Congratulations, however I disageree with your approach as you sent in too much in my opinion - my total application was 16 pages using one paper clip (and NO chats, emails etc. - they were for the interview not for the petition.)
So! Do what makes you comfortable - I do not like the overkill approach and was happy to send more if asked for (but was never asked for more.)
I would add that my fiancee was not from a high fraud country (take that into consideration also.) Good Luck

I agree with Texasbound; allow 3 hours for the Miami airport. You can get away with less time if you do not travel on Friday-Sat-Sunday. Also if your fiacee isn't too comfortable with language/airline traveling - allow more time. Having said all this - I almost missed my flight on a trip from Costa Rica through Miami because of long delays - I had 2 hours between flights (I am a USC). When my fiancee came through Maimi last August - she was the first in line in Immigrationand was outside the customs area (done with everything) in 15 minutes! Good Luck

I also do not think you need a letter from your parents if you have a few photos and boarding passes etc. (I did mine with a minimum of supporrting docs also.) ALso, your fiance is from France - not a high fraud country so don't worry too much. And lastly, I do not like the wording of the letter - unless your parents are lawyers :lol: Most people will write routinely that they met their daughter's fiance and know him to be a nice person and hope that they can marry and have a nice life or other words like 'normal' people use. My advice - don't worry about a letter and if you do get a 'normal' letter. Good Luck

When I sent in the petition, I forgot to write names, dates and who was in the pictures (there were onlt 2 pictures of us together) - Didn't have a problem. So, do what makes you feel comfortable - Good Luck

hey Stinger don't abandon the K1. I see that you just filed at the end of September - give it more time - the normal is between 4 to 6 months from the beginning to the end. Do not abandon the K1 process unless you get rejected - then you may have to face the same problems with K3.
In any case - Bogota is very very easy for K1s and hands them out very routinely. Do a search for club colombia and read other people's timelines/experiences etc. You can also email some of them to get some help. (You can check my timeline also. )Good Luck

Hey stinger, my wife (then fiance) received her packet 3 from Bogota about 2 or 3 weeks after the NOA2 was received. So perhaps by end of January she should have it. Mail is not very good in Colombia so if she doesn't receive it, she will need to call - the process is screwy - you have to pay to get a pin number then you can call using the pin number to find the status of your case on a specific day and time. Many people had to do this (but for my wife - she received packet 3 and then 4 at her home through the mail without a problem - she is from Barranquilla.) Good Luck

Do not get married if you are not ready for it. Marriage is more important than a visa or being in compliance with the rules. K1 is not for dating but assumes you are reay for marriage but if you are not, then let her go back and refile if and when you are both ready or look for another person. Whatever you do, do not get married if you are not ready - that will be worse than trying to refile for K1 or K3 etc. later on
I had walking Pneumonia once - It is extremely weakening and I do not agree with Girona's definitions - when I had it, I could not even hold a glass of water in my hand (dropped it on the sink trying to lift it - don't ask me how I drank the water and swallowed my pills) - only after 2 and a half days was I able to walk and function. But no matter what - Do not get married if you are not ready, most people seeem to be stuck on the visa angle and not the 'life' angle. Good Luck

Don't worry - your pics are too close to the requirements for a problem - my fiancee got hers done in Colombia and they were slightly smaller (1.75 inches by 1.75) and wrong dimensions (the head to chin etc.) - I didn't even realize it and sent them in - no questions were asked. Good Luck

My feeling is that the temp EAd (at JFK) is not worth it for many of us - as you still have to get the SSN (a delay of a few weeks 3 to 6) and then you may end up having a gap between the temp and the next one obtained after applying for EAD. The gaps could mean not being able to work in the meantime (it will depend on the employer if they elect to continue the job.) Also unless he has been here before and knows the way of life (r.g. communication, driving, mass transport etc. etc.) the stamp at the POE doesn't do much. Its just my opinion, others do better with it. Also, you can save the money by not making multiple trips as you will need lots of money and time and patience in this proces. Good Luck

Jorge has a good and fast plan but be sure that your fiance also gathers all the documents needed in the meantime - many times there are mistakes on birth certificates/divorce decrees etc (wrong names/dates) and I know of someone who took a long time to get the papers from DAS. You want to try and avoid having the interview and not having some of the papers needed for the interview. Bogota is pretty fast and gemerous in K1s - not many are denied, so there is no need to hurry the process in my opinion - I let my fiance get comfortable with the docs - she did them one by one and understood what she was doing. There's a lot that she will need to do before she leaves - its hard saying goodbye to your family and friends etc. etc. - so I think taking it slow works well. Good Luck

My wife is from Colombia and the process for changing her name on the passport, meaning getting a new passport in the married name is very cumbersome. Currently she has her old passport in her maiden name and the green card is in her married name. We buy airline tickets for out of country travel in her maiden name (to match with the passport).
We discussed if the next time she goes to Colombia - if she should try and get a new passport in her married name and came across a problem- if we buy the return tickets here (which we routinely do) - the tickets to and back are in the same name unless you buy them separately. Buying them separately will most probably be more expensive (whenever I tried I got this result). So if she travels to Colombia - she will need to buy a one way ticket in her maiden name and coming back another one way ticket in her married name! So, she will need to try and get her passport changed and then buy her ticket back - probably way more expensive. Also if she can't get it in her married name then she needs to buy a ticket in her maiden name to travel back. And the longer you delay buying tickets - they may increase in price as well as cause problems with your schedule.
We decided - to heck with all this #######. She will just get her new passport in her maiden name and we will stop worrying about this when she files and gets her citizenship. Perhaps Kez traveled to Scotland on one way ticket so she was able have her passport match her new ticket purchased there and she got her passport fast enough to not have problems with her schedule. Scotland must be efficient in doing those but many other countries are really bad about it. For us, it isn't worth the trouble. Good luck with whatever you choose to do.

If you are getting married in India then you need to look into a K3 or a DCF (Direct Consular Filing). On a K1 - she can come here as a fiancee that means you can not get married in India and have her come here. Entiende? The residency requirement for DCF may be what you are referring to in your question but you have posted it in the K1 forum. You may need to check into the consulate website for that requirement or hopefully someone else may know it from their recent filings. Maybe they can move your question to the correct forum. I just realized that its the 'expensive' part that you are concerned with. If that's the case, are you prepared to have your fiancee not work for 6 to 8 months while waiting for her green card when she comes over on a K1? Also are you prepared for thousands in fees for adjusting status (green card fees)? Yes you can apply for employment authorization when you enter on K1 but that seems to be not worth it - it expires when your k1 expires so creates gaps in any meaningful jobs. Maybe you need to get some savings built up - in the meantime put up with the hassle of crossing the border in her car or take a bus ride across the tunnel/bridge and have your fiancee pick you up in Windsor. Generally you can transfer the title in your name and put down a nominal amount as what you paid. I did that once for the car that my sister gave me (she will need to sign over the title - remember.) When the MV office person asked me how much I paid for it (I had put down $5) I explained that my sister had basically given me the car; she crossed out the $5 and put gift instead. I had to pay the title transfer fee and taxes etc. to get new plates in my name. It was pretty fast and routine.
In my case - it was all done within US so no foreign citizen was involved. Is the car currently registered in Canada? If yes, tell her to sell the car - its a headache to sell/keep the car in USA - my friend's girl friend is from Canada and eventually she drove her Canadian car across the border back to Canada and junked it. If its a US car then you can do the title transfer easily. Good Luck

You are being too paranoid. US consulate in Colombia (Bogota) is very good in giving out K1 and K3 visas. Few are denied and those that are denied normally do not have the documents asked for or enough support (monetary). My wife is from Colombia and she was a little scared at first (she was denied a tourist visa 2 years before her K1 application). She called me from Bogota after the interview and said - "It was very easy." There is a thread for Colombians on visa journey and they can help you in Spanish or English with documents you need and what are the steps you will need to take.
Keep in mind - relax; do it slowly - one document at a time; don't worry. You can answer all questions truthfully - e.g. Yes I will be working in USA. Yes I will stay with my fiancee (wife) or her parents till I can find a job and support us both etc. etc. There is nothing wrong with that. You are migrating to USA to live - to study or work or start a business or all of these. Tell them of your plans etc. but only if they ask for it. Good Luck

I disagree. My fiancee's baptismal certificate ( a document required by the US consulate during the interview process for K1) - had her name misspelled - she didn't disclose that - she got a corrected certificate issued and submitted that with her documents at the time of the interview (that's what a couple of her friends had done also in Colombia).
The rationale - that's not a name she used - it was an error by the issuer of that certificate and the name was never officially spelled like that in any of her school, college, employment etc.- hence she just got it corrected on the certificate needed for her documentation but didn't say that she had used 'another' name. Do not report it as a crime committed or you may have big problems. On an immigrant visa application - an Indian guy checked that he had a criminal conviction and described it as getting a speeding ticket and paying the fine. The US consulate in Delhi denied him his visa for being a criminal - last I heard - almost a year later, he was still hiring lawyers and filing paperwork to try and get his visa. I had applied for and received my visa during the same period and left India shortly after I heard about this incidence. Yikes!

Its interesting to see how people categorize primary and secondary evidence and what's strong and what's weak - I sent in a one page copy of my itinerary from expedia and two pictures of us together, and we were approved.
At the interview, I didn't go to Colombia a second time, she didn't have any pictures with her; she took about 5 emails and 5 chat records nothing more in terms of evidence. She has been here for 2 years now. Colombia is an easier consulate I agree but a lot depends on how you present your petition and how she presents herself at the consulate. I felt very comfortable with the initial petition and subsequent material also. And so did my fiancee then. My advice, send what makes you feel helps meet your petition both in quantity and quality and present it as such. Good Luck

Since she is already here on a permanent residence - you could get married and file for AOS (Adjustment of Status) - Once applied for AOS - it should extend her greencard till approved. As someone else said - it's not clear if she has a 2 year greencard or not but I assume it is -else she could have just filed for citizenship. Was the greencard from a K1 to another US citizen? If yes then there could be more complications - perhaps you may need to talk to an immigration attorney or post more details of her greencard status - how she came by it etc. - More knowledgeable VJers will be able to help you then, Good Luck

It's very common for younger people to have little or no money - because they have just started in a career (or haven't started); have just bought a house (or are trying to, or planning to buy one); have just rented a house on their own (lived at home before); just bought a new car; just bought new wardrobe - etc. etc. etc.
For all these reasons and more - most younger people have very little in the bank and actually have negative equity because they owe lots of money to the credit card companies. I was one of these younger people, neck deep in debt, way back when, also.
Your fiancee needs to make 125% of poverty level to satisfy the US counsel - she may not make enough money or have enough money to satisfy your brother-in-law (He has no business butting into your affairs but I understand how some overbearing relatives are and you need to deal with them appropriately).
