If they recently filed for AOS she can just call the USCIS and find out what she needs to do to cancel the petition. That's it, this will prevent him from getting his green card. As for making sure he leaves the country, if she can't make him go, then it's up to the authorities to do so. Bottom line is, he won't be here legally for long.

She needs to file for divorce and perhaps get a restraining order against him since he has been abusive. He can then buy his own plane ticket and go back home if he wants to but just because they're married, she does not have to keep him living in her house.

You also have not given any details about their AOS process. Have they filed for it yet? If not, she shouldn't and he will be out of status. If she did and they haven't had their interview, she can call the USCIS and see if she can cancel the petition or go to his AOS interview and tell them the truth about the situation. If he already got his 2 year conditional green card, there is nothing she can do for 2 years but collect all kinds of evidence so that when the time comes to file to Remove Conditions, she can prove that the marriage was a sham from his side and avoid him getting his 10 year card. If he does get his 10 year card, there is nothing she can do to get him out of the country.

The way I see it, he's doomed just because he married a US citizen does not guarrantee him to stay legally in the country. I don't think he's aware of this.

LOL!!! Oh I'm sorry, I thought you meant you had only made a mistake about the dates and that was that.

Anyway, the stamp that your wife got has to have an expiration date on it. This is the stamp you need to make her residency valid. In her case, it should be valid until January 2009. With this stamp she can travel anywhere she wants and come back to the US without a problem. I know this because the POE officer told us this and I asked him "So if we leave for Paris tomorrow and come back next week, all my husband needs is this stamp to get back to the States??" and he said "Yes, that's correct".

The stamp is all she has for now to show she's a permanent resident until her green card arrives in a few weeks. It's 100% valid.

Also, if you don't feel comfortable with the stamp your wife has on her passport, make an Infopass appointment with your local USCIS office so they can verify it. If it's not the stamp you need, they will stamp her passport.

You need a G-325A for both, yourself and your wife. This form is made up of 4 identical pages and they all need to be signed. What most people do is have their SO print them out at home and send them signed to the petitioner. Others, have signed them for them. I don't recommend signing the form for your wife since I'm pretty sure it's illegal, but others have done it to avoid the wait.

The DS-230 is generated by the NVC once they receive payment for the IV Bill. If you sent this payment already, you have to wait for them to generate the DS-230. If you haven't received the bill, see if you can get your IIN from them and check it online and see if you can pay it there. Two days after you make the payment online, you can print out the DS-230 coversheet that you have to send with the DS-230.

The DS-230 itself can be downloaded from this link DS-230 and make sure you start collecting the civil documents you will need to send with it. You can check that info out here: DOS link

I always got through when I called them at 7:30 a.m. sharp but got kind of nasty, grumpy agents. Then I started calling at 11:30 p.m. and saw that the agents were a lot nicer and more helpful. You will never get to speak to an agent if you call in the middle of the day. Oh, and remember that those times are Eastern Standard.

Since the police certificate is a little booklet in Colombia, we put it inside a little plastic bag with his name on it. But we didn't sen copies of it, we sent the actual police certificate since that is what they are requesting.

Actually you're still within the normal waiting period for the VSC. Try going to the Timeline section of VJ and search for people who filed an I-130 a few months before you did at the VSC. You'll find that many of them waited between 6-9 months for an approval.

If you receive an IR1 visa then you will get your 10 year green card in the mail and there isn't anything your husband or his family can do to force you out of the US. Try to keep evidence that your marriage is bonafide though.

But if you get a CR1 visa you will receive a 2 year conditional green card and two years later you will have to remove conditions. You can remove conditions on your own, meaning you still don't have to be married to him to do so but again, you will have to prove that your married for love.

It actually makes sense to me since child support should not be considered extra income so the beneficiary can count on that, it's money that should go exclusively towards the child/children's well being. BUT... it can be used as additional income for immigration visa purposes.

I'm really surprised to see how quickly your CR1 visa was approved. Is the US Embassy in the Dominican Republic processing these faster than previous years, do you know? I had read several posts of people who had to wait in line for an interview after their cases were completed at the NVC.

Exactly, you also have to pay the fee to remove conditions after you get your green card through AOS.

Also, EAD may take up to 90 days and AOS may take longer than that. You wouldn't be able to work until you get at least the EAD in the mail.

The total fees you will pay for the CR1/IR1 visa are: $190 for the I-130, $70 for AOS and $380 for the IV bill. Once the beneficiary enters the country he/she will get the 2 year green card in the mail.

For K3, you wouldn't have to pay for the I-129F (correct me on this one). But the AOS fee is $1011.

As far as time difference, I suggest you check out the timelines of other people her on VJ who are going through your embassy. Each embassy is different.

You can find this information in the instructions for the I-864 found in the USCIS web site. It's on page 6:

19. Citizenship/Residency.

Petitioning relatives who have already filed proof of their citizenship or immigration status with Forms I-130, Form I-129F, I-600 and I-600A do not need to submit proof of their status with this form.

Proof of U.S. citizen or national status includes a copy of your birth certificate, certificate of naturalization, certificate of citizenship, consular report of birth abroad to citizen parents,or a copy of the biographic data page of your U.S. passport.

Proof of permanent resident status includes a photocopy of both sides of the "green card," Form I-551, Alien Registration Receipt Card/Permanent Resident Card; or a photocopy of an unexpired temporary I-551 stamp in either a foreign passport or a DHS Form I-94, Arrival/Departure Document.

This page give a good outline of the fees and when they are paid. When the actual visa is approved, there is often a small fee for delivery by mail or courier. How much is consulate specific. Some allow you to simply come back and pick it up.

Your wife will have to change her name in her cédula first, then change it in her passport. It's a huge hassle and not very easy to do. What most of us do is keep our married names here in the US and use our maiden names in Colombia. When traveling all she needs is show a photocopy of your marriage certificate which explains why she has a different name in her green card.
