It takes about 3 days for the case to arrive at the embassy. So send them an email on Friday or Monday of next week to find out if they have it. If they do, they will send you the K Visa Instructions Package via email. Just follow the instructions on how to register on the link provided, pick your DHL destination, pay for the visa and pick your interview date. If you hurry, you might be able to make your appointment for August.

But wouldn't it take longer than that? Maybe my understanding is wrong. I thought that:
1) Processing center approves K-1 and send you an email (like the one above) telling you that they have approved it.
2) Processing center mails your approval packet Visa and approval documentation) to NVC (timeline 1-3 weeks for NVC to receive and process this)
3) NVC mails your Visa packet to Embassy (timeline 1-2 weeks for embassy to receive and process it I guess??)

Now after all of those steps the embassy will have the packet and an interview can be scheduled. Am I misunderstanding what occurs? Thanks because I'm in same boat as the OP - my NOA2 email arrived Jul 18.

Hello and congratulations. We didn't wait any time. I called the NVC to get our MNL# after about 3 days. With the MNL# we tracked the package (DHL) and had the interview set up to coincide with the physical.

We had the interview physical and completed before we ever received anything stating the package was in Manila.

So once I am able to get the MNL# (which I assume is a tracking number) and I find that the package is at the Manila embassy, then I can schedule the medical and embassy interview - is that right? And I heard you can schedule the medical 3 or 4 days before the embassy interview to avoid 2 flights to Manila - is that your experience also?

Once her status is adjusted, she has her green card , she can get a SSN. You do not need a SSN, for her, to claim her as a dependent on your taxes if that is why your asking.

Thanks. But she will need an ITIN (individual tax id number) to be claimed as a dependent on taxes. To get the ITIN you fill out IRS form W-7, and physically submit a paper copy of your taxes along with her passport. Or you physically take the W-7 and your taxes to an IRS office and they verify her identity using passport. Then your taxes are processed along with the W-7 and an ITIN for her is created.

My question is - on the W-7 form they ask for a K-1 ID. I'm not sure what to enter in that field.

Technically she came here as a K2? Also, babies born here can get a SS almost after birth so I do not understand what you mean by "too young".


Yes, she came here as K2 but K2 is not really handled separate - it's always just a part of K-1 for processing.

As for too young, you can't get an ITIN when you are young -you have to wait until you are old enough to file for EAD (permission to work).

Anyway, the original question still needs an answer if anyone knowledgeable is able to answer it please?

We need to file Form W-7 to get an ITIN for our daughter who came here in October 2012. She is too young to get an SSN so I'm filling out form W-7. Box 6c asks for "Type of US visa (if any), number, and expiration date"

So I can list K-1 and expiration date of 1-17-2013 as type and expiration. But for number - any idea what I list? Our MNL?

Thanks Trailmix and txladykat. Since my job allows me to work from where ever I am, there is no point in getting a letter from them, but I can bring proof of my apartment lease. Is there other proof I can bring as well? I guess I was thinking of saying I was visiting my girlfriend because the second I say wife, it triggers a whole new level of questioning, etc. But they will see in the computer that we have started the CR1 process correct? Regarding the 6 month limit, is there a limit on the number of times you can go? I usually go every other month for up to 3 weeks at a time. Is that six month limit cumulative over the course of a year or is that just per visit?

Greetings all!

My wife and I were happily married last weekend and thus begins the long journey of getting her here to the states. Quick question, I noticed on the form G-325a on both this site and the USCIS site says it expired on 5/31/09 at the top of the form. Am I interpreting this correctly and if so, is there a newer version to use?

Once we submit the first set of paper work and get the process rolling I have a few more questions:

It's my understanding that it is pretty difficult for her to come and visit here, but I can go there (Canada) correct? We were planning a trip to Mexico in September and if she had a layover here for 2 days is that an issue as well? Is there a limit on the number of trips and or length of time I can visit up there in Canada? Do I need to disclose the border guards that I'm visiting my wife? My job is pretty flex in terms of location as I've been going up there every month or so and staying for about 3 weeks each visit. We are definitely very fortunate in this regard!

We are both also looking for jobs in one another's countries in hopes of being sponsored on a work visa. If one of us happens to find a job once this process is started, it doesn't matter correct? My understanding is that once process does not effect the other.

This is a really great site and I'm so thankful to have found it! We appreciate the input!

The address bit is a little tougher. USCIS will sometimes handle it appropriately, sometimes not. As for the name change, if every single one of your documents lists the changed name, use the changed name. I'd include the birth name in the "other names used" box (#7) on the I-130.

How did you get them to change your birth certificate? I was under the impression that barring a typo by the registrar reported immediately, your birth certificate is set in stone. After all, it's a register of your birth, not a name assumed years later.


I thought I was the "petitioner"? Isn't my wife the beneficiary and did you mean that the other way around?

I'm reluctant to put my other names used as won't this then be cause for an RFE? Perhaps I should just go ahead and provide the court documents of the name change.

As far as my birth certificate, I went down to the health dept, showed them the court record of my name change, and they issued me a new certificate with the updated name. It was that simple.

Had another question about changing addresses and/or jobs once we submit the I-130. There is a small chance that I may move in the next few months due to financial circumstances. My wife may also sell her condo in Edmonton and move in with a friend or relative. She may also change jobs in the coming months due to personal reasons. Once we submit the I-130 with our current jobs and addresses, is it a big deal to then change employment and/or addresses? Do we need to submit additional forms if this happens and what are they?

I realized another issue when filling out the G-325a and I-130. I had my name changed (when I was a minor) simply switching my first and middle names. All documents I have to date including birth certificate and passport, DL, social security card, show my new name as it's been since I was 14 years old. There isn't any reason to put other names used on either of the forms regarding this is there?

Wow, if only the rest of this process was so fast....They said she doesn't need to worry about the Police certificate from Korea and she doesn't need to fly back there. The person signed the email OP2. I have this for my records now, but do you think it's important to get a name as well? or is the OP2 sufficient?

So it looks like the Alberta Motor Association issues them, but they are pricey at $36 a piece. For the DS-230 form, how many actual copies do we need? Right now, she has this little ID card that's really basic looking and she says that's all she has ever had. Hello VJ'ers. Have a question regarding the medical exam. It states:

Applicants treated or hospitalized for psychiatric or mental illness or alcohol or drug abuse must present written certification, which must include the diagnosis, duration of treatment rendered, and prognosis.

At one point, my wife did have a bout of depression and was seeing a therapist. I imagine that this would then count? So she needs to obtain a statement from her therapist for the diagnosis, treatment and prognosis? What have others in similar situations done?

We are now about 1 month in since filing our I-130 package and were curious about something. If my wife came to visit and stayed for a longer period of time, say 3-6 months before our final interview in Montreal, will this negatively affect the process at all or be a concern? She was able to visit just this last week and the border guard gave her no hassle at all other than asking to see the NOA 1 and how long she was staying. I guess if she planned travel here and said she was staying for let's say 3 months, the guard might have more problem with that? She can show proof of a lease agreement as well as employment since she can work from abroad, but again my main question is will her longer stay here affect our CR1 process at all?

thanks for the reply canadian_wife. So it seems that it's pretty cut and dry. She can just spend sometime travelling, visiting friends, and working as a waitress while she's back in Canada until our approval. As far as EI benefits, I've already added her to my health insurance plan which will be effective Jan 1st, so she will be covered once she get's to the states.

So I'm curious about this. My wife is currently in a very stressful job and it's not going to be getting any better in the forseeable future. We submitted our I-130 app back in August and she is thinking of quitting her job near the end of this year and possibly selling her condo as well. She is debating taking up some lighter, less stressful work such as waiting tables, or something similar and then just travelling for a bit to visit friends around the world while possibly living with her sister and/or friends as we wait for our interview in Montreal. Some places she wants to visit her friends are in Mexico, S. Korea, and around Canada. She may even visit there for longer periods of time, say 3-4 weeks. I'm just curious, will this affect our CR-1 process? I will still be employed at my same job and do meet the 125% minimum so nothing will change with me, but I'm wondering if her actions will affect the process any? Your input is appreciated!

So it seems to me that our case is moving along pretty fast and wanted to see what all was next on the horizon for us.
We submitted the 1-130 on 8/14/09 and received the NOA 1 on 8/25/09. I've been out of town for the last month (visiting the wife smile.gif ) and got home tonight and saw the NOA 2 in the mail as of 9/25/09 and also that the case is now at NVC. Does this seem faster than normal? I have a form instructing me to pay the $70 fee for NVC as well as the DS-3032 Choice of Agent form. Once I pay that fee and fax the DS-3032 to my wife to have her name me, how much longer (approximately) is left? It seems there is the whole affidavit of support piece, then the medical and interview in Montreal, but about how long on average are cases at NVC at this point? Are there any other key docs to obtain? My wife and I already have passport photos, she obtained her long form birth certificate, and I believe she has yet to get the police certificate so I know we'll need that too.

So I'm assembling the I-864EZ package now and noticed that it says to submit "each and every Form 1099, Schedule, and any other evidence of reported income."

I'm using the EZ form specifically because I'm using my salary alone to meet the income requirements. I do have a 1099 due to some rental properties, but I'm not counting any of those for my income. Although, they will show up on my most recent tax return, so should I go ahead and submit the 1099 too? My fear is that they'll see that, and I'll get an RFE (not a big deal, I know) for more information concerning the rentals.

This is my final checklist that I'm submitting with the I-864EZ package assuming I should submit the 1099.

1. Receipt showing AOS fee “PAID” on October 27, 2009.
2. Form I-864EZ, Affidavit of Support.
3. Letter of Employment from current employer.
4. W-2’s for 2008 Tax Year.
5. 1099-Miscllaneous Income for 2008 Tax Year.
6. Federal Tax Return for 2008 Tax Year.
7. Weekly Pay Stubs for the past 6 months (28 total).


What does everyone think? My gut says to include it smile.gif.

I'm also in the process of putting together our DS-230 and my wife has already obtained her Police Certificate for Canada. In the form, she'll have addresses in S. Korea for the two years she lived there teaching English, but they do not issue police certificates in S. Korea for persons no longer residing there. I already sent an email to the consulate asking if we needed this and they said no.

My question is, do we include a brief explanation with the package stating why there is no police certificate for S. Korea? I can even include a copy of the email from the consulate stating that they didn't need it. Thoughts?

Okay I searched on this form and it seems the form has changed a bit over the last year and thus the corresponding numbers aren't the same anymore. I know people get lots of RFE's on this one for simple mistakes so I'm going to ask away.....

#2, it say if married woman, give maiden name. My wife did not take my last name and thus I've read conflicting answers on this one. Do we put her last name as it is shown above since it's exactly the same or do we put "N/A"? I want to be careful here as I've seen people getting RFE'd for this one.


#12 For present occupation, it's just the title correct? Not the name and address of the organization too?

#31a. Since I would be crossing the border with her, we put me in this box as well right even though I'm the USC? I'm also the person listed in #14.


#35 so for this one my understanding is to list all the ones she can remember, but beyond that putting something to the effect of "various trips since 19XX, but never stayed longer than 3 weeks or overstayed any visa"
She has been here countless times on family vacations since she was young and of course to visit me several times in the last year and she also many friends here in the states she's visited over the past 7 years.


#36, 37, and 38 are just repeats of 1,2 and 3? So same question for #37 as for #2 above.

#43a and #43b. I assume we want the SSA to assign and issue a card so we would answer yes to both of these?
Which address do they mail the card too, is it the same address I put for the green card address? The reason I ask is I put my friends name and address for the green card as we are going to move shortly after her arrival here to a bigger place as my place is tiny!

And as for the bottom of Part II, she doesn't sign this section until the actual interview. Since we are doing electronic processing, we only need the one copy of the package right?

I had my wife put my address in #10 for the permanent address she intends to live at, but for question 11, the address for the permanent resident card, I had her put my friends address. The reason being that we are intending to move almost immediately after she arrives into a bigger place. Is this going to raise any red flags to have different addresses for question 10 and 11 and if so what do you all recommend? Thanks again!

Yay!!

I signed in to NVC on Monday and got the "sign in failed" and received the email the next morning from NVC stating they had all the required documents for processing.

I'm curious when can we start calling to schedule the interview? When we call to schedule, do we actually call the Montreal consulate or NVC?

Hello All-

We haven't had our interview scheduled yet, but it should be sometime in the next couple months. In the meantime, trying to get everything ready for the interview, I know one item everyone brings is the immunization records. My wife is still looking for hers, but doesn't know if she can find them. Are these absolutely necessary to bring? Can't they look this up? If not, where would she obtain a new one?

Since our interview will most likely be in early/late April, I'm wondering if it is required that I bring my filed 2009 tax returns. If so, do I need to show on the return that I'm married and filing either jointly/separately too? My wife hasn't even lived here yet, so in my accountants eyes he would just file me as "single" for the 2009 tax year, but if this is for immigration purposes then he would rather file me as "married" if it's going to be viewed by immigration officials for that purpose. It just get's messier apparently because then he has to count her 2009 income on my tax statement even though she worked in Canada and wasn't even living here. He say's I could owe a significant amount then depending on what her income is. Is the tax return really necessary for the interview or can I just bring pay stubs?

Yes, I realize the DCF route does seem a bit off path, but I was really unfamiliar with how it exactly worked and since we were both talking about moving to Thailand anyway, it seemed like a viable alternative. Although, I'm not sure how long it would take to obtain the legal status there, I guess it just varies. Still maybe an option.

Yes, it seems the CR-1 route may be the best bet as it allows for the ability to find work virtually immediately upon moving here is my understanding, but this takes about a year correct? With the K-1 route, it's a bit faster (6-7 months?) to get her here, but then another 90 days or so of waiting for SSN and EAD right? Also, since we both like to travel a lot (international) then the CR-1 really is the way to go as you don't need to obtain the advance permission as with the K-1 correct?

Hello All-

New here and just exploring options at the moment. Met this amazing gal online last summer. We met in person, fell in love, and doing the back and forth thing at the moment. Unlike many of the stories I've read here, the distance to travel is not that far at all so I feel we are very fortunate in that department. My gf lives in Canda and I here in the states. We are both looking for ways to get her here and that is how I ended up at this webpage. We have already talked about the possibility of being engaged/married, but am curious how that may/may not affect other avenues we are exploring.

For example, she is looking into getting work here at the moment with either a nonprofit or university. From my research and understanding those institutions are exempt from the H1B quota that private companies are subject too. If she can find a job in one of those sectors, they would sponsor her on an H1B and she could move and live here for up to 3 years and possibly longer if needed.

However, if were to be engaged and begin the K1 process, how/would this affect the process of looking for work? Would she not be able to get an H1B any longer once that is started? Is it one or the other only?

Also, if we were to go the DCF process, my understanding is that either I would need to live up there for 6 months or she and I both would need to live in another country together for 6 months minimum correct? The reason I ask about this is we have both talked about leaving our respective countries and going to live abroad in Thailand for a year or so. If we do that, you just have to show proof of having lived in the country for six months? Then we could get married there, go to the US consulate in Thailand with all the appropriate docs and move back to the states? Or as option 2, I could move up there to Canada and live for six months and then we would go to the US consulate there? Am I understanding this all correctly?

Any input or guidance is greatly appreciated!

I am also waiting to schedule a January Interview, I am a little apprehensive about this new system and how the USEM is going to release information about how we will accomplish different steps. Last week, I had my Fiancee in Cagagan de Oro, Mindanao, go to her local Bank of the Philippine Islands and ask the branch manager what documects she will need in order to pay her Visa Application Fee after Dec 1 when BPI is suppose to have responsiblity for doing that. The Branch Manager at BPI told her that she was incorrect, that BPI was not going to accept any money for the USEM. He told her to go to Banco De Oro to make that transaction. When she told me that, that scares me, because transition is next wednesday, and BPI does not even know what their new responsiblity is. I may buy a pin thanksgiving night and try to make an appointment for Jan 18, and have my fiancee pay the application fee on Nov. 30. Trying to get information about this. Be Good All !

I must wholeheartedly agree with this post as I experience something similiar. It seemed for a while in our case that we were just not meant to be together. Our case took 3 years and buckets of tears but yesterday he finally came. It DOES happen!! luv.gif Try to hang in there because love is priceless and you will be stronger when he comes once you have survived this hell together.
