Ryan: I too am going through Nebraska but I am not too upset about reading of these delays - I have re-joined the forum as we go through the lifting of conditions process. My feeling is this - they will extend the residency for one year and if nothing happens in 9 months - my wife can file for citizenship. Whether she ever gets her 10 year card is irrelevant - isn't it? And I am aware that there are delays in processing citizenships but wouldn't the 10 year green-card be pointless if she can apply for citizenship and focus on that? Do you agree or do you have a different take on this? At least I don't see the need to be angry as some other people are posting in this forum. Good Luck

I would add some photos of you two together with family and friends - over the last two years and maybe sending the bank/credit card/utility bills spanning the last two years e.g. one from 1.5 years back, one form 1 year back and one recent. I don't believe yo can change your name during biometrics - I think you can try it when filing for I751 or later on with SSA by paying for it. You may have gotten her suspicious when you asked for a name change at biometrics. Just wait for the result of the I-751 and do what needs to be done. Good Luck

I mailed it on March 17th to Nebraska and received the NOA extension letter today (it had a date of March 19th). So for me it took 21 days to get the extension letter - and yes, it came from the California service center (I mailed my packet to Nebraska). Good Luck

I read the submittal info for the affidavits and decided to not do them. It seems like a hassle to have your friends/family go to a notary to do this - so I decided not to send them - if they ask for it, then and only then will I ask people to do this for us. You can do what makes you comfortable. If you are going to do the affidavits, they must be notarized according to the instructions. Good Luck

There is really nothing special about the I751 package - no notarized statements etc. are needed, only copies of lease/rentals/bank/medical/insurance statements are submitted - you can recreate the packet without much work the way I see it. Good Luck

I used a cover letter with page numbers for the documents attached and a description of what it was e.g.
1. Joint Bank statements - Page 1 - May 2006; Page 2-3 April 07; Page 4 - Jan 08
I wrote the page number on each document e.g. 1 (and circled it) and highlighted the names on the documents to show that it was a joint statement etc.

It depends on your level of comfort. I never blacked out account numbers - and didn't worry about it since I always sent everything certified - getting lost in the mail would be the only thing I would be concerned with. But many people black out account number info so its up to you.
I used a cover letter detailing the contents of my filing and signed it myself. I filed it as a "Joint I-751 petition for removal of conditions". Good Luck

An infopass appointment is basically like a doctor's appointment - you wait till your number is called and then you talk to the officer and they will either do what you need right away e.g. extend your stay or tell you what you need to do to get it done. I didn't send any title/lease/rental in joint name as my house is jointly owned with my sister as is hers (vise versa). I was confident in our evidence of Joint Bank statements, utility bills, credit cards, insurance bills etc. and so far I haven't had any issues. I didn't add my wife to my title - (the house is clear) and have filed for everything without using this portion of the 'evidence' - so far no problems. Also, yes you can do a quick claim to add your wife or someone else to your property - it cost me just $8 through a local Remax office - a friend I know used to work there and called to set up my appointment. (I did a quick claim to add my sister to my property and she did a quick claim to add me to her property - so we can dispose of each other's property in case one of us was to die.) I believe I have enough evidence - like bank statements, credit cards, health insurance, utility bills to tie us up sufficiently. Good Luck

I think generally they need to be from people who know about your relationship and logically they would be your friends, co-workers, neighbors here in the USA but if your parents travel back-and-forth often then why not? This is incorrect - you can file for citizenship 3 years (minus 90 days) after the issue date of your green card (approval of AOS). When you got married is irrelevant. There are separate requirements about actual time spent in US, etc. which you can find on the N-400 application instructions.

John is right. I meant to say three years from the issuance of the greencard but in my mind its the same as three years from marriage (she got the greencard about 7 months later - so my mind is somehow screwed up on this bit) blink.gif Good Luck

Why not try calling again (and save yourselves a trip, possibly) - you could get someone more knowledgeable next time. If you get the same person, why not ask for their supervisor - most places you could get to someone who knows their 'stuff' not a 'newbie' who is unfamiliar with the process. Good Luck

Lawyers that pass "The BAR" are awarded the title of "Esquire" or "Shield Bearer", originating from the "Crown of the City of London". Were this a Commonwealth nation (UK, Australia, New Zealand, etc) you would have better luck. But this is America, where the gov't sees you (and treats you) as an enemy combatant and lawyers will only ask how much "justice" you can afford.

I agree with mawilson. I would think that USCIS wouldn't consider this at all - this would be no harm no foul type of deal. Since one could file today and get divorced prior to the approval. But if there is an interview, she may have to go alone (if the husband doesn't go with her) and prove that the marriage was genuine. which application? K1 or AOS or Removal of conditions or Citizenship? Different rules apply for different status - so it all depends. Generally 2 or 3 months are OK - up to 6 months are not bad. More then that - look for Advance parole and Reentry permit rules. Post more details and someone can help you. Good Luck

As for me - I didn't include any such affidavits - they do not appear to be strong evidence in my mind - we have enough other evidence of co-mingled finances and lives. I do not think the affidavits prove anything (my opinion) and didn't send any. We do have a lot of financial (bank, credit cards, insurance etc) and social evidence (pictures). I would say you shouldn't worry too much - send what you have and what you feel comfortable with. You can deal with an RFE if it happens - but I doubt it will be for this. Good Luck
