Colorado is great! The weather and the view are amazing... I don't think I've ever seen this much sunshine! Its definitely an adjustment but so far so good. Its actually easier to adapt to living here then I expected. Colorado and Canada have a lot of similarities, the environment and the people especially. I think your wife would be happy here! Then again, I've heard great things about Edmonton as well. You're very lucky to have 2 great options!



As an FYI I just received this response from my immigration lawyer contact here in Denver:

"This is possible. However, the issue comes at the second step when you need to file an affidavit of support. The affidavit must be filed by a US citizen or permanent resident who is "domiciled" in the United States. Therefore, you would have to be back in the US and employed such that you have sufficient income to support the two of you (125% of the poverty level or 18-20K per year). This may be difficult if you are between jobs."

Hello All-

I know I've been asking a lot of questions lately, but this board and the people here are such a great resource!

As some of you are familiar now, my wife and were married two weekends ago here in the states, and we are now assembling the items for the I-130. Our ultimate goal is to have here come here to the states. but......

I work in a very niche oriented tech field and there is a decent chance I can find work up there in Canada as I've already been networking through some of her friends. If I were to find work and get a temporary work visa, could I go up there and work while the paperwork was pending here in the states for the CR-1? or does that negate the process?

The other thought is if she found work down here and were able to get a job she could move down here and eventually just apply for the change of status, but chances of her finding a job here are more difficult. She works in nonprofit and academia and certain places/institutions are exempt from the H1B quota and timeline and thus she could come in immediately if she found an employer to sponsor her.

If I did find work and move up there, the other option could be to become a permanent resident and then since we are already married, couldn't we then go the direct consulate filing route after I've lived there for a certain amount of time?

My wife and I are assembling our I-130 package and I wanted to make sure it's okay to send the file package from Canada? I realize the check for $355 has to come from a bank located in the United States which I will do, but wanted to make sure it doesn't need to be mailed from the US as well. I will be up there next week visiting and we will merge our documents and send!

Just curious, my wife resides in Edmonton and was wondering when we get to the medical exam piece, is there a place in Edmonton that does them or are we stuck having to do it in Montreal/Vancouver?

You need to wait for the letter from the consulate before you can schedule correct? Ideally, you want to schedule the exam close the interview date as well is my understanding? Since we are applying for CR-1, and our interview is in Montreal, is it better to just have the exam done the week prior the interview in Montreal? I've heard great things about Dr. Seiden's clinic anyways. Your thoughts and comments are appreciated.

My wife has a few house plants she was wanting to bring to the US once she moves here. I've read on here that you need to obtain a phyto sanitary certificate from agriculture Canada in order to do so.

Is this all that is needed and does anyone know where to get this certificate? I did some looking online and can't seem to find an actual application or contact.

The 6 months refers to the country of the person's nationality. So basically if she is not a national of Mexico then no police certificate is required for Mexico.

I've received conflicting answers on this so I thought I'd ask. My wife is the beneficiary and has lived in other countries. S. Korea for 2 years and Mexico for maybe 6 months?

My understanding is police certificates are only required for places she resided for more than 12 months, but I've also heard 6 as well?

As far as S. Korea is concerned, they do not issue certificates to people no longer living there and I emailed the consulate in Montreal and got confirmation that the S. Korean cert is NOT required. Therefore she only needs her Canadian one from the RCMP correct?

So I'm travelling to see my wife and family for the holidays and was curious is there a max amount of gifts I can bring into the country. I believe as of right now, everything will total around $300-$350 which includes a bottle of scotch. I don't need to bring receipts for everything do I?

Interestingly long ago they did record everyone who entered the U.S. - including Canadians. I have a border crossing record of my Grandfather entering the U.S. in 1926.



Yes, it is a little odd being that when she's visited me in the past, her passport has never been stamped. Either way, it sounds like the consensus is that it's fine if she stays the extra week or so. In total, it'll be less than 30 days so I don't see why it would be an issue.

Well it's just that if your wife is a Canadian citizen, the fact that she got a B2 at all is a bit out of the ordinary.

Also, the I-94 has two portions, the bottom portion should be retained in the passport and returned to customs when she departs the country.

"The bottom section of CBP Form I-94 is a departure record and must be returned to U.S. officials upon exiting the United States". link

Anyway, i'm not trying to make you paranoid or make this any more complicated than it needs to be, just curious :lol:

Thanks for the replies. My wife didn't get the I-94 back? I believe you are referring to the form that is filled out at customs correct? I looked at the form online and it doesn't ask for the specific length of stay here and she didn't receive it back since they took it from her at the border when they admitted her and stamped her passport. What other details are missing that can help make the situation clearer?

there is only the stamp in her passport and it says "admitted feb 08 2010 class until _____" and in the blank spot the guard wrote in "B2".

It was issued on Mindanao, 1 1/2 hours by plane south of Manila.

Unfortunately, I hired an incompetent, unreliable attorney, but that's another long, drawn-out story. Fortunately, I have been reading the posts in VisaJourney which has help me to direct him. I understand that I will need a co-sponsor and a friend (i.e., single man and no other dependents) has agreed to being our co-sponsor. As usual, my attorney sends me an iPhone text reply of "No", but does not give me any clarification as to how much total income or "adjusted gross income" the Guangzhou consulate needs to see along with my co-sponsor's 1-864. (My email and attorney's reply shown below.) Is this immigration attorney correct? If so, please tell me the minimum amounts of adjusted gross income the Guangzhou consulate needs to see? I can never get a straight answer from this attorney and working with him has been a nightmare. It's a shame I did not know about VisaJourney.com before I hired this guy. (I did erase this attorney's last name and email, but I would love to warn everyone about him.)

I think the main thing is that you have plenty of evidence that you plan to return back to the US. I had a lot of trouble the very first time I came to England. I was coming for a visit for 7 weeks, had quit my job, didn't have anything on me showing that I planned to go back to the US. I was so naive and was almost denied entry. Since then, I have entered a few times and am pretty much always hassled. This last time I went back to Colorado for Christmas, I decided to apply for a visitors visa (although technically I don't need one) just to be safe. The immigration officer still asked me loads of questions but I am here in Leeds and can stay until the end of June. Now only if we could get Rich's K-1 by then!

Good to know about HSBC opening accounts for you in the USA before getting there. My fiance has his accounts there and we were wondering about this. Does anyone know exactly how his credit score will transfer, if it does at all? He has great credit, mines not as spectacular as his, so we are hoping his will transfer to the US. My fiance has his visa interview on July 20th and we are trying to get a feel for about how long it will take to get his passport/visa back from the London embassy (assuming there are no problems.)

I've been meaning to ask about the police certificate, just so I know we got the right thing. Our's just says "there is no information held about you on our computers blah blah blah" and at the bottom it says "this doesn't constitute a certificate of good character" or something like that.
