You are probably Ok, but some people do get denied. How sure are you of your documents, especially support papers? If you buy the cheaper ticket, you may still be OK - I think they charge you $100 to reschedule most of them. Good Luck

One of the problems of trying to adjust from a visitor's visa or the like lies in what happens if they are denied. I believe that with the K1 denial you have many recourses whereas with an AOS denial from a different visa - you are hauled out and banned for many years! So, why take the chance when you do not fall in that category (besides also being dishonest!) If you think its OK to do what others do dishonestly - you are showing your morality or lack therof. I have read before that the homeland office (immigration) just discards the other 3 copies - so it is very possible that you may not get a RFE. The best thing would be for her to go through community colleges - they are typically less expensive than state universities but it varies from college to college and state to state. She can then 'transfer' most of those credits to a university that she wants to graduate from later which she joins after a year or so of establishing residency and hence gets the state tution (avoid the out of state tution - they are very high.) Typically the admissions director can explain the requirements of meeting state tution eligibility. Just call or write to them. Good Luck

No. Relax. Just send the proof of meeting at this point. The I134 and employment proof is needed at the time of interview not now. Make sure to do the G325 (send them all 4 copies - with original signatures) both yours and hers and definitely some pictures of you two together and copies of passport pages with stamps of entry and departures, itineraries etc. Good Luck

As you will agree, most of the USCIS process is vague and bureaucratic but we all know that the initial application doesn't need to meet even the 125% of poverty criteria. Also all interviewers have formed their methodology to evaluate the petitions and in my opinion a Bank statement is never needed for those qualifying based on income alone notwithstanding all the mumbo jumbo of their procedural codes. You do not need anything from the bank
- Most of us qualify based on our income alone and do not need any other information. This is a misconcept that people are repeating adinfinitum.
If you do not meet the income criteria then you will need other proof like bank letter, stocks and bonds and property values etc.
For most of us - you can leave everything blank except for the income part. If you meet the 125% of poverty requirement - you are all set for now and later (AOS) also. Good Luck

I didn't tell them that we met through the internet in the petition. I just put down the dates of my visit to Colombia and gave them the copy of my itinerary. Because I construed it to mean meeting in person not how we got to know each other or how we got introduced.
At the interview, she was asked the website name and she told them. I have heard there's new legislation about to become law that covers internet 'marriage brokers' but not sure how it applies. Good Luck

Even though it seems a lot of paperwork - it really is very simple. Talk to her and have her understand that she should take it one document at a time and get it done slowly - no need to hurry - e.g. get the police clearance one day, vaccines another day; birth certificate another day; passport photos another day; etc. etc. It just seems complicated but its all really very simple. Though some people believe that the bank information is vital. I didn't give them any bank information for the K1; I134 or the AOS (I864) - because I was qualifying based on income alone. Jenn is correct. For the petition I only sent in 2 pictures and a copy of my itinerary (airlines) and for the interview she took about 5 emails and 5 chat records and nothing more. This was for the priod of about 6 months (since we met.) So, it all depends on what you feel comfortable with - some people take suitcases full - she only took a small folder with her. Good Luck

A friend of mine used a lawyer as he doesn't have any time for this either - He paid $3000 for his fiance's K1 and her two kids (K2). I told him he can do it for free but he chose the lawyer route - who incidentally doesn't even live in the same state that we are in! Since losing a $1000 ticket is too much for you, you better take some time and learn the process as it doesn't seem like you have the money for a lawyer yet! I did it on my own and used the money for trips to Orlando. Good Luck

I think this is all secondary info and is not critical to the process. You can prepare correct copies and submit them at a point where its possible (say at the interview stage or now.) Don't worry about it too much - if you get an RFE then it will work out even better for you. Yes RFEs are not really bad after all. :lol:

Just do the easy thing - email or call the US consulate and ask them what else you need (or don't need - more likely.) Then go with what they suggest. I would assume that the Swiss law will be what the US consulate will want to satisfy (its what they do in Colombia - they satisfy the Colombian law for taking kids out of the country and yes there they need an agreement(a court paper) signed in the social (child welfare) court office if the name of the father is on the birth certificate.)
