It doesn't make sense to hire an attorney in India if your wife is migrating to US. They know little about what needs to be done. If you are to hire an immigartion attorney, it should be from the US. Personally, you don't need an attorney. Most people here, do it themselves. You jus have to read and read and read... Check and check and check, make sure you have everything they asked for before you send it... Signatures should be in ink. Forms should be submitted original with signatures not scanned and not xerox copy... you can photocopy them but that serves as your copies ( it is your choice ).

I-130/Bonafide marriage question

I am getting ready to file I-130 for my wife who is currently in Honduras.

One of the requirements is to show evidence of a bonafide marriage. I am

sending about 15 pictures and many letters/cards with the application.

Is that enough? Is it mandatory to send sworn Affidavits from friends?

Aside from the ones mentioned, it would also help to send them copies of your passports stamps (including the old passport if there's any) to show that you are travelling back and fort to her country.

Expedite Request

Hi guys...

I already sent my husband documents and requirements to file for our I-130. He plans to file it next month. My question is I heard that filers who has beneficiaries from Philippines can request for expedite. I live in Luzon, actually we were not affected ny Typhoon Haiyan/Yolanda since it attacked the Visayas. but are we eligible to request for an expedite? And if we file it next month, can we request it right away? And how can we request? Are we going to call USCIS or mail a letter? Thank You.

Requests for expedite is a case to case basis. If you live in the area affected by the Haiyan typhoon, you'll get it, otherwise, you have to go through the same process just like everybody else does. If I may ask, what is your ground for expediting?

Expediting Case

Hi everyone I recently made a request to expedite my case, my case is already completed and I was wondering if i did the correct thing to get a faster interview date due to the fact I am 6 months pregnant and dont want a interview close to my due date. Also if its possible how long does this take?

Normally, they send the interview letter close to two weeks from the time they completed the case. The interview date schedule is about 3 weeks from the date you received your interview letter. I am not sure about the expedite, but I do hope they make considerations...

SLEC Advance Medical - No Interview Letter?

Hi sportymom! nvc didnt send us an interview letter since we were expedited, they just sent the case directly to manila and told us to do the scheduling with the embassy. I have read that applicants can do the medical in advance even without the interview letter, they just have to present a letter from the nvc with the case number. I just want to know if the letter that they meant is the same as what i have here on hand.

If that is the case, I personally advise you to call the US Embassy before you make your trip to Manila. Good Luck to both your medical exam and interview!

Our case is now in transit to usem and im planning to have my medical exam done in advanced. However, we dont have an interview schedule yet since our case was expedited. What document do i need to bring if i dont have the interview letter?

Is it the VERY FIRST email attachment i received from nvc containing my case number, invoice id number, beneficiary id number, us department of state logo and a couple of barcodes, and instructions to complete ds261???

I just really want to make sure since i will still be flying all the way from visayas. Pls enlighten me. Thanks!

They will ask for the interview letter from the NVC before they conduct your medical exam. It is very important. You should have it soon, so no need to rush into it without your letter.

Joint sponsor has expired passport ..please help me by reading

he is a us citizen that's why h has a passport. h was born Pakistan so obviously no us birth certificate. he snt his valid voter rgist. card along with documents thinking it might help cause embassy wants to determine the status of the joint sponsor and data sheet off the passport clarifies it even if it is expired.

Your joint sponsor is a US Citizen but was born in Pakistan? Any US ID like driver's license would help. What stage of the process are you at now? Had the inteview already?

Okay sending in a DS-3032 and you have an attorney tells me they do not know whats going on. The IV Bill and AOS Bill (Affidavit of support-I-864 package) would have been invoiced together.

You have to be doggit about it. Because attorneys do not call NVC to see if anything is reviewed or accepted or if you have case compete.

Youu having an attorney cut literally 3 to 4 weeks off your time (you didn't have to wait for DS-3032 to be accepted). You should honestly barring any Checklist (mistakes) takes 4 to 6 weeks. NVC says 20 business days to review.

The checklists have been almost running 90% (people making errors). That new I-864 has been a beast.

And honestly if you get case complete in 2 to 3 months you are doing good. Than you get to wait for interview and that will be a month to 2 month wait.

Meaning you get case Complete by August month in you are in queue for October. September interviews were just announced this week.

Hope that helps shade some light. It's a wait so hang on and just focus on getting things accurate avoiding errors.

Only if the attorney will alter their normal procedures upon request of the client. Usually, they won't. The attitude is, "You hired me to manage this process for you. You don't get to tell me how to do it. That's what you hired ME for." :-)

The answer to your actual question will not be helpful to you. In an immigrant visa case, you do not simply "wait" for NVC to complete your case. How long it will take will depend on how quickly and efficiently you prepare and do your part. You will need to provide 5 separate responses to NVC. If you use the shortcuts efficiently, you can complete this in about six weeks. If you drag your feet, it can take a couple years.

the ds 3032 and i-864 bills have been received paid and returned cant say if the attorney paid the iv bill.

traveling to the US after filing form I-130

My husband has a B2 (tourist) visa valid until 2022. He lives in Brazil and we just filed the I-130. I live in the US. Would there be a problem for him to come visit me during this time? Will he be turned away at a point of entry because he's traveling on a tourist visa during the time we are going through this process of obtaining the IR-1?

My husband first attempt to send me all the required documents on 9/10. He used the Nigerian postal service (big mistake). He thought he was being thrifty and saving some money. Well the 12 day guarantee arrival came and went. After much complaints and my husband going back to the post office on two occasions they admitted during all the rain that was happening the week he dropped off mail that much of the mail was lost or destroyed in flooding waters and could not be retrieved. We lost 6 weeks on that.
So my husband gathered again all the documents (it takes about 7 to 10 says to get everything). We heard so much about DHL so we tried that. That was 11/21. This time no mail again. That was attempt #2.
So on 12/21 my husband gathered all documents the third time and this time we used FedEx. I setup a FedEx account and it was sent from Abuja. For some reason the envelope sat for a week at the Nigerian customs and finally was sent 12/27. It arrived today 12/31. And to my horror all documents were removed replaced by 5 sheets of blank paper.

We have now tried 3 times to send the most sensitive of documents to me so I can than send to you at the NVC. Who knows what hands these documents are in. And you know that in the wrong hands in a country like Nigeria someone could very well be assuming my husbands identity. They have our marriage certificate, His birth certificate, His Police certificate, his biographical pages of his passport and all the personal information about me and him and his parents and mine on the DS-230. My social security number all my personal information where I live, his moms address everything. Very upsetting this is.
It worries me very much that these precious documents are out there and we are not even finished at the National Visa Center.

First please get on phone to NVC speak to a supervisor and ask that your case be closed and you present all documents at interview.
You may have to follow up with a letter but do that NOWish.
Is there something special or difficult about your case you feel you need an attorney?
I am sorry you got such a bad one. Call now if you need help writing the letter I can help I did it and didnt have to send nothing to NVC got case complete no wahala.

we been speaking to nvc on the phone and we wanna get the docs,sent ourselves and take it up from there.

Our case been stuck at NVC for five months now, they requested more information as some docs spouse sent were missing but my attorney has been dragging the process and consistently negligent spouse intends to send the docs they requested and employ another attorney to finish the process but the few attorneys she has met are unwilling to continue from where we are and would rather we start all over again. IMO, shifting to IR-1 at the POE is useful. I do agree, coming off a 15 hour international flight, all groggy, sleep-deprived, smelly with dried drool on yer face, doesn't make for a perky camper.

However, suggest you write a note about getting IR-1 designation, put it INSIDE the passport, so the beneficiary can remember to handle this at the POE.

If they are confused, ask for the supervisor, remind supervisor to review the date of marriage
