I changed my name mid way and labeled the petition this way:

LEGAL LAST NAME (NEW LAST NAME), First name

and they have honored both names for me. They have sent all of my docutments with both names listed.

If you are already married, and your spouse came to the US on a tourist visa with the intent of immigration and marriage, then he/she should return to his/her home abroad, and the I-130 should be filed with the relative outside of the U.S to avoid deportation or denial. (Better safe than sorry)

My fiance/fiancee came to the U.S on a tourist visa and we intended to get married and for him/her to return home afterwards and then immigrate from outside the US. Does this mean our petition will be denied, and is what we did illegal??
No. It is perfectly ok to marry in the US on a tourist visa as long as the intending immigrant returns to his/her home country to file the I-130, and does not try to adjust his/her status and remain in the US during the I-130 process, as that is illegal.

What's odd is that ours both approved on the same day and they pushed the K3 through. I am so irritated by that because we were not notified and I would have rather pursued the I-130 an abandonned the K3. I am trying to see if there is a way that we can obtain the CR1 even though it is unlikely. We want to be together sooner, but we were less educated in this in the beginning aas to what it meant. Either way, Loke and I will do whatever we have to do.

However, I did get her to tell me that my I-130 was approved in her system because I told her that I already knew it was approved and the NVC said they hadn't received it yet and I advised her the approval date (my last touch) that was the same as the other touch and she did confirm that I was correct. Either way there is little we can do about it now.

I actually talked to the immigration officer twice on obtaining my NOA2 because I am freaking out about adjusting my husbands status and not having the right paperwork and the lady told me that she didn't understand why people were filing for K3 because if the I-130 gets processed before the K3, then they will only forward that one to the NVC and abandon the K3 (which would esentially be a waste of money - processing fee)

She also told me that because my K3 was processed faster than my I-130 (even though they were both approved on the same day) the USCIS will hold onto my I-130 and process the K3 instead. If the K3 is sent off to NVC then the USCIS will hold onto the I-130 and you will have to pay them $200 to forward it and even then, your K3 will still beat the CR1 and you will again be wasting money.

She said that the cost difference is really not that high because the K3 blobs all the fees and fines together as opposed to the CR1 that has each party pay a fee. Essentially it all adds up to the same amount because we are paying for the same forms to be processed just in different ways. She told me that the difference is around $200.00 and if I pushed my I-130 through then it would end up costing the same amount due to fees and then we would spend even more time apart as well.

She told me that I should stay on track with the K3 and the fact that the I-130 is already approved only means that they can adjust my husbands status faster.

We have a very common name...too common, but we were very detailed in our paperwork and we followed every checklist and added even more than what was required. It was all kept very well together in a binder so that no loose ends could get lost. It has not caused us any problems so far because once you file, you are no loner a "smith" or "Jones"... you simply become a case number. When you e-mail the consulate, always head your subject line with your case number and always put that in the body of your e-mail as well. This will help them to establish exactly which case you are at all times despite the name. I hope this helps you some.

The USCIS will process your I-130 first and send the petition that is approved first to the NVC. They will not send more than one petition to the NVC for a case number at any given time because they are only allowed to issue a certain number of visa's per year. This is why all unpassed interviews get sent back to the NVC (So they can re-issue the visa number to someone else) If your I-130 has been sent to NVC, then you and your spouse will each get a packet of instructions, just fill them out and send them back and you will be fine. The USCIS will not forward your K3 unless you request them to forward it because they approved your I-130 first. I only know this because after about five calls to these people a day, they finally gave in a little and let me know the basic process and reason (I was asking them how I can process my I-130 instead of the K3)

Yes true true. Be sure to follow the rules to avoid a 10 year penalty dear. You can come on a visitors visa through the waiver program but you cannot extend your stay or it can be big troubles.

Thank you. I have another odd question. On the I-864 it says that your assets have to equal 3 times the difference between the poverty guidelines and your houshold income. My household income already exceeds the 125% of poverty guidelines, but my assets do not equal 3 times the difference. Is this only relevant in cases where they are using assets in order to meet poverty guidelines? Or do I need to meet poverty guidlines and have 3 times of the difference as well?

On my husbands checklist in packet 3, it askes only for the I-134 Affidavit of Support for the K3 Visa interview. I also e-mailed the consulate and asked them and they said that he should bring that to the interview with him.

Now I am looking at the requirements to change his status so that we can hopefully get that in before the rate increase. The change of status calls for the I-864 Affidavit of Support as well. Should I just send them both since I have a duplicate copy of the I-134? Why do they need both? Does the Australian Embassy keep the I-134 without forwarding it?

Am I over thinking this?

His interview is 10 hours away and I am so nervous. I tossed and turned all night. He flew into Sydney a couple of hours ago. He landed safe, but they lost his check luggage, but they brought it to him so he has it. His interview is at 8:00 am Aussie time.

I just know that yours will come soon and I will remember what you have done for me during my time *hugs*. I know that each day is like a year and that the pain and suffering to be without your loved one is so hard, but remember that this time will pass. The government will touch your petition soon. Yes Loke has already booked his flight from Melbourne. He will hopefully pass the interview and get the visa. I am excited!

Kimm - You are not far from us. Things will go your way and soon you will hear something. We did not even get notice of our approval until it was already at the NVC and perhaps the USCIS is just behind on the NOA's but that does not mean that the petitions are not being approved and sent off. I am proof of that! They never did update the website for us either and we never got e-mail notification. Keep checking your mail!

No you don't need the NOA2 unless you are adjusting status (And even then, you only need the NOA2 for the I-130 only) You can use the letter that you got from the NVC stating that they received your approved petition... well that's what I used and it worked just fine. He was approved before my mail even came that day lol. Even if you do not get the NVC letter, then it is still okay because the embassy already has your approved petition and therefore they know it is approved. So if you get packet 3 in the mail.. just run with it because you are approved.

mamalovedada - Please call USCIS to see if theky have held onto your I-129F. if you filed for the I-129F too late, then they will process only your I-130 and you will be waiting endlessly. Call them to enquire about it. For some reason I-129F cases that are not received in time to be paired up with the I-130 are stuck in some sort of limbo.

You need to let them know that you are no longer going to pursue the K3 or else they will hold your I-130 at CSC until the K3 arrives. You must ask them via, e-mail and also request with a letter, but if you do not let them know then they will sit on it while they wait for the I-129F.

The divorce decree is just the document that the judge signs stating that your divorce is final. The settlement is basically the separation agreement between assets and stuff like that. My divorce decree was two pages long whereas the settlement is quite a lengthy book.

You are just looking for certified evidence of the Disolution of Marriage and if you ask the county clerk in the courthouse you were divorced in, then she will let you know what it is that you are looking for.

regarding copy of that when medical exam is done the reports are sealed , u cannnot open them and then u have to submit to vfs ppl and then they transfer it to consulate ppl and then consulate ppl gives again sealed packet and that is supposed to be given to immigration officer.
i did the same thing

Actually you are right, but Loke just asked the lady for a copy of his and they gave him one. Maybe Australia is different but you have a right to obtain a copy of the medical report before they seal it. I know that we did anyway.

I think that we are finally picking up some speed at CSC now that they have gotten all those H1B visa's done. They slow down and speed up based on how many petitions are being filed at any one given time. This means that the more people filing, the longer it takes.

I know that it seems to take forever, but try to pass the time the best way you know how. There may be a day when your timeline looks like mine and you are saying this to someone else as well. I remember so much ache in my wait and knowing that my husband touches American soil in 5 days makes every second of misery worth the wait.

Well it's up to you, but if you are looking for speed, then you should just pursue both of them as they come until one of them works out for you. You may have filed your I-129F late and the I-130 was not able to be paired up with it at the USCIS, if this is the case then they will send your I-130 directly to the NVC and you and your spouse will both get a packet of instructions.

Check out the guides above and weigh your options. You can file a K1 Fiance visa or you can go the K3 or CR1 route, but every situation and individual need is different. You should look at all your options before you choose.

If you marry in Egypt, it will have to be a legal marriage that can produce a certificate of marriage. You have to have the certificate in order to proces a K3 or a CR1 visa.

You can do any type of ceremony you want for your own purpose, but you would need to have a legal marriage document as well. You should also follow what monnik has said and ask your fellow Egyptian/American couples for advice because they would know best in regard to that country.

The most important thing is that she can answer all the questions that they ask so test her on it and have her memorize stuff about you. The best thing is to look at reviews that others have written about their interviews at the manila embassy. We learned so much from those on how our interview would be.

You are a "legal" citizen according to the law... he is not... all you must do is speak the truth...he is not legal until he is made legal through immigration law. File your I-130 to do this and go through the process. If you are legal and you both can prove binifide marriage then it's nothing to worry about.

ok so you have a green card because of your parents right? If you have citizenship you are still registered with an INS so you should state that on your paperwork. He is not a citizen and does not have an A# but he will be givin one upon point of entry. List N/A for him and list your INS number for you and it should be fine.
