K-1 Fiance(e) Visa Process & ProceduresCalling card
Phone records are an overkill in my estimation - for the petition you just need to submit proof of having met - nothing more. At the time of the interview you need to provide proof of ongoing relationship - my fiance just took 5 emails and 5 chat records - nothing more - and they only looked at one email for a few seconds! Good Luck

K-1 Fiance(e) Visa Process & ProceduresAttending fiance's interview - suggestion
Good for you but actually it depedns on the consulate - some of them don't even allow the petitioner into the consulate! And I know that in Colombia the fiance/e is definitely not needed - it often takes 10 minutes and they almost never ask anything from the US C. I did not even go as I had done some research and it seemed most people were there just for "Moral support" and didn't think it helped the case at all. May be Brazil is different but you can't go by one rejection - you should look at others experiences and then decide how complicated your case is and if you really need to be there - I saved $1500 + by not going there and we went to Orlando instead! Good Luck

K-1 Fiance(e) Visa Process & ProceduresUK RESIDENT WANTING TO MARRY USA GREEN CARD HOLDER
Be careful with the green card holder applying for your immigrant visa (family based.) Last week I checked and saw that the waiting time for a spouse for most countries was 5 years. If he gets his citizenship (after 5 years of residency) then he can do a K1 or a K3 depending on your marrital status at that time. A K1 or K3 can take a few months (3 to 6 months generally) where as an LPR petitioning is taking years and no guarantee if the dates are pushed back or not. Best bet - have him talk to an immigration attorney and then decide which route he should follow. Good Luck

Hey don't hire a lawyer - just check out the example forms on this site Towards the top left hand side of this page. If you have a specific question on a field ask and people will tell you what they put down. And its OK to put down any of your work study or even unpaid internships. Good Luck
P.S. If you got money to spend and don't have the time you can find lawyers through this and other sites also

K-1 Fiance(e) Visa Process & ProceduresCD and Notary
What are you - NUTS! Way way way overkill. All you need to provide at this point is the proof of meeting like stamps in your passport, airline tickets, pictures of you two together in a drum going over Niagara falls etc. And even at the interview all you need to provide is some ongoing proof like emails or letters or chat records (again just show them a sample not your life history.) Remember KISS - Keep it Simple Stupid - The simpler your application is, the easier it is for the examiner and/or interviewer to approve it. Try and make his job easy not more complicated. Good Luck

K-1 Fiance(e) Visa Process & Procedureswhat is green card?
Green card is the proof of legal permanent resident (LPR) status. And yes you normally get it within a few days or weeks after the AOS (Adjustment of status.) The Green card allows you to do pretty much everything a US citizen can do except vote or hold certain jobs. And its no longer green in color its more white than green! Good Luck

Like others have posted before - show letter from employer stating he is expected to be back on the job on xyz date; Have a return ticket (I am assuming he is doing this anyway); have rent/lease agreement showing he is living there and will be back.
He should be able to explain why the K1 was canceled - e.g. decided to have her migrate to france instead of me in 2007 because it will be better for us in these ways
Number 1 through 10!

Most people don't even have rings or receipts for rings (We didn't.) We just had a vague plan - we will get married in vegas if the visa is granted - but no one asked her at the interview! (We got married in a court - simple in and out deal.) Don't worry about this aspect of the interview - show proof of relationship - letters/emails/chat records etc. Good Luck

K-1 Fiance(e) Visa Process & ProceduresI-129F, QUESTION 10

Yes, I was born in the US and yes I do have a birth certificate, but does that mean that I have obtained a certificate of citizenship in my name?

Your birth certificate is your proof of citizenship. For others like me; we have to submit a certificate of naturalization (I wasn't born here and became a citizen through the green card route.) And No - you did not obtain a cerificate of citizenship - you are a citizen because you were born here! You are good to go. Good Luck

One of the idiots at a place I was filling a form asked me for my middle name and when I said I had none - he put down something - when I got their receipt it had "NMN" as my middle name! This was not an official document (I think I was getting a flue shot) so I just laughed at their idiocy! Put down "none' or leave it blank or put down "N/A" I think all are acceptable.

If you have the time to learn the process - read the guides here, see the example forms here and read the forums and follow people's timelines - you will realize that you can do it yourself whether you go for a K1 or K3. A lawyer will cost you anywhere between $2000 to $5000 or more. I was able to figure out everything on my own and have even sent people my filled out forms and packets to help them - so I am sure others will help you as well. Don't be afraid to ask for help in the forum or through emails to individuals. We all know how it is and are willing to share. Good Luck

K-1 Fiance(e) Visa Process & ProceduresNEED PEOPLES OPINION
For me this is a no-brainer. I would give them pictures, full names, locations times and all details - many papers do stories on naturalizations etc., so this is no different and unless you were bad-mouthing the USCIS I don't see why it will hurt you. But its your comfort level - I won't have a problem doing this. And by the way, I disagree with most people - pictures are less likely to out you; the names will be easier to identify you (yes even just the first names.) Good Luck

K-1 Fiance(e) Visa Process & ProceduresEmployment Issues
Your employment history won´'t make any difference now, but be sure to know about employment opportunities here. It all depends on which state/city you come to and what your education and experiences are - do not expect too much and be prepared to start at the bottom if need be and you will be OK. Also, be aware that you may not be able to work for a while as your EAD gets processed (unless you come through JFK and get the EAD stamp.) Finances can be tight, especially in the beginning - so be ready to eat lots of hamburgers, beans and rice! Wish you the best
Being prepared for a delay and the survival conditions will be best for your mental well-being so you do not end up expecting too much and getting little or nothing in the beginning.
Hope for the best for you and yours

The letter also should say that you are 'able' to marry. That means all prvious marriages must have ended in divorce or annulment or death and you need to provide the proof of that. If you read the forum, some people forget that they had a marriage several years ago and do not get it resolved and then they get stuck in the K1 business for a long time. Good Luck

K-1 Fiance(e) Visa Process & ProceduresChildren of K1

A K2 can have their interview/medical to apply for their K2 visa up to one year after the K1 visa is issued, but then must use that K2 visa to travel within 6 months of its issue date.
Hope that helps to clarify things for you.

That would make the faq incorrect or unclear at best.
I now understand the time frame to be
1) The minor children of K1s can apply for their K2 visa within one year of the K1 being granted
2) All K2s must travel within 6 months of the K2 visa being issued.
I hope this is in fact correct? Any other opinions?
Thanks:

motu,
Doesn't take an expert - look at the expiration date on the visa. (It will be 6 months from the date of issue.)
Yodrak

Ok Yodrak:
I thought you are right (you do know a hell of lot more than many others) but someone else sent me an email with this.
"A K2 Visa holder (child of K1 Visa holder) may enter up to one year after the K1, but a K2 Visa holder may not enter the U.S. prior to the K1." This is from Visa Journey http://www.visajourn...sa-outline.html Read step 3.
So, is it one year for the kids or they changed it to 6 months?

You didn't specify which country the beneficiary of the petition is from; so, do what makes you comfortable - I sent 2 pictures, a copy of my itinerary and a two line statement on the form.
Sending letters from family seems like an overkill at this poiny. You can do that if you get an RFE, which I doubt in your case, as you have more evidence then I sent. Good Luck
