One thing to look at when hiring lawyers - take a good look at their websites - many of them claim to file forms for immigration - and that's all they are - do not go to them. Go to others who have actual experience with waiver cases - talk to them - before hiring get references and talk to their former clients. Many people have hired attorneys from a website not realizing these guys know less about immigration than most people on VJ - since they are mainly marriage and divorce attorneys with no court experience and zero immigration knowledge. Make sure of this before paying any money. One last thing to think about - since you are not married - can you both take this long, hard and bitter process? Talk to him about it and do a true soul search before proceeding. Good Luck

This man went to jail and owes child support and can't get a passport to fly out of USA! Its not a good choice you are making - my advice - take the blinders off and evaluate him - not your love for him, but him as a person. As any parent will tell you - not a good choice - look for a better person or wait till he reforms (pays off his child support, rehabilitates for whatever offense landed him in jail etc. etc.).
In my opinion, life is not worth it with this person. Look for another, there are another 6 billion people in this world. Not all Americans are good - we have our share of nasty people too. You have already been forewarned by his past - be careful. Good Luck

Curiosity. My fiancee's (now wife) nephew, niece and some friends wanted to see what was inside - I guess they thought inside was candy or an out of this world alien or something fantastic - rofl.gif I had warned my fiancee about it and had told her that it basically contains papers that pertain to your visa - you don't need to see them - just carry them - I guess in a few years when they really do get a system working - one would not need to carry any paper with them - it would all be in the 'system' to be looked at and verified. If he is here illegally then you have a big hurdle in front of you - e.g. denial. If he is granted status with a rule change in the next few months (who knows how it will all end up) then he should stay here and you should get married here.
Your previous sponsorship or petitioning for a K1 that was never completed (or even if completed) won't have any bearing on the next petition (other than the number of petitions in a short period for the IRMB (or whatever it is called) rules. Good Luck

Are you planning to be their at the interview? I am not sure if they allow the USc in with the fiance or not, check that out. In such cases some consulates have asked to speak to the USC fiance and then approved the visa - I assume they are making sure the relationship is genuine. SO, be prepared for something similar. I have heard them ask if you know where his/her parents live but not if you have met them - especially because I visited her and not she visited me (in which case she could have met them - if they were alive. :lol:) They are more interested in if you have a relationship and know a little bit about him/her e.g. birth date, where he lives and what he does and if he was married before and has any children etc. Good Luck

The fee is for the visa itself ($100 for K1) - but the costs are more for typical interviews - medical exam; lab tests, vaccinations (if needed) and then the ususal hotel/airline/food/taxi etc. - total roughly $1000 to $1500 at the high end and $300 to $400 at the low end (if you live in the same city as the consulate.)

If you are getting a co-sponsor then you need to send his Tax returns only (you do not need to send your own unless you had some income - then you can include yours as well.) Also, bank statements are not always needed if the income exceeds 125% of poiverty level; and some consulates require multiple years of tax returns. Good Luck

When my fiance wanted me to come with her to the interview (in Colombia) - I did some searches and based on my reading of people's experiences - I decided that it was completely pointless for me to go to the interview - because I would not help her and instead would increase her and my own anxiety! So, I didn't go and she was perfectly fine after she talked to a few acquaintances who went alone to their interviews also. She called me after the interview and said "It was very easy."
Most USCs are not asked anything or asked very little and it doesn't matter if they are present or not (yes - some consulates require their presence but many don't and some don't allow them inside the premises.) By not going, we saved a couple grand and used it for a vacation to Orlando! Good Luck!
Though I won't mind going to Costa Rica and taking a look at Paos volcano (I hear its active again!)

Why do you need phone card records? Just because others overkill the consulate with information doesn't mean you must do it also. When I filed for I129f I only submitted an itinerary and 2 pictures (to show we have met); when she went for the interview in Bogota she took printouts of 5 emails and 5 chat records and they only looked at one email for 5 seconds. So you don't need to do it unless you are in an overkill mode - please don't kill any more trees (my friend in Costa Rica is crying :lol:) Good Luck

I agree with meauxma - and I would advise all Indians never to use their engagement pictures - just take couple of your pictures together nothing more. I lived in India many years and attended many engagements and weddings including three of my sisters' - and EVEN I CAN'T TELL YOU IF A CEREMONY IS A WEDDING OR ENGAGEMENT unless someone tells me differently. Because they are extremely elaborate - anyone see Monsoon Wedding? I think the mistake people make is show them their engagement ceremony pictures - not a smart move no matter how much you love your 'bollywood type showcase' engagement. Good Luck

To clarify, it's not just the employement letter that's in question. I sent ALL the documents: I-134, DS 230, DS 157, etc..etc. Proof of relationship, bank statements....EVERYTHING that is needed for the interview. All he has in his possession are the medical forms.

Why did you do the DS230 and DS157 - do you know that he has to do them - I hope you filled out the correct information (its not your info its his.) And are you nuts waiting till the last minute! I guess you like to play with this - so it is your choice. I would suggest emailing him everything and then he can go with copies of the docs and can explain to them if he doesn't get the originals. I did not use assets to meet the sponsorship requirements, as my income was more than enough. (Yes, I didn't use them for AOS either.) Just because its listed on the form - you don't have to provide it - the way I understood the form was to provide proof of meeting the sponsorship requirement (and I did that based on income alone.)
Now, if you need to use your assets because you do not meet the 125% of poverty level then this is the way you can deduce the value of the property
1) From the county property tax assessment you will get a tax value - yes it is not the market value but this is an 'official' value that you can use - short of paying an assessor and using their value its an easy step (we all got these every year.)
2) From your mortgage statement (you get one for tax purposes every year) you can show the 'principal' amount 'owed'
3) The difference between the two is your 'equity' or asset value (for I134 or I864.)
Remember the value of the assets (yes you can use other assets e.g. 401Ks, bank accounts, mutual funds etc.) must be 5 times the annual requirements (rule of thumb.)

i posted this question some other place too but i think i'll get an answer here faster so i'll ask here too.... on the I-134 in the notary section... where it says before me (at) and a line to fill in.. does that mean (at) the county the notary is signing in? we're not sure what she should put there.

My notary was from my local bank and she put her stamp on it and signed - she put down the name of the bank on the line where it says "at" and the stamp only has the state's name on it. By the way she didn't mention the city, county or state with the name of the bank just the name. Good Luck

First of all you do not need to disclose your assets unless you are using them to meet the 125% of poverty level requirements. Most of us qualify using our income alone (It's only $16,500 a year for 2 people!) Check here http://aspe.os.dhhs....06poverty.shtml
Second - if you are using your assets e.g. homes to qualify then you can do one of two things
1) Use the property tax statement to establish the value (yes its understated on those) and your mortgage statement (we get this annually for filing income taxes) to establish your debt - the difference is your equity.
Or 2) Get an appraisal done and submit that for the market value and then subtract the mortgage owed for the remaining equity.
Ah! How much will you need to establish? The rule of thumb is 5 times the annual requirement so $82,500 worth of equity for 2 people. Good Luck

Some of the consulates are rather noisy and have no privacy - you go to one of several windows and talk to the interviewer (almost like buying a ticket in a movie theater.) I doubt any of them tape these.

As far as birth certificates are concerned they are not critical - so if you can get the police clearance you may still be OK. I base it on the fact that I do not have a birth certificate and the US consulate has mechanism for other proof - in my case two relatives swore in front of a judge that they knew me and my date of birth (I had to submit those as proof of my birth for an immigrant visa (green card) to USA - this was in India.) So check out the documents that can be substitutes for the birth certificate on the USCIS website and do not worry about that one - the police clearance hopefully doesn't take that long. Good Luck

Regardless (though very critical to file) you easily qualify based on your income level. However, even if your income is non-taxable (I don't see how it can be but maybe there is more to it than you stated) you can still file and show 0 taxable income and use the transcrpts (or tax returns) for the proof that's needed for the petition and the AOS. Its always a good idea to file even if you don't have taxable income or you don't owe taxes - just to have the record and to keep your record straight. Good Luck

It only costs a few dollars to have your own letterhead printed - so if one was to try and fake it; its not that hard and the tax returns don't even need to be signed (I never sent signed copies) so even they can be fake - but if you get caught - the penalty can be deportation for the non-USC and criminal record for the USC and may be even worse - so is it worth the risk to you? Not worth doing it the hard way when you can do it the legal and easy way and not have to worry about being caught or of that knock on the door.

Relax. I have never used IRS transcripts, I file my taxes electronically and just print copies - and have not had any thing questioned (since I file electronically my copies have no signatures either and it still doesn't matter). Good Luck

It has to be notarized - the sponsor (USC) should sign it in the presence of the notary, who would then stamp it and fill out the info. Most banks do it for free or a local law office may charge a dollar or two (check with them before you do it in case they are out to fleece you) to notarize if a bank is not easily available. If its prior to April 15th then you should be okay - make sure and have the explanation ready if they ask. I am not sure about the Moraccon embassy requirements but to be safe have the birth certificate translated. I had my wife (from Colombia) get two copiers of the translation and used one with her AOS (green card application) - so have her get two copies just to be on the safe side. Good Luck

Its based on the number of people residing with or being supported by the sponsor. Generally speaking you need to make 125% of the poverty line to not require a co-sponsor. By the way the people who can live with that little money - wow! Most people can't - Good luck
