Hi again to all... I'm waiting for my NOA1. But I live in a cabin in Colorado a little bit far from the city so I have some long delays when somebody sent to me any mail using basic or cheaps methods like US Postal Service (with no Priority or Express).

What shipping method normally use USCIS to send the NOAs, EAD, AP and green card?

I had my interview for my K visa in London, when you leave you can pay for the express courier service. They list the time as up to 10 days, but I received mine within 3. I asked the guy when I paid for the service & he said they had been processing passports really quickly & getting them out,

Okay, I've just recently learned about this 2 year rule and I have a few questions. I filed a K-1 visa in Feb of this year for my fiancee and her docs are currently in route to the German consulate for packet 3 and interview. She was here in the summer of 2007 doing a 6 month college internship and living with me. I have looked at the visa in her passport and it says nothing about being subject or not. She doesn't have a copy of the DS form. So how do I find out if she is subject to the rule or not?

We then looked at an older J-1 visa she had back in 2000 where it says right on it, " not subject to 2 year rule"

I have found this info from one of the links and she doesn't fall under any of these. She paid a private company(I beleive) to help find her an internship in the US. She paid for the visa herself, her own plane ticket to get there and recieved not government assistance.

An exchange visitor is subject to INA 212(e) requirement, if the following conditions exist:
  • The program in which the exchange visitor was participating was financed in whole or in part directly or indirectly by the United States government or the government of the exchange visitor's nationality or last residence;
  • The exchange visitor is a national or resident of a country designated as requiring the services of persons engaged in the field of specialized knowledge or skills in which the exchange visitor was engaged for the duration of their program (Exchange Visitor Skills List 9 FAM 41.62, Exhibit II);
  • The exchange visitor entered the United States to receive graduate medical education or training.
If the exchange visitor is subject to INA 212(e) requirement, he or she cannot change his or status to that of H, L, K, or immigrant lawful permanent resident (LPR) until he or she has returned to his/her home country for at least two-years or received a waiver of that requirement. You might be just fine and be issued the visa with no issues... Not saying it is a guaranteed denial... Fr one thing, We have no idea if your case has any "red flags" or other issues... You may be successful without supplying anythng, but there is certainly a higher chance you will have issues by not front loading than if you had supplied them evidence beforehand.

However, for applicants starting the process through Lagos and reading this, I certainly hope they will heed the astute advice of many of the members here and send in relationship evidence with the initial petition, aka "FRONTLOAD" to maximize their chances of a successful outcome.

Keep us posted either way... VJ can also provide great night into the re-affirm process and 212g requests if need be...

Those four categories are as valid today as they were 9 years ago, when I first heard them.  No, Casablanca is not on par with Lagos but is on the high side of high.  Accra, is about on par with Lagos now though.  Anybody who wishes to believe Lagos isn't the highest of the high in terms of the visa fraud attempts dealt with, both in numbers and percentages, is misinformed, and cruising for a rude awakening.  I have no further information to offer the OP, except to say, "Good luck."

When we have divergent views, we discuss them.  When you are the one asking the questions, you listen to the answers you get from those with far more experience than you.
 
You are not suggesting front-loading.  That's done in the "front" of the process.  What you are suggesting is "back-loading".  From all my experience, I would suggest you carry the evidence to the interview.  You can mail it if you like. Nobody is stopping you.  Go for it.  What I'm telling you is not to count on the evidence even getting added to your file, much less being looked at or considered.

You would have to assume that each Consulate had a similar cross section of applications to handle.
 
2 classic example of differences, Philippines it is not unusual for the US applicant to be male and older, North Africa the applicant is likely to be Female and older.

As a well respected Immigration Lawyer on another board said there are 4 categories of Consulate for Fraud
 
Low
Medium
High
Lagos
 
He had flat fees for the first 3, but not Lagos.
 
As for the amount of evidence and when to submit is, it does depend on the factors of the individual case. Many you see on VJ fall into the atypical category.

I might regret posting this, but I know someone who was a CO at Lagos (and at other consulates too, high fraud and lower fraud), and since I considered going that career route, I had lunch with her, discussing what it's like to be a CO.

 

She confirms Lagos is the worst in terms of scammers, and denials. 

 

But relevant to VJ people, YES,  please front load, especially K-1's, as the odds are not in your favor for K-1's.

Let us clarify one thing here:

When you say SEND it to the embassy it implies sending it through the mail or email as an attachment.

If you interpret "sending" is the same as hand carrying on the day of interview then of course you can. That is called





bringing or carrying not sending.

Any ONGOING relationship evidence, like visits, more photos and all communication that happen after your initial USCIS and NVC

submission, you hand carry (not send) to the embassy on the day of your interview in hopes that the CO will accept it,

sometimes they do and sometimes they don't, there is no rigid 'procedure' you think will work for you.

Beware, not all men get to eat after work even though they should, because the bread is not in their own hand. It is given to them

or not given, depending if the boss liked your completed work.

I bolded the last because this is left up to you to show what you deem to show. As we know the government is slow to update or change. The I-130 form as far as the co-mingling you see is directed more towards couples who live together (ie. before they immigrated or when they are going through removal of conditions). It wasn't targetd towards the new age.

 

Cuz Wham the internet revolution happened and now we have emails, and chats, and IM's and Skype a whole new world of evidence and fakery.

 

I don't know where people get you aren't suppose to send anything when that's what USCIS accepts. Sure I know a few Lagos folk who sent NOTHING but a marriage certificate and of course lazy USCIS approved them send them on their way but guess when interview time came they were ALL denied. Sent back reaffirm all but a couple (other issues they had) but still a lost of an additional year.

 

I know thats not what you want to hear you want sunshine and unicorns. Well This is Lagos. By the way they all prayed and know God.

You may have missed my previous posts ? I don't now how much clearer I can say it.

You can NOT send anything in the mail to the embassy. If you do it will not be accepted. Therefore NO I would never send anything

to the embassy.

 

Embassies don't accept regular mailings like you send a letter to your auntie ! Security reasons.

Put that out of your mind. Forget it. Focus on your interview. It's too late to 'send' anything.

 

Should you get refused and your case returned then your petitioner must  frontload when re filing, not you !

Lagos has specific instructions and then a sideline of unspoken "requirements" not comparable to the norm.

Meeting application requirements and actually being approved are a night and day different. Apples and oranges.

Your last sentence about 'every embassy is different' is what the advice was about, it was Lagos specific advice until  the

watered down "everything is ok don't worry" comments were posted and will distract from the meat of this thread.

I think you all are crazy... Or being thick headed... You have access to many personal stories of how difficult Lagos can be and how the system and consulate there works... Yet you choose to ignore it. I believe god helps those that help themselves, and right now, you are not. So if you are denied, does that mean god was not with you or abandoned you in that day?

 

but what does one do when even on VJ we have divergent views on whether the petitioner/beneficiary/attorney can send extra evidence after a case has already been sent to the embassy.

 

Simple question if you were scheduled for  your interview in lagos and you have extra evidence that came up after you had already concluded with USCIS/NVC

what would YOU do? "frontload" or carry along to interview and hope for best?

This is how I look at it, when you read the instructions provide the information
they are requesting. If you feel that the information your providing is satisfying
the requirements do it!. I did not front load my petition, So, I read the instructions
about 10 times to make sure that I was supplying the information to supplement the application and submitted it without any problems. Working for the federal government, Ive learned
that the instructions are pretty specific, if you supply the information they
are requesting you shouldn't have any problems. Because you meet the application
requirements. Good Luck! but,every embassy is different. So, check out specifics for
the embassy you will be using.

Think you are missing the whole point. Seems you guys are dead set against sending evidence that's your choice. Roll the dice and play the odds.

 

There's no front-loading after the horse has left the stable (USCIS). Your case file goes to the embassy after its processed at NVC and you are scheduled an interview.

 

The questions asked are based on the evidence presented. I have yet to hear of anyone through Lagos who was approved with presenting nothing?

 

Front-loading became a big thing for Lagos and other high-fraud countries because of how people were treated at interviews. Many complaining they had brought boatloads of evidence and CO wouldn't look at or consider. Yes many of these people like you thought no evidence was required to send with petition and all was to be brought to interview.

 

People send in extra at the NVC at times because they have a trip to add more quality evidence. And yes some find out  "OMG I sent in nothing I better do it now" which is risky because it may look like you are trying to skip over USCIS and present something they might have rejected or denied. I know of someone who was denied at embassy for that very fact but they were trying to side add divorce decree they didn't add at USCIS and other rubbish.

 

It's up to you to present your bonafide relationship however you want. This is Lagos you are dealing with which is no small thing. But it can be easy and effortless when you follow instructions and guidance of others who have gone before you and been there done that.

 

Like I said I have yet to read one person say they were approved at Lagos Consulate and presented nothing. :no:

 

 

No doubt i have followed you extensively o this site and respect your expertise on the subject matter.

 

But note that I WILL BE JUST ONE OF THOSE RARE STATISTICS that came out of LAGOS embassy without frontloading but rather took the chunk and box load of evidence to interview( approximately 14days from now) and CAME OUT APPROVED!!!

i feel like some answers have come so harsh like i am being bullied to accept the answers.

I just may be another slow learner who needs details and some bit of back and forth before understanding is instilled

 

Now i understand that frontloading isnt techicaly an "official" term as per immigration just some make up by petitioners in the visa process.

I would rather follow what the law says wait for the questions to come during interview based on what was officially sent by the immigration institutions to the embassy as at time of filling and hope the CO ask for more current evidence as per what is stated on their site then i present other than that with "everything been equal" any genuine relationship that God has sanctioned is their time to be together will be approved.

 

what baffles me sometimes is why SOME and i MEAN some  CO's still base their judgement on past interviews of genuinely sham relationships thereby jeopardizing outcomes of genuine ones
