I vote for zyggy's approach. Seems to me that too many bils and statements from each month and all kinds of documents are an overkill and don't necessarily help the process. I am going to save zyggy's list and use that as a guideline when we go for ours. That's the same approach I have used in the K1 and AOS - as little as possible (or just a tiny bit more but not too much!) :lol:

It happened to me too - but I just mailed the whole packet back with the correct form (my packet was hole punched and had a clasp on it) - it came back from California even though I had mailed it to Nebraska - the check was still attached to it. I sent it back to Nebraska, got an acknowledgment and then NOA from California in 10-15 days - no big deal really! Good Luck

Or - it could be because you used an expired form (Happened to me) or didn't send the right amount of check or failed to mark the correct box (happened to a friend of mine) or any of other hundreds of reasons. Check the packet and you will know why it was sent back - no need to worry about the 'unknown'. Good Luck

Try talking to one of the Indian/Pakistani attorneys in your area - there are hundreds in New York, Chicago, Los Angeles areas. They can tell you exactly what needs to be done including if he can ask for a 'hearing' or 'appeal' the decision. Most of them charge around $100 for an initial consultation (some of them don't charge anything for the first consultation - so you can look around and find one that meets your pocketbook needs). Yes Pushbrk I read it again - all 11 pages but its still clear as mud to me. So, His wife (the USC) files an I864 and includes his income on it - does she also include her mother's (the co-spondsor's) income on the form she fills out?
And when her mother fills it out does she include her daughter and son-in-laws income on her form or leaves those out?

Thanks but I still do not know how the form is filled out - does it show all the incomes on both the forms or just the person who is filling out's income in their respective forms? - Do they add up all the forms to see the total incomes or does everyone's income needs to be included in all the forms?
Yes, they do live with her mother - Yodrak.

Yes its being filed on his behalf but he is filling out all the forms for his wife and the co-sponsor to sign - just like most of us did for our wives. I think when I first asked the question - I didn't want people to be confused with who, how and why but Dan thought it might help others to respond - sorry for that confusion.
Still not sure how its done.

Thanks but you didn't answer my original question on how the I864 should be filled out. Yes, he is filling out the I485 but that's very simple and easy. The only problem is in filling the the I864. Can anyone else help? Has anyone else used a co-sponsor - how did you show the incomes?

My friend is in the country legally - waiting for his mother's asylum to be finalized. They have been here 3 + years - in the menatime he has married a US citizen and she will be filing an I130 for him along with the I864 - and that's where I am a little confused as how the income's are shown.

Friend of mine is filing an I130 and I864s. His wife is the US citizen and she will fill out one I864 - but she didn't have any income last year so her sponsoring contribution is 0. Her mother will fill out another I864 and she has enough income to cover the 3 people (and more). He will fill out an I864 and he has some income but not enough.
So, for the amounts in the I864 - are they the same on all the forms - e.g. he her Income, his income and sponsor's Income
Or are they different - each only filling out what they contribute. - If that's the case how does he show the combined income (or does he not have to?)
I filed a simple 864 as I sponsored my wife but this is a little tricky for me.

I don't think you can sue the federal govt. Immigration for your wife (and relatives etc.) is not a right, its a privilege. Besides the govt. choses not to be sued in any case.
Your best bet is to talk to an immigration lawyer and find out what you can do. If there is a specific incident/report based on which they suspect visa fraud - you may be able to overcome it but most people on VJ may not know much about such cases.

I think as long as they were sent "By Air" you are OK. If I mail a packet to India by air it gets there in 5 to 7 days - by 'surface mail' it can take 2 or 3 months. I don't understand what a 'first class' mail to international destination is? I thought those designations were for USA only. Good Luck

I have not heard of any one being asked for copies of any of these documents at the interviews whether in the embassy or at AOS. They do suggest make copies (as I did for my fiancee also) but she wasn't asked for these and I do not expect to be asked at the AOS interview either. My suggestion will be to make another one and keep it with you in case its needed - you can have another original - it doesn't hurt. The things most often asked for and looked at are pictures, letters, proof of living together (At AOS) etc. Good Luck and don't worry too much

Each country has a different way they do these so check with your local police department about what their certificate covers or ask the consulate. Maybe someone from the consulate you are going through can tell you how/what they did. (My fiancee from Colombia just needed to get one certificate as the whole country is covered by DAS and the local office provided her the certificate that is accepted by the US consulate in Bogota.) Language is just one means of communications. That said - how many Americans (or English speaking people) have you met and can not communicate with? I had several friends (including girlfreinds) that could not communicate well enough and that was the end of that - language was not the barrier - their way of thinking and acting was the barrier to our relationship going further.
Currently my wife is learning English and we talk mostly in English - I intend to learn Spanish through a language school (I know a little bit now) but this has not been a hinderance to our relationship. And yes sometimes its a blessing to not know too much - who wants to discuss the sorry state of politics in this country and religious fanaticism in this country (and the world) - better off discussing our trip to California and Vegas! :lol: Best wishes to you

I don't think her knowledge of English matters at all. My fiancee had her interview in Bogota (Colombia) and she told them she wanted to do it in Spanish and she got her visa without a problem! Her AOS (now she is my wife) is in 2 weeks and we will take an interpreter with us - she is still learning English and is trying to get over her fear of saying the wrong thing or not undrerstanding the other person. So! Unless the US embassy in Turkey is stuck on the K1s knowledge of English - she should not have any problems because of that. Good Luck

I did not give them a bank statement or any other asset statements with the I134 or with the I864 (for AOS) because I met the 125% poverty test easily with JUST my income. (I just gave them a statement from my employer.) So, I would suggest - don't worry about it unless you do not meet the 125% test, then you need to line up everything to meet the test and maybe a cosponsor also. Good Luck

I made an extrta set of copies for my fiancee and one set for me (of everything.) They didn't give anything back to my fiancee form the 'original' package. But she had extra copies of her birth certificate (and its translation) and her vaccination supplement (from the Doctor's office.)
We needed the birth certificate and the translation for the AOS filing along with the NOA2 from the K1 and nothing else - but they have asked us to bring copies of everything (Including the K1 package) to the AOS interview. You are right that its nonsense as many of them don't look at any of that but we are taking it with us to the interview as asked - in our case the K1 package was only 16 pages (so not a treekiller!) Many people distinguish between meeting the 125% rule for K1 and AOS - but these are only abour 6 months or so apart and I would suggest that if you don't meet it now then line up a cosponsor - just to be ready in case the K1 is denied. Good Luck

I would also add that some consulates are 'tougher' than others. So read up on people's experiences through the Manila consulate and send what makes you comfortable. There is no way to guarantee that submitting a ton of evidence will help the process or submitting bare minimum will impede the process (I sent in bare minimum with the petition and she had a little more at the interview - emails, chat records - she says she was well organized and could produce anything they asked for and hence it was 'very easy'.) As everyone else says it's quite a bit - I would add that either way - whether you get married now or later - all processes cost nearly the same. And things like having to travel to the consulate (hotels, airfare, taxis etc.) adds to the process. My wife's initial K1 was a little over $1000 and then the airtickets etc. to come here and me joining her etc. another $1500 and then the I485 etc. added another $500 - so it all depends on where you live and what and how you want to do. If you do plan to get married eventually - the visa fees are not that big a deal - its the other costs that are many times more. Good Luck

Hey Rose - meeting in person is a very strict requirement unless you can explain the reasons why this should not apply to your situation! And not having enough money is not a valid reason.
If you can not meet now, then you may have to continue the long-distance relationship till such time that you are able to meet. Also keep in mind that coming here and settling down and eventually finding a job and working etc. is a tedious process and you may not be able to generate any income for quite a long time and in fact may drain away money for such things as marriage, insurance, immigration related applications etc., so be aware and be prepared - waiting may be better, so you can establish yourselves and not have the relationship fail because of finances (vey common.) Hey Jimmy:
Ask her to get the following -
1) Police certificate (from DAS)
2) Birth certificate - I had my fiancee bring 2 copies to US (and one was given to the Bogota embassy)
3) Translations of Birth certificate (I had her bring 2 copies) none needed at Bogota
4) Baptisimal certificate (make sure the name is spelled correctly - if not then get it corrected)
5) Vaccination Records (to show the doctor)

You can in the meantime start getting your tax returns (3 years) and the I134.

Contact an immigration attorney at least for an initial consultation and then decide if you want to retain and use him/her. With an illegal stay status of your wife, I think your situation is more complex than of most people on this forum but maybe someone else may have an answer for you. Good Luck

Adding: If she gest sent back home, hopefully she is not banned for reentry - in that case you will be able to do a K3 - If banned for reentry, you will be in much more difficult situation. Good Luck

No, you can't; the fiance visa (k1) is done from here but its sent to the US embassy in her country. She then comes on the K1 and then you have 90 days to get married and file for Adjustment. You are probably thinking of adjusting status by getting married here - which is niether K1 or K3 or CR - but maybe others can post about their experiences - Adjusting status after marrying on a visitor or other visa is not too common a topic on these forums. I have been filing for many years online (turbo tax etc.) and I sent unsigned copies with just a notation "Filed electronically - Unsigned copies."
If you have unsigned copies - they should be 100% acceptable (I even accepted them when I worked in the tax dept. when auditing accounts.) Good Luck Oh yes! You should have copies of W-2s.
