Good list - only thing I did diferently was to send - 3 statements for Banks, credit cards, utility bills - one from 2 years ago, one from a year ago and a recent one - this was to show that we have had all these together (in both names) for the last 2 years - but I assume that one doesn't need to send three and just recent statements should be OK. They seem to want three years tax returns - so even if you didn't have income (or taxable income) - you can still file for previous years - showing for example - zero income, zero taxes etc. This way you can satisfy the requirement of having three years tax returns (a requirement of producing old tax return is different than requirement of having income in those years). Old forms should be available for free on the IRS site or many other sites - just do it. The fact that you are over the poverty line currently should be good enough - if not then you can call up on your old co-sponsor again. Good Luck

Another thing to consider - I sent in three statements from the banks, credit card, utility bills - one from 2 years ago, one from 1 year ago and a recent one - to show the continuity for the last 2 years - I think it helps but maybe its overdone (only adds about 10 or 15 sheets more to the packet otherwise; also I absolutely refuse to send in affidavits from friends/family as I feel they are very weak proof of relationship). Its not really funny - check out Al Capone's story - and see why he went to prison - not for murders, gambling, extortion etc. but for not paying taxes on his 'illegal' income! There are tons of crime bosses that have gone to prison for not paying taxes (easier to prove than to prove their involvement in murders/extortion etc.).

mzagorski - they do not typically respond to your response to the RFE.
Their approval of your removal application is their response to your documentation - else they may send another RFE or a denial. You only need to worry if they deny you - then you have a shot at trying to get the denial overturned - but do not worry - they may take a few months before you hear about your approval - this is normal. I didn't even send in this year's tax returns as I hadn't filed in January - when I sent in the N400. So, my wife will carry copies of the tax return and other stuff when she has her interview. Technically you can file your taxes until April 15th so if you are filing your N400 before then - that would probably mean that you don't have your tax returns filed by then (and its OK to not worry about sending what you don't have) - worse case they will RFE you for it and then you can send them the copies if you have filed by the time you get the RFE (for example I have filed since I filed her N400 and now I do have copies if they RFE us for it). TheWoat: I agree with your approach. Apply for removal and see what happens - later on decide on the citizenship issue (hopefully with an immigration attorney's advice) - if all else fails move to Mexico - or else come live with me and my wife (and a couple of dogs) - we plan on moving out of the USA eventually and settling in Colombia (hopefully in a year or two).
You are most welcome even if you speak what we don't understand - as long as you like some beer and some chillean red wine (they are available aplenty in Colombia and are pretty good). Ignore the idiots on this site and do what's best for you. Good Luck

I sent in a check with both names and also wrote 'void' on it. Credit cards - I just sent in copies of the front - I copied and pasted in a word document and sent in the word document with both cards (they have the same account number). I didn't blackout any numbers on the check or credit card - I guess I am a little less paranoid than others - but it should be OK as long as you leave some part of the numbers on the copies to show that they belong to the same account. Three things -
1) The back of the greencard is not just blank - it does have a barcode and a number (I don't know what the number is for?)
2) You are probably OK especially since most people are not interviewed for the removal in any case
3) Never carry the greencard on you if you have a driver's license - that's what my wife does - the driver's license is primary proof of her legality here (as far as policemen, govt. offices etc. are concerned - many of them do not recognize greencards as they do not understand it). Even I came to US as an immigrant but after a few weeks when I had my driver's license, I stopped carrying my greencard till I traveled or finally for the citizenship interview and oath (where they take it away).

One of the things you must send with your application - is a copy of the greencard (front and back) if you don't have it, you better apply for a replacement and send a copy of the receipt from that. You should use your joint account and send copies of the statements from across the 2-year period (I sent three statements - one 2 yr old, one 1 yr old and one recent); Also, what about credit cards in both names (and the statements) and utility bills in both names. I ordered a photobook (6 by 8)- about $30 with about 16 pages - you can write any description - it shows up at the bottom of the pictures. You can have one or multiple pictures on each page. Pretty useful for this purpose really. Many websites (e.g. Kodak) offer these - they deliver within a week or less. Good Luck

Affidavits are very weak evidence in my opinion. I never sent any for my wife's AOS or removal of conditions - and we were fine. If you have sufficient evidence of co-mingled lives e.g. Insurances, bank accounts, credit card accounts, tax returns etc. - then you do not need affidavits, but if you lack evidence of co-mingled lives then and only then send affidavits. This is very troublesome for removal of conditions (and for citizenship based on marriage) - I am a tax professional too (only worked for 20+ years in tax administration). Anyone that says that they are filing separately because of 'financial' reasons are full of it - generally they are too scared to disclose full income for fear of being caught.
Jointly filed taxes are primary evidence of your married lives together - not doing this is outright stupid in my opinion. Good Luck

My friend filed AOS for his wife - and the whole thing came back because he forgot to check the box for husband/wife on I130 - It's the first box based on which the I130 is being filed - so yes it's frustrating - but also an important lesson; to be as thorough as possible (I also wondered why they couldn't have checked the box themselves in the USCIS office? They had the cover letter explaining the same thing as well as marriage certificate as proof.) Good Luck

My total packet was 40 pages plus a photo book (another 10 pages). Those that try to send too much are putting themselves at a disadvantage - I think of the process as this - "How can I make the examiner's job easier?" To do this - I list everything in my cover letter (and I number those items - e.g. 1. Bank return Dec 08 - 2. utility Bill Dec 08 and the evidence itself is numbered (corresponding to the cover letter) - this way if the cover letter doesn't meet his/her requirement, then he doesn't need to go through my proof - if it does, he can check whichever piece he wants to check. I have worked as a tax administrator for 20+ years and have thrown out boxes of supporting evidence if it doesn't meet my criteria (I realized some tax preparers were making money by printing out more pages of unnecessary and unneeded 'proof'. They must charge by the number of pages). However, you must feel comfortable with your amount of proof - I do not believe in sending too much. Good Luck

I disagree. My wife's name is not on our house because its co-owned with my sister (in case of death she can dispose my house and vise-versa (I am co-owner of her house)). I never submitted any such statements - as we had enough proof of co-mingled lives - a mortgage is part of that proof - your bank, credit card, utility bills, insurance are more than enough proof of this. Many of us have not included mortgage/lease as proof, nor have explained this, you only need to do this, if you lack other proof. Good Luck

When I got loans for education - I asked for and received additional funds for dorm, food and transportation - you should move into the dorm - they are cheaper and the loans will cover it.
Are you trying to live in an apt. - don't be too proud to get a shared dorm room - do it for yourself. Also, you could look for jobs in retailing/fast food/health care industries - yes they will be minimum pay but every little bit helps. You must give up your hang-ups of having been well off previously - think of it as a passing phase - just do it - it will be over in a year or so. Good Luck

You are the same as you were with the greencard - you can travel, work etc. as before - just use your NOA and the expired greencard - (e.g. when traveling). As for affidavits - I consider them extremely weak evidence and didn't use them ever. If you have enough evidence of co-mingled lives like bank statements, credit card statements, utility bills etc. - then you don't need the affidavits (I too hate to inconvenience my friends or relatives for this). There are many things you can do:
For instance - you can both go to the local JC Penney or Target and apply for a store credit card in both names.
You can buy very cheap life insurance for each other (for $10 a month especially since you are both young) and put each other as beneficiary.
You can add her on your bank account and get chexks that have both your names on it .
These are all pretty cheap and easy and fast to do - do it by Monday!
Also, make sure to address each item asked for - you can write an explanation of why you don't have it - e.g. We don't own a home (we are renting and she is on the rental lease that you are sending (or resending);
Also you can explain the lack of evidence by telling them that your wife went back to finish her degree for xx months - hopefully it wasn't too long as that also means abandoning residency.
Your case is not too bad - just that you do not have much (as a student most of us had nothing either) but your situation can be remedied fairly easily from what I can see.
And remember to move on it NOW! headbonk.gif
