Removing Conditions on Residency General Discussionaffidavits
I do not think the affidavits prove anything (my opinion) and didn't send any. We do have a lot of financial (bank, credit cards, insurance etc) and social evidence (pictures). I would say you shouldn't worry too much - send what you have and what you feel comfortable with. You can deal with an RFE if it happens - but I doubt it will be for this. Good Luck

Removing Conditions on Residency General DiscussionTravelling while waiting for conditions to be removed?
My wife came back to USA from a 3 month trip to Colombia on March 5th - her greencard was expiring on April 16th - No questions asked (she didn't even have the extension letter either because it wasn't filed till she came back). Don't worry - Good Luck

Removing Conditions on Residency General DiscussionJust a couple questions, please help
QUOTE (Paul and Melanie @ Apr 28 2008, 06:18 PM) <{POST_SNAPBACK}>
First of all, I apologize, but I have some really dumb questions...

Paul's card expires in 4 days!!! When we were approved for the 2 year, we signed an affidavit saying we would file again in 2 years between Feb 2- May 2 2008. I guess we're not late as long as we have it post marked by the 2nd, am I right? Please say yes!

And....
While the case is pending, is he allowed to still work here? His drivers license also expires on the 2nd of May, will he be able to renew it?

Thanks a lot to anyone who can answer these.

Melanie and Paul

As long as you mail it by the date of expiration on the greencard - you are OK. Make sure and send certified with acknowledgment along with next day delivery etc. and have the USPS papers with you as proof that you filed in time. Look at the greencard's expiry date and beat it. Driver's license is a ####### shoot depending on which state you are living in - some states will give you a new one when you show the extension letter - others won't. He is eligible to work with the extension letter - so that should not be a problem - but you need to send the I751 fast - so you can receive it in time. Good Luck

Yes. You will need to get a divorce before you can remove conditions. (I am assuming that you have your greencard based on AOS already, since your post is in Removal of Conditions). Do a search in this forum - you will see lots of posts about this and what people did. Good Luck

Yes. You will go through biometrics again during Removal of Conditions and then one more time if you go for Citizenship. Hopefully, since they have cleared you already, the next go around would be faster but I don't know for sure. Good Luck

Removing Conditions on Residency General DiscussionBank account numbers
QUOTE (bettenan @ May 3 2008, 06:26 AM) <{POST_SNAPBACK}>
BTW. Government agencies and their contractors shred any documents with your personal information on them. But before they get the jobs with access to your personal information extensive background checks are done.

True - in our case I worked for a state govt agency - we didn't shred documents - we paid an outside agency to destroy them - they use some kind of acids etc. (an employee of our agency oversees it as it is done). So this was better than shredding.
Not true - only sensitive jobs (where cash is handled etc.) require a background check. However a lot of work is privatized and those employees are required to be checked but we wouldn't know if they are or not. However, I felt very good about the process we had and till I retired I had not heard of any info being stolen. My only hope is that others are doing the same than we were doing. Good Luck

I left all info intact and actually used it (highlighted) to show the same account number for both of us, establishing joint ownership. Do what you feel comfortable with - blocking out all but last three or four digits seems to be a good idea but I didn't want to do this (too lazy). Good Luck

Removing Conditions on Residency General DiscussionThe weight of evidences?
QUOTE (julianna @ May 3 2008, 09:51 PM) <{POST_SNAPBACK}>
I don't start LOC until this next winter... but I was wondering-- do certain evidences "weigh" more than others? For example, does a joint bank account "weigh" less than a baby in proof? Or is it just sort of the whole picture they take into account? I'm assuming a baby isn't always a free pass, as it were, to getting approved-- I had figured it was more dependant on the overall picture.

A bank account weighs nothing - its just a number - a baby about 6 or 7 pounds when born and 200 pounds or so when fully grown. whistling.gif

Removing Conditions on Residency General DiscussionChanging my family name before filing I-751
QUOTE (Pat4316 @ May 3 2008, 08:14 PM) <{POST_SNAPBACK}>
Hi!

I have plan to change my family name to my husband's family name. should I do it before filing I-751? Could you please suggest me how to do it? How long would it take? Will it be efftected to my new green card? For filing I-751, do we have to do it by mail or in person? Thank you very much.smile.gif P.S.I got my first green card on July 22.

Yes you can put your 'new' name on the form and then your 'old' name as 'other names used'. Your greencard will then have the 'new' name. You need to mail the I751 in. Good Luck

Removing Conditions on Residency General DiscussionOld I-751 on Visajourney returned by USCIS
I just got our I751 package returned by the California Service Center (I had mailed it to Nebraska) with a form letter stating that "The form I751 you submitted has been revised. You must submit the form I751 with a revision date of 2/05/07."
The one I found on the USCIS website has a revised date of 07/31/07 so I am sending that back to Nebraska as they didn't ask me to re-submit it to California and No they didn't cash the check so the application is going back as it originally was - check and all. Hope you avoid the extra time and the mailing cost so you do not do what I did. By the way - the only difference between the two forms is that the newer form has a bar code on the bottom of page 1. I guess that helps them scan it etc. oh well! Good Luck to you all

Sorry I can't change the header - the form on Visajourney has the date of 8/01/06. Do not use it. Get a newer version.

Removing Conditions on Residency General DiscussionChange Of Address Problem
What is your current status? 2 year greencard? what? You need to fil out an AR11 for address change each time you move but at least do it for the last move. If you are making enough money - you could self-sponsor - and remove conditions on your own (you would need the divorce decree to do this). Good Luck

Also be aware that many of us chose not to send in these affidavits. I feel that they are not worth much in the ways of proof of having a relationship - we had other (better) proof of co-mingled finances and social life. You should send what you feel comfortable with - none of these things on the lists are a 'must' to be sent - just a guideline of what could be sent. Good Luck

Removing Conditions on Residency General Discussionbackground check - 751 question
If you are divorcing - you can do the removal of condition on your own (you will need a copy of the divorce decree for it). Its possible that no interview will be held for the removal so you might be Ok on your own. But if your divorce comes through before the removal of conditions happens, then you have to go back to step 1 and redo the removal. What stage are you at right now? Have you filed for removal or is that a year from now? The background check or criminal checks are done to make sure you are 'clean' they donot get into who lives where and with whom. You may have a tough time ahead of you in this process, read up on the forum and do as much research as you can on similar cases . Good Luck

Removing Conditions on Residency General DiscussionI need help folks - Change green card and address
QUOTE (truthonlytruth @ May 14 2008, 03:56 PM) <{POST_SNAPBACK}>
[My question what has to be done to come back to US ...

Because her green card has my last name and she is getting a new passport with here maiden name i do not think she can enter US like that...
So what form she has to fill out...

Or anybody know an email address that i can ask Immigration about this issue???

Thanks

A passport is used to travel in and out of the country and generally the name on the ticket she buys should match the name on the passport. The greencard is used to enter USA - and if it is valid and she hasn't abandoned her residency in the eyes of the Border/Immigration officer - she will be allowed to enter. The names on the greencard doesn't matter as far as matching with the passport or tickets. Understand?

Removing Conditions on Residency General DiscussionI need help folks - Change green card and address
Her greencard is valid for another year I guess - till Oct 2009. She can come back to USA and file to remove conditions on her own. Are you still trying to help her? Why?
But yes, she can come back and do it - she will need to show that the marriage was entered into in good faith etc. If she stays out of US for a long period (a year or more) she may not be able to get back in and she will have a hard time proving that she hasn't abandoned her residency. Good Luck

It is a little screwy in the sense that it doesn't show anything except they change the date - so unless you are keeping track of that, you may think nothing has happened. I think if she can show him the extension letter (or stamp) and that would be OK. If your divorce happens before your conditions are removed - you will need to refile with the copy of your divorce decree. So, if she is willing to wait the 4 to 6 months it takes for your I751 to be approved, OK. If not, then get the divorce decree and refile on your own. Good Luck

P.S. Update your signature - it shows filed for K1 - confusing. (Fill out your time line too - it helps others.)

Why would they want W2's? They're not checking for proof of ability to financially support, only proof of co-mingling of finances. A W2 would not be joint, so what would it show?

Yeah - that's what I was wondering too... but if everyone's sending them in, then that's what we'll do too - even though I don't understand what W2s/1099s contribute that the tax transcript doesn't already show...

It doesn't show anything. Maybe some people have gotten approved after sending in photos of their a$$ too, but that doesn't mean I would imply that it was a requirement. tongue.gif

I believe all of you are right and a W-2 isn't required. However I was an accountant, CPA, tax expert for most of my working years and without the W2 or 1099 the tax return is not completely valid in my mind (Yes, I am a little stuck up on that) -
So I have sent it always - 1) With my citizenship application; 2) With my wife's K1 (with the I134); 3) With my wife's AOS; 4) with my wife's removal of conditions and in another year with my wife's citizenship. Good Luck to all of you, especially the ones who sent photos of their a** like Jenn states laughing.gif
