As long as you meet the minimum requirements for the household (I am guessing it would be you and your fiancee and maybe your son also) you are fine. You meet the financial portion of the requirement (you will also need a letter from your employer). There are other things e.g. proof of meeting in the last 2 years etc. that you need to show also. The US consulate (you haven't mentioned which country) will also have local requirements and level of scrutiny that your fiancee (and you) must pass before the visa will be issued. Generally speaking people from so called high fraud countries have a harder time. Good Luck

You also don't need a W-2 to file - you can use the last month's (or week's) pay-stub for filing. However, if you need other things like bank statements, Property tax statements etc. - then you may have to wait. If not, then you can file on Dec 31 and when you get your W-2 send a copy with the copy of the electronic filing (yes you can print a copy when you file electronically). Many people file on Dec 31 - we had to have our electronic filing system (Colorado state) up by Dec 31 to allow people to file that early - there were always a few people doing it that early. Try consultation with an immigration attorney as both of you seem to have issues that could be troublesome. In my opinion its better to know from a professional what to do or not to do. In any case you must tell the truth about your situation if and when asked so perhaps he doesn't have to divulge his part but you will have to when you get the packet3 and 4. I agree with you - generally the passport must be valid for another 6 months to allow the person to travel - it doesn't make sense that it should have been issued 8 months earlier for them to grant her a visa - perhaps they are saying it must be valid for another 8 months to allow an additional 2 months for getting the visa and buying tickets etc. Perhaps someone going through the Thai consulate side can clarify. Don't stress about little things like that - Even the 'Declaration of Independence' has spelling errors and words crossed out - they didn't wait for it to be typed correctly and looking neat etc. - it was more important to have the declaration written and signed. Good Luck

My fiancee took 3 or 4 letters and 3 or 4 emails that she printed out - no phone records, no pictures, no IMs etc. - She had no problems (she went through Bogota, Colombia).
Take what you have or can and don't worry too much - most people seem to be rejected for two primary reasons 1) Financial support insufficient or questionable and 2) Paper work missing or incomplete - yes they are allowed to re-do it and come back to remove the 'objections' later on - it just delays their visas by a few weeks or months. Don't worry about the postal codes. On my application for citizenship - I wrote that I had lived in several places from xx year to xy years while going to school and then while working in Michigan - and nothing more. If you know the address write it, if not - mention the city or state whatever you remember. (I had lived in Detroit, Southfield, Port Huron, Ann Arbor and a few other cities that I don't even remember the names of over aperiod of 3 or 4 years!) Good Luck

Even my regualr camera (35mm) has a feature to turn a date/time stamp on and it prints on the front of the picture - but I don't like to use it as it makes the photos look a little strange! I sent in our photos without any dates (digital or otherwise) I even forgot to put names and dates on the back - they were sent blank - I guess our examinrer was OK with them - If he wasn't - there was no way to go back and redo it unless I had the Walgreen people put dates on them. :lol:

I thought some muslims have gotten away with it (from India/Pakistan etc.) but do not know of any specific cases. However there are easy examples of people not being able to meet - consider that many areas are in the war zone (Iraq has been for several years) or are in war-like areas and the foreigners are not issued visitors visas by the US consulate. I assume they are not part of the VJ community and therefore no posts have appeared here relating their cases. It will make for interesting reading if they post.

The RFE I received said - "Place this letter on top of your response. Submission of evidence without this letter will delay processing of your case and may result in a denial. Please use the enclosed envelope ... ... "
The RFE also has a barcode on the top - so a scanned copy may not work but I am not sure if any one sent in a scanned copy and were okay. I sent the original copy with my response.
SO, you can go ahead and hope you don't get an RFE and if you do then you have a choice to use the scanned copy or not. If your lawyer is going to receive this - isn't he going to respond to this also? In that case he should be sending the original back with the response - isn't that his job?
I think in either case you will be okay. Since you have already decided to pay someone to do this, what's paying a little bit more, if you have an RFE. I hope you don't because the reason you hired a lawyer would have been to avoid a mistake that is sometimes made by others - correct?

A little different. I didn't send my birth certificate because I was born in India (I don't have a birth certificate in any case). I sent in a copy of my citizenship document (send a blank paper and write back of naturalization certificate on it in addition to the front copy). Generally speaking the petition is valid for 4 months within which time the visa is normally issued (provided you do what's required in packets 3 and 4). However, the embassy's automatically extend this time if the delay is caused by them (generally because of a backlog) and the end date is not considered 'critical'. Your visa is valid for 6 months for one entry - meaning you can travel to the US at the latest on Sept 6th in your case. After which you will have 90 days to get married and then you can file for AOS. So, get a ticket for your fiancee prior to Sept 6th and forget the petition date - you are beyond that stage now and need to focus on the next step. Don't worry about every little thing and try to enjoy the arrival of your fiancee. good Luck

I submitted two pictures of us together; no receipts, no boarding passes no letters just one line on the I-129 on how we met "I visited Barranquilla and met her from February xx, xx to xx, xx. That's all.
Don't worry too much. When and if you get an RFE then you can deal with it. For now, you can check the dates the service center is working on and worry only when they go past your NOA1 date. Good Luck

You probably have more than enough but each examiner have their own criteria - I only sent two pictures of us together and just used one line on the I129 to describe how we met. (No passport copies, ticket copies or boarding passes - I sent a copy of my itinerary and that was all. )
What concerns me about your trip is that you didn't stop-over in Khajuraho - a one day stay and you could have seen the fabulous temples of Khajuraho (also known as the sex temples)! Don't worry - send as much evidence as makes you comfortable - I always send the minimum (and for the petition I only had 2 pictures of us together anyway!) Good Luck

I dont know if you realize the form is 4 pages long, I believe it says page 1, 2, 3, and 4 at the bottom of each page. It sounds like you want to make 4 copies of the first page.

I don't know if it would matter if you sent 4 page 1's since they are all the same, but thought that I'd give you a heads up.

Also please note that they want original form with signatures - so make sure and sign each page (or each copy if you choose to copy it) and send the original signed pages - both sets - keep the copies for your own records. Good Luck

Quick note. If you have an engagement ceremony in India - do not include these pictures in your proof. Why? Because no one can tell the difference between a wedding picture and an engagement picture and at least one person was rejected for being married. Search the archives and you might find the discussions from about one year ago. I am from India too and the weddings and engagements I have seen - even I couldn't tell the difference - so take some pictures with family and friends but avoid including engagement pictures, especially those with elaborate dresses and jewelery. What if I make 125%+ of the poverty guidelines but don't have squat in the bank? Should I leave the "I have this much in savings" line blank? Also what about the assets, stock options, etc.?

Because I qualify based on Income Alone I left the Bank and other asset lines blank in both the I134 and I864 (for the AOS). We got through without any questions asked, so you don't need to fill those lines or gather those documents either. Good Luck

Though I agree with almost everything you say - I think that many people come across this site 'after' they have started the process (I and many of you found this before or at the same time as when we started the process.)
For those, who didn't; its a hell of a task to read through all the guides, example forms and pinned info and do searches for specific topics etc. - and many of these features are unknown to the new users - it took me a while to figure all this out also. For them its much quicker to just ask the one or two specific questions they have at that point in time; they do not know if this site is even worth their time or not; its only later that they will realize as we did, how helpful it really is - if at that time you help them by giving them the links to the guides or example forms or suggesting it - that's very valid and gentle thing to do. Or, be the brave one and give them the answer directly or by describing how you handled that question. I like reading some of the new posts asking the same questions - to see how people respond based on their experiences - it tells me that there are many ways to 'skin the Immigration cat'. Rationale - no one has the kind of time to verify each and every piece of info on all the pages, let alone on 4 copies of one of the forms!

My fiance came here without knowing much English and she is taking ESL classes but she talks to all her friends and family in Spanish and is making very slow progress (we took an interpreter to our AOS interview also.) She is in her 2nd semester of ESL classes (level 4) and may have to go another semester or 2 (they only go up to 6 levels!) She has been here since late August - she does have friends/family in Florida some of them actually speak extremely little English (even after 2 or 3 years) but are working! Good Luck

Also, is it true the form must be double sided? I would say it doesn't matter, just photocopy it that way at the end, but since it has to be notarized....

I used option 2 when I filled it out as it seems most appropriate meaning basically that all supprot will be provided if needed.

I asked someone and they suggested I do not do the onesided copies - as they might think it was not an original form - so I just printed one side and then printed on the back of it. Its not that hard to manage.
