K-1 Fiance(e) Visa Process & ProceduresContacting US Interest Section in Habana

Hey all you with Cuban SO... What is the best way to contact the USINT to find out if our petition has arrived there yet? I know they will eventually contact my fiance, but wanted to see if there is any way to speed that up. I know there is a "toll free" (though a fee for a pin #) to call and schedule appointments for a family memember. Does the USINT have an e-mail that is regularly checked? I know the local number there but do not want to pay unless it is worth it. Just wanted to check with you all who have the experience... muchas gracias!!!

You can't use the toll free line for Fiance Visas. I don't know the email address off hand but I have posted it and may have sent it to you in a PM. I have sent 2 emails. The first was answered w/in 2 days, the other took over a week. You can also fax (number is listed on the USINT website) but I have had problems sending faxes because of the problem with phone lines.
Pocamuela

Thanks so much for your help. I will double and tripple check the PMs because I did not see it in there the first time... but do remember seeing it somewhere. Thanks again and best wishes.

K-1 Fiance(e) Visa Process & ProceduresProof

Are you sending translated birth certificate of the beneficiary also?, it's not required but some got RFE for it

I sent my fiace's birth certificate (translated from Spanish to English) as well as a "certificado de solteria" (translated) and got no RFEs. I figured it helped the process and at least did no hinder it. Plus you will need them for later on in the process, but it is not technically a requirement. The rest of your evidence looks great, oh and nice photo you look happy. Good luck!!!

One other question, if my fiance's interview is not going to be until June should I wait to get all the I-134 information or jsut go ahead and compile all that now?

Ok, so I just noticed that the I-134 form expires on 04-30-07. Does this mean unless your interview is before then that you should wait til the new form comes out to fill it out and send it to your fiance? Just wanted to double check, thank.

I used the acco fastener, had my contents page as well as "title pages," so to speak, for the other sections. Everything was well organized, but other than that I didn't do anything else and it seemed to be just fine. Whatever makes it easiest to browse through. Good luck!

K-1 Fiance(e) Visa Process & Procedureswhat would happen...
I just read your post and know how frustrating and sad it is to be apart for so long. For us it has been 15 months since we last saw each other and it is terribly hard. But we thought the same thing, that it would take longer than it is now and because of that we feel a new hope. This is a long and trying process, but ultimately you will make it and be together. The other thing is that if it is just too much to be apart any longer you could marry there and do a direct consular filing. I know he is not in Managua, but if there were anyway to travel between the two areas or fax things there, even mail secured mail there... you could marry there and file in country. I say this because a friend of mine found out that it was much shorter to do that and it took them only 5 weeks to get his spousal visa by filling in Managua. This might not be an option however if you need to keep your job and have no co-sponsor. I just encourage you two to hang in there and soon things will pull through for you. Also just make it work for you... so if you need to go see him again soon, take the time and do it. Best wishes to you both!!!

K-1 Fiance(e) Visa Process & ProceduresForeign Address

My fiancee does not have a typical mailing address, according to her, her address is like the pink house, across the walkway from the bar, number 146. How in the world do you fill out the form for this type of address?

I have friends that live in Costa Rica and have mailed them things to addresses just like this, so go ahead and put the address as she gives it to you.

K-1 Fiance(e) Visa Process & ProceduresNE Service Center and being "touched"
Hi There,

I'm a bit new to this site, but am finding it incredibly useful. I've spent hours going through many pages and reading everything I can, but doing so has raised 2 questions for me:

1. I understand the Nebraska Service Center is no longer processing I-129F petitions. I know they officially changed that July 30, but I sent my application to Nebraska on July 28. The guidelines still said to send there at the time of mailing. My question is, will that create a significant delay? I still have not received my NOA1 (though I see others who sent to NE on the same day also have not).

2. What does it mean to be touched? I keep seeing this, and while it doesn't currently apply to me, I am curious and would like to know what's up just in case.

Thanks to all for the helpful advice- I don't feel so alone any more!
Jennifer

I am in a state of panic right now. I really struggled with the best way to list my finace's address on our paperwork, and now in retrospect I think I did it incorrectly. I listed his neighborhood when I now believe I should have listed his district as that is what is connected to the postal code. I just received my NOA1- I am afraid that if I call to change this they may return my petition to me. Does anyone have any experience or insight with this? It's for an address in Peru if that helps.

Hope this helps---we had a similar situation due to my fiance moving to a different country mid-application. I called USCIS and my lawyer, and both said the same thing--no biggie b/c right now they are interested only in your contact information b/c you are the petitioner doing the requesting at this stage of the game. Only when you get approved with your NOA 2 will your foreign fiance's address become important, b/c that's when your case goes to NVC and then they WILL need the correct mailing address in order to send out the packets. So don't stress! You can call and change it if needed when your case is at NVC. good.gif

Thanks- I called USCIS and they told me the same thing. I feel better now. smile.gif

K-1 Fiance(e) Visa Process & ProceduresEmployment an issue for K1?
QUOTE (Jomo @ Dec 13 2007, 10:49 AM) <{POST_SNAPBACK}>
I would think he may have to explain what you just said and show some sort of proof along the way. Not that it matters much in the whole scheme of things where they work at all. It's just sometimes that "unemployed free ride" ####### comments come into play and may need to be proven wrong.

I'm not sure how we could show proof- he either plays in public places to sell his CDs, or people hire him to play at various events and it's never been a practice to exchange receipts, contracts, etc.

K-1 Fiance(e) Visa Process & ProceduresEmployment an issue for K1?
I'm starting to worry (as I often do) about my fiance's employment history and whether it will affect his ability to get a K1. My finace is a musician, and he earns money by playing music independently. He works very hard and makes a good living at this, but he has no employer or employment record to speak of (with the exception of one official music job he held for 7 months last year). I actually didn't even list the independent musician part on our application because I wasn't sure if there were issues with taxes or anything like that- I simply stated N/A under current employment. I make around $47k and can show my ability to support him, but could he be denied if it looks like he doesn't work? We are both aware that he will likely not be able to make a reasonable living here as a musican- he is happy to do other work so this isn't an issue from our perspective. I'm just worried what the big guys will think. Anyone have any insight on this?

K-1 Fiance(e) Visa Process & ProceduresFiance Address Change
Something similar happened to me- I figured out after I had sent the application that I had listed his address incorrectly. I called USCIS and they told me to wait until the application was sent to the embassy, and then call there to change it. They told me they would not need his address until that time. Don´t worry- send it in. Good luck!

K-1 Fiance(e) Visa Process & ProceduresWhy so few NOA2s in January??
OK, I know there is no rhyme or reason to much of what happens, and please forgive me for whining, but what´s up with the California Service Center right now? There were well over 100 NOA2s in both November and December, but so far only 29 for January! Right when my date is getting close, they all but stop processing. Is there a reason for this? Maybe my question is rhetorical, but I feel the need to vent and want to know if anyone has any insight. I´m in Peru with my fiancee right now and we are realizing that we are not going to be together again for much longer than we had anticipated, even with the additional 2 month cushion I had added on in my head for possible delays. It´s devastating. sad.gif

K-1 Fiance(e) Visa Process & ProceduresPassport name
My fiance has to get a new passport, and I am trying to figure out exactly what name he should use. As with most Latin Americans, he has two last names. When I filed the I129f petition, I used only his first last name. When asked if he ever went by another name, I said no. So his second last name is nowhere on our paperwork (though we obviously DID show his mother's name, which is also his second last name). So my question is, when he gets his new passport (which he will need for the next phase of our visa process), should he use only his first last name, or should he use both (as I believe is the norm in Peru)?

K-1 Fiance(e) Visa Process & ProceduresNVC
I have also been trying to call and have been getting kicked back to the automated sytem, but last night (around 10:30 PM eastern time), I finally got through on my third try. I received my NOA2 on January 31 (from CSC), and as of yesterday the NVC did not yet have my case.

Good luck!!

K-1 Fiance(e) Visa Process & ProceduresDesperation
Hi All,

I have just returned from 8 days with my love, and I am having a really tough time. I cried for a good hour after getting on the plane, but after that I was ok. I mean, I was really sad during my 18 hour trip, but I was reasonably calm.

But once I got home, I LOST IT. I had a total panic attack- I suddenly felt the immesity of the distance between us, and realized that I couldn't just get to him if I needed to. Even if I had the money (which I don't), it would take me 2 days to reach him. It's just so far. I could see his face in front of me but I couldn't touch it. I felt like I was trapped in a bubble and couldn't get out to get to him- almost like claustrophobia. I tried to go outside but the sky just felt like it was closing in and I was nearly hyperventilating. I couldn't breathe or think rationally for almost an hour. It really freaked me out. I'm a pretty strong person and we have gone for several months in the past between visits, but this time feels different. WAY more intense.

The whole last week doesn't even feel real right now- like it was a movie or a dream I woke up from. I'm just back to my same old life again, and he is exactly where I left him. Exactly where I want to be.

I am sleep deprived after my long trip and overwhelmed by the situation, and I'm sure this is contributing to the problem. I know we're all in (or have been in) in a similar boat so I hope I'm not the only one feeling this desperate. Am I?? This is far beyond missing him. I feel a little bit crazy. wacko.gif Would sure appreciate any reassurance.

I will see him again when I go for his interview, whenever that may be (hopefully 2-3 months).

Thanks,
Jennifer

K-1 Fiance(e) Visa Process & Proceduresa few last questions before i finally send in the first packet!
I sent mine in Express Mail, and was able to track the package online. This gave me some peace of mind knowing that it had been delivered. I am not sure if you can do this with Priority Mail or not.

K-1 Fiance(e) Visa Process & ProceduresWhich postal service
I used USPS Express mail, registered. I got a tracking number which I was able to use online to track the package. It got to CSC at 9:34 in the morning, the day after I sent it.

I think just about anything that gives you a tracking number is good, though it is also nice having that green card in my hand showing they "signed" for it (actually stamped it, but whatever)

Good Luck!

K-1 Fiance(e) Visa Process & ProceduresTime line status for K1
They will send you a letter, which is called the 1st Notice of Action. That letter will have a case number in the upper left hand corner. With this you can track your progress on the USISC. I have also heard that if you look on the back of the cancelled check it will have your case number. Unfortunately for me, the scan of my check that is online on my bank's website is of such poor quality, that I cannot read it clearly enough to find the number.

I sent mine in on 4/14 and they recieved it 4/15, but still no NOA1 as of today.

It should come in the next week of so I would think.

K-1 Fiance(e) Visa Process & ProceduresDoes too much documentation slow the process down?
So a couple of olks have mentioned "red flags" but I have seen a list of red flags on the site. Do people know some of the red flags? And if so, what are they?

Thanks

PS already sent in my package, but it would be nice to know if I need to start finding a way to overcome something if folks know its a "red flag"

K-1 Fiance(e) Visa Process & ProceduresDual Citizenship

The U.S. does not accept dual citizenship. They assume you are just a U.S. citizen.

Other countries allow dual citizenship, such as Canada where I am from.

DCCY, all you have to do is put that you are a US citizen in your application and they won't bother you. They'll assume you're a US citizen regardless of the location you were born at.

For a household of 3 he needs to make at least $20750
For a household of 4 he needs to make at least $25000
For a household of 5 he needs to make at least $29250
For a household of 6 he needs to make at least $33500

Mononoke28FemaleColombia2007-02-24 14:14:00
K-1 Fiance(e) Visa Process & ProceduresThis is confusing
A quick way to find out if they're working on your case is to check with your bank to see if your check has been cashed. If it has, then the copy of the cashed check should have a receipt # written on it. You can take this number and plug it into the USCIS web site to follow up on your case.

How about plane tickets, hotel receipts, phone bills, letters, and most importantly pictures of both of you together, of you with her family, with her friends, etc?

You can write down all you want to describe your relationship, but if you don't have actual physical evidence that you have talked and even spent time together, it's no use.
