K-1 Fiance(e) Visa Case Filing and Progress ReportsVermont buys another 6 months?

Well Ruby and I received our answer on the service request filed Feb 18th. It came in the mail today. Our original I129f was filed August 30th, case touched once in December and then nothing until now.

Here is what the letter says:

The processing of your case has been delayed. A check of our records establishes that your case is not yet ready for decision, as the required investigation into your background remains open.

Until the background investigation is completed, we cannot move forward on your case These background checks are required to be completed on all applicants who apply for immigration benefit you are seeking. We will make every effort to make a decision on this case as soon as the background checks are complete. If you do not receive a decision or other notice of action from us with 6 MONTHS of this letter, please contact customer service at the number provided below.


Ok, so it's been 6 months 11 days. Our case is one of the last ones from August I see on Visa Journey.. Has anyone ever heard of this happening? Is this a stall or the beginning on a turn down.

Any advice or help or comments would be most appreciated. We are devasted.

Other senior VJ members state the entire background check takes all of 5 minutes. I call BS on USCIS. I don't think they want to admit that your petition is laying in a big pile across the room.

I just faxed requests this morning to my Senator and Representative and in less than a day I am approved. I am not sure if they helped but that's the story I am sticking with. :thumbs: :thumbs: :thumbs: :thumbs: :thumbs:

OH well. I thought it would work. I knew that I would receive an RFE and sure enough, it happened. Five days after I sent in what I thought was every missing document and all supporting evidence; around 75 pages. They will probably only need a small fraction of what I mailed last week. I just thought it would be at least two more months until they reached my file. I was hoping the packet I mailed last week would find its way into my first submission prior to them reviewing it. Only cost me 5 hours of copying and $10 for postage. But now, I must be positive. At least the approval or another RFE is right around the corner. Back in 1984 when I assisted my ex in petitioning her 4 kids from the Philippines, it was so much easier. Now they want everybody to put on tap dance shoes and get in line. I should just count my blessings and get with the program. I wonder if I should include in my response the fact that the packet I mailed last week is somewhere inside the CSC? I think I should just stop while I'm ahead. Keeping all my fingers and toes crossed now.

An ombudsman is an office that acts as an intermediary between an agency and the people who are served by that agency. There is an ombudsman office that gets involved in making inquiries from USCIS on behalf of applicants. You can submit a request to the ombudsman office in a DHS form 7001.

A congressional representative (Congressman or Congresswoman) and a Senator are elected representatives. The US equivalent of a Parliament is the US Congress, which is divided into two houses - the House of Representatives, and the Senate. The House of Representatives consists of elected Congressman and Congresswoman from each district in each state, allocated by population. The Senate consists of 100 elected Senators, two for each state.

ok people , wut is the first thing that you do with your wife(or husband ) when they are here in the us ?. me , i am gona drive her around the area where i live . when i met my wife few years ago back in vietnam she is the one that drove me around on her scooter , then taught me how to ride scooter. then after that ill order fast foods like pizza so she know what it taste like. there are fastfood restaurants in vietnam yet most of them dont taste like the real stuff we have here in the us. post stuffs that you did , or plan to do with your spouse on here people , that will give me ideals of what to do to keep my wife happy and ease the culture shock that she will have to go through. i can not do guy stuffs like shooting , fishing , fix car , build a gaming pc or go out to bar for a drink with her since most women dont like stuff like that( and my old man told me to stay away from girls that like to do that stuff :rofl: ).

That is a hard one. They will have spent 18 hours in a cramped seat along with 350 other uncomfortable people. I don't think they will be in any mood for much. In my case, I will be going from a household of one to one of five. They are going to be exhausted and hungry. Something good to eat would be in order. Keeping everything relaxed for them is also important. They do not have any family here in the Detroit area; some in Virginia, New York and Las Vegas. Making things as comfortable for them as possible is paramount. Being able to communicate with family and friends will be key so high speed internet will be crucial. She only has access to wireless broadband in San Ildefonso with very weak signal at best. Having an HD Webcam will also be key. Things will be different for them as well as myself. Getting into the family mode is most important. I will let her know that she is in command. The first week will be the civil marriage in Toledo. The next week will be the AOS application and SS#. The next week will be intensive driving training for the first time in Marilou's life, to include my new 17 year old daughter Jinuel. The next week will involve getting the 11 and 13 year olds (Mariane and Andre) enrolled in the middle school. I will be working while this is all happening too. If you are talking literally what would happen the first thing after she walks out of that airport terminal, I would have to say "Break down in tears". Sorry, even though I am a macho type guy, can bench press 350, run an 8 minute mile and swim like a shark, I have feelings; especially when it comes to my family, who I will be seeing after a long 8 months. My family is the most important thing in my life and I have been without one for way too long. Marilou has given me something which I thought was lost forever. A new opportunity to live a normal life. I owe her everything I have in return. I thank you for making this post. It gives me time to think about what is most important in my life and I so dearly need that!!!

Dose of reality time. :whistle:

Four hour flight from HCMC to Taipei. A couple hours layover. Eleven hour flight to the west coast of the USA. After 17 or 18 hours of travel, you're going to arrive in the US at nearly the same time you left HCMC, and on the same day! On top of this, the jet lag going west is easy - one night and you're back to normal. The jet lag coming back east is a monster - you'll be dog tired for days. I don't know what it is about crossing the date line in the fast forward direction that's so easy to adjust to, but rewinding is a killer. :wacko:

I'd suggest not making any big plans that involve a lot of activity for at least a few days. Give her (and you) some time to rest and adjust to the new time zone. After that, ease into it.

Does she have any family in the states that live near you? Invite everyone over for a family get together. My house was packed with people when we arrived. My wife's uncle decorated my house with "Welcome Home" stuff, and her aunt and sister cooked up a storm. My wife and step-kids were happy just to eat and visit with family on their first evening in the US. We arrived two days before Christmas, and I had the week between Christmas and New Years off work, so we had time to drive around, see the area, visit friends and family, do some shopping, etc.


Here's a funny little story - for about a year before the visa interview, nearly every time I would drive home I would pretend in my mind that I was bringing my wife and step-kids to my house for the first time. When I would walk up the steps to the door I would pretend in my mind that her family and mine were waiting inside to greet everyone with a big "Welcome Home!". When I was getting ready to go to Vietnam for the interview I was adamant - nobody is going to come and pick us up at the airport. I wanted my daughter to drive my car to the airport, and I would drive us all home. I wanted it to be just like I had imagined so many times. It was. And I still remember it often. :blush:

As of 10:30PM, (1030AM in Manila), I can happily report that our visa has been approved. I am on logitech webcam talking to my love and we are celebrating. I am so upset because I need to go to bed to wake at 5:30AM. I am so happy. Praise GOD in the highest!!!!!!!! We will be a family once again as God wanted it. HE does everything for a reason. May God give all of you the strength to endure your journey to happiness. We are so happy!!!!!!!!!!!!!!!

The most important documentary evidence that you could possibly prepare is the 134. This trumps everything else by a long shot!!! The petitioner should already have been working on collecting the required documents. It should be finalized ASAP and forwarded to the beneficiary. Congrats and Good Luck!!!!!

I let my then fiancee find the ticket, including the discount and then sent her the money to buy the ticket, it saved alot of time and headache for me to find out who would and who wouldnt allow the ticket to be purchased outside the country.She shopped around for the best price.

I purchased the tickets for my fiance and kids for a flight aboard Delta(One Stopover), Manila-Narita-Detroit. Made purchase online through Expedia. Confirmed that my fiance did not need to have a copy of my charge card or anything else. The flight from Manila to LAX are the cheapest and they are one way in most cases. Some offer first time immigrant discounts. Good Luck in your visa journey!!

Hi All
I am getting so frustrated with all the waiting!! I know it will all be worthwhile in the end but at the moment it feels hopeless! We submitted our package and recieved our NOA1 on 12 Oct 2011. I have just checked and the last time the case was touched was 14 Oct 2011!!! According to all timelines etc we should be hearing about our case anytime soon but does the fact that it hasnt been touched since 10/14/2011 mean it will be delayed??? I am feeling so despondent at the moment and just want to be with my man ASAP!!!

Don't be surprised when you get the NOA2 tomorrow. That is what happened to us and we were pleasantly caught totally off-guard. USCIS works in very mysterious ways!!!

Hi there everyone,

This is my first time in the removing conditions forum (me being the the permanent resident). I was granted permanent resident status in september so I have a while to go before removing conditions yet.

However, in January, my husband (the USC) got fired unexpectedly from his job. We have been on the job search together since then and although several promising leads have come up, they have all fallen through. We are both feeling very depressed about the whole situation but we somehow managed to come up with the money for our rent and bills last month. This month we are really struggling and don't think we will be able to make it this time.

I just wanted to ask if anyone knows if my husband is allowed to claim unemployment benefit? I know that as the permanent resident, I would not be able to, but would he? It's all very confusing because I thought they granted me permanent resident status based on his job and his income that would support me? We don't want to hinder my application for removing conditions in 18 months time but we are really worried and don't know which way to turn now.

I am more concerned about your USC spouse finding employment. Everybody here is trying to give you advice that will not help your situation. I will. Get a good job that is stable. How you might ask? TRUCKING!! It has always been the most stable industry during good and bad times. Check out the website BUBBUJUNK.com. You can explore the occupation and current openings across the country. Some big companies will hire and train you. You will probably be required to pay the company back over time. You would be able to start almost immediately if you like. Starting pay $35,000; not bad. Most importantly, that final ROC interview will be a breeze. If you like, your lady can also train right along side you and then you can have a six figure income within two years and always be together. Not a bad deal if you ask me. By the way; I have driven trucks on the side while working for the USPS for 8 years. Think outside the box!!

If you plan on filing for ROC before she leaves for her trip to the Phil. please note that she should get her biometrics appt. approx. 2 weeks after acceptance of the ROC petition from the USCIS. My gal and I are now going through the ROC and her biometrics appt. was approx. 1 month after acceptance of the ROC by the USCIS.
You can reschedule her biometrics appt. for a later date. I only know what I have heard from others and rescheduling any appt. can and probably will delay processing of your petition. Others may have better information about this than I do.

I am just about ready to file our ROC. I noticed something on what to include. The instructions for I-751 state that those residing overseas on orders must submit passport style photos and fingerprints. We are not overseas. I am not in the military. Just stating the facts concerning mucous functions. Go ahead and consume a lot of dairy products. The next few days you will will have chest and nasal congestion when your body tries to protect itself from the acid that is produced.

She is responsible for obtaining any and all police certificates from home country and any place she worked abroad for more than 6 months, such as Saudi Arabia. Unfortunately or fortunately, Saudi Arabia does not issue any police certificates for those outside the country. The beneficiary is the one who must obtain these items. You can check the reciprocity section on the US State Department website for any country you stayed for more than 6 months. Maybe you might get lucky and the country does not give out these documents if that is your case. If it is inside your home country then local and national clearances can be obtained quite easily. The USC or petitioner is not required to present a police clearance or certificate. When you supply the State Department with your social security number and your birth certificate, they will have everything they need to conduct a very thorough background check on you, plus the G325A form that you submit will have other information that will aid them in investigating you. Don't worry, they will know all they need to know without you obtaining a police certificate.

We ran into the same problem. My fiance worked in Saudi Arabia. The reciprocity section of the state department states that some countries will not issue this certificate if you are living outside the country (you worked there previously for more than 6 months). I (petitioner) contacted the Philippines Embassy in Jeddah. They stated that we could obtain a non-derogatory statement from the Kingdom. They are obtained through Philippine DFA after we submit copies of the entry and exit stamps in the passport and employment certificate from her employer. We did that and are waiting for it to arrive at DFA. Although Saudi Arabia is listed as one of those countries that does not issue police clearance certificates, we went ahead and requested the non-derogatory report which takes two months. DOS puts these reciprocity tables together, so if your country is listed as not requiring it, I would just not bother.

Hi everyone. I have many questions about the I-134 for my K-1 fiancee. If you know the answers to only some of them, please answer just those. I have read a few posts about this topic and seen some conflicting answers. Any help is appreciated.

1. Do I need to report my USC ex-wife as a partial dependent on my I-134 form in regards to my K-1 fiancee? My ex will be receiving alimony for another 5 years.

2. What about my children who I pay child support for, but I do not get to claim on my taxes? I assume I still report them as partially dependent since they live with me 35% of the time.

3. When reporting income, do I report my total annual income, without removing the amount paid for alimony and stock to my ex?

4. What if I don't have money in a savings account, but keep some extra as cash instead? Will that matter that I report none for savings? I have stock that vests quarterly from my company that I plan to report instead.

5. Should I report my 401k?

6. Do I need to report that my ex wife gets half of my unvested stock for the next 2 years as it vests? Should I only report the amount of unvested stock I have after subtracting what my ex gets?

7. I'm hoping that I should be able to include my total income without subtracting amounts that I pay my ex. Either way, the amount will be plenty, so I don't have to worry about that. I just think that payments to an ex are like debt that they don't care about, just like other debt. If they want that info, they can get it from my divorce decree. Things would be a lot easier if I just reported my W-2 income and didn't have to mention my ex or subtract her amounts, especially since the amount is high either way. What do you think?

8. When reporting my house value and mortgage, do I only report half since my ex gets half when it is sold in 3 years? Maybe I report the total value of the house and then put my ex's portion as part of the mortgage, leaving a difference matching the value I have in it?

9. When reporting life insurance, what do they mean by cash surrender value? I have life insurance equal to 5x my annual salary through work, 3x of which goes to my ex, and the other 2x to my father to give to my fiancee until she gets a SSN. I think the full value is given out if I die, so is that the surrender value? Do I put the full value as both the insurance amount and the cash surrender value?

I am not an expert, but according to those who have been on this site for ages, if your annual income will be sufficient to qualify under the federal poverty guidelines for your family size you have no need to use other qualifying documentation such as bank acounts, 401K, insurance policy values etc... by the way. are you a fed govt employee too?

The bold above is not correct. All children of the petitioner count in the household size whether the petitioner is currently obligated to pay support or not.

I have four stepchildren who are in their 30's and are citizens. I sponsored them in 1984. I also have a biological 24 y/o son who is independent. What would be my requirements on the I-134?

Hello everyone,me and my fiance was discussing about the 125% poverty level and we're confused how it works for us including his twins. It is $27,937 for a family of four. He said he is making 125% but he is just worried about paying child support,have student loans because he is studying right now (mastering Bachelors of Nursing) so he was telling me that he will include his dad for co-sponsor so that no questions asked, but base on what I read from different cases here on VJ was everything will be fine even he has a child support or even a student loan as long as he is making 125%? Is this correct? :unsure: I need your help,I mean what is the point having a co-sponsor it will be just complicated because some CO here in the Philippines doesn't accept c0-sponsor. I'm confused please enlighten me so I can discuss him about this. Thank you in advance for all your response. :help:


Whatever outstanding loans he has will have no bearing on the I-134. The CO will look at his tax return, W2 and maybe the employer letter and find total number of dependents to include the fiance (4) and bounce this off the poverty guidelines sheet he will have posted on the wall. 125% is the magic number.

Made 19,000 last year and will make 21,000 this not great but still 125% above the poverty line. Have about 2500 in my savings and 1000 in my checking. Sent last 4 w-2's which include my old job from the pretanked economy when I was making 2x what I get now.

Any rate embassy said she would become a public charge and I needed to have more in my savings. Didn't say how much though and wasn't happy about my current full time job. What if you could make double that while learning a new career? I am talking about getting into the trucking industry. Training for most big companies is handled internally and you pay them back over time. Starting pay is around $40,000 and goes up with each year of experience. There are 10 jobs for every driver now. Do research on Bubbajunk.com. Your fiance can ride with you. If she likes she can get her license after one year of having an operators permit and drive too. That would put your combined annual income well over the $120,000 mark and you would be together all the time. And if something happened to you she could easily take care of herself. Sound appealing to you? If you have a better idea, I am all ears.
