Thank you Rings , i think the same way , and i am here because of my Husband i love him and i wanna be with him and that was the only way for us to be together his Job made it impossible for him to move to Germany so i gave everything up on my part to be with him , i don't think that is the wrong reason and i haven't regret my decision , not that i have to explain myself but maybe it helps others not to ask stupid questions about my opinion again , still this person who asked a Question like that should check very carefully why she is here in the US , that question says everything i would think .

It's late and I could very easily be confused due to lack of sleep BUT ..

She said in her post that she got her conditional green card in August of this year; so that means she has already filed AOS .. she cannot file to remove conditions until 90 days before her green card expires and that will be May of 2011. The rest of the advice about collecting evidence sounds right though.

I believe that the answer she was looking for is, yes .. you can stay at least until your green card expires at the very least.



A conditional greencard is a 2 year greencard based on being married, she cannot file AOS until her divorce is complete. ie: she needs to have an actual divorce decree (legal documentation) she may have adjusted her status, but she still needs to remove the conditions of that status (ie: her 2 year to her 10 year greencard) If she files for divorce and the divorce goes through, she can immediately file to remove conditions prior to the 90 day requirement of married couples. She should file immediaely after her divorce decree is in hand despite that 90 day requirement of married couples.

They extended your 2 year conditional greencard to wait for your removal of conditions and they are processing your case. You must concentrate on proving that you had a valid relationship and that both of you were "merging" your lives. You need to have the documents. Lease, credit cards in both names, anything that shows the USCIS that your relationship was real and you entered it in "good faith" of staying married. You are required to show them that you are not here to get a greencard by fraud and that you married with good intention and you were in love and it just didn't work out. Showing that you both singed a lease or had shared debt, utlilities, medical bills, etc... you have to show the USCIS that you were together and it was legitimate. Proving you entered in good faith is the most important thing when removing conditions.

Even if you are divorced you must prove to them the validity of the relationship so yes you need these documents

You can actually go back and file a change on your taxes and update them. it's normally a quick process but the form cost like $100 to file. You should call the tax people who did your taxes (Their names will be on your forms) and inquire about it. It may help you out!

If you already filed just wait for the RFE (which I don't think you will get) you have a good amount of evidence! Awesome you will get your 10 year soon! I am so excited for you!

Thanks. I filed the l-751 based on marriage in good faith/ divorce on 9th Sept 09 and received the NOA (I-797) 1st Oct 09. My question, if I still need to submit the documents their asking for. Below are the documents need to submit;

: Lease of joint tenancy
: Joint mortgage agreement and/ or property
: Joint ownership of asssets
: Tax returns
: Birth certificate(s) of any children born from the meriage
: Joint policies of life, medical and/ or car insurance



Yes you still need to prove you entered the relationship in good faith and that you were merging your lives.

They need you to prove that your relationship was real. You have to prove the validity of your relationship. You have to show them documentation that you entered the marriage in "good faith" and it just didn't work out. You have to show them that you were "merging" your lives together. Joint banks accounts, joint credit cards, medical insurance, renters insurance, anything with both your names on it, leases, affidavits from family, friends neighbors... anything that can prove that you were both married and you are not here to commit immigration fraud because you entered the marriage in "good faith". You have to prove to the USCIS that you did not intend on coming here simply to get a divorce and get your greencard by marrying a US citizen.

If you have submitted all of this then you are fine. If something is missing, mail it to them and also bring a copy with you for biometrics as well. It's not an RFE, it is a notice stating they are taking action on your case and you will be receiving a biometrics appointment letter soon. Get your documents in order. Make sure you have everything on that list there. Don't worry it's just a processing letter to confirm they have received your documents and they are processing your case. *hugs* smile

If you get divorced and you have your "divorce decree" then you can simply file your I-751 without the waiver. Just file based on divorce and make sure you have the evidence I stated above. You have to be divorced to file this way and you MUST have your divorce decree.

Do not forget that entering the marriage in "good faith" and the proof of that is something you MUST have!

You can file even if you are divorced, but the burden of proof is your responsibility. What I mean is that you have to prove you entered the marriage in "good faith" and not without intention of gaining a Greencard. You will have to prove that you were merging your lives by providing USCIS with copies of your lease that show you lived together, credit cards in both names, medical documents in both names, insurance documents in both names, etc... you have to show USCIS that you came here and intended on sharing your life with this persono and things just didn't work out.

Awe thanks for asking. I am well. I have not filed yet. Not till October 28th, but I am like a mad woman gatering evidence already. There is no way in heck that my baby and I are going to fail if I have something to say about it. I will march all my family, friends and neighbors right into court with giant picket signs hahahaha. BLAB AWAY I AM HERE TO HELP YOU! First they will send you a letter stating that they have received your removal of conditions and they are processing it. That will take a load off your back. Then if it get's close to the time of expiration, call them. If you have valid information that you sent them, they will not send you an RFE... you may even be approved without a interview! Wouldn't that be exciting! You still have to do biometrics, but wait a couple weeks... breathe... let them process it and give them time. I know it's hard not to worry, but time is all it takes. i will be here with you the whole time *hugs*

Thank you all so much for your advice. I think that at least if Loke gets these things lined up and appointments made, then we should be able to have all of it done and ready before they expire and it will make us both feel as if we are doing something more.

NAME CHANGE
- I actually know about this because I am doing it at the moment. I am in Denver, Colorado though so I think it may be slightly different depending on where you are. I actually had to change my social security card first. They require all original documentation in order to do it so you have to make sure that you have certified copies of stuff because you may need it for the immigration process and the social security office can hold the originals for a couple of weeks. Once you change your name on this, then you can change your drivers license, but it is a waste of 4 hours at the DMV if you have not changed your social security card first. After these two major things, then everything else is easy and most people do not require proof (bills and stuff) as long as you call them and tell them you got married and you now have a new name. You will want to change it on your post box as well, but also keep your other last name listed as well until things slowly turn over. All that you need to change your information is the marriage certificate and the social security office honored the Australian marriages certificate for me, but I did also provide them with a certified copy of my divorce decree as well. I hope this helps you out some.
