K-1 Fiance(e) Visa Process & ProceduresFiled our K-1 today yeehaaa! But just realized.......
It really doesn't matter - I also didn't put any names on our photos - they were able to tell who was the petitioner and the beneficiary without any problems. Don't worry about these things - if you miss something and have an RFE - you correct it then - its part of the process. RFE typically would add another week or 10 days delay - so its not a big deal when you consider the 4 to 6 months process for most. Relax and Good Luck

K-1 Fiance(e) Visa Process & ProceduresHow long is the K1 Valid after Issuance
My wifes K1 visa is valid for exactly 180 days - it has an issued date and an expiration date. The petition itself was only valid for 4 months - but its automatically extended if the consulates are running behind. Good Luck

K-1 Fiance(e) Visa Process & ProceduresGoing through US Customs to visit
Why would customs question you at all? Generally you go through Immigration first and they are the ones who ask you these type of questions - customs check your bags for drugs and other illegal and prohibited substances etc. You need to tell customs the truth and hope they let you therough if your K1 is in process etc. Check out the rules on traveling while your K1 (and then your AOS) is in process. Good Luck

K-1 Fiance(e) Visa Process & ProceduresPhotographs for Interview in Mumbai
Samital - my advice is not to include any pictures of the engagement - even with the 'simple' garlands that you are describing - it would appear to be a wedding in the guise of a simple ceremony.
When my fiance went for her K1 interview - she did not take any new pictures (we didn't have any new ones - just the two we had sent with the petition). I would say take a few with you; say 5 or 10 - but do not include any with any ceremony in it. When rejected because of a 'marriage' picture - you are left with a big fight on your hand and lots of time spent overcoming the objection of the consulate. Be smart and avoid any of these. Good Luck

Take a look at the instructions for AR11 http://www.uscis.gov.../form/ar-11.pdf

K-1 Fiance(e) Visa Process & ProceduresOptions for temporarily remaining in U.S. after K1 marriage without filing AOS
Pushbrk is usually right (only about 100%). But I do have another option, cancel the K1, he can come her on VWP, get married and then go back. How sure is he of getting that job? If not much, then go ahead get the K1 and don't worry about the AOS. Good Luck

I had similar question. I was naturalized, but I think they took my certificate when I was applying for passport. I wonder if passport is enough. It's been so long, not sure if I still have the certificate.

Generally they mail your certificate back around the same time when they mail back your passport. You could get a duplicate copy, but I do not know the costs for it. However, almost all places accept the US Passport as proof of citizenship.

K-1 Fiance(e) Visa Process & ProceduresBiometrics?
You have filed for K1 so don't worry about it. When you arrive in USA and get married and then file for 'adjustment of status' - e.g. greencard - at that point you will have a biometric exam scheduled by USCIS after receipt of your AOS application. For now just relax. Good Luck

K-1 Fiance(e) Visa Process & ProceduresAnother qs...
If I understand you correctly - you left after arriving here on a K1 without an AP - that means you have abandoned your residency. An I94 is just a proof of arrival in the country and is generally sent (a copy) for adjustment of status - did you file for adjustment of status? EAD? AP? Did you leave without an AP or greencard? If you did then you have abandoned your residency. Did you get married while on your K1? If you did you will need to file for a K3 now. Give us more details of your status and what you left with and we can help you better. Good Luck

You can estimate the dates you were here and explain that you do not know your status as you were brought by your parents. I think you should be OK. On another point, why can't you ask your parents? They should be able to help you even if the relationship has soured - as it is they are the only parents you are going to have in this life, and you are going to be their child in this life no matter what. QUOTE (pushbrk @ May 26 2008, 01:21 AM) <{POST_SNAPBACK}>
In this context "abroad" means outside the USA, so your fiancee would answer with her current or most recent occupation. On your own G325a, you would put "none" if accurate.

Just make sure that - since she has already listed this employment - she would therefore write 'none' in this box. (Because it's already shown above - per the instructions - this is how my wife did.) Entiende? Good Luck

K-1 Fiance(e) Visa Process & ProceduresA couple of questions
You can contact the nearest UK embassy in USA (google for it) and apply there when you are ready to get a new passport. You will need a SS number to work even after the authorization, so look for one in your home area and apply about a week after arriving - it may take 2 or 3 weeks to get (If you already have one - then you are good to go). You can apply for AP when you get married and apply for AOS - generally it takes 2 or 3 months, so it all depends. Good Luck

K-1 Fiance(e) Visa Process & ProceduresBad lawyer experience-please help!
I agree with littleasianman (why choose such a name why not bigfantsticguy?) Friends of ours who live 5 minutes from our house and used the K1 process to get her here three months after I did, hired a lawyer and paid $3000 or so for a K1 and then more for AOS, even when I told him that he can take my forms and papers and do it himself! To him its like doing taxes - he would rather pay somebody $500 or more than do it himself (say online for $40).
But for me, I would rather take that money and use it for fun - we took trips to Mexico, Panama, Colombia and India (well it took a little more money than the savings from the lawyers!) Do what makes you comfortable, lawyers are like plumbers - if you can fix your toilet yourself you can save a few bucks else pay someone else to do the dirty/hard work.

Don't worry about it. You can't send it in and hope that it will match up with your documents. Best to wait for an RFE and my feeling is it won't cause any. If it does, the RFE only causes a week or ten days delay -not a big deal really. Good Luck

You do not need to sign copies of tax returns, many of us file electronically and use unsigned copies for sponsorship at this and other stages - I have always used printouts from Turbo and they are never signed. I would suggest just scan the W-2s and email it, she can print it out there. If you are really concerned - you can write (or have her write) "Not-signed - filed electronically" at the bottom of the tax return where the signature would be. Good Luck

K-1 Fiance(e) Visa Process & ProceduresENGAGEMENT'S PICTURES .
I think the critical point to consider is this - K1 is not a visa requiring an engagement whereas K3 is a visa requiring marriage. A K1 generally is faster than K3 and the consulate examiner is trying to avoid any attempted fraud by parties who are married and trying to get a K1 (trying to shortcut their separation).
The culture in many countries is such that an unmarried girl is not allowed to be with a man - India and many Muslim countries are like that. Its considered a social insult for an unmarried girl to go be with a man (even her husband to be). As a result of this, many Indian parents would insist on a marriage before letting their daughter go (yes, a few are more liberated now, but not many), and thus in India its probably very common to see this kind of fraud occurring. And that's why if an 'engagement' picture seems to be a 'marriage' picture - you could be denied a K1 visa.
You are going through Egypt, I do not know what the fraud potential is in Egypt but I guess it may be high. So, do what you feel is comfortable for you but be prepared for a denial or delay if you do take a chance with such an evidence which may turn against you. Good Luck

meli - what consulate are you going through - at some they have started asking for the USC fiance to show up for interviews (they get denied on the first interview; approved at the second interview when the USA fiance shows up) - This has happened to a few people in Colombia, Mexico etc. - so be prepared for that. Did you send it through USPS with acknowledgment due (and certified)? If you do, you get the acknowledgment card back signifying that they received it. You should hold on to that receipt in case of a problem with dates and times (especially good during AOS and removal). If you did not do this - make a note to do it from now on.
This way you know that they have received it, and to see when the check has been cashed you can check with your bank's website. This removes some of the anxiety you may have with lost mail/packages etc. Good Luck

K-1 Fiance(e) Visa Process & ProceduresCo-sponsor questions on Affidavit of Support
QUOTE (fwaguy @ Jun 9 2008, 01:07 PM) <{POST_SNAPBACK}>
Why file a zero return? Just prepare them and keep them in your permanent files ....

So that it will match with the IRS records in case someone ever verified or if you wanted to get an IRS transcript. I worked as a Tax Administrator for Colorado state Govt. and often told this to many people who are trying to establish residency (for tuition purposes or even welfare purposes) - it doesn't take much to do (you can do a 1040EZ and then the state short form (if they have one)) and have a permanent trail through the US and (for many state govt. also).
In my younger days, I worked some part time jobs as a student and had very small amounts withheld - by filing I got the few bucks back and established my residency for the state also. MY trail from those small jobs helped me establish my SS credits too (not enough for retirement but close!) Good Luck

K-1 Fiance(e) Visa Process & ProceduresCo-sponsor questions on Affidavit of Support
I would suggest that you file a tax return now - listing 0 income (I assume thats' the case). Even though it is not a requirement for you to file - its better for you to file because you will need a paper trail in this process. Then you can always satisfy USCIS or consulate requirements to have a tax return (sometimes they want three years tax returns and yes you can file them now - there is no penalty for filing late as you had no income to pay taxes on.
And for Visa purposes - you can attach explanation if you want to - why you don''t have sufficient income - or just get a co-sponsor. Good Luck

2. Check with your local city/county office on what the requirements are (some states require a SSN others don't - hint - you can drive to Vegas and get married there (no SSN required)
3. When you have your 'new' address send an AR11 form to the USCIS for address change
4. As long as you make enough (125% of poverty) or still have a co-sponsor (when you do the AOS) - it doesn't matter what job, or how much etc.

QUOTE (PeterFB @ Jun 9 2008, 08:43 PM) <{POST_SNAPBACK}>
Her K1 visa allows her to work without EAD. She doesn't need to get a work permit until her K1 visa expires but by then she should have her EAD or at least AOS filed.

Though technically correct - it doesn't work for most of us in practice because the employers insist on an EAD or greencard. Also most do not receive their EAD before the POE stamp (or I94) expires and are forced to quit (legally) - its really quite useless to get this stamp at POE unless you have jobs lines up, are familiar with US system and do not have a language barrier. For most of us its better to take it easy. Get married, get the greencard - in the meantime learn the language, get used to the city and surrounding areas (get a drivers license) and then start applying for jobs. You can choose what you want to do. The short stamp at POE is pretty useless and arguing with your potential employer about legally being allowed to work on K1 isn't very successful for most either.
