I really honestly think you will be fine as people have prolly got approved after doing worse!! One main one is the photos - they are meant to be US standard (2"x2") but plenty of people have sent in UK standard and been fine smile.gif

Laura/Nick are right - you can prepare by just making sure you get the forms filled in correctly - then at least if there is a problem you have already dealt with it and hopefully it shouldn't delay things much more than the post would normally! biggrin.gif

Of course with the USPS that might not fill you with hope and joy laughing.gif

We personally haven't used a lawyer - I know there are people who have had good and bad experiences of them. Personally, and this is just my opinion, I would only use a lawyer if there are added complications to your case and only you can decide on that.

Would it be worth pointing your fiancee in the direction of this website to help ease her mind? The whole process can be very daunting at first and I can understand why she would want to just offload it onto a lawyer but really it isn't too bad and there are so many people here to offer advice and point you in the right direction smile.gif

Ultimately the choice is you but as I mentioned above - unless there are complications I personally wouldn't bother with a lawyer smile.gif

They have an uphill battle and it would be easier to cancel the k1 which will in all likely hood be denied after how many months. They may as well get married again in april. The time to research and find the quickest way for her to come here was before they filed and included the wedding info.

Now they are stuck in damage control and its not going to be quick. The damage is done. Unfortunately she will not be entering the USA asap. They will get a notice of denial, or a RFE, or be put in AR for awhile. And in the end after all that if they get to an interview, the interviewing consul will probably deny based on the wedding photos and him admitting they got married. The non legal non binding wedding with K1 works when you dont mention it. If they see anything that looks like a marriage, the K1 is off and the burden is on the petitioner to prove they arent married.

The consul cannot deny the visa based on information that was provided to the USCIS with the petition. If USCIS approves the petition with this information available, then it cannot be returned to them for further adjudication based on information that it already had during the original approval. The consulate doesn't deny the petition, they can only return it to USCIS recommending they readjudicate it based on new information that was not presented with the original application. There is a good chance that the USCIS will deny the petition. If they don't, it means they accept his declaration that the marriage was not legal and qualifies for K-1.


So if you get a NOA2 then the Embassy can't deny you based on the evidence you initially sent the USCIS? I never knew that!

So did you sign a wedding certificate or register? Or was the wedding a non-legally binding one? If this is the case then they might ask for more evidence that you aren't married (which would be really hard to prove). If you are to go back to marry in India then if this will be a legally binding marriage then you will be breaching the conditions of a K-1 visa and will get denied. If however you were to have another non-legally binding ceremony then this would be ok although can look suspicious to authorities.

I would say to postpone the wedding in India and have a non-legally binding ceremony following the K-1 and your legal wedding in the US for your OH's family. In the meantime I would go with the flow - if you get an RFE and are not in a legally-binding marriage then it might be wise to consult an immigration lawyer. If however you are determined to have a legal wedding in India, you might be best to bring that forward and then file the K3/CR1 - it is for you and your fiance(e) to decide smile.gif

I know what you mean - I was fine until about 130 days or so but when everyone else was getting approved and I was slipping behind more and more... I was "only" waiting 150 days or so for mine so an extra month+ would have been awful smile.gif

I brought a letter from my employer saying that I was due to return to work following my trip to the US post NOA2 but before sending packet 3 back - I was never asked for any proof of ties and merely said I was visiting my boyfriend for Valentine's Day. Of course, entry denial is always a possibility so I would never say it is a guaranteed thing but if you go through immigration control with hard evidence, be honest and generic and don't offer any specific information unless asked then it might be ok.

As for other advice, I would really really suggest that K-1 is the best route to take. I don't know if it would make a difference if you filed before or after he entered the country but that might be worth looking into as well... I believe RI will be under Vermont Service Center (anyone? I haven't checked) which seems to be processing quicker than California at the moment if that is any consolation to you.

It really really does suck - there are lots of people here who are and have been in your situation and for the most part, we've all pretty much had to grin and bear the distance. If your OH gets to stay for the 90 days permitted on the VWP then you are really lucky to have that time together smile.gif But defo don't let him overstay - if you follow the K-1 route then he will need to attend interview in Spain anyway. And sure - there are tales of people coming over to the US on "holiday" then getting married and adjusting status - but this is insanely risky unless there was obviously no original intent to get married - for example if he were to have come to the US on a student visa, then you met and got married etc etc. It might seem like a chance you would be willing to take, but what is worth the price of him not being allowed back into the country for 5-10 years? A few months apart, imho is a much more feasible and safe option - I wouldn't want to take any chances if it meant that I wouldn't be able to be with my OH.

Debz is right - I was a wreck about it all because as others have said, there is no guarantee that the non-USC is able to enter the country for the non-legal ceremony. Also mentioning the non-legal ceremony in any kind of immigration contact (Embassy/Paperwork/AOS interview...) is a big no-no - as far as the authorities are concerned, you only have one wedding and that will be the legal one.

We booked everything in advance based on timelines we had seen and then got caught in the huge summer 2007 backlog. Sure, maybe we were naive, but it happens like you say smile.gif

We had a wedding planner who was awesome - they even wrote us a letter to say that we were going to postpone the wedding (as we had sent the contract saying we were to marry in Feb 2008 to the USCIS) in case there were any problems. On entering the USA, I made sure I had as many ties to the UK as I could - I had a rental agreement and a letter from my employer stating when I was due to return to work. If you have any other ties then bring those as well - for the record I didn't have to show them but definitely bring them.

I went through pre-clearance at Dublin airport. Warning - if you do this, then check baggage restrictions. I flew with Ryanair and got stung both ways for having too much baggage... It really isn't much different to US Immigration (although the IO was friendly tongue.gif ) but it meant that I could travel across the Atlantic without the huge weight on my shoulders. I told the guy that I was going to visit my boyfriend for Valentine's Day and our birthdays - also true. And when he asked if I had any intention of getting married I said "no" - as far as he was concerned I wasn't.

Don't get me wrong - I don't recommend doing this at all - if there is any way you can change the date then do so - it will be much less stressful. We had no other choice short of spending thousands of dollars we didn't have and I would never suggest it as a viable option unless there was literally no other choice smile.gif

You can go over and have a non-legal ceremony (no licence etc) then return to wait out the rest of the K-1 then have a legal (with a license) wedding when you have the K-1. This is not recommended and should only be done if you have no other feasible options - it is what I am having to do as the whole process has taken months longer than initially stated on the USCIS website mad.gif. It's risky as we have booked the whole wedding (did so before the screw up s with post and USCIS) and I may get denied entry into the US but we have deemed it our only option short of costing ourselves thousands of dollars.

If you have not booked anything or if you can postpone for not too much money then I would STRONGLY recommend it - if you get legally married while on a K-1 then you will be breaching visa conditions and will have to return to your home country to file for a spousal visa which takes longer than a K-1 as a general rule smile.gif

My sister gave me a bunch of old winter clothes, not really old but she bought them and wore them once for a party or something and never wore them again. They all look nice. But if they are too big or Charry does not like them they will probably go to good will.

3 days after I move Charry is arriving.

We have no living room furnature, other than the entertainment center. We have no bed never mind a bedroom set. I do not plan on getting anything either until she is here so she can help pick them out.
I saw an inflatable bed on sale for $12.99 or something like that. That should be good enough for a few days while we decide.

I'm taking the entire week off after she arrives. We can pick out the furnature we do not have, I can show her the sites around here as well as show her how to get places of importance, although she won't be able to drive for a while. Then there are the things we all know will happen after being apart for 9 months or more. biggrin.gif


Oh Jeremy and I are going to be in much the same situation aisde from the fact that we are not going to have any money to buy any furniture for a while!! We have a second hand sofa that someone has given us and I am sure we can make do with sturdy boxes and cheap rugs etc until we can save up for other things smile.gif It is nice to hear about other people starting from scratch as well! Jeremy doesn't even have a place for us to live yet!!
