Since your 07 tax return is less than the 125% line you do need to to show the assets - provide proof of the assets e.g. bank statement. Generally speaking you need to show 3 times the amount that you are short. If you can show proof of the cd that you mention (bank statement) - I believe you are OK. Good Luck

It should work, however, to be safe multiply the hourly rate with the weekly hours times 52 to get the annual salary (divide that by 12 to get the monthly salary if you wish). Add another space in the employment letter for the annual or monthly salary. Good Luck

One of my wife's friend was also denied her K1 visa because the examiner didn't believe the relationship was genuine - she was told to have him come for the interview - she rescheduled the interview and he went with her. The second time she was issued the visa - they did ask both of them several questions relating to their meetings etc. Perhaps her 1 year old request for a visitor's visa with a sponsorship by another man may have been the reason for earlier denial. I would suggest, schedule another interview and go this time. Good Luck

I understand you don't want your mom and dad to be co-sponsors but what about your friends in USA? Why not ask them to be a co-sponsor - explain to them that the sponsorship entails supporting the intending immigrant but it 'may' never be needed or officially enforced because you would be taking care of her with your assets and the new job. Most friends might be willing to be a co-sponsor - and the only requirement is that they must be US citizens or Legal Permanent residents - and make enough money to support themselves plus one (I am assuming your fiance is by herself). At the minimum send an employment letter from the people you are starting your new job with. Consider redoing your I134 to match the new income. I would assume Delhi is like any other consulate - if your paperwork is in order and they do not see any potential red flags, they should issue you the visa. I have had two visas from Delhi - a student visa, and an immigrant visa - both were issued without any problems. You need to be secure in what you are doing and not be nervous - remember, if they deny you, you need to ask them to tell you what you need to overcome the rejection. Good Luck

You should be good to go. Perhaps the confusion arises from the questions about the beneficiary's foreign employment and income, which are irrelevant in this process. The basic thing people forget is - a visa is not a 'right' its a privilege. So its not like you are going to the Best Buy store to buy a TV and they must give you one if you have the cash. There is a lot of fraud that goes on - many trying to get to USA legally, illegally and some by paying others (my hair cutting lady told me that a Russian who works there told her that any girls willing to marry a Russian man to bring him here can make $10,000 easy - I am not sure if it was a joke or real).
The consulate must use their judgment in making this decision - by prolonging this process they force many an illegals to just drop out as they do not have the patience for this. Also, many an Americans are dead against foreigners - legal or not - and this hatred has boiled into laws and processes to make it harder for the genuine people, I look at it as a test of your relationship and your ability to go through a slightly harsh (extremely harsh for a few) process. Go back and try again - remove the objections they raised - this is quite routine - just read this forum and you will see thousands who are denied and almost all seem to overcome this hurdle in their next try. Do not take engagement pictures to New Delhi - people have been denied because the ceremony looks like a marriage ceremony. You are not trying to prove you are engaged - you are actually trying to stay away from any hint that you 'might' be married - the distinction is the K1 visa is for people not married and K3 for married people. You don't have to submit employment letters since your parents are co-sponsoring, they would need to submit their letter of employment. I assume just one of them can be a co-sponsor (someone can correct me if I am wrong) and they would need to make enough to support both of them and one more person (your fiance/wife). You can go to the Uruguay or some other consulate and download the info - its all the same. Good Luck

No he doesn't need to provide bank statements since he is meeting the requirements based on his income alone. Nothing other than I134 needs notarization. Check with the consulate - some require three years tax returns. Just carry one copy of evidence - if you want to save it for your self (make another copy). Good Luck

TBoneTx - if you turn hostile they would just tell you to go away - its very common at some consulates. In India I observed this many years ago - one of the applicants kept insisting on being heard (he wasn't too loud or obnoxious) but the interviewer told him to leave - walked away from the 'window' and the next number was called to that window in another few seconds. I saw this happen several times while waiting my turn. Your being a USC may have some bearing on it but he could terminate the interview and turn away the applicant. And hostile is what they deem hostile - not what you think may be hostile. I have seen too many people get caught in this and lose not only at the consulates but other places too. Just go to the interview and handle it in a calm, cool manner. Good Luck

Having just 2 or 3 minutes requires you to be prepared (and in my opinion not carry so much junk as many people do). Good Luck

I have followed my wife's friends' case in Colombia and it seemed that the case wasn't 'straight' forward - they girl had applied for a visa before (visitor) (and the sponsor for the visa was another man) - she was told to have her fiance attend and when he did ( a month later) she was granted the visa. It seems to me - if you are both 'clean' - no previous marriages/divorces and no other visa applications etc. - you should be OK without the USC being present for the interview. Perhaps there have been several instances where the K1 visa recipient upon arrival in USA - didn't get married and get adjusted to resident status, instead just became an illegal - and the thought in the consulate's mind might be - that its a sham relationship entered into for money - and hence the request to produce the USC fiance at the interview. The worst thing that can happen for you - is a delay of a few weeks and the expenses of flying, hotel etc. Good Luck

Others have been told to do this also - bring your US fiance to the consulate for a subsequent interview - My wife's friend got her visa a month later on her second interview when her fiance also went to the consulate in Colombia. It seems when the evidence is weak - not the quantity but the quality and or there is suspected fraud or inconsistency - the USC fiance is asked to attend - in all cases that I remember the visa is granted at the second interview. There was a Mexican, an Indian, a Peruvian, another Colombian and a Philippines beneficiary who went through this or is going through it recently also. Its quite simple - go there at the next interview and answer the questions put through - most are granted visa. (Yes you end up spending money for airfare, hotel etc.) Good Luck

Your interview is in London - thats not a fraud or high fraud country. You have more than enough evidence. When my wife went to her interview in Colombia she just had 3 or 4 emails and 3 or 4 chat records (no pictures) and nothing else, she didn't have a problem and Colombia consulate is a lot harder than others. They looked at one email for about 3 seconds. I believe you will be fine, don't worry about it. Good Luck

My wife is from Barranquilla - she got her vaccinations in Barranquilla - they are around the same cost in both places so there is no savings as such but a trip to Bogota can be $1000 plus each (for air tickets and hotels etc). Just make sure that they get their vaccination card filled out in Barranquilla and carry it with them to the medical. But yes, you can do it as you are planning. Good Luck

I was wondering, how one goes about having their tax return notarized. Notarizing a tax return is not needed. And I always just send copies form my turbo tax and it has always been OK (no signatures as I also file electronically) - just be sure to attach W-2s or 1099s if applicable. I never ever thought it worthwhile to get IRS transcripts but many people like that - it's your choice. Good Luck

I recently sent three years tax returns to support a sponsorship at the Bombay consulate - it seems that's what they want to see. Even if you didn't have any income - you should still send the three years tax returns, the consulate in India like some others, expect this from what I have read. Good Luck
The Three year tax returns are a sort of requirement - your current income is what qualifies you to meet the 'poverty level plus' test.

Nich is right about the legal part however I have never heard of USCIS or another branch/agency going after a sponsor or co-sponsor. So understand that - even though they can legally hold the sponsor responsible they do not have the means to enforce this or a history of ever enforcing this. I will definitely disclose both sides of the issue to a co-sponsor including the fact that you the fiance are never going to let this happen. Most people I know (relatives, friends co-workers etc.) would never hesitate to co-sponsor for me. Good Luck

In my life? Yes, but I'm not the USC. My fiancee' in the US is the one with few options. I know asking on here is a stretch, and we're still hopeful of one of our options will work out, but I'm not ashamed to ask on VJ.

Have your USC fiance talk to his friends/relatives/co-workers. This is not very hard unless you live in a completely isolated area. All the co-sponsor needs to be is a US citizen or Permanent Resident (and yes make enough money) - so even a friend of yours who is a permanent resident can help - for example one of my wife's brother lives here and he can co-sponsor her (if her fiance doesn't meet the 125% level). Your fiance needs to be convincing enough to sell his case - again not very hard to do. You do not want to pledge your first born or something like that to some unscrupulous person lurking here!
