need to think outside the box. The CO looks at current income and what will they see at the next interview; many pay stubs and letter of employment. This is a slam dunk. Remember that this economy is in the garbage, so beggars cannot be too choosy.
