I'm not sure if I'm posting this in the correct area or not. Has anyone ever tried to visit the U.S. after a K1 visa was issued but the marriage didnt take place? Not trying to stay in the U.S. ONLY visit. My fiance left way before the 90 day period to be married would have been up. There was a family emergency and he left urgently. Because of the situation at home we don't want to refile any paper until we know for sure he will be able to get here and not have any further issues prior to receiving the advance parole. We haven't seen each other in 5 months and we just really are looking forward to the visit but I can't help but worry about that visa being in the passport and him going through immigration and them saying NO WAY BUDDY! LOL. Any input would be greatly appreciated. He's been here several times, never overstayed.

I know at one point or another we have probably all asked questions that the answers are available on visajourney, but this question seems to come up time and time again! Are people not doing any research at all? Why in the world would someone think that a visa for a FIANCE is ok to use for a SPOUSE? Sorry I just don't understand why this particular question is asked so frequently...it states specifically in the instruction who can and can't apply. Come on folks lets take a little responsibility for ourselves here and take 60 seconds to ready the forms before we ask questions that aren't needed to be asked.

My current UK to USA visit timeline looks a little like this:

First visit : Oct 12th 2009 - Nov 9th 2009
Second visit : May 10th 2010 - Aug 5th 2010
Third visit : Nov 10th 2010 - Feb 7th 2011

On my third visit I was sent to the office to be dealt with by a man who clearly enjoyed tormenting people, he made me pull out photos of my fiance and I, mocked me not having a job (my fiance supports me as it's our choice, I live with my parents as renting is simply dead money and it's easier to pay a little board in between visits). Then he called my fiance to ask if what I said was true and what his jobs were, and eventually backed down when he was told that we'd be intending on applying for a fiance visa upon my departure of that visit.

Now I am back in the UK, we have sent in our I-192F and received our NoA1 now we are just waiting on NoA2, we have seen the Texas processing times are currently 5months. So, we have booked return flight (round trip) for April 28th until July 26th (of which can be changed and amended as soon as required for me to return to the UK in time for them to contact me for medical and interview).

As of tomorrow I am putting in for my ACPO check and getting my vaccination history together.
My fiance will be forwarding me a pdf to print of the NoA1 and a copy of his finances to use as proof if I am sent to the office again at PoE. What else could I take as proof of my return to the UK, we don't want any hangups and we will be doing everything by the book meaning I'll definitely be returning to the UK.

How can I make sure I am allowed entry or have a strong enough case to present to, hopefully not the same, officer in Atlanta?

Any and all help is greatly appreciated



My husband has always been in the same position as you. He lives at home and thanks to the economy hasn't been able to find work in a VERY long time. We have always chose to have him fly through Dublin...the pre-clearance is fantastic. The reason I say this is because god for bid they deny you entry you haven't spent 8 hours on a plane only to have to turn around and get on another one back home. I've read other peoples takes on going through Dublin...thanksfully my husband has never had any issues with going through there. He was asked to wait one time and that was only because we had a K1 visa and obviously it's in his passport now that we didn't use. The officer simply asked why he was coming, why he didn't use the K1 and advised he was not to stay, which was ok because he never planned on staying. He has been to the US several times, all but 1 visit as been for 6 weeks up to 3 months. He brought a letter from his parents saying the date he was planning to return, had a return ticket, and that was it he was never asked to see any other information. When we had applied for the K1 he did bring a copy of that with him as well but like I said it was never asked for. Nobody can guarantee you are going to get through but I tend to take the "just in case" approach and say fly through Dublin just in case you are denied entry. If you've stayed out of the country longer than you've been in, you haven't stayed more than 180 days in a 12 month period, and have always left withing your 90 days the VWP allows then I would say it shouldnt be an issue but be prepared for someone who may be having a bad day.

When we were engaged going through K1 and now that we are married my husband always goes through Dublin. He stays with his parents right now as we are in this crazy period. He's never been asked for anything other than to show a return ticket. He's never had travel insurance, never been asked to show how much money he has, never been asked for an extra information at all. He even has the old K1 in his passport and even that only got a "don't stay" talk. that was it. Obviously there's always the possiblility of denial but they aren't there to make life miserable. I wouldn't get too worked up over it.

While there's no "sure thing" I would just come as prepared as you possibly can. My husband has traveled while we've had applications processing and hasn't had any issues nor has he ever been asked to present documentation other than showing a return ticket. Saying that I know there are people on here who have been questioned so the only option you have is bring what you can and hope that it's sufficient if you are questioned.

I see a lot of "touched" updates in signatures and such - how do you know when your case has been touched?

I signed up for email notification the USCIS website - but when I check my status it just gives a general "your in review"...am I looking in the wrong place?


When you check your status on the USCIS website there will be a date listed that says last updated...if this date changes/updates you've been touched.

You are able to come into the US on the VWP but under that program you are only allowed to stay max 90 days. The other thing to keep in mind is that typically you aren't allowed to be in the US more than 180 on a rolling year and you should stay out of the US as long as you've been in the US. So if you stay for 2-2.5 months and go back to the UK it's in your best interest to not try to come back before you've been in the UK for 2-2.5 months. Just keep that in mind while you are doing your planning.

Hi all,
It would probably be best if I outline briefly my situation, as it's a little complicated :help:

Basically, I've been long-distance for just over 10 years. I'm in the UK, she is in the US (IL). I have a good degree, soon to have a 2nd (with honours/a distinction at the moment).

I've tried looking for jobs and am finding that on the whole, employers are unwilling to assist with any sponsorship or visa support etc - they only want Americans.

I would like to possibly study, but the reality is that I am already in about $15,000 US in debt thanks to my degrees :blink: So, unless I can get financial aid/a bursary of some kind to pay the degree in full (unlikely), a masters, or really any qualification, is out of the question.

That leaves me with having to find a job, but it's far easier said than done. I have spoken at length to the US Embassy here and even they are strongly advising a K1.

Whilst I'd happily marry my girlfriend, the suggestion hasn't gone down well with my father and I'm not sure it would go down well with her parents. Both sets of families are keen that I have a job to already go to BEFORE i get married, but the reality is that I am unlikely to secure one due to the aforementioned reasons.

My big concern with going down the K1 route is that I get over, get married, and then find that a job is hard to come by. I am aware that I can apply for an EAD (Employment Authorisation document?) as soon as I am married, but does this limit the hours I can work and the jobs I can do?? How difficult do you think it would be for me to find work, given my qualifications? (For the record, I am a journalist/writer).

The only other option I have open at the moment is the Disney Cultural Representative Program, which I've just applied for. Basically, you represent your country (in my case, England) at one of Disney FL's resorts (I believe Animal Kingdom is the one that I'd be in if successful, although Epcot's British showcase would make a lot more sense) and then spend a year out in FL, with the possibility of a permenent role at the end. I will know if I'm on the shortlist in about 2 weeks' time or so, and the interview would be end of September if so. Any other suggestions on that kind of route? Disney's CareerStart program is not hiring at the moment, sadly...

Do I have any other options, or is a K1 pretty much my only route REALISTICALLY?

Please, if anyone can help, even if it's just thoughts or experience, it would be really welcome.

Realistically your only option without finding a company to sponsor you would be a K1 or a CR1. The thing with the K1 is that once you get here and you get married you still have to apply for the EAD which can take a few months to get. With the CR1 you are already married and when you finally enter the U.S. you have a green card hence can go to work straight away. I'm not sure about job prospects in your field. I would think at a minimum you may be able to find freelance jobs. The question is how much you want to be with your girlfriend or are you really just wanting to live here? If you are doing it to be with your girlfriend and you want to get married then either of those visas are going to be your only option to be able to be here and eventually be able to work.

After my fiancee has her K-1 approved, we will goto the US and immediately (like the week we arrive) get married and send in the next stage of paperwork. But I want to know about her restrictions (if any) about traveling back and forth from the US and Honduras. I think the K-1 is a single-entry VISA, but family situations require us to go back to Honduras for a while soon after we marry (within a couple weeks). Will she be able to travel back and forth after we are married? Are there additional forms we need to complete in order for her to be able to come and go between the US and Honduras? She will not be working in either country - but she is the primary caregiver for her three year old nephew and we can not be away from Honduras for any longer than required.

Once she enters on the K1 visa she will not be able to leave the country without having AP. In order to get AP you must file for the AOS. Once you have the receipt you can make an info pass appointment and they will determine if they are able to issue advance parole as an emergency. DO NOT let her leave the U.S. without the AP or you will have to start the process over under a CR1.

I got the same response you did followed up with one stating that USCIS says the file is en route and we will be contacted in 6-8 weeks. All we can do is wait at this point.

When I called a couple of the places local they were going to require another physical even if you only needed the shots. The health department was listed as a choice for us and there they would do the shot and not require everything all over again. I would start calling all the civil surgeons listed in your area and see what they say.

Is there a way to tell what interview dates are being issued for a certain embassy? Maybe something like Igor's list or something?

We are going through London, and I was just curious to know what type of dates they are giving out. I saw one timeline that said Oct 3rd was given a few days ago, but about a week ago I saw Oct 27th handed out. Let me guess - like many other aspects of this process - there is no rhyme or reason!? Lol

If you go to the Immigration timelines for the K1 and filter it to just the UK and then go to the column that says interview, click the little down arrow next to it...it will show you most recent interview dates given and move back. It gives you a good idea when they are being given because you can see when other peoples packet IV have been received and whatnot.

You are allowed to use child support as part of the affidavit of support. You will need to show proof of those funds such as a bank statement showing deposits and also the court order (divorce decree) showing the order of those funds. You will need to include all your children on the affadavit of support, it doesn't matter if someone else claims them on their taxes.

Per the instructions the forms should be sent to TX. Your check would have been cashed before they sent it TO california. I would be resending that paperwork and sending another check. There's no reason that they wouldnt cash your check right away.

We've had 2 interviews in London and neither time have we been asked for additional information. The first interview we brought it just in case but no request was made so the 2nd interview John didn't take anything except for a copy of some forms we submitted just in case. Which in the end we needed because one piece of paper with additional visit dates had been misplaced.

We used a lawyer for the K1 because I wasn't aware of this website, it was a HUGE waste of money. As you pointed out you still had to supply them all the information, all they had to do was take our info and put it ON the forms. When we did the CR1 we didnt use a lawyer. We did all the paperwork ourselves and didnt have any issues with it at all. I would say to a person unless they have a seriously complicated case such as an overstay or legal issues that would be a reason for denial to not waste their money on paying a lawyer.

my fiance make about 24k where minimum income for us o get visa approved is 125 % of poverty guideline that is almost 28k for family of four( my fiance ,me , and 2kids ) ryt ?
we dont have anybody to sponsor us ryt now , what we can do in this situation every day without each other is pain .
(1) she is getting child support including child support she makes near 34k and also she has some debts and use medicaid for children she owns house can that considered as asset ?

(2) one boy is 9 and and other is 6 (both are sweet heart ) so can consulate consider child support ?


(3) i come to know she using medicaid for kids can be problem so what we can do about medicaid thing ?


(4) so if she makes income 125% of poverty guideline in coming financial year then medicaid still be problem and what should we do about it ? if she stops using medicaid this year is it ok to start procedure next year ?



She can use the child support as part of her current income but she will have to show court documents where the support is ordered and also show those funds going into the bank account. Basically she has to PROVE she is actually receiving the funds.

Hello to all. I am very, very happy for all of those who are receiving approvals. I have reviewed the immigration timelines closely. Just wondering whether the approval process (NOA1 to NOA2) usually slows down during January. It is understood that the holidays will cuase some delay, but the holidays should be over by January 7 (for federal employees at least). Just wondering whether November filers can (not should) look for possible approval in January. Before anyone objects, I understand that we all have to wait. I also understand that there are many who filed before October and have not been approved. I understand that patience is necessary during this process. My fiancee would like to get an idea (optimistic and conservative) of how long it might take. Any and all thoughts on this subject will be greatly appreciated.



I am an October filer and I have received nothing yet. I was hoping this month but I too expect January because of the holidays.

I feel like a part of me is missing. I miss him so much. :cry: I am American and he is Australian. I just pray that this process will be as painless as possible. Well we mailed our paperwork 10/23/06 for a K-1 visa. We also did the paperwork on our own with the help of this site. I haven't seen Natasha since July and yes it is very difficult. But we talk everyday and we both have webcams so we can see each other. I hope that they can process just a little faster. :yes:

So I'm trying to be zen about it... I'm confident it's coming very soon!!

They have to be working on some other types of visas. When you search for K3s and CR1s etc., they havent gotten approvals either. I even had a peek at VSC (I had stopped doing that a while ago), and they're not really getting approvals either.

I haven't been in any sort of rush to get the NOA2 but it's nice to know they are being processed even if what they are working on isn't mine smile.gif Yesterday was the first day I had actually logged on to the USCIS website for quite a while. I had to put the password in twice (whoops i forgot what it was!) because it had been so long. I do think that our little window that we've been given may very well pass. I suppose for John and I it just means that he won't have to hold on to the packet 3 for as long as we thought. We are trying to plan the timing of the interview/approval with the fact he wants to get here shortly after the visa is approved but not too long before we plan on having the wedding. I'm telling ya for all the planning we are all having to do we deserve a big cookie!

I know it will happen, it's a matter of days, and Ive stressed so much about this since the beginning, because of little issues with my case, that I dont think I have it in me to worry anymore - for a while. I will admit I do check on here to see if anyone has been processed but because I've read so many things that people say they never even received an update on the USCIS website I very rarely check it. I figure if it happens to update and I get an email I'll know then! It's hard to believe it's nearly Thanksgiving already and that it's been 2 months since we submitted the application to begin with. I'm glad John is here with me for now. It would be great if we could get the NOA2 before we are apart again...we have till the 3rd of January that way! I'll will be uber excited if we could get it before then.

I haven't been in any sort of rush to get the NOA2 but it's nice to know they are being processed even if what they are working on isn't mine smile.gif Yesterday was the first day I had actually logged on to the USCIS website for quite a while. I had to put the password in twice (whoops i forgot what it was!) because it had been so long. I do think that our little window that we've been given may very well pass. I suppose for John and I it just means that he won't have to hold on to the packet 3 for as long as we thought. We are trying to plan the timing of the interview/approval with the fact he wants to get here shortly after the visa is approved but not too long before we plan on having the wedding. I'm telling ya for all the planning we are all having to do we deserve a big cookie!

HA! You have this little meditation/mantra thing going on! I'm sure it won't be long now before one of those nice people in their cubes have a box labled Kizza smile.gif I just wish SOMEONE from Sept would get approved already. There will be a flurry of emails when it happens. I'm excited for whoever that first person is!

Well, not that I don't want my NOA2 NOW, but at least we saw from August that once they start working on a particular month, they can practically go through it within 2 weeks. And we havent reached our predicted window yet.

So I'm trying to be zen about it... I'm confident it's coming very soon!!

They have to be working on some other types of visas. When you search for K3s and CR1s etc., they havent gotten approvals either. I even had a peek at VSC (I had stopped doing that a while ago), and they're not really getting approvals either.

Ok seriously??? Not one approval showing up since the 12th? What the hell is going on now? Everyday I'm checking this thing hoping SOMEONE has gotten approved. How is it possible that there hasn't been a single person at the CSC on VJ not approved in nearly a week?

At the top of the page it says Immigration Timelines. If you click on that it will bring up a page and in BOLD print it says IGORS LIST. If you click on that it will tell you the last 15 people to be approved and if you scroll down further to whatever month you filed in you should find your name as long as you've filled in your timeline. Also on that page that says IGORS LIST to the left of that it will say view timeline and it will show your timeline and the approximate date that you should be approved based on the timelines of the people here on VJ.

Congratulations on the ring!! that is exciting! I dont think it is a problem either if she doesnt have a ring at the interview. From what Ive read in other threads, it's often the case. And I know a lot of people havent "officially" proposed.
Just so you know though, they do sometimes ask at the interview when you got engaged. I say that just so that she expects it and doesnt get flustered if they do ask. (I get scared they'll ask me a question that throws me off and I'll look like Im lying or something - I've been interrogated before and they have a way of asking weird questions just to see your reaction... not that asking when you got engaged is weird...)

Yeah, the last 10 days or so have been a bummer on Igors list, but Im thinking things will pick up after Veteran's day. And I know these guys like to do overtime because it pays so well, so maybe some took files home to work on them and we'll get a bunch of approvals tomorrow good.gif Ive decided I would be stubbornly positive about this.

Wont be long now guys smile.gif All of us at the CSC have been very patient and I believe we will have plenty of exciting days coming. But... here's a little hope. I know there is a least one August filer who was approved this week and hasnt updated their timeline. So let's hope there are more.


It does suck but it's bound to get better. Like I said before...even at this rate we are still ahead of the game. I orginally planned on this process taking about 8 months...so to think that it could be finished a 2-3 months before that is enough to keep me satisfied!

I was thinking the same thing...####### nobody was approved? I'm ok with waiting a bit now that John is here it doesn't seem so bad to wait. But for all you folks without your loved one it's hard to wait. I was getting antsy before he got here. It will be nice to finally see a September CSC filer approved.

It's funny because John NEVER got on this website when he was back home. I get home from work and I show him and he's excited that our number keeps going down. He's so laid back he never gets excited about anything so it's nice that he's excited about this!
