K-1 Fiance(e) Visa Process & Proceduresfee question

Just making sure I understand you correctly--so he would pay the fee after the petition is approved and forwarded, but before the interview and (presumably) the medical? He would pay the fee when he actually goes online to do the application? Sorry for the stupid questions, I'm just a bit lost and I don't want a silly mistake costing time and stuff (I would like to get James (the fiancé) to the US by this winter/the end of this year) headbonk.gif

K-1 Fiance(e) Visa Process & Proceduresfee question

Hello all, I'm a new member who is in the process of obtaining a K1 visa for my british fiancé. I'm working on the petition now and that's no problem, but I do have a question about the visa application fee. I understand that I must send payment for the petition fee when i actually send out the petition, but for the visa application (as in, the stuff my fiancé, James, would have to do on his end in London), when would he have to pay that fee? Would he pay it once the petition is approved, or at the interview, or at some other time?

I'm seriously confused and tried looking everywhere for info, but I might have missed some (it's 8 AM here and I've been up since 2:30 AM) things. (Also, I apologize for any spelling or grammar mistakes; my cat decided that my laptop was the best place to be while I tried to type this post.

USEM will not start interview without the results and clearance from SLEC. Call them to reschedule to later date

When I asked them to reschedule on the phone they told me they could not reschedule it.   Is there a way for them for an emergency interview based on my fear of what will happen to my business?

K-1 Fiance(e) Visa Process & ProceduresMedical Exam not yet complete - Interview with Embassy on Monday - HELP

1.  go to the interview without completing the medical exam and

2.  expect to get a 221g about the medical exam and

3.  ask for a pass to return to the embassy for tuesday and wednesday (both days, just in case) and

4.  go back to the medical place after the interview is finished and

5.  finish up with the medical and

6.  hand carry the medical stuff into the IV unit, using the pass obtained back on step 3.

That's about all I can think of, for now.

Thank you for responding.  Will this cause a huge delay in our Visa processing?

ok.  What would happen if we didn't go to the interview and just finished the exam and then called to reschedule the interview?  Would that cause an even longer delay?

K-1 Fiance(e) Visa Process & ProceduresMedical Exam not yet complete - Interview with Embassy on Monday - HELP

We need help with this question.  We have our interview scheduled with the embassy on June 3rd.  We went to have her medical exam done, however the OBGYN was not in to do the full exam, so they told us to come back Monday.  Monday is the date of our Interview.  The reason her medical exam was not yet completed was because her son became sick with Dengue and then complicated it into Bilateral Pneumonia and she needed to take care of her son.

Does anyone have any advice what to do?  Should we still go to the interview on Monday and explain the situation to them?  Is it possible they will complete the interview and we will just need to go to ST. LUKES and then return to the embassy with our documents for them to process at the embassy?  I tried to call the Embassy to reschedule but they told us it was not possible to reschedule so near to the interview date.

I am worried that if we push this back any farther it will have a huge impact on my business in the US.  I have a wedding this next Sunday and if I do not show to photograph it - it may be very detrimental to my business.

Anyone have any advice?

IR-1 / CR-1 Spouse Visa Process & ProceduresI-864A help
My apologies for the delay. I was asked to call 0871 562 6666 option 1 for collection of documents to the embassy. They offer a next day collection service. Mine were collected on the 1st September and....

...IR-1 arrived by DX courier on the 11th (today). I have paid ELIS $165 immigrant visa processing fee and am now waiting to board for the USA.

Not a bad journey by all accounts. Started the process in mid April and received IR-1 5 months later.

Thank you to all for your advice and I am happy to share any experiences that may help other UK residents on their journey to the United States.

IR-1 / CR-1 Spouse Visa Process & ProceduresI-864A help
Tax: wife was earning in the UK up to July 2013 but had not filed us taxes since she moved to UK in 2002. IRS allows rectification of simple delinquent taxes with a no jeopardy filing of last 3 years, plus last 6 years FBAR if greater than $10000 in accounts in any year. She quit work in July 13. Taxes are properly filed by CPA and full schedules are in hand. Joint sponsor covers financial requirement. My income is UK earned but I will be moving for non-res tax status in UK as of 2014 new tax year. So, she files I-864. Zero income. My income is on it but may not count as UK earned. No I-864A requirement at all. Send. Hello visa.

Your guys rock (I believe the Americans say).

IR-1 / CR-1 Spouse Visa Process & ProceduresI-864A help
Thank you so much for the advice. Really great. To summarise then. Wife submits I-864 because she is petitioner, even though we have a joint sponsor in her parents. Wife does NOT submit I-864 A. Not required for IR-1 unless I travel with dependants. My earnings are on her i-864. Daughter is a USC already in USA with wife. Daughter included on I-864 as household member. Wife has filed delinquent taxes for 2010,11 and 12 and offset all earnings in the uk using foreign earned income exclusion.

I am UK airline crew, commuting from USA to work in uk so job will continue.

So, the packet will contain :

I-864 from wife

Signed tax return from wife

Proof of assets and income from both of us

Please, have I got this right?

Many thanks again.

IR-1 / CR-1 Spouse Visa Process & ProceduresI-864A help
Please could I ask for some advice and apologies if this has been asked before. It's my first post.

I have just been for my interview at the us embassy in London for my IR-1 visa as the spouse / immediate relative of a US citizen (my wife). I provided I-864 from a joint sponsor (my father in law), along with I-864A from mother in law as household member. All good so far. Except consular officer asked me to produce my wife's I-864 as the main sponsor and she had not completed one!!

She has now produced one for me to courier off to the embassy. My question is, do I need to submit I-864A as household member? Wife's income is now zero. My income is easily in excess of the requirements AND I have already submitted a joint sponsor whose income and assets cover the deal on their own. Our daughter is already in the us. She has a us passport. Is she an accompanying dependent? I think not as she was a returning citizen and I am going through the green card process alone.

The I-864 instructions read :

If you are the intending immigrant and the sponsor is including your income on Form I-864 to meet the eligibility requirements, you need to complete this form only if you have accompanying dependents. If you are the intending immigrant and the sponsor is including only your assets on Form I-864, you do not need to complete this form, even if you have accompanying dependents.

Additionally, when I was advised that extra documents were required, the consular officer sent me off with a blue form giving advise on what was required. I quote:

Documents indicated below are required to continue visa processing:

"An affidavit of support from the petitioner / sponsor who filed your petition. If both the sponsor and their spouses income are to be used to meet minimum income requirements (not applicable for IR-1 cases), your sponsor and their spouse must complete the I-864A."

Without pre-judging, as it is an IR-1 case, I am guessing that I do NOT need to send I-864A. However, would it hurt to send one with a coving letter explaining that there is some ambiguity in the sets of instructions so I have sent I-864A for completeness, feel free to disregard. I guess what I am saying is that it must be better to send a form that is not required rather than not send it and cause potentially more hold ups.

Sorry for the complicated post but I am guessing that there is quite a bit of expertise to draw on here.

Opinions?

Many many thanks, Paul

US Embassy and Consulate DiscussionCR1 interview experience

Hi Folks ! here is my CR1 interview  experience in casablanca/ Morocco !!

I won't go into great depth as I'll be just  repeating the many reviews already submitted.

My appointment was scheduled for April 1st / 8.00am and I arrived at 7.15 am ! Just as I walked up,  the  security guard  said : all Immigrant visa Applicants appointments form a queue over there. So I joined that queue! we were about 3 people, but by 7:45 the queue had already quadrupled!

At 8:00 am the security guard let me straight through after checking my interview letter ( to verify if my name exists in the list of that day Interviews) ,  and then through the metal detector  (checking for weapons I suppose LOL )  ,. after the security check I walked all the way round the consulate to get inside. Once inside , I went through a window where a  Moroccan young  lady  asked for my passport , interview letter and 2 photos ! then they ushered me through !!

Once I was inside the building, there was another check point , I went through the stationary detector , and the security officer asked  if I had anything to declare ( cell phone , laptop ?) , so you?d better not to bring anything extra , just your paperwork and yourself  :P

After that , I went into a large room with about 7 windows for people to conduct interviews ,  About 40 mins later my name was announced by a Moroccan  lady  to come to window 1 !!! she was  veeeery nice and friendly  , she returned some of the NVC and Original docs and asked  me to give  her all my NEW docs and phone number , then she asked If I  had already traveled abroad ! where ? when ? and for how long ? is this our 1st  marriage ? and which language I would love my interview to be in ?  !! she then said to have a seat and I would be called for finger printing later . Oh and then with a huuuuuuge smile she wished me good luck!  :wow:

After 10 mins , I was called for fingerprinting , and  I sat back down again !! my name was re-announced after 15 mins for the actual interview ! the CO was a very sweeeeeeet , adorable American lady , Made me swear I was telling the truth, then asked me few questions :

how did you meet?
How did he immigrate to the USA? And when ?

What does he do?

Has he ever visited after marriage ?

When did you get married?

Have you ever had trouble with the police LOL ?  :o  :innocent:

What does he do in his free time !! hhhh I expected that Question !!!

Was out of there by 10: 15 am !! the interview was very smooth , pleasant and so much easier than I expected ! I really couldn't have hoped for a better experience  !! And I can't believe that we have been APPROVED! yaaaaay

First thank you guys! Vanessa & Azure the ceremony is pleasant and you can bring your own camera. Since the weather suck yesterday because of the rain they waited for the late comers. Im wondering if we have the same venue because they held ours in WHO radio station and in air in the morning and broadcast it on noon news the same day ands even take pictures of us together with the immigration officer and the judge then posted it in Who channel 13 website. We arrived 20 minutes before the ceremony but since the since its raining they didn't start right away. They guide us to this one room and waited for the rest to begin the ceremony they did roll called and give us a small flag and white big envelope the officer explain stuff about traveling and getting a passport and bringing relatives in he US you know what she didn't explain what's inside of he envelope but its easy to understand its about updating Ssn and a passport application welcome to the us and new citizen book.oh and while we're waiting we sign our certificate a photo copy and original. We arrive around 7:10am and left 9:00am. That's about it I you want you can go to WHOradio website and clicked Van and Bonnie and you can see why happen. Goodluck

I got in the interview place and again tell the security I was late and said told worry about it, there were 3 people including me. About 5 minutes later the officer(he) called my name. He ask me to sit down then stand up oath to tell the truth and sit down he gave me the pics I sent together with n400 and told me to sign it and asked for green card and dl. he was very friendly and pleasant. He go thru the whole n400 question word for word and let me sign the last page. Then he asked me 6 question. This is random I didn't remember the exact order. 1.What is freedom of religion? 2. When does the constitution written? 3. What states border Canada? 4. Selective service? 5. What ocean in east coast? 6. How many senators? The reading and writing Is all about taxes. Then he asked me if I bring some documents.i told him yes and he said he need the one will utility bills or letter with both me and my husband name on it I even show him family picture and he took it and that's it he said congratulations you pass and I recommend you for approval and wait for the oath letter to be sent.
