It sounds to me like she could get married and then just file for AOS but I am no expert... Maybe someone else has a similar situation?

I'd like to say no but it depends on the person dealing with your case. I sent UK standard photos instead of US standard ones and got no RFE. You should be fine but if you have already sent the forms off then it might be worth you printing some others that are filled out correctly so that should you get an RFE you can send it off right away which should cause minimal delay smile.gif

You would have to file for a CR-1/K-3 visa - it is kinda the same sort of process as K-1 but generally takes a while longer. If you are set on getting married in Scotland and living in the US and don't mind waiting a year to be together then go for it but just bear in mind the quicker route tends to be a K-1 where you file then get married in the US when you get the visa smile.gif

All has pretty much the same result (although I believe with a spousal visa you are able to work straight away?) in that you will be together there but they have a few differences and take slightly different amounts of time smile.gif

Also you can remain in your country for (I think) six months after the visa is issued. I am delaying mine as I want to move at the end of June so I can be here for my mum's 50th birthday smile.gif

I just got packet 3 (yay!) and I am due to visit my OH in just under three weeks so I am not going to return it until I get back. Then when I get my visa I am not going to move until the end of June smile.gif

Yeah - I think you *should* be ok but I would take out wedding insurance (check the terms) and if you can get a venue that will allow a sliding date then that would be good too - of course that doesn't help your family booking flights.

Remember that once you get the visa you have six months before you have to enter the US and then you have 90 days before you have to marry - that is almost 9 months to plan a wedding and more than enough time for your family and friends to boko time off etc smile.gif

I know it really sucks but sometimes it is best to play it safe - you never know what is going to sneak up behind you tongue.gif

I wouldn't worry just yet - there are still people waiting from July smile.gif It took me 152 days to get my NOA2 and I know people who are at 180 days+ smile.gif I know Vermont are quicker but you really have no cause for concern just yet smile.gif

If you have the intention of marrying while on a tourist visa then this would be visa fraud so I would avoid it like the plague smile.gif From how it sounds you have a couple of options: go through the K-1 route and get married at the end of it or get married first then apply for the K3/CR1 etc although I think this normally takes the longest and as I am aware the non-USC cannot enter the US until the visa has been granted (I might be wrong on this as I am not so familiar with the spousal visas)

I think the best advice I have seen here is to take time for you... You always say that the following relationship isn't a rebound... I've done the same (*many* times blush.gif) but it was only really when I told myself that sod it - I am not going to jump from relationship to relationship trying to find "the one", I was going to be single and proud and wait until I found someone who deserved me, that I realised what love was.

My OH and I have known each other for six years (just over). We met, tried to have a relationship, failed, gave up, lost contact, exchanged occasional e-mails, started talking more... all over a period of four years. At first I refused to love him - I fought against it, I warned myself that we had tried it before and that it didn't work. I warned myself about how we were going to be together without just rushing into a wedding for the sake of being together in a relationship I was skeptical about at best. I warned myself that we would have to cope with 5500 miles distance, not see each other for months at a time... hell - when I was warning myself we hadn't even met. We didn't know if we would hit it off in person...

Jeremy booked a flight to see me and I was freaking. As it happens we did hit it off, we did make a go of it and we did work through things. In a previous relationship I ended up suffering from clinical depression because I could only see my boyfriend once every week!! This process and situation has helped us both grow and develop.

Anyway - you can read most of our story on our website. I guess what I am trying to say is that it took me vowing to remain single and truly meaning it to actually take a step back and realise what *I* wanted out of life and my life partner. Our relationship was on *our* terms where neither one of us would back down about what we wanted. We just happened to want the same things smile.gif

Please take some time for you - make new friends by all means but don't get yourself into a situation where you keep repeating past behaviours because you don't know how to break the cycle - took me a while to figure it out but I think everyone is capable of getting there smile.gif

It means that potentially you can use the CR-1 to enter the states as a spouse (as far as I am aware) but generally the K-1 option is quicker... although if you are with California Service Center I would seriously check the timelines - I am not sure if K3/CR1 visas are taking as long as K1s but it seems to be real slow right now.

On a K1 you can visit each other as long as the non-USC shows strong ties to their home country (letter from employer, rental agreement etc). Again, as far as I am aware, this isn't possible with a K3?

Someone correct me if I am wrong - we learn by our mistakes wink.gif

From my point of view I am going to take my NOA1/2 with me so if they require I can show them that I am going through the correct channels and that if I wanted to stay and get married then I wouldn't have bothered going through the legal procedure!!!

This time I am going to say I am visiting my boyfriend because it is best to be honest and tbh sounds better than fiance (which I use rarely as a term anyway because I don't like it).

Yeah - I've noticed from various timelines I have seen that a lot of touches early on post NOA1 tends to not result in anything spectacular... I think I saw someone with an RFE early on due to some kind of spelling mistake on a form or something but don't quote me on that!

I doubt it is anything to worry about - like someone said - they prolly can't figure out where they want to put your package right now!!!

It is really interesting reading these stories smile.gif Being "younger" I don't have the ties I do that "older" people may have - mortgages, children, lifelong careers etc etc, but I definitely think we find it more challenging as we have to deal with so many new life experiences to the extreme that we may never have coped with before: getting married, becoming independent, living away from home, trying to figure out mortgages, bills etc... I think when you get older you become more "steady" for want of a better word. You've had more life experience and understand better what you want out of life smile.gif

I find that I have come across more "old folks" than "young 'uns" but then when you share a common interest and lifestyle choice it doesn't really matter. When I get on with someone well I make the (totally wrong) assumption that I am speaking to a female in their mid-20s from the UK. I have to keep reminding myself that I am speaking to people from all over the world who may be male or female of any age laughing.gif

Does anyone else do this?! Or am I the only one? (Same with reading books where I always read in my head in an English accent - the characters no matter where they are from always sound English in my head!)

I think that this process, no matter how many of us bemoan it, has taught my OH and myself a lot about our relationship, our strengths, weaknesses and ourselves. I really honestly think you will be fine as people have prolly got approved after doing worse!! One main one is the photos - they are meant to be US standard (2"x2") but plenty of people have sent in UK standard and been fine smile.gif

Laura/Nick are right - you can prepare by just making sure you get the forms filled in correctly - then at least if there is a problem you have already dealt with it and hopefully it shouldn't delay things much more than the post would normally! biggrin.gif

Of course with the USPS that might not fill you with hope and joy laughing.gif
