Just use a paperclip or some such device - stapling may cause damage to the docs when they take it apart - so I would advice gainst it. Make your check out to US Dept. of Homeland Security (though they will cash the check even if it was made out to USCIS). Read the instructions one more time to understand - who to make the check out to, and where exactly to mail the packet. Good Luck

I do not think that denial of tourist visa has anything to do with a K1. I totally disagree with Wallace on that. The only thing is that since she has been repeatedly applying for tourist visas they will look at the relationship angle more thoroughly - so make sure and go with her to the interview. Best of Luck

K-1 Fiance(e) Visa Process & Proceduresmeeting last 2 years
QUOTE (johnm @ Jun 12 2008, 09:29 AM) <{POST_SNAPBACK}>
Thanks. For the meeting in March 2008. Will it be enough to show:
1) My passport showing I was in Country A in March
2) Her plane ticket receipt and copy of baggage ticket (only can get if she was on plane) going to Country A?
3) We have a few photo's I will send but they don't have date on them
I also have a small video I made on my phone I can try to put on CD Rom. Will they accpet that?

For being together in 2006:
I have my passport showing I was in her Country until Jan. 2007. Will that be good enough? As I mentioned I don't have any other primary evidence since we were both in the same country and have no phone receipts (togther), hotels (lived at her mom's), ect...

You have more than I submitted - I submitted a copy of my itinerary and two photos of us together. That's all. However, You have not filled your timeline or signature to show which country are you trying to sponsor your fiance from? For many countries you have enough evidence but for some (more fraud prone countries) you may need more, but you do have more than minimum required. And yes you can write the names, dates and places on these pictures e.g. Dec 17, Paris France, me and my fiance rappelling down the Eiffel Tower. Good Luck

K-1 Fiance(e) Visa Process & ProceduresIntroduction and question
QUOTE (pushbrk @ Jun 11 2008, 08:19 AM) <{POST_SNAPBACK}>
Now that you've asked this, I want to give you some important counsel. This process requires one to read and follow instructions carefully and to interpret literally. For some, language skills are not sufficient or they just don't have the aptitude to handle the detailed work. Any who cannot do what is needed, should probably get help. For many, a simple wake-up call like this is all it takes to get them on the right track.

My advice - don't fill these forms or gather your packages in the morning or late at night unless you have had at least 3 or 4 cups of hot coffee to wake you up. Better to create a list of what you need to gather - from the guides here and thousands of examples submitted on the forums - and then you can keep checking things off the list to get to where you are going.
I also tried to tell the same thing - about the 5 year passport requirements on another forum - but the forum members insisted that this person must get a new passport and I think he took their advice - I was surprised how many people misinterpret the instructions in horrendously twisted ways - I always try to make logical sense out of the requirements and that seems to work well for me. Good Luck

If there is anyone who has successfully completed the K-1 process and obtained the visa, who has experience with the forms involved for filing, that would be willing to look over our forms, I would greatly appreciate another pair of eyes looking at our I-129F, the G125, and my fiance's affidavit. I could send the files to you via email if your willing or through VJ if it allows me to do so. I don't wish to post them on here as they have identifying information. We just want to be sure we are doing this correctly. thank you in advance.

WHy don't you just post here what you are enclosing in your petition for example - I129f, G325 hers and mine etc. etc. - and we can tell you if it sounds good - no need to look at all the details - this is not brain surgery! Good Luck

K-1 Fiance(e) Visa Process & ProceduresInterview Question
Its a non-issue - the petitioner is not required to attend. Also Canada not being a fraud country - there shouldn't be any problems with his not being there. Many of us didn't attend the interviews because of time and cost constraints. Good Luck

Two things - the petition is generally pretty thin (mine was only 18 pages), so you can just use your cover letter to describe the contents and then put the contents in the same order behind the cover letter and use a paper clip. No need to go fancy or send them tons of paper work. Good Luck

sydkym is right on! Declare all your divorces on a separate sheet (its true for all questions if you run out of space). However, I don't think its too critical and that's why they probably do not care about it. The USC has nothing to lose in any case but, if the beneficiary is lying about their info, it can come back to haunt you during AOS, Removal of conditions or during citizenship - so be truthful. Most people get married in a court to facilitate the paper work and then have time to do a planned wedding later on - some of us are OK with just the court wedding. So, you can choose to do either or both and do not need to have a set plan; instead you can tell them (if asked) that we plan to get married in xxx days after arriving in USA. Good Luck

I always use USPS certified with acknowledgment due - never used express or overnight (It always got there in two or three days even with just the regular package mail (1st class)). With the certified receipt number you can track it online and the acknowledgment card is proof that you sent them your application or ehatever (and was received). Good Luck

K-1 Fiance(e) Visa Process & ProceduresAdvice neeed!
the US consulate in Colombia requires you to submit your tax returns with the I134 (my fiancee was required to provide last 3 years tax returns); so if you made enough money in the past 3 years and have assets (to overcome any shortcomings of your current income situation) - you are OK and do not need a co-sponsor. To be sure, though, a co-sponsor is a pretty safe bet. Good Luck

K-1 Fiance(e) Visa Process & ProceduresI NEED HELP AND ADVICE PLEASE
If you are both living in the UK now, the best option would be to do DCF if the consulate in UK allows it - I am not sure if they do. Else you can pursue the K1 or K3 options depending on when and where you want to marry. If and when you go for the K1 (or K3), you will have to prove to the interviewer that your relationship is valid etc. If you come here and try to adjust status then you have a bigger hurdle - to prove that you didn't intend to marry when you came here and if denied its a 10 year ban I think. The best alternatives would be DCF or K1/K3 in my opinion. Don't worry about a previous relationship, that has happened to many and you have to convince the interviewer that your case is genuine. Good Luck

K-1 Fiance(e) Visa Process & Proceduresplan to live in Brasil
It all depends on what you and she wants to do. In our case; my wife wanted to spend some time in USA (no visas are available in Colombia - less than 5 or 10% get a tourist visa) and I was not ready to move till I decide on 'where' I want to live.
Originally I was looking at Costa Rica but the greedy real estate developers have made the country useless (it also has developed some dangerous problems) so now we are looking at either a small city in Panama or a temperate climate in Colombia - in the meantime my wife will get her citizenship and then we can travel on an equal basis with our US passports (Many countries are hostile towards people with non-US or European passport holders, especially in granting visas). So for us, its important to get the US citizenship for traveling before we settle down somewhere in Central/South America. Talk to her and discuss what's important or not. Good Luck

K-1 Fiance(e) Visa Process & ProceduresQ about me taking my daughter with me to USA
QUOTE (tallcoolone @ May 4 2008, 11:36 AM) <{POST_SNAPBACK}>
Suggestion.

Go to NSO office and do another Birth Certificate, and for father leave blank or put in Unknown.

I wouldn't recommend removing the fathers name from the birth certificate - many places have mechanisms for taking a child out of the country if the father is not traceable - you may have to ask a local attorney. I don't understand why you would make the child to not have a father - that would be very humiliating once the child grows up and looks at you with resentment. Good Luck

K-1 Fiance(e) Visa Process & ProceduresQ about me taking my daughter with me to USA
It all depends on whose name is on the birth certificate - if a father's name is there, then you may need such a letter - if there is no name, then either nothing is required or a document from a court is required depending on the country's requirements to leave. Post a little more details and someone can tell you exactly what you will need - many people have done the same. Good Luck

K-1 Fiance(e) Visa Process & ProceduresJoke from USCIS
USCIS is overall excellent - how to compare - look at other countries' immigration systems - Costa Rica sucks big time; Colombia - doesn't provide any information and every process is subject to change and change retroactively - India - you need to feed everyone with $$$ (Rupees actually) to get anything done. Perhaps a few European nations and or Canada may be better at this but USA is pretty good and above all you can approach your congressmen to help you; in other countries they will laugh at you if you asked them to help you with their bureaucracy (I know my own first cousin - a Member of Parliament who laughed at my brother for help - this was in India!)
So, before you complaint too loudly - look at everything else involved and you may agree that it's better than DMV or IRS or SSA or Medicare or etc. etc. etc. Good Luck

K-1 Fiance(e) Visa Process & ProceduresPermission letter
It's quite common for the remaining parent to bully or blackmail the parent going to USA - for most of them - USA is clearly a very rich country and their ex-spouse should be able to pay them at the very least (or they like to make it hard for them because of jealousy of his/her better status). Its a common advice given (especially in Colombia) to not disclose the reason to the remaining parent (of course they invariably find out what's going on - most other relatives already know and it gets out fast). But sometimes telling them that they want them to visit another country can get the permission (they can fake them out by saying they are going to Panama for example instead of disclosing USA). Not an easy task - most other countries the ex-spouse rarely supports the kids that are not residing with her/him in any case but feels the power and uses it when he/she can.

I know of another K1 whose fiance's sister was here illegally (overstayed and is now seeking asylum or something like that) and her attorney advised them not to mention anything in their K1 - mind you it was the illegal's attorney not the k1s. Do what you think best as it is a tricky situation but the k1 visa is for your fiance it doesn't matter who else is here legally or illegally - I don't think USCIS has the time to look into your relatives mentioned or not mentioned on the forms but I could be wrong. K-1 Fiance(e) Visa Process & ProceduresBank Letter - Switched Banks?
Hey stl: You really don't need a bank statement if you qualify based on your income alone. If you meet 125% of poverty level for the new household size ($16,500 per year for 2 people) you do not need to provide any bank statement; stocks and bonds or real estate valuations. I did not provide anything other than my income letter for the K1 and the AOS (both were approved.) If you do not make enough then you need to worry about assets and then the bank that's currently your bank (not a closed bank) will be relevant for establishing your $$$$s.) Good Luck

All previous visas and denials are immaterial because the intent of K1 is to settle in USA. So, don't worry about the past unless he has overstays or criminal record - everything else - just disclose where appropriate and tell them if and when asked. K1s are meant to get him to USA to settle here permanently previous visas have no bearing. Good Luck

I agree with rahma - This is a money and time consuming process. Your fiance/e won't be able to work till they get their EAD or green card and it will cost you to file for their documents. You need to be prepared to help them transition to living in this country (with new wardrobes or at least winter clothing) - learning the language and trying to find a job after they get their EAD or Green card - And you will have wedding expenses! I would guess you need to have about $5,000 more to help them settle before they can contribute to the household - Yes! A lot of mac and cheese the first year! Think carefully about the first year of his/her life here before deciding to go for the visa. Good Luck

K-1 Fiance(e) Visa Process & ProceduresCSC are they that stupid WTF RFE!!!!!!
Hey dude:
You are doing the right thing - drinking scotch that is!
Like others have suggested; send exactly what they are asking for and be cool; if you can provide additional evidence of meeting - do so; else send copies of what you sent before (maybe it got lost.)
Your initial petition may have been too bulky - I sent in 16 pages total with one paper clip and one cover letter explaining what was in the package - Remember they don't want to spend lots of time figuring out what you have sent and how you have organized it (No one wants to spend their time doing this.) Almost everyone wants a simple organized packet that they can page through, verify and approve. Your having sent multiple cover letters for each section may have thrown them off and they may have just looked at the first cover letter and said - He didn't send anything! Entiende? But of course you need to send what you feel comfortable with.
No, I don't believe they are stupid but I sympathize with your feelings - you need to understand how they work and make it easier for them to approve your case and yes they almost always do - very few are denied from what I can conclude!
Now, have another scotch and get this sent back, today. Good Luck

K-1 Fiance(e) Visa Process & ProceduresK1 or K3?
OK - When I did the same research - K1 or K3 - I realized that roughly both the K1 and K3 took about 3 to 5 months but for the K3 you have to first get married - which could take a few months of planning etc. and then and only then you can apply for K3 - so the K1 beats K3 by the time it takes to just get married and then file (you will need the marriage certoificate for it.) For K1 you can file at any moment with the G325a's and pictures and I129f. So you can draw your own conclusions from my experience - and others are right - if you have to get married in one place or other then you can base it on the need for marriage first and where it takes place.
