So there I was at the store sending some money to my fiance and had a little talk with the store owner. To make the story short. He said that I cannot use the calling cards that I used for evidence. Is this true? The calling cards I'm using is call ESCANDALOS and I manage to get copies of the phone bills history just for this reason. I mean I got stacks of it here and ready to be send in with the I-129F. I even kept the used calling cards. Tell me this is not true.


Take a deep breath and don't start off the process by listening to a store owner who is clueless (does he think he's an immigration attorney on the side?)

Copies of your phone bill history from the calling card will be just fine. Don't send stacks of anything. Stick to proof of having met in the past 2 years and proof of ongoing relationship and try to relax. You have a long way to go and there will be plenty of time for worrying!!!

I knew my fiancee 1½ yrs when I filed and I submitted 7 of the significant chats (average 2 pages long each), 8 emails (average 3/4 page each, ticket stubs from my trip to see her, phone bills and several greeting cards she sent me for various holidays. She will also include the 3-4 snail mails and several greeting cards I sent her. From the advise of others in VJ, this is a fraction of what I was initially going to send her.

My fiance was denied entry into the US last month (we don't plan on submitting our K1 petition until September). He was not charged, not fingerprinted, and not photographed. It was recommended by the CBP officer that he reestablish ties to Canada for a few months, but there was no offical ban or time period put as a limitation on him. He was denied simply because he couldn't provide proof of his return to Canada. We know this denial went onto his record, so we know it will come up sometime in the K1 process.

We were thinking, would it be a good idea to have a letter included with our I-129f petition explaining the situation and our negligence (we flat out didn't know he needed to provide proof)? We also have the names and contact information for the CBP officer and his superviser we talked to, they were amazingly nice. Should we include that? The officer told us to contact him if we had any questions.

Or, would it be better idea to leave it out of our inital application and wait until it comes up in an interview?
Has anyone been through this?

The I-129F petition is not the place to present or argue your case. All they look for is if you meet the criteria to petition for a fiancee visa. Take any information you can to the interview and present it then.

Declaration of how you met in person in the last two years. This should be a single typed page regarding question 18 of the I-129F. Make sure to sign and date it.

What they are asking for is a summery of when you and your fiancee met in person within the past two years and the circumstances surrounding it. Mine began by saying how and when we met online, fell in love, and when I first proposed. Then I gave the dates I visited my fiancee and recapped the things we did and a few of her friends and family members I met and how meeting her confirmed and strengthened the love we felt. Hope this helps.

Well, I don't know what the F*#k!! happened but all the e-mails I was saving in seperate folders in outlook express are gone!! over 500 e-mails between me and my fiancee from the start of our relationship. I guess I won't be using that as evidence at the interview. I'll just have to start saving the ones from this day on. I guess I'm lucky for printing a couple of them out a while ago. I have other stuff to give her for the interview but it would have been nice to have those!! computers can be the devil sometimes!!!!

Something my instructors taught me in college: "The most important thing about computers is BACK UP YOUR DATA!!" I keep all mine on 3 different computers plus CD's.

I just got off the phone with my fiancee who just came from her interview at the US Embassy in Manila. She said the consulate and people there were very friendly. The last thing the consulate said to her was, "Enjoy your stay in America". My friends here on VJ, you are the first to know and I thank you all for your support and advise over the past eight months. Our journey isn't over, but the most stressful and trying times are behind us (I hope). :dance: :dance: :dance:

At Vermont, the application assembled into a file by people who do that, then sent to adjudication and entered into their records (NOA1) then enters the adjudication queue. The adjudicators look at files when they make it to the front of the queue and either approve or RFE.

At California, the application is assembled into a file by people who do that, then sent to adjudication and entered into their records then put in a storage box at the back of the third stall on the second floor ladies' bathroom. Sometimes they move the boxes to clean the toilets, this is known as a "touch." Once every four months, the CSC adjudicator hauls out a box to go through the files and either approves or issues RFE or, if he feels like it, tosses aside unopened. Then he glues the applications to his office ceiling. It takes three to six months for the glue to weaken sufficiently for an application to drop back to the floor. Every morning when he first arrives he picks up the applications that have fallen from the ceiling, and because they have shown the most effort, forwards them to mailroom so the applicants can be notified.

P.S. I made that up.

We filed the K-1 petition in January...then patiently waited. The reward for our patience was our NOA1. We were elated! Then we anxiously waited and waited for NOA2. The reward for our patience was our petition approval. We were ecstatic! Then we waited to hear that the NVC had forwarded out petition to the foreign consulate. When we heard it was received at the foreign embassy, we were anxious. Then we patiently waited and waited and waited for her interview packet to arrive from the foreign embassy and when it did, we were ecstatic!!! Then we patiently waited and waited and waited and waited for the interview day and our reward was the granting of her visa. By then we were so excited!! Now the longest wait; the 7-10 days it takes for her visa to arrive by mail so I can make plane reservations to fetch her and bring her to our new home and life in America. To those beginning or in the earlier steps of the visa process: The hardest part of the visa journey is not the paperwork; It's the waiting. And the reward for your patience is spending a life-time with the one and only person in the whole, wide world made just for you. :yes: God bless you all :)

Are you thinking that the limitation is two years from your "first" meeting? Not the case at all.
It is that you have met in person "within" a two year period. Last week, last month or last year. It appears you have met 9 times total within two years. Is that correct?

Hi All!

With all the approvals lately (YAY!) I'm thinking we should start to prepare for the next step. I'm thinking specifically about the need to show sufficiant income and the need to provide all the correct documents and tax returns.

I've looked at the "poverty level" guidelines, etc. and don't think those should be a problem as far as what i make, however, I have not made this wage for 1 full year yet (I was in college till march of this year) And this past year was the first year i was required to file taxes. Soooo... what's a girl to do? Any suggestions? :help:

Submit what tax returns you do have, a letter from your employer stating your income, job title and employment status(full-time?), pay receipts for the previous 3 months, and to be on the safe side, get a co-sponsor. I was in the same boat. Had my job less than 4 months before filing the petition and no taxes the previous 3 years because I was a full time student. Had my mother submit forms and evidence as co-sponsor and the consulate didn't even look at them.

Is it possible for them to work on Sundays (I really don't think so). I'm guessing maybe it has something to do with the RFE, maybe they mailed it out. WHat do you guys think?

Your letter is excellent. Some of the evidence of you two meeting is a little weak. It puts either of you in certain places at certain times, but not necessarily together. But combined with photos (date the back of them) make for better evidence. A hotel receipt with both your names and signatures on it would cinch the deal.

I met Jessica in an internet chat program known as ICQ in the late 1990s. In September of 2002, Jessica moved to Peterborough, Ontario from Dorchester Cape, New Brunswick to attend university and we committed to attempting a relationship January 27th, 2003. I first traveled via Greyhound Bus to visit her in Peterborough, Ontario February 16th-23rd, 2003. Visits thereafter occurred monthly until Jessica spent the summer of 2003 (May-August) at my residence in Port Leyden, NY. Monthly visits to her residence in Peterborough continued until I proposed on December 18th, 2003 while spending Christmas together in Port Leyden, NY.

We have continued regularly, monthly or more frequently, visits since then. Visits lasted from a single night to a couple months. Friends and family have driven us across the border at the Thousand Islands? Border Crossing, as well as driving my own car.

In the past 2 years we have spent every holiday together at Jessica?s residence in Peterborough, Ontario, including Halloween, Christmas, Thanksgiving, and special events such as birthdays and parties. Most notably Jessica was a bridesmaid in my sister?s wedding in Booneville, NY on September 2nd, 2006. I intend to marry Jessica once she receives her visa and is finished her degree at Trent University (June 2007).

Reason it's a bit long winded - we don't have a lot of concrete evidence of meeting as far as K-1 standards are concerned, we have:
2 parking tickets with date, time, his car's liscence plate number and my address on them.
1 slip from border immigration when he had to declare a gift for me.
One ATM record (mine) from his sister's hometown during my visit for her wedding.
Photos of us together at various holidays and his family functions.

We are considering staying in a hotel for a night this weekend and having both names on the reciept to help out. We are also considering:
One notarized letter from my best friend, including a picture of the three of us together at a Halloween party.
One notarized letter from his sister, including a picture of John and I together with her at her wedding.

I was wondering if there were other members here who have gone through the K-1 process and have a significant age gap between one another. There are 27 years between my fiance and I and I'm afraid we may be treated differently/unfairly because of it (already experienced discrimination of sorts at the border with US Customs because of our age difference). :unsure:

No

Just an educated guess on my part, you can apply, but I doubt it will be granted. I don't believe they will grant an employment visa to someone going through the k-1 visa process. Reason being; if (s)he is here on an employment visa and they reject the k-1 visa application for any reason, there is reason to belive (s)he will stay when the emplyment visa expires.
