According to the other posts a page back DCF is starting to look like something is happening. I havent personally looked too deepy at DCF, but I hope it comes back in an even better way for you guys because you guys deserve a chance to be together and fast!

Loke and I have been reading what you guys have said and we are tossing a lot around. We are going to take a longer look at this over the weekend before we determine what is best for us, but I think we may stick with the K3 route because we can do a lot of the paperwork together when he gets here. It may really just fall into the question of "Will it hinder our life in any way if we choose one option over another?"

I kept copies of the first ones. It does not specifically state that I need to send in originals, but I am worried that the copies may not be honored. I was going to send those in with the original signature on the actual 129F petition. Do you think that will be alright? Also I was reading this and it says that I should notify the consolate in Australia, but I am reading in other places that the USCIS does that. I would assume that because we were married in Australia, then the marriage was recorded into their system there, but do you recommend that I send in some information to the consolate to ensure that they are aware of the petition? Is that an added step that possibly won't hurt?

We got married at Airey Inlet off the Great ocean Road on the beach at 10:15am on January 25th. our wedding was so sentimental. We called it "The 25th Hour" because it represents the Time Out of Time - The place you can be no matter where you are. It was beautiful and wonderful and I just loved Australia so much. I hope to go back there someday soon.

I know that one of the differences with DCF is that I would have to fly back to Australia for the interview.

The cost to fly to Melbourne from Colorado is a lot and I wanted to do the DCF but the reality of me getting off work and being able to afford the flight there and back another time would have hindered me. I am a mother of two and Loke is in Australia so its harder for me to get there. He is coming to visit me soon I hope. He is trying to get the time off of work to make the trip.

I am not too bothered by him having to file for the change of status when he gets here because at least he will be here and it will be easier for us to do it together. I figured that we would do that pretty much straight away while we are still in the paperwork mode. Then when it's all done, we can kick back relax and grow old together, but when the kids are grown we will have to go through it all again when we go back to Australia.

I don't know lol I have never done this before. I was just so paranoid of everything being right and we don't have the money to keep trying over and over again or anything so it is important for us not to get denied and have to start over. I had people notarize the affidavits because I am freaking out about them saying that we lack enough proof of our relationship or something and I wanted the documents to be seen as legit to the government, but the reality is that I don't know ####### about what I am doing here lol. I am just trying to take any added extra steps that I can. i should have thought to send in some regular photos or IM conversations or e-mails or something I don't know. I do know that once I am done with this I will try to help out others that are in my position right now so they feel less worry. I just know that we are going to be ok. You guys will make it. And really... if they don't know who it is in the photo then what the hell are they doing working for the government lol. Thank you for the laugh. I really needed to smile.

I sent mine priority express post and I paid for them to have to sign for it. I tracked the package on the website and requested a proof of delivery and a signature of who signed for it. Because it contained so much important documents, it meant a lot to me to know the details in case it was lost on who touched it. Now the package was fairly expensive to send, but it was laid out nicely. I had it in a 3 ring binder with deviders and everything. We didn't send all of our IM conversations and stuff, but we did send in about 5 or 6 sworn affidavits that we had everyone notarized before they signed them. I thought the main proof of the relationship was done during the interview and that we only had to send one or more items of proof with the petition (according to the directions on the petition) I hope I didn't do it wrong. I am already so paranoid. I forgot to write our names on the back of the phots so I hope that wont mess anything up either gah!

YAY I can actually help someone!

I am in Colorado and a Denver Native. Now if you are going to the Springs, the you should bring winter clothes, but Colorado demands layers. One day it will be 30 degrees and that same afternoon can warm up to 75 degrees and then drop to below freezing. Bring things that are easy to wear in layers so that you can peel off and add when you need to do so. One of the wonderful things about Colorado Springs is Pikes Peak. It is huge and beautiful and one of the most amazing mountains in Colorado. The good thing is the beauty, but it snows onto it and the wind blows cold air off the top of that. If you hate to be cold then I would make sure to pack some warm stuff.

I am so glad that you will get to experience the beauty of it, but if you are from Australia just take note that your cold and our cold are very very different. I hope this helps some.

If you are truely worried about your birth certificate, then you can acually order a certified copy. I ordered 3 of them in case I would need them anyway. It shouldn't matter that they wrote on it, but you never can tell with the government. I know that I am very paranoid so I made sure to have mutiple copies that are all certified in case I had to send off originals to multiple locations. I wish I was more help, but I just started :(

I am getting ready to submit the petition this week, but I wanted to see what you guys thought on a name change first. Now I have two certified copies of my marriage license and I can send them both off at once, but I am afraid that it may hinder or help me and I really have no clue which way it would be. My name is Rings and I am new to this forum. I was invited here because Loke is in Australia and I am in the USA. When I file the I-130, I was supposed to send it to Nebraska. I was going to mail our petition on monday, but I have been scanning this thread and I noticed that there are some issues and I didn't know if they pertained to us or not. I am at work and I do not have much time to go through the posts all the way until I get home later on tonight, but this has caused a panic inside me and I need to know.

Are they recommending that we do not file the I-130 until Sydney is all straight? if I do file it Monday like I planned do you suppose it would get caught up in the hangup? I am so worried about this. Any advice would be so greatly appreciated.

If you want the child you need to listen to these people. You must establish your parental rights in a court of law. You need a family attorney that can file for a custody agreement. Has this child ever left the country? If not, then the child probably does not have a passport. I doubt she is leaving America she probably used you to get here. She is not likely going to leave, but if you want your rights to that child then you must file for custody. You must establish that you are the father by law and you must do this fast.

Well there are a couple things that can change the dynamic of this situation so I am going to try to help you the best way i can here. If the child is yours and you are listed as the father on the birth certificate, then legally you have parenting rights to the child. If you are not listed as the father on the birth certificate, then you have no legal rights to the child unless you can establish paternity through DNA testing.

If she does not marry you within the 90 days then she will become an illegal immigrant, but because she has a child that is a US citizen then I am pretty sure there is something that she can file certain documentation allowing her to stay simply because she is the sole guardian of the child... unless she is not.

What I mean is, if you can prove that you are stable enough to care for the child then a judge may grant you full parenting rights and ship her back to her own country. If she takes the child to her country then it's a felony I think because that would be kingnapping a US citizen and that's something that can get her into a lot of trouble. Thats a federal offense.

I would wait the 90 days, turn her her in to ICE especially if you know where she is, obtain the phone records from her family because then she can be traced and file kidnapping charges against her if you are listed as the father on the birth certificate. If you're not listed as the dad, then file the kidnapping charges anyway and request DNA validation in court. If you wait out the 90 days then they will arrest her when they find her because she is illegally here. You can propbably even file kiddnapping now and she would still get arrested if they find her.


I don't know these are just my random thoughts. You can also call a lawyer for fathers and get advice with a free consultation. If you are the father they will fight for your rights.
