K-1 Fiance(e) Visa Process & ProceduresI-134 Affidavit of Support question..pls help..
QUOTE (dixie2028 @ Mar 11 2009, 12:42 AM) <{POST_SNAPBACK}>
OK so I was just reading about the process for the K1, and I see that after the first NOA I should be doing the I-134 Affidavit of Support form.. I didnt think that we had to do that until after we were actually married and applying for the AoS? I'm nervous about it because I dont believe I make enough on my own according to the guides that I have seen and my parents wouldnt be able to help because they dont live anywhere near me. Any advice? Any stories or suggestions?? Please and thank you!

You can mail your family the forms and then they can mail it back to you with the proper info, and that should work.

K-1 Fiance(e) Visa Process & ProceduresHappy to see K1 approvals

I have just been looking through the site, (forums, igor's list) and I must say I am super happy to see that many people have been approved. I know for everyone, it sures seems like a long wait. Hopefully the wait is almost over for all those people who filed in July/Aug. And that the rest of us that filed later, are also up for approval soon. Happy day everyone!!!

K-1 Fiance(e) Visa Process & ProceduresFinance Interview in Canada?

Yep.  She's lucky - she's not that far off.

Just realized that Calgary's consulate doesn't do the interviews...derp....that's gonna come back to bite us on our forms I think.

Did you put Calgary as your consulate on your application? Because we sure did. It wasn't until further reading that we discovered that Calgary wasn't an option. Hopefully they don't send us and RFE for that....

K-1 Fiance(e) Visa Process & ProceduresPhotos for Interview

That's a really great idea and it keeps all the photos together in a neat and handy book that makes it easy to take with you and present. I got something similar for my graduation last year from an Irish company and they are really great because they allow you to customize them online. I'm thinking of doing the same. smile.png

Ya they are super awesome! I am going to make one for our wedding photos too. At that price I could make one for every occasion.

Good luck on the rest of your journey!

I am under the impression that the petitioner's background does matter. My fiance and I got a RFE asking for notarized copies of his police record and court records. I am not sure if his record will impact their desicion on our approval or not, but they did ask for it.

Thanks everyone for the advice. i will be going through the Vancouver, Canada consulate, and I have heard that it is a very easy consulate to go through. I have the transcrips and recent paystubs. I think that will be enough. Hope so anyway.

K-1 Fiance(e) Visa Process & ProceduresQuestion about I 134

My fiance and I have recently been approved for our K1 peition. I am the beneficiary. We recently filled out the I 134 form and we got copies of his last 2 years income tax records and about4 of his most recent paystubs. He makes about 30000.00 a year, which is quite a ways above the poverty limit for 2 people. I am wondering if that is enough. I have read that others have gotten copies of bank statements and letters from their employers. Is that required?

Beth-Ravi
Copies of travel itineraries are not primary evidence. Copies of plane tickets are not primary evidence. Boarding passes and passport stamps are primary evidence, photos are secondary evidence and are useless without other support.
Beth-Ravi,
I submitted my I-129 last November without any boarding passes or plane tickets (did not keep any of those since I did not know then I was going to marry this woman).
All I did was printing out from my airline web site my list of trips to my fiancee's country. With some pictures copied on a 8x11 page.(without any date on them) and copies of my passport.
I sent the same list from my fiancee's airline. This was accepted as evidence we met.

Now my petition is at the embassy, so my evidence were accepted as is.

My case is in NVC and I have also been worrying about that matter, my fiancee makes $13.5 thousand a year, which I think is not enough. On the other hand I have one of my relatives in the US who makes more than $50.000.00 and owns a big house. He said I can help you and grant you affidavit of support. I want to hear from you about someone other than your Fiancee granting you an affidavit of support???/

K-1 Fiance(e) Visa Process & ProceduresK1 Visa Help?!
We want to do everything in our power to get his K1 approved for our wedding and to live in the US where we are mostly settled, but if it doesn't work out we will likely get married anyway and apply for me to go to England instead, let him keep working for a few years, and then come back. That idea is less than ideal though, so looking for advice on moving this process along.

K-1 Fiance(e) Visa Process & ProceduresK1 Visa Help?!

Sounds like you have done everything you can do under the circumstances. But I will say, at least once or twice a week I read of people on VJ who have made wedding plans and made deposits on dresses, reception halls, caterers, etc... the whole 9 yards, only to have to change everything and lose thousands of dollars because they didn't wait until they had the visa in hand before they made huge wedding plans. There are so many things that can go wrong during the visa process, people really need to take the advice of others who have gone before them on this site and never put deposits on a wedding before the visa is issued. You still have 5 months until wedding time, hopefully the visa will be issued by then. Good luck.

It is not a huge wedding - fewer than 100 people and we won't lose thousands of dollars if we don't get the visa in time. What we lose is the ability to have my brother be there, which is beyond important to me. He can't get time off during fire season without requesting it during the season before.

K-1 Fiance(e) Visa Process & ProceduresK1 Visa Help?!
Hi All,

My fiance and I submitted our paperwork early July and got our NOA1 July 17th 2012 from the CSC. We waited, very patiently, and on January 7th we called the USCIS hotline and were told they were processing July 17th and we might hear something within a week.

Two weeks passed, no word, so we called again January 21st and filed a service request which we never received a response for. January 21st we called again, spoke to an officer rather than agent, who said that a response had been emailed (they spelled my name wrong for the email address) and we should receive a hard copy soon. We never received a hard copy.

We called again January 28th and were told by an agent that we had never filed a service request - despite the fact that I had my confirmation number for it - and were told they could file one for us then...so we went ahead and filed a second.

On February 4th we received a response that said, essentially, they were doing their best under budget constraints and if we did not hear from them within 120 days, we should feel free to call back. At this point, they were still telling us on the national hotline that they were processing July 17th.

We then started the process of getting in touch with our congresswoman, Diana DeGette. A week and a half later (Feb 13th), with no response from her office, I stopped by in person and filled out a release for them to make an inquiry on our behalf. February 20th they notified us that the USCIS said our case was taking longer than posted processing times and gave them a number to call for the CSC. Today, we received a response from the CSC basically saying they are doing there best under resource constraints and if we don't receive a decision within 60 days then the Congresswoman's office can make a second inquiry.

It is also baffling to me that their posted processing times indicate they are working on cases from July 18th. Which is after our case was submitted.

At this point, we are lost. We have planned a wedding for August 2nd and when we made that decision, we prepared to have a courthouse wedding before if the process took less time than expected, but we didn't make plans for if it took significantly longer. My older brother is a Midnight Sun Hot Shot (elite wildland firefighting crew) and had to give notice last fall in order to get time off during the fire season to attend the wedding, so besides the serious loss of money from deposits if he isn't approved in time, I also won't be able to have my brother at the wedding.

At this point, we have been waiting 7.5 months for our NOA2, our application has not been 'touched' since it was submitted, and people with NOA1 dates in August are getting their NOA2s right and left. Of the last 50 visajourney applications approved, only 5 were before our date and one shared our date. 12 of the last 15 to get approved at CSC had NOA1s in August or later.

Is there anything that we can do? Any recommendations? I know that everyone at CSC is antsy and impatient, but it is brutal seeing all these August and September petitions getting approved and even more upsetting knowing the across the board budget cuts are bound to make the process any slower....

Any help would be greatly appreciated!

Yes I believe miracles do happen. Thanks for the input!

As someone who is 10 days away from 8 months after NOA1 with the CSC not having even looked at the petition, I would say that believing in miracles is a great thing and also that you will need one if you are to get married by June. We applied in July 2012 and are hoping to get married the coming August and things are not looking like they are going in our favor at the moment.

K-1 Fiance(e) Visa Process & ProceduresK1 Visa I 134... No tax forms, no income!
Thanks guys.

Well, I can file now for the last 3 tax years here in the US.

Looking into the CR1, it seems like the better option. I have had an FM3 for the past 3 years in Mexico. I believe that makes me eligible for DCF???

As I see it, I can file taxes here, marry there, apply for CR1 via DCF there, use a co-sponsor, and go for it.

Jay, you mentioned cheaper... I see that the CR1 filing fee is about $80 more. Would the rest of the process be less? Also, we're much closer to Mexico City than Juarez. The travel time and cost could be saved if all this could be processed in Mexico DF.

Cheers!

K-1 Fiance(e) Visa Process & ProceduresK1 Visa I 134... No tax forms, no income!
I'm going to try and make this as quick and to the point as possible, but it seems to be a complicated topic.

I have been living outside of the US for about 10 years. I've been back and forth to visit, but have only filed for taxes once in all that time. It was brought to my attention recently that I was responsible to report all income (as a US citizen) regardless of where I lived and made money. It's a little late for that now.

Currently I'm living in Mexico, but visiting the US to kick-start the K1 visa process. My fiancée is Mexican and we have been living together there for about 3 years. Now we want to move to the US, get married, and make a life here. I'm 35 and she is 31.

I have no income to show for. No paper trail, that is. Nor does she. We've been working in tourism and getting paid cash. I have a little savings in a Mexican bank account. I have no tax returns, W2's, or anything tax related to show for the last 3 years. I CAN file for 2012 now, but I don't know what I would claim. 0's and unemployment, maybe.

I do have plenty of friends and family who would be willing to present co-sponsorship. I can pick up work in the States if need be, but I prefer to file and return to my work, fiancée, and life in Mexico. She has already been offered a job here in the US once we arrive.

My question at this time is: Can anyone recommend that we follow through with the K1 filing or would it be smarter to get married in Mexico and file for the Spouse Visa?

I've heard the K1 is quicker. Of course, we want to take the quickest, least complicated, most successful route. Money IS an issue. And we hope not to waste time. Personally, I would prefer to marry in the US.

Thank you for taking the time to read and respond.

I received an email from USCIS on 12/08/10 with a receipt number and notification that our K-1 paperwork was sent to the California Service Center. I tried to go to the website (https://egov.uscis.g...ectusertype.jsp) enter our case with the 13 digit case number I received in the email but it sends me an error and says that no case exists with this number. I just talked with USCIS this week to change my address so I know they have the case...I'm totally confused.

What should I do?

I wanted to thank everyone for replying to my post. You have helped a lot, as well as other newbies. I apologize to anyone I may have annoyed as well. I am a firm believer in understanding potential outcomes and avoiding pitfalls, before going forward with the process. Sure, if you are in your 20's or 30's you have the luxury of time on your side to recover from mistakes (as well as lots of time to build a relationship before submitting paperwork). It seems for most of the guys on this forum, their girl is already in love with them (which makes everything easier because she is motivated for success too). If my girl were here, I am confident she would fall in love with me. She has already told me she likes me very much and believes I am the one for her. Thanks again. My best to all!

Dear Readers,
I am trying to find people who have been denied fiancé visas due to insufficient communication exchange. My biggest concern is frequency of communication exchange from my girl and more specifically, e-mail (or lack thereof).

Have you, or do you know someone, who has been denied issuance of the fiancé visa due to insufficient number of e-mail responses from your girl?

Does anyone know how heavily the reviewer’s look at frequency of e-mail exchanges or communication in general?

If everything else in the application is “perfect” except there are very few e-mail responses (one every 5 or 6 weeks), will they deny the visa? Has this happened to anyone?

Thank you.

They may its very subjective, how many visits have you made during the process ? phone records, letters ? remember they are looking for evidence of a ongoing relationship, so they look for all these things.

QUOTE (Nini & Bee @ Oct 18 2007, 04:01 PM) <{POST_SNAPBACK}>
Sorry, wrong phrasing. I know that K medicals don't require the vaccinations to be done at that time.

What I have heard though from the boards is that there are some panel physicians who have asked that vaccinations be dealt with prior to the POE and AOS process. I know from my experience that I was asked specifically to have proof of being vaccinated, or they would do it at the medical exam (for a fee). I'm sure that if I'd asked to defer the vaccinations until I reached the US that I would've been able to, but seeing as how it was free with my own health insurance I didn't see a reason to wait.

Moving on...

Yes and you nailed it with the "they will do it for a fee"
