Fraud is definitely a consideration.

I don't know the whole process, but the Immigration Dept's sole reason for being isn't to hurry up and process your K1 Visa. They have a responsibility to all people in the US to protect the borders. In order to do it, they probably do need time.

I'm frustrated by the 5-6 month wait, but if it makes our country safer then I can understand.

A couple of questions related to the K1 that I am wondering about...

1) How long after marriage will it be until my fiancee can work? We plan on filing any necessary paperwork immediately after we marry. I've heard both EAD and AOS, but which one determines whether or not she can be employed? (I just want an estimate of time..I know there's graphs that show exact timeline projections for the EAS and AOD...Is it approx. 3 months, 6 months??)


2) I expect my fiancee to be here around late July/August and married in late August. Will I be able to claim her as a dependent on my 2012 Tax Return? What is the first year she would have to file taxes as a US Citizen - 2012 or 2013? (again, assuming I take action on all of the K1 actions ASAP that are on the flowchart)

Faster than 6 months - no expedite. Now you've seen one. And it was by PURE chance (trust me I've already talked to him and asked. He did nothing out of the ordinary or anything special)


To the original poster - it's possible to go quicker, but it's pure 100% LUCK and 99 times out of 100 you will be waiting 6 months. 0.5 times out of 100 you'll get it as quick as the timeline I posted above. 0.5 times out of 100 you'll not get approved until 10 months.

It's all by chance, really. If there was a quicker way that existed, we would have all taken that route. My only advice is to get the paperwork 100% completed, then check again to make sure it's 100% correct, then send it off overnight mail so your wait can start sooner than later.

Bank Statements showing expenditures in Mexico

Photos marked with time/date stamps that are close to days where you took out money or used the Sentri pass (google "photo time date stamp" - there's programs out there that will stamp your photos for you)

Our app was approved 2 days later.


They did directly contact the CSC to help. I had to sign a letter releasing my private info for them to explore the case. I'm not military or anything else and my fiancee wasn't pregnant.


They CAN help, but it is completely dependent on which person in congress you are talking to. I tried doing some research on both my congress reps and senators to see which one of them had a historical voting record promoting family or immigration. You should also be able to see which committees they are on, which can also give you insight.

Be courteous, have a valid reason for why you think your application should be advanced, and be respectful. They probably get a million requests from folks. Your request should stand out. Avoid criticizing the government in your letter/email.

Is there a big age difference between you ?

I think the CO worried about the email because some women get hit up by romance scammers ( people that create profiles on dating sites as well off people with lots of issues that require money to fix) Some of these deluded souls will still stay in "love" with the scammer when they say ''' I have to confess I am not a white man stuck in Africa but a african and I feel so bad for taking your money , I love you" and then petition for the scammer to come. To the CO your email having another name hinted that you fell into this group. You need to be vary careful to cover your relationship next time.
Getting married is not the cure. The second more complete petition is. Second petitions rarely result in denial. Yes she should visit again and stay for a longer time.


There is nothing bad about courthouse, you do this for the paperwork and then have a real wedding after a while. Anyway it takes time to prepare everything for the wedding and you need to rent almost anything at least 5 months ahead. We went to the courthouse and we really had a good time that day, I was very happy, and now we are planning our wedding for June. If you have another interview be yourself and honest, say what you really feel, and of course short and clear to the questions. Don't ever mention about money, like "we want a better life or "show evidence that she sent you money or anything that implies money and proves you want to go there only for money. When you love the person you don't care about money, you just want to be with him/her. Try to bring more evidence, if she comes to visit you show her to your parents and take photos, my consular was interested to know how my parents reacted when he told them in my language his feelings to me, in that moment I felt like she was my friend but not the consular. Don't forget that they are good psychologists, they can tell when you are lying and when not. Good luck!

Not a requirement, but it probably helps. My fiancee didn't wear one, and she told the officer that we were waiting to buy a better quality ring in the US with better warranty terms.

Just a note though - even though I say it's not a requirement, you should check with other people that have gone through the same embassy as your future spouse is going to head to. There's some embassies out there that have crazy demands on proof of a relationship. Really, any question that you ask about the interview process should be directed at someone who has gone through it already at your specific embassy. You're just going to get a broad generalized answers here. It's unfortunate that the embassies sometimes work differently from others and not consistently everywhere in the world, but it does happen.

During my first visit to my now-wife, we filled out the paperwork. I had only seen her for 7 days, but we took photos, I kept every single receipt and boarding pass, and we went through the K-1 process without any hiccups.

The sooner you file the less you're going to have to be banging your head against a wall waiting for the approval. I visited my wife once while we were waiting for the K-1 to get approved, and even that didn't seem like enough.


I would say one piece of advice though - you're hurrying, and that's all well and good and you should do it if you feel it's right....but really have serious conversations about her first year and expectations...financially, work, etc....Have the tough and difficult conversations about money and everything else BEFORE she comes over here. And know that while she's filing for Adjustment of Status, she's going to be home bored a lot until the work permit or Green Card comes. She may be sitting around doing nothing for 6 months and that's really tough on anyone.

We finally sent out our response to RFE on May 2nd.
We sent it out by FedEx (we were told by an officer that it gets to an adjudicator a little quicker if we send it in by private courier, which is very understandable.). It was delivered in the morning on May 3rd and was signed by N.LA BARRIE. star_smile.gif

So, now it is at CSC and we have to wait for our response to get delivered to our adjudicator.
I have several questions here. I really appreciate it if you can provide us some advices.

How long did it take for you to receive an e-mail notice that they received your response?
(it seems that it takes about a week by looking at many people's timeline.)

How long did it take for you to receive your NOA2?

Hi,
I think sometimes they ask for more evidence even though we sent in the evidence originally. For example, my RFE they wanted more proof of relationship even though I sent them some pictures, emails, and chat logs to them. So as a response to the RFE I sent them more pictures and emails. I thought it was kinda odd. I think if you follow the instructions and send in some new passport photos again you should be fine. Standard passport photos that you get at Walgreens and any other place should be fine.

NN1980, besides the additional evidence, we also RE-SENT all the other evidence, like the same photos (there were only 6 photos of us together in existence at that time), passport pages, etc. I also wrote a cover letter certifying that we had met on such and such dates and describing every bit of evidence proving it, all attached paperwork. I suggest you write an explanation letter how you stayed with your fiance so don't have hotel receipts, etc.

Our case was updated twice this week. (We were told that we have RFE request and should receive a letter in a week last Thursday. It will be a week since then....) However, we do not see our case status change.....We are gonna call tomorrow and see what is going on.... It will be 7 months since we sumbited our original packet and we have not heard anything since then.....


My case status online did not change as well when I got the RFE email. I'm assuming they don't change that, but just send out the RFE email. You should be getting the letter soon, if they touched your case then that means they may have just sent it out. For example, they touched my case a day after I received the email even though they said that they sent it out on May 3rd they touched it on May 6th which I'm assuming they sent it out then and then it arrived on May 13th.

Hey guys,
Thanks for the advice, but I had already sent in my itinerary, all my passport pages, and even my boarding passes in my original I-129F package. I did not stay in a hotel when I was in my fiance's home country and for obvious reasons I could not use my credit card there so those items were ruled out. The only thing I could think of that they wanted more evidence for was more pictures that were taken in front of signs and landmarks in the country to show I was there, phone cards, and chat logs, but we'll see how this goes. I'm assuming that they are pretty sometimes picky when your fiance is from a particular country because of high fraud rates from that country and single out a person for an RFE, but I think these items should be good enough since I sent the original evidence in my I-129F.

The bad thing is that two officers told us that we were RFEd when my fiancee calld them last Thursday. They also told us to call them back if we do not receive the letter within a week.
However.... our case status has not been changed (it still says "case received and pending".)....we have not receive an e-mail notice either.... (Is it because they have not sent our the letter yet?) On the other hand, our case was updated today....Mmmmm.... we are not sure what is going on??....

The good thing is that since my fiancee lives in L.A., it will take just a day or two for the letter to get to his mail box once it is sent out from CSC.

You have to sign up on the uscis.gov website to get an email notice. The email notice does not necessarily mean that they sent out your letter to you. In my case I got an email notice that my letter was sent out on May 3rd, but it was touched on May 6th so I think it was actually sent out on that date. I will probably wait till Wednesday and then try and call them to see what happened if I don't get the letter by then. Since you didn't get the RFE since last Thursday I would wait till the end of the week to call them.

I'm doing the same thing for my fiance, and I was told by the embassy that the earliest you can request a specific interview date is one month prior to the date that you want.

About the birth certificate...the only birth certificate that is needed is the birth certificate of the beneficiary. Check out some of the recent K-1 interview reviews on here about the Peruvian consulate...they have some good information that should help you.

Everything on this site seems to say DS-156 is what you need, and even one of the letters sent by one of our fellow VJers, but another pointed me to a site on the US embassy page that seems to suggest the DS-230 is needed.

I'm in the process of getting this paperwork together for my fiance in Lima as well, so...

Only the DS-156 and DS-156K are needed. Recent K-1 applicants at the U.S. embassy in Lima also reported handing-in the DS-157, so you might want to fill out that one also. The U.S. embassy website for Lima doesn't specifically address the paperwork needed for the K-1 visa, but your fiance will receive a list of all the documents that are required for the interview. I'd also recommend reading the reviews on here about recent K-1 visa interviews in Lima. If you have any other questions, the Lima embassy's website has a contact form that you can use to ask questions, and they seem to be pretty quick in getting responses back.

From what I've read, it seems as though each employer is able to choose which types of reports are available for their employees on theworknumber.com. My employer uses theworknumber.com, and I was able to print off a report that included my position, salary, and employer information. I don't exactly remember what that type of report was called (maybe a personal income datasheet???), but it is something that you can request and print off directly from their website.

For the visa interview, I included that report along with the I-134, my pay stubs, and my tax return transcripts. We didn't have any problems at the interview, but it didn't seem like they reviewed much of the income information that we presented. Hope that helps.

The process makes me curious if there's a way for me to be in Canada with her if we marry there; I'm happy to be there for the time being if it means less time apart. I know that Canada doesn't have a 'fiance' visa, and that she'd have to be my sponsor if I was to stay, but is there a method that would give me immediate rights to stay if we married? I assume it probably comes down to intent at the border. Of course, I could always try to find an employer and get in that way.

Hi all,

After spending days combing the forums, I'm reaching out for some insight. Feel free to link me to a previous topic if there's one that's relevant (as I haven't found it).

Background:

I'm a US citizen, she's Canadian. We just got engaged on Saturday as she was with me visiting family in the South.

We plan to live in the US after we marry. But, all of her family and friends are in Canada (Alberta) with family coming from the Middle East and India, and it will be easier (and much preferred) to marry in Alberta.

And here is where I need some help. As I understand it, I have a couple options. I'm not interested in lying or misleading any border agents or otherwise.

Is there a process that would allow us to have our time apart happen now - ie before the wedding - rather than after we are officially married? Here's an example:

In the K1 process, she comes to the US when visa is in-hand (say, 8 months from now) and a Justice of the Peace marries us, then we return to Canada to have the "actual" wedding ceremony. However, isn't the K1 a one-entry visa? Since she came to the US for us to marry, could we legally enter the US again as husband and wife, or is there another process we need to get through to make that happen? Are we talking months of waiting? Also, would I have trouble getting into Canada for the "ceremony" if I had proof of returning to the US?

I've also read all of the guides on the CR1, but it seems that we would have to spend many months commuting between countries to visit each other (after marrying) until that process was complete, or am I misunderstanding?

Finally, would either route allow us to marry and then move to a different, third country to be together while we await her US visa? We wouldn't mind spending 6 months wandering around Europe or South America while these things process, if that's an option.

I appreciate your help and creative thoughts...

Just got our NOA2 last week and was checking out the requirements for paperwork the consult requires. One section states:

If you have one or more children not listed on the visa petition, or a current pregnancy, or a prior undisclosed

All our paperwork says "none" for the sections where you list kids for K2, because the kids are going to stay with the grandparents (who mostly raised them) in the Philippines.

Should I include this information in with the letter of intent to marry, or should I write a separate document and get it notarized by itself?

Maiden name is the same last name they had before they got married. The first last name that they were given. That's the name that should go there.
