K-1 Fiance(e) Visa Process & ProceduresTo marry or not to marry..that is my question!
He can file for AOS after you get married. Just be sure to prove that getting married and staying here was not the intent when entering US. I think your case is somewhat normal and you should be OK. Good Luck

K-1 Fiance(e) Visa Process & ProceduresQuestions about the G-325
This is what you do - if it is the same employer - list the most recent address - in case they try to contact the employer - (seldom if ever done.) If you can't remember the full specific address - its Ok to just put down the street name (if you know) - I used just the name of the city and state and put a statement like "lived in Detroit, MI while attending college - 19XX through 19XX" - It's understandable by the authorities. Good Luck

K-1 Fiance(e) Visa Process & ProceduresWould this be good primary evidence?
Another set of evidence is letters from his family and friends saying they know that you were together (they should mention time period e.g. from Oct 2004 till she left in Sept 2005!) and have a genuine relationship (when you lack other evidence - this could work.) Good Luck

K-1 Fiance(e) Visa Process & Proceduresquestion 18 on I-129F
I wrote one line - I flew to Colombia and met her from Feb 3, 2005 to Feb 23rd. (I attached a copy of my itinerary and 2 pictures of us together.) But I do agree that copies of passport with the stamps and boarding passes are good to send (I didn't send them.) Also, write in as much as you feel comfortable with - I only described our actual meeting nothing about meeting on the internet for 4 months prior to in-person meeting! Good Luck

K-1 Fiance(e) Visa Process & ProceduresBank Letter
Actually you don't even need the letter from the bank - I qualified based on my income alone and din't include any documents from the bank, stocks and bonds etc. etc. If you can meet 125% of poverty line - you are OK - this is almost universally accepted. Don't worry about it too much if you are including it as a secondary evidence. Good Luck

My feeling is that you might be OK for the K1 interview (does he have any assets to supplement the sponsorship?) But for the AOS you may be in trouble and will need a co-sponsor - they are more strict for AOS from what I have read on this forum. You might be better off looking into a co-sponsor right now and be prepared if they don't accept his I134 for K1. Good luck

K-1 Fiance(e) Visa Process & Proceduresproof interview
You seem to have more proof than we did - but my fiance went through Colombia - look at the experience of people that have gone through your consulate to gauge what is expected and needed. My fiance only had 2 pictures of us together; 5 emails and 5 chat records that she printed out and a new letter of intent from em and she had no problems. Good luck

K-1 Fiance(e) Visa Process & ProceduresTranslation for just official documents or my emails also?
You don't need to submit emails - at this point - normally people use them at the interview stage and do not require translation at that point. All you are trying to prove now is that you two have met - an email will not prove it - an airline ticket, passport stamps, pictures with Arenal volcano in the back will prove you have met. Good Luck

K-1 Fiance(e) Visa Process & Procedurestranslation of documents
You are missinformed - I like millions of others have used translators both from the native country and here - they are cheaper in the native country. No authentication other than they know both languages is required. I used a translation done by a notary in my fiance's home city - he charged about $5 for it. No International Validation is required for Anything. Sorry to burst your bubble but you have incorrect information. good Luck all the same.

K-1 Fiance(e) Visa Process & ProceduresAnother question: Orignals or copies ok at interview?
You really only need to send him the original I134 and supporting proof e.g. employment letter and tax returns (if needed)- rest you can send copies - for proof of relationship my fiance printed out 5 emails and 5 chat records (so no originals of anything were sent by me for that.) Good Luck

K-1 Fiance(e) Visa Process & ProceduresBirth Certificate Notorization Question?

Ok, I have a similar question.

I recently requested a certified copy of my Birth Certificate (BC) and on the BC it has stamped 25 AUG 05. I noticed that on the copy it no longer has an embossed state seal.

-= Abel =-

Is this a Colombian BC or a US BC? I used my wife's Colombian BC (original) and a certified translated copy when I filed the AOS (She brought 2 BCs and 2 transalted certified copies for use here.) That worked well. Good Luck

K-1 Fiance(e) Visa Process & Proceduresquestions about bank statements?
Why do you need a bank statement anyway? If you qualify based on income alone - I wouldn't submit any bank statements (I didn't for K1 and for AOS either.) However, if you do submit them - they do not have to add up to anything - people borrow monies and withdraw monies from other sources (e.g. 401s, stocks and bond sales etc.) and can often have more money in the bank then they make (lucky ones!) Don't worry about that part of the statement. Good Luck

Did you send a payment (or your lawyer?) Was it cashed or not? If cashed that would mean you will receive your NOA1 soon (or your lawyer might if he used his address.) K-1 Fiance(e) Visa Process & ProceduresWhat will happen when denied?
Hit the nearest bar and drink cervezas till the wee hours of the morning. You are rarely denied - mostly delayed for missing documents or not meeting sponsorship requirements (most common in some consulates e.g. Bogota.) So, once you produce the missing docs - they normally approve you. Don't worry - check your documents and make sure you have everything to provide adequate proof of finances and relationship. K-1 Fiance(e) Visa Process & ProceduresGross income? --still unclear (form 134)

The income they count is the amount on Line 12 of your 1040. They will not count your gross receipts before your self-employment taxes and business deductions are taken out...

This is the risk of self-employment.. you personally want to make as little as possible to pay the least amount of self-employment taxes and pay as much of your expenses out of your business as you can... it works most of the time, but in this case it is working against you. Unless you want to try and find a co-sponsor, redo your taxes to get your self-employment income above 125% of poverty line.

I disagree - I am not working so don't have a W2 (I get a 1099) - I used my AGI from line 22 on the form I864 - I think others are confusing you because they work and have only one source of income - their work.
In my case I have a little income on line 7; a little more on line 10; most income on line 16; negative income on line 21 and the total/net on line 22 is what I used for my forms.
Good Luck

You will need to support her from becoming a 'public charge' that means if she goes through public assistance programs you will be liable for the payments. In reality you need to meet 125% of poverty guidelines for your 'new' household size. Here's the link http://aspe.os.dhhs....06poverty.shtml
You need to make $13,200 times 125% for two people (if thats just you two - no kids) or $16,500 per year. Good Luck

I think you will be fine if you meet the requirements now - but I do not know how strict those guys in the Indian consulates are - you can line up a co-sponsor just in case (a friend is OK - all they need to meet is the 125% of support and they must be a US citizen.) Why delay your marriage and AOS to the last possible day - that is going to extend the time you can't work or be productive here? If you are having second thoughts about living here - you may want to discuss it with your fiance/e - there's no shame in bailing out now - and this country is not for everyone - many don't like the marketing nature of the economy and the fast paced life and lack of social interaction that is so different than in many other countries. Many forms are used for multiple visas so the DS2001 maybe similar. To file for K1 you file the I129f and later on the embassy gets involved and sends out various forms - where in this process are you?
